To all, present and to come, Hi.
The House of Representatives adopted and sanctioned the following:
CHAPTER 1er. - General provisions
Art. 1-01-1
This Act regulates a matter referred to in Article 74, 3° of the Constitution.
Art. 1-01-2
The 2006 General Estimates are approved:
1° with respect to the appropriations provided for the holdings, in accordance with the table annexed to this Act;
2° with respect to appropriations by programme, in accordance with the totals of the programmes contained in the budgets by section and by base allowance, annexed to this Act.
Art. 1-01-3
§ 1er. Provision for programmes related to administrative costs, known as subsistence programmes, includes:
1. Generally any remuneration and allowances of active and lay-off staff, the remuneration or wages of auxiliary staff, the allowances for higher and special duties, the intervention in public transit subscriptions, the compensation for occupational accidents - including the payment of these allowances to family members of the victim in the event of death - as well as the reduced remuneration or wages of temporary or auxiliary personnel, accidented in service.
2. Other expenses of the social service.
3. Permanent costs for non-expendable property and services:
- Lawyers and doctors fees - Civil, Administrative and Criminal Affairs Justice Expenses - Attendance fees, travel and residence fees for persons outside the State administration - Remunerations of foreign experts to the Administration and third-party benefits;
- Consumption expenses related to the occupancy of premises - including energy consumption expenses "mazout, gas, petrol, electricity, coal" - and maintenance expenses - Office fees, transport, taxes, retributions, department publications, vocational training, clothing and other small administrative expenses;
- Generally any allowances to State personnel for real expenses and material damage, transportation costs for service trips and insurance premiums from departmental delegates travelling abroad.
4. Miscellaneous operating expenses related to computing.
5. Exceptional expenses for the purchase of non-expendable goods and services, such as work and supplies for the development of new premises and moving expenses.
6. Real property rents and related taxes from the various departments of the department, paid without the intervention of the Buildings Board.
7. Other costs related to the operation of services that are detailed in the subsistence programmes.
8. Expenditures for the acquisition of non-expendable furniture: machinery, furniture, equipment and means of land transport.
9. Investment expenditures related to IT.
§ 2.- By derogation from Article 15 of the Acts on State Accounting, coordinated on 17 July 1991, the basic allowances for remuneration and allowances generally referred to as "11 03 - Statutory staff and trainee" and "11 04 - Staff other than statutory staff", may be redistributed only to each other within the same section of the budget.
§ 3. By derogation from Article 15 of the Acts on State Accounting, coordinated on 17 July 1991, the basic allowances 11.05 - Social Service Expenditures - and the basic allowances for operating expenses, with economic codes 12 and 74, specific or non-existent and belonging to subsistence programmes, may be redistributed only between them within the same section of the budget.
Art. 1-01-4
By derogation from Article 40 of the Acts on State Accounting, coordinated on 17 July 1991, the payment of birth allowances and burial allowances shall be made in accordance with the rules laid down in Article 41, paragraph 1erSame laws.
Art. 1-01-5
For orders placed through the Federal Public Service Personnel and Organisation, instalment payments may be made for the benefit of the Special Fund established with this public service, through payment orders by transfer to the Treasury Board's records.
Art. 1-01-6
Provision can be made to lawyers, experts and judicial officers acting on behalf of the State.
Art. 1-01-7
§ 1er. By derogation from Article 7, 1°, of the Royal Decree of 1er July 1964 fixing the rules of imputation of the revenues and budgetary expenditures of the general administration of the State, the expenses resulting from obligations arising from the dependants of the State in years prior to the fiscal year 2005 and regularly incurred on a non-dissociate credit that is no longer likely to be deferred may be charged on the appropriations opened by this Act.
§ 2. Ministers ordinators or their delegates shall communicate every three months to the House of Representatives, the Court of Accounts and the Minister of Budget the use made of the exemption referred to in § 1er.
Art. 1-01-8
The Treasury is authorized to make advances where transactions relating to a "Remunerations and other fixed expenditures for subsidized contractual personnel" (sections 93 to 101 of the Program Act of 30 December 1988) of the "Treasurement Operations" section, create a debiting position.
Art. 1-01-9
By derogation from Article 12, paragraph 3 of the Acts on State Accounting, coordinated on 17 July 1991, subsidies may be granted, pursuant to Article 43 of the Special Law of 12 January 1989 on Brussels Institutions, and charged with the Fund for the Financing of the International Role and the Capital Function of Brussels.
CHAPTER 2. - Special provisions of departments
Section 02. - SPF Chancellery of the Prime Minister
Art. 2.02.1
By derogation from section 15 of the Organic Law of the Court of Accounts of 29 October 1846, advances of funds may be made:
- for a maximum of 370,000 euros, to the extraordinary accountant of the SPF Chancellery of the Prime Minister;
- for a maximum of 25,000 euros, to the extraordinary accountant of the Standing National Commission of the Cultural Pact.
By means of these advances, extraordinary accountants can make the payment of claims of any kind, including the purchase of heritage furniture goods, not exceeding 5,500 euros.
Art. 2.02.2
By derogation from Article 15 of the Organic Law of the Court of Accounts of 29 October 1846, advances of successive funds in an amount not exceeding 2,500 euros may be made to the accountant responsible for the liquidation of relief and social allowances.
Art. 2.02.3
Within the limits of the basic allowances concerned, the following subsidies may be granted:
PROGRAMME 31/1 - EXTERNAL COMMUNICATION
1. Meeting at the International Press Centre "Residence Palace".
2. Subsides to the A.S.B.L. "Musée de l'Europe".
3. Any grants under the information and communication missions approved by the Council of Ministers.
PROGRAMME 31/2 - BI-CULTURAL INSTITUTIONS
1. Subside to the Royal Theatre of the Mint.
2. Subsides to the National Orchestra of Belgium.
3. Subside at the Palais des Beaux-Arts.
PROGRAMME 32/3 - SOCIAL PROVISIONS
1. Subsides to the Belgian Vocational Foundation.
2. Subsides to the European Movement - Belgium.
3. Trade union bonuses.
Art. 2.02.4
By derogation from articles 12 and 14 of the Acts on State Accounting, coordinated on 17 July 1991, all expenses of the SPF Chancellery of the Prime Minister relating to compensation to third parties due to the commitment of State responsibility, may be charged to the A.B. 01.34.02 of the Organic Division 21 - Management Organs.
Art. 2.02.5
The Prime Minister is authorized to pass, in the interest of the Treasury and provided that public procurement legislation is respected, exchange agreements to encourage the renewal of the equipment of the ITC Shared Services.
Art. 2.02.6
Within the limits of the credits listed in program 21/1 "Network ICT", can also be adjusted - in addition to the recurring operating costs and investments - of any kind related to presumed services, as well as to the installation and maintenance of the software and equipment of the various user services connected to the ITC network.
Art. 2.02.7
The External Communications Branch is authorized to make expenditures for information and communication missions to federal and programmatory public services. To this end, the External Communications Branch receives prior payment of these expenses, advances from the SPF and SPPs concerned.
Art. 2.02.8
The dependant payments of the variable credits of program 31/1 "Fund for the financing of the information and communication missions developed by the External Communications Branch" can be made in advance of funds. To this end, and by derogation from Article 15 of the Organic Law of the Court of Accounts of 29 October 1846, advances of funds of up to 200,000 euros can be made to the extraordinary accountant to the effect of paying claims not exceeding the 5.500 euros.
Art. 2.02.9
By derogation from Article 1-01-3, § 2 of this Law, a new breakdown of the credits of the basic allowance 31.11.1227 - "Different expenses relating to external communication" may be carried out within Program 31/1 - "External Communication".
Art. 2.02.10
By derogation from Article 1-01-3, § 2 of this Act, a further breakdown of the credits of the basic allowance 32.11.1222 - "Process funding for administrative simplification", within Program 32/1 - "Agency for administrative simplification", including staff credits (base allowances 32.10.1103 and 1104).
Art. 2.02.11
By derogation from art.18,§ 1.2° of the law of 19 April 1963 creating a public establishment known as the Royal Theatre of the Mint, amended in particular by Royal Decree No. 545 of 31 March 1987 concerning the Royal Theatre of the Mint, the 2005 grant to the Royal Theatre of the Mint (AB 31.20.41.21) is paid for 75% in the first quarter.
The balance will be transmitted each time in 3 equal instalments for October, November and December.
Art. 2.02.12
By application of art. 18 of the Act of 22 April 1958 establishing the National Orchestra of Belgium, the 2006 grant to the National Orchestra of Belgium (AB 31.20.41.22) is paid for 75% in the first quarter.
The balance will be transmitted each time in 3 equal instalments for October, November and December.
Art. 2.02.13
In execution of art. 13, 3° of the Act of 7 May 1999 establishing the Palais des Beaux-Arts in the form of an anonymous society of public law with a social purpose and amending the Act of 30 March 1995 concerning broadcasting distribution networks and the exercise of radio distribution activities in the bilingual region of Brussels-Capital and by derogation of art. 32 of the management contract between the Belgian State and the anonymous society of public law with social purpose "Palais des Beaux-Ars" of 18/11/2002, approved by the AR of 2/12/2002 (MB 21/12/2002) the 2006 subsidy to S.A. of public law with social purpose Palais des Beaux-Arts (AB 31.20.41.25) is paid for 75% in the course of the first quarter.
The balance will be transmitted each time in 3 equal instalments for October, November and December.
Section 03. - SPF Budget and Management Control
Art. 2.03.1
By derogation from section 15 of the Act of 29 October 1846 on the organization of the Court of Accounts, advances of funds of up to 500,000 euros can be made to the extraordinary accountant of the SPF Budget and Management Control.
By way of these advances, the extraordinary accountant is authorized to pay claims of any kind, including the acquisition of movable property, the amount of which does not exceed 5.500 euros.
Can be paid through these advances regardless of the amounts:
(1) Social expenditure;
(2) costs for foreign missions and for the posting of correspondence, as well as advances related thereto.
The extraordinary accountant responsible for the payment of foreign mission fees is authorized to make the necessary advances to officials sent on mission abroad.
Art. 2.03.2
The provision under program 41/1 may, after agreement of the Minister of Budget, be apportioned as required, by Royal Order, between the appropriate programs of the budgets of the departments concerned.
By derogation from Article 5, paragraph 2, of the Act of 16 March 1954 on the control of certain public interest bodies, the distribution by royal decree of this provisional credit may also increase the State's financial intervention in favour of public interest bodies.
Section 04. - Personal SPF and Organization
Art. 2.04.1
By derogation from section 15 of the Act of 29 October 1846 on the organization of the Court of Accounts, advances of funds of up to 250,000 euros can be made to the extraordinary accountants of the services and institutions whose expenses are recorded in this section.
By means of these advances, extraordinary accountants are allowed to pay all service fees not exceeding 5,500 euros, as well as, regardless of the amounts, water consumption costs, gas, electricity, telephone, fuel and fuel for motor cars, as well as any allowances and allowances of any kind allocated to the budget.
Can be paid through these advances regardless of the amounts:
(1) Social expenditure;
(2) costs for foreign missions and for the posting of correspondence, as well as advances related thereto.
Extraordinary accountants charged with payment of foreign mission fees are allowed to make advances to officials sent on mission abroad.
Art. 2.04.2
Within the limits of the basic allowances concerned, the following subsidies may be granted:
PROGRAMME 21/0 - DIRECTION AND MANAGEMENT
Subsides to the A.S.B.L. "Social Service of the Ministry of Public Service".
PROGRAMME 31/1 - PERSONNEL AND ORGANIZATION
Grants supporting initiatives for agents for the exchange of professional knowledge, the improvement of staff culture, the policy of equal opportunities and diversity, and the updating of knowledge on important social developments and their impact on the functioning of the administrative apparatus.
PROGRAMME 31/2 - TRAINING
1° Contributions to the International Institute of Administrative Sciences;
2° Cotisation at the European Institute of Public Administration in Maastricht;
3° Intervention for training activities organized by representative trade union organizations.
Art. 2.04.3
The provision in program 31/1 and program 31/2 may, after agreement of the Minister of Budget, be apportioned as required by royal decree between the appropriate programmes of the budgets of the departments concerned.
By derogation from Article 5, paragraph 2, of the Act of 16 March 1954 relating to the control of certain public bodies, the distribution by royal decree of these provisional credits may also increase the State's financial intervention in favour of these public bodies.
Art. 2.04.4
The cash account on which compensation is charged and various allowances for final and intern statutory staff and the contractual staff of the Federal Administration Selection Office (SELOR), a separate management State service, may present a debt balance.
Art. 2.04.5
The King is authorized to use, as a matter of priority, the balance of the Special Fund of the Personal SPF and Organization set out in section 63.01.A for the payment of amounts arising out of convictions or transactions in the context of public procurement litigation by P♣O in favour of federal public services.
Art. 2.04.6
By derogation from articles 12 and 14 of the Acts on State Accounting, coordinated on 17 July 1991, all expenses of the Federal Public Service Staff and Organization relating to compensation to third parties due to the commitment of State responsibility may be charged to A.B. 01.3401 of Organic Division 21 - Management bodies.
Art. 2.04.7
The Minister of Public Service is authorized, in litigation, to make transactions and make payments to the Caisse des Dépôts et Consignations.
Section 05. - SPF Information and Communication Technology
Art. 2.05.1
By derogation from section 15 of the Act of 29 October 1846 on the organization of the Court of Accounts, advances of funds of up to 250,000 euros can be made to the extraordinary accountants of the services and institutions whose expenses are recorded in this section.
By means of these advances, extraordinary accountants may make the payment of claims of any kind, including the purchase of tangible property, not exceeding 5,500 euros, as well as, no matter what amounts, the costs of water consumption, gas, electricity, telephone, fuel and fuel for motor cars, as well as the allowances and allowances of any kind allocated to the budget.
Can be paid through these advances regardless of the amounts:
(1) Social expenditure;
(2) costs for foreign missions and for the posting of correspondence, as well as advances related thereto.
Extraordinary accountants charged with payment of foreign mission fees are allowed to make advances to officials sent on mission abroad.
Art. 2.05.2
By derogation from section 1-01-3, § 2, of this Act, the basic allowances relating to remuneration and allowances generally "11.03 - Final and internary statutory staff" and "11.04 - Non-statusary staff", as well as the basic allowance "12.20 - Contracts for the provision of services by the ABL Egov" may be redistributed only between them within program 21/0.
Section 12. - SPF Justice
Art. 2.12.1
By derogation from section 15 of the Act of 29 October 1846 on the organization of the Court of Auditors:
(a) advances of funds of up to 2,500,000 euros may be made to the Department's extraordinary accountants. By means of these advances, the Department's extraordinary accountants are allowed to pay all service charges not exceeding 12,500 euros, as well as, regardless of the amounts, the costs of water consumption, gas, electricity, telephone, fuel and fuel for motor cars, as well as the allowances of any kind allocated to the budget and the costs incurred when the civil liability of the State is incurred;
(b) advances of funds of up to 875,000 euros may be made to the extraordinary accountants of the Management Service Budget and Control of Management responsible for the payment of lump sum allowances to members of the State Security and Houses of Justice;
(c) advances of funds of up to 2,500,000 euros may be made to the extraordinary accountants of the Department responsible for the payment of assistance to victims of intentional acts of violence granted by the ad hoc Commission.
Extraordinary Accountants of the Department responsible for payment of advances on mission charges abroad are authorized to make the necessary advances to officials sent on mission abroad.
Art. 2.12.2
Appropriations may be made:
(a) the Criminal Justice Fees Service for the payment of fees to judicial experts and judicial officers, as well as all other legal fees, including claims of receivables relating to international judicial cooperation;
(b) to the General Directorate for the Enforcement of Penalties and Measures for the payment of urgent expenses relating to:
- food and maintenance of inmates and internees;
- energy consumption, water and related taxes, and telephone bills.
Art. 2.12.3
By derogation from section 15 of the Act of 29 October 1846 on the organization of the Court of Auditors, advances of funds may be made, within the limits set out in section 2.12.1 of this Act, for the payment of social relief and allowances, as well as allowances for cultural and sporting circles created among the staff of the SPF Justice.
The recovery of advances made to staff members in the form of a loan may, if any, be made in accordance with section 23, 4°, of the Act of 12 April 1965 on the protection of workers' wages.
Art. 2.12.4
Expenditures on prior year receivables may be charged against current year credits in the following cases:
(1) Grants to public bodies and associations responsible for the guardianship of foreign minors (prog. 40/2).
(2) Criminal, correctional and police justice costs (the cost of transporting aliens to the border is assimilated to court fees and liquidated on the same rates). Costs of service of expulsion orders. Indemnities in cases provided for in Article 447 of the Code of Criminal Investigation and the Act on Preventive Detention. Reparation of damages incurred in the course of judicial proceedings. Costs resulting from the application of the Judicial Assistance and Free Procedure Act (Act of 10 October 1967). Costs arising from Letters of Request (proc. 56/0).
(3) Compensation to be awarded to provinces and communes (arts. 77 to 81 of the Act of 14 February 1961) (prog. 56/0).
4) Quote-part of Belgium in the operating costs of Europol and the "Schengen Information System" (prog. 58/2).
Art. 2.12.5
Within the limits of the basic allowances concerned, the following subsidies may be granted:
PROGRAMME 40/2 - TUTELLE MINEURS ETRANGER
(1) Grants to public bodies and associations responsible for the guardianship of unaccompanied foreign minors.
2) Grant to the a.s.b.l. "Coupole" in charge of the organisation of the guardianship of strange unaccompanied minors.
PROGRAMME 40/3 - STUDIES AND DOCUMENTATION
(1) Grants to publications and scientific institutions.
2) Grant to a.s.b.l. "Litiful travel commission."
3) Grant to the public interest institution "Belgian Committee for UNICEF. »
4) Grant to the Kinderrechten Coalitie Vlaanderen and the NGO Coordination for the Rights of the Child.
5) Grant to the Institute of Corporate Jurists.
6) Subsidy to the a.s.b.l. "Compilation Commission - Construction".
PROGRAMME 40/4 - NTERNATIONAL COLLABORATION
Intervention by Belgium in the operating costs of international bodies.
PROGRAMME 51/0 - SUBSISTANCE
Subsidies to bodies responsible for the therapeutic support of sexual assault authors.
PROGRAMME 51/1 - ENTERTIAN AND DEVELOPMENT
Grants for the financing of an external care circuit for the guidance, care and support of middle-risk internees.
PROGRAMME 56/0 - SUBSISTANCE
Subsidies for the use by judicial services of bar libraries in certain courthouses.
PROGRAMME 56/2 - JUSTICE MAISONS
Subsidies to bodies allocated for the organization of work of general interest and training activities in the context of judicial proceedings, restorative mediation, support of the right to visit and judicial assistance to victims.
PROGRAMME 58/2 - INTERNATIONAL COLLABORATION
Quote-part of Belgium in the operating costs of the International Criminal Police Organization in Lyon (O.I.P.C.), the European Police Service in The Hague (EUROPOL) and the "Schengen Information System" in Strasbourg (S.I.S.).
PROGRAMME 59/2 - ISLAMIC CULT
Grant for the recognition of Islamic worship.
Art. 2.12.6
By derogation from Article 15 of the State Accounting Laws, coordinated on 17 July 1991, resales may be made from the basic allowance 56.3.1.1201 to the basic allowance 56.0.3.1240.
Art. 2.12.7
The Minister of Justice is authorized to provide financial intervention to inmates under electronic surveillance, which will be charged to AB 12/51.0.4.3301.
Art. 2.12.8
The proceeds of receipts for order carried out in connection with the partial financing by the city of Brussels of the security corps, created in the penitentiary institutions, will be carried out using account 87.09.68.98.B+ of the section "Treasury operations".
They may be used to cover the staff costs of the Security Corps.
This account may present a debtor balance for up to six months.
These expenses are subject, prior to any legal undertaking, to the opinion of the Finance Inspectorate in accordance with the provisions of articles 14 and 15 of the Royal Decree of 16 November 1994 on administrative and budgetary control.
Art. 2.12.9
The proceeds for order made under the cooperation agreement establishing a National Commission for the Rights of the Child will be recorded on the accounts 85.01.04.89 C and 87.09.74.07 B of the "cash-order transactions" section.
Such income may be used to cover the operating and staff costs of the Commission, respectively.
Art. 2.12.10
The Minister of Justice is authorized to negotiate a transaction with French-speaking, German-speaking and Flemish bars, in the context of the litigation that opposes the federal state to bars about the extent of the federal government's obligations to cover costs for the organization of legal aid offices.
For the execution of this transaction, in derogation of art. 15 of the State Accounting Laws, coordinated on 17 July 1991, the credit of the basic allowance 40.0.3.3401 may, if necessary, be fed by a redistribution between basic allocations involving economic codes 12 and/or 74 or from the interdepartmental reserve, in accordance with the provisions of Article 2.03.2.
Section 13 - Internal SPF
Art. 2.13.1
By derogation from section 15 of the Act of 29 October 1846 relating to the organization of the Court of Auditors, advances of funds of up to Euro371,840 may be made to the extraordinary accountants of the services and institutions whose expenses are listed in this section.
By means of these advances, extraordinary accountants are allowed to pay all service fees, allowances and allowances of any kind allocated to the budget as well as water consumption, gas, electricity, telephone, fuel and fuel for cars not exceeding 6.197 euros.
Can be paid through these advances, regardless of the amounts:
(1) Social expenditure;
(2) expenses related to the training and occupation of full-time and reduced-time civil security personnel;
(3) costs for foreign missions and for the posting of correspondence, as well as advances related to them; Extraordinary accountants charged with payment of foreign mission fees are authorized to make advances to officials sent on mission abroad;
(4) all operating expenses and allowances and allowances of any kind of provincial governments within the limits of the basic allowances of Program 58/0, with the exception of expenditures for the acquisition of non-expendable movable property;
(5) all expenses of Program 55/0 for repatriation and removal of undesirable persons;
6) all program expenses 40/7 and 56/6 for litigation allowances and fees.
Art. 2.13.2
Within the limits of the basic allowances concerned, the following subsidies may be granted:
PROGRAMME 51/3 - PROTOCOL
1° Allowances for the perpetrators of acts of courage, victims of their dedication or the rights of the heroes who have lost their lives by carrying out such acts or obvious follow-ups of these acts, as well as compensation for funeral expenses.
2° Amicale des rescapés de Breendonk.
3rd Flame Committee.
4° Committee of the monument of King Albert to the Yser.
5° Subside to the Brussels Union of Initiative and Promotion, as an intervention in the fees of the festivities organized each year in the Brussels Park on the occasion of the national holiday.
PROGRAMME 54/0 - SUBSISTANCE PROGRAMME
1° Grant to the Fire Services Training Council.
2° Intervention in civil security information, documentation and public relations costs.
PROGRAMME 54/2 - OPERATIONS OF THE CIVILE SECURITY; EQUIPMENT AND TRAINING FOR CIVILE PROTECTION, SERVICES AND THE CENTRES "100"
1° Grant to the Brussels-Capital Region, to the municipalities, and intercommunal for the purchase of special equipment for fire services.
2° Interventions for fire services in fire prevention campaign fees, support of local initiatives.
3° Grants to the Higher Council of Training for Incendie Public Services, the Programming Commission, the Equivalences and Dispenses Commission, the Drafting Committee, the French- and German-speaking supraprovincial Council, and the Dutch-speaking supraprovincial Council.
PROGRAMME 54/6 - DIRECTION OF FINANCIAL INTERVENTIONS TO THE PROFIT
1° Intervention in laboratory fees conducting fire prevention research.
2° Subsides to the Royal Federation of Firefighters of Belgium, French-speaking and German-speaking wings, subsidies to the Flemish Association of Incendie Services and the Caisse nationale d'entraide des sapeurs-pompiers.
3° Interventions in the funding of courses organized by provincial training centres for fire service members.
PROGRAMME 56/1 - GENERAL ADMINISTRATIVE FORMATION, PREVENTION AND EQUIPMENT
1° State intervention in spending for initiatives to promote contacts of police services with the public.
2° Achievement of expenditures, in the area of police and crime prevention, including for the realization or acquisition of common-use infrastructure, equipment, equipment and software and for the financing of campaigns and study fees.
3° Grant to be given to Belgian universities or other organizations, concerned with the study or control of crime, public or private initiatives in the field of crime prevention, including hooliganism, integrated local crime initiatives and the investigation into the presence of certain criminal phenomena.

Art. 2.13.3
The amounts to be recovered, for the years 1998, 1999, 2000, 2001 and 2002, from the authorities that use the services of a regional receiver or a regional inspector, under the cooperation agreement on the method of apportioning the costs of the regional receivers and the method of debiting the contribution in these costs, concluded in Brussels on 9 December 1997 between the Federal State, the Flemish Community and the Walloon Region, are exempted from the five-year provisions.
Art. 2.13.4
The Minister of the Interior is authorized to withdraw from the specific budget section provided for in section 1er, § 2quater, paragraph 2 of the Act of 01.08.1985 on social provisions, as amended by the Act of 30.03.1994 on social provisions, funds for coordination and supralocal actions in the areas referred to in Article 69 of the Act of 30.03.1994 referred to above.
These funds are paid to the Special Accountant of the Permanent Secretariat for the Prevention Policy, which justifies their employment with the Court of Auditors.
Art. 2.13.5
The outstanding receivables as at 31.12.2000 on the basic allowances 56/10.63.08 and 56/13.63.07 of section 13 "Inner PS", may be ordered on the basic allowances 90/15.63.08 and 90/26.63.07 of section 17 "Federal and Integrated Operations".
Art. 2.13.6
The Federal Inland Public Service shall pay, within the limits of the allocated staff credits, the salary, allowances and allowances, plus the employer's contribution, to the municipalities that have continued the payment of the salary, allowances and allowances to their staff, seconded as part of the "Electronic Identity Card" project to the Federal Inland Public Service.
The claim must be made at the beginning of each year for the previous year, on the basis of an annual survey, transmitted by the municipalities concerned to the Federal Interior Public Service.

The provision under program 21/1 may, after agreement of the Minister of Budget, be apportioned as required by royal decree between the Department's substantive divisions. The provision is intended for the Knowledge Centre of Civil Security, the State Council and the Council for Stranger Disputes.
Art. 2.13.10
By derogation from section 1 01 3 of the general provisions the department is authorized to make basic allowance redistributions between basic allowances 56.60.3401 and 40.70.3401 (contentious).
Art. 2.13.11
By derogation from Article 45 of the Acts on State Accounting, coordinated on 17 July 1991, and from the Act of 27 December 1990 creating the budgetary funds, the Special Fund for Integrated Emergency Call Centres (centres 112) is financed by a non-dissociate credit in the basic allowance 63.01.33.01.
Section 14. - SPF Foreign Affairs, Foreign Trade and Development Cooperation
Art. 2.14.1
By derogation from Article 15 of the Act of 29 October 1846 relating to the organization of the Court of Accounts, successive advances of funds in an amount not exceeding 10,000 euros, of which it will be justified subsequently, may be made to the accountant responsible for the liquidation of relief and expenses of a social character.
Art. 2.14.2
By derogation from section 15 of the Act of 29 October 1846 relating to the organization of the Court of Accounts, advances of funds of up to 750,000 euros can be made to the extraordinary accountants of the Directorate of Budget and Accounting and of 375,000 euros to the other extraordinary accountants of the department.
With these advances, extraordinary accountants are allowed to pay receivables not exceeding 5,500 euros.
Art. 2.14.3
Some expenses made outside the framework of the Royal Decree of 19 November 1996 relating to emergency assistance and short-term rehabilitation in favour of developing countries may be charged on the basic allocation 14.53.41.35.80 of programme 53/4. These are the following expenses:
- funding of studies related to disaster prevention and preparedness, broad-based emergency assistance, short-term rehabilitation both material and psychological;
- training of nationals from low-income countries, specifically related to the issue of humanitarian assistance and provided by specialized international organizations;
- expenses related to the provision of personnel and the provision of goods and services in very complex or exceptional situations of crisis.
Art. 2.14.4
The credits in programme 42/0 (A.B. 42.04.03.50) are intended to provide permanent working capital for the payment of expenses related to the operating and investment costs of Belgian diplomatic and consular posts and permanent representations to international bodies. Expenditures on these advances are regulated by imputation on the budgetary appropriations provided for this purpose. For the same purpose and with the application of the same budgetary regulation procedure, the Treasury is also authorized to replenish these working capitals abroad.
Art. 2.14.5
Expenditures, whose regularization occurs a posteriori, carried out in diplomatic, consular and co-operation posts and in permanent representations in previous fiscal years may be charged against the credits of the current year.
Expenditures on prior-year receivables may also be charged against current year appropriations, in the following cases:
(1) Reimbursement of medical care expenses in Europe to Belgian and Luxembourg missionaries in Africa (progr. 54/2).
(2) Expenditures on training in Belgium of trainees and students from low-income countries, and expenditures on social and cultural assistance (prog. 54/1 and 54/2).

- and on the other hand, under programme 54/4 - Special interventions, in the context of transition, reconstruction and consolidation of society, as well as in the context of food aid;
the assignment of goods or services free of charge is authorized. Legislation and regulation in public procurement are applicable in the procurement of goods and services to be disposed of.
PROGRAMME 55/1 - EUROPEAN RELATIONS
(1) Contributions from Belgium to international bodies established in the country;
(2) Contributions from Belgium to international organizations outside the country;
3) Subsidies for European integration.
Art. 2.14.7
Within the limits of basic allocations 14.53.41.12.31 and 14.53.41.35.22, in programme 53/4 "Humanitarian aid", expenses of all kinds can be made, with prior agreement of the Council of Ministers, as interventions and initiatives by Belgium in the field of preventive diplomacy.
Art. 2.14.8
The liquidated expenses of the permanent working capital, provided in 1996 by the basic allowance 54 09 0350, are regulated without delay by charging the following basic allocations: 21 01 1201, 21 01 1228, 40 21 1201, 42 02 1201, 54 04 1227, 54 14 5442, 54 3511, 54 40 3550 in 54 43 3521.
Art. 2.14.9
For the year 2006, the Belgian Survie Fund (base allocation 54 40 3550) has a commitment authorization of 35.000.000 euros.
Any undertaking to be made under this Article shall be subject to the visa of the Comptroller of Commitments and the Accounts.
Prior to the 10th of each month, the Comptroller of Commitments shall forward to the Accounts Court, together with supporting documents, a statement in three copies indicating, on the one hand, the amount of the commitments covered in the past month and, on the other hand, the amount of commitments covered since the beginning of the year.
Art. 2.14.10
Subsidies attributed to an indirect actor, under a multi-year programme, will be justified on the date provided for in the relevant orders or conventions. The unutilized balance of such an annual subsidy, attributed to a previous fiscal year, may be deducted from the dependant subsidy of this fiscal year to the same indirect actor.
As a result, the approved annual plan of action or programme for the new fiscal year will be funded with new means to be undertaken, and with means still available to the indirect actor, as a result of unutilized amounts in the framework of previous annual action plans or programmes.
This article covers the following basic allowances: 54 20 3570, 54 20 3571, 54 21 3565, 54 21 3566, 54 22 3331, 54 22 3332, 54 22 3333, 54 23 4501, 54 23 4502, 54 24 4552, 54 24 4553, 54 24 4554, 54 25 4552, 54 25 4553, 54 25 4554, 54 26 3564, 54 26 3566 and 54 40 3550.
Art. 2.14.11
In principle, subsidies for projects and programmes of international organizations must be justified in accordance with the terms and conditions set out in the relevant decrees and arrangements. However, the subsidies granted in previous fiscal years, as well as the unused balances, may be redirected on a due basis and with the agreement of the Minister of Development Cooperation or, with respect to basic allocations 53 41 3524 - Conflict prevention, peacebuilding and human rights and 53 41 3580 - Prevention, emergency assistance, short-term rehabilitation and humanitarian action, the Minister of Foreign Affairs. The approved amendments will be forwarded on a regular basis to the Court of Accounts and the Minister of Budget.
Art. 2.14.12
In 2006, the State will be able to enter into new multi-year commitments with partner countries for a total of 175.000.000 euros. In addition, the stock of bilateral commitments, to be carried out by the CTB, cannot exceed 550.000.000 euros. These are projects and programs to be carried out by the CTB on the basic allowance 54 10 5402.
Any commitments made under this section shall be subject to the Comptroller of the commitments that will verify the application of administrative and budgetary control procedures and compliance with the cap.
Prior to the 10th of each month, the Comptroller of Commitments shall forward to the Court of Auditors, for information, a statement in three copies, together with supporting documents, which shall include both the amount of commitments entered in the past month and the amount of commitments entered since the beginning of the year.
Art. 2.14.13
The provision for the basic allowance 54 33 8409 will be transferred by the Minister of Development Cooperation or by his or her delegated director on a cash account managed by the Minister of Finance or by his or her delegated sponsor.
Art. 2.14.14
§ 1. For the year 2006, a loan program for foreign states can be negotiated up to Euro 33.050,000.
In view of the budgetary resources for this purpose, the loan programme must be approved by the Council of Ministers. It mentions, on the one hand, loans to be made as a priority and, on the other, priority replacement loans as a multi-year program.
Replacement loans may be substituted at any time for the original loans that are deleted.
The liability controller records the accomplishments and replacements of a program's loans.
§ 2. Loans to foreign States are made by the Comptroller of Commitments prior to notification of the loan agreement, at the time the Minister of Finance agrees on the loan to be granted by signing a proxy or loan agreement.
Credits for this purpose are credits of commitment within the meaning of Article 7 § 2 of the laws on State accounting, coordinated on 17 July 1991.
§ 3. Credits for the payment of these loans are ordinance credits within the meaning of Article 7 § 2 above.
Art. 2.14.15
The provision in programme 21/0 (A.B.01.01.01) - provision to cover expenses of any kind relating to the presidency by Belgium of the Organization for Security and Cooperation in Europe - may be apportioned, as appropriate, between the appropriate programmes, by Royal Decree and with the agreement of the Minister of Budget.
Art. 2.14.16
Public contracts for pre-work studies (basic allocation 14/42.11.12.44) and work (basic allowances 14/42.04.72.01 and 14/42.11.72.02) that are awarded abroad and that remain below the European thresholds, may be awarded by negotiated procedure provided that the necessary announcement is made to ensure effective competition and that the equality of bidders,
Art. 2.14.17
The treasury is authorized to make advances when the current account of Treasury operations 83.05.11.90 B (Contribution of Belgium to the European Development Fund (EDF)) is in debit position.
Art. 2.14.18
The Consolidated Revenue Fund is authorized to make advances when transactions relating to the Account 83.01.04 (Type B), an open-order account on behalf of the B.I.T.D. (International Customs Tariff Office), create a debiting position of the Account.
Section 16. - Ministry of Defence
Art. 2.16.1
By derogation from amended section 15 of the Act of 29 October 1846, relating to the organization of the Court of Accounts, advances of funds of up to 20,000 euros can be made to the extraordinary accountants, to the effect of paying expenses not exceeding 2.500 euros.
Art. 2.16.2
By derogation from Article 41 of the State Accounting Laws, coordinated on 17 July 1991, fixed expenditures relating to the civilian personnel of the Ministry of National Defence may be subject to credit opening orders.
Credit opening orders may also be issued in the same way as fixed expenditures: funeral allowances, birth allowances, and expenses resulting from foreign air operations and travel, long-term cruises or immediate action in the event of a land, air and naval accident, regardless of the amount of such expenses.
Art. 2.16.3
Expenditures on prior year receivables may be charged against current year credits in the following cases:
- contributions to international bodies required under international agreements,
- orders of supplies and services to foreign governments and NATO production and logistics agencies,
- payment of compensation for occupational accidents and compensation to State personnel for material damage,
- in military graves.
Art. 2.16.4
By derogation from the provisions of Article 143 of the Acts on State Accounting, coordinated on 17 July 1991, the Minister of Defence is authorized, both in the context of technical cooperation and emergency assistance to third countries, and in the case of mutual assistance provided for in Article 3 of the North Atlantic Treaty, to make ex gratia payments for service and/or to dispose of equipment and/or materials granted to the Forces of the countries
Art. 2.16.5
The Minister of Defence is authorized to dispose of advances on:
(a) compensation to the State of the head of damages suffered by personnel or by third parties;
(b) expenses related to hospitalization costs in civilian establishments, long-term treatments and supplies of pharmaceuticals by civil informals;
(c) costs of using foreign facilities.
Art. 2.16.6
The funds required for the payment of contract expenditures to be made by the Department of National Defence in the United States of America and Canada can be obtained through credit opening orders. These contracts may be concluded under the negotiated procedure.
These funds may also be used after the fiscal year to charge the expenses resulting from the above-mentioned contracts.
The excess funds are transferred to the Consolidated Revenue Fund as soon as the accountant has submitted to the Court of Accounts the management account with the final account of the contracts for which these funds were allocated.
Can also be concluded in accordance with the negotiated procedure, the contracts and exchange agreements with the NATO Maintenance and Supply Organization (NATO Agency for Contract and Procurement and its subordinate agencies), as well as those with a NATO member country under an international agreement, with the objective of eminent supply of spare parts, maintenance or maintenance
Art. 2.16.7
Withdrawal of the Minister of Defence's exclusive decision to resolve the disputes arising from the receipt of supplies resulting from contracts passed by the Ministry of National Defence:
(a) in the United States of America, Canada, with the NATO Supply and Repair Agency and its subordinate agencies;
(b) with the Government of the United Kingdom of Great Britain and Northern Ireland, as a result of the logistic agreement on the supply of spare parts and other equipment for CVRT;
(c) with the Government of the Federal Republic of Germany, as a result of the agreement on the supply of spare parts for the LEOPARD weapon system and its derivative versions.
Art. 2.16.8
Expenditures to be made in Germany may be made in accordance with the rules in force in the Federal Republic and be subject to credit opening orders, regardless of their amount.
The funds obtained can also be used at the end of the fiscal year to charge the aforementioned expenses.
The excess funds are transferred to the Consolidated Revenue Fund as soon as the accountant has submitted to the Court of Accounts the management account with the final account of the contracts for which these funds were allocated.
Art. 2.16.9
For markets subject to liquidations for NATO infrastructure, bids or offers, depending on the type of market, will be compared without taking into account the value added tax, or the tariffs applied in the countries of the European Union.

Art. 2.16.11
The treasury is authorized to make advances when Account Operations 87.07.01.25.B of the Treasury Order Operations Section - Current account of payment and reimbursement of remuneration for other departments or services, foreign or international organizations, or other third parties - create a debiting position of this account.
Art. 2.16.12
Revenue and order transactions conducted under international and national treaties or agreements will be carried out using Account 82.04.01.68.B of the "Treasury Order Operations" section.
This account may present a debtor balance for up to six months.
The law of the markets on behalf of the State and the corresponding delegation system are applied to the expenditure transactions.
The latter are subject, prior to any legal undertaking, to the opinion of the Inspector of Finance in accordance with the provisions of Articles 14 and 15 of the Royal Decree of 16 November 1994 on administrative and budgetary control and to the visa of the Court of Accounts within the meaning of Article 14 of the Act of 29 October 1846 on the Court of Accounts.
Art. 2.16.13
The Minister of Defence is authorized to use, up to 800,000 euros, revenues from the interest generated by the advances filed with the Federal Reserve Bank of New York as part of the contracts for the supply of aircraft, logistical support, ground installations and related costs for the entire F-16 fleet.
These interests will be charged to Account 87.07.03.27.C of the Treasury Order Operations Section. They will be used to cover the costs resulting from the above-mentioned markets.
The Minister of Defence is authorized to use the available assets relating to the ongoing contracts and exchange agreements with the NATO Maintenance and Supply Organization (NATO Agency for Maintenance and Supply and its subordinate agencies) within the framework of the supply of spare parts, maintenance and withdrawal of the use of the equipment on the credits of Section 16 - National Defence Program 16
Art. 2.16.14
By derogation from Article 143 of the State Accounting Laws, coordinated on 17 July 1991, the Minister of Defense is authorized to sell the furniture made available to the families occupying the housing managed by the Belgian military authority in Germany. This furniture will be sold on site by the said authority to the families concerned who, as a result of the restructuring of the Armed Forces will return to Belgium.
The proceeds of this sale will be charged to the Ways and Means Budget for the general Treasury needs.
Art. 2.16.15
By derogation from section 151 of the Act of 2 August 2002, benefits for the benefit of the Central Office of Social and Cultural Action of the Ministry of Defence (OCASC) and for various public bodies belonging to the civil element in order to ensure the repatriation of their heritage, following the final withdrawal of the Armed Forces in Germany, are carried out free of charge.
By derogation from article 28 of the co-ordinated laws on State accounting, benefits for public bodies may be made free of charge. The Minister of Defence is responsible for setting out the terms and conditions of this gratuity.
Art. 2.16.16
The Central Office for Social and Cultural Action of the Ministry of Defence (OCASC) is authorized to carry out missions as provided for in section 1er of the Royal Decree of 10 January 1978, as amended by the Royal Decree of 7 December 1998, determining the mission and regulating the organization and operation of this body, for the benefit of the Federal Police personnel.
The members of the Defence staff who, pursuant to Article 11 § 2 of the Act of 10 April 1973 establishing the Central Office for Social and Cultural Action of the Ministry of Defence (OCASC) for the benefit of members of the military community, are made available to the CSCO, remain in charge of the Defence budget.
Art. 2.16.17
By derogation from the provisions of article 28, 2e paragraph of the State Accounting Acts, coordinated on 17 July 1991, the Minister of Defence is authorized to value the benefits provided to the Federal Police, with the exception of those relating to staff permanently available to the Federal Police, and to compensate the benefits provided by the Federal Police on the basis of the additional costs incurred.
Apart from occasional benefits, the financial coverage of benefits whose volume is known priori is subject to a provision of credits whose amount is determined by the estimate of the benefits to be realized and the count of those actually carried out previously.
Art. 2.16.18
The Minister of Defence is authorized, within the framework of an international integration of the Armed Forces, or in order to deal with emergency cases, to conclude agreements with foreign countries on mutual benefits of services.
The financial regulation of these transactions may be made by means of compensation, either when the agreement has ceased its effects, or at the expiry of an agreed period or by the common will of the parties involved. The potential balance will be the subject of an imputation, either in the National Defence Budget or in the Ways and Means Budget for the benefit of the budget fund for benefits against payment.
Finally, the Minister of Defence is authorized, with regard to materials, materials, weapons and ammunition, to pass conventions of mutual assignments, exchange and loan with other departments, Belgian or foreign companies and third countries, provided that this is favoured by the renewal of the relevant stocks to the Armed Forces.
Art. 2.16.19
The Minister of Defence or the delegated official is authorized to return, in whole or in part, real property or other property intended to be returned as a result of the restructuring, which is owned by the Federal Republic of Germany or a Land and which has been made available to the force or civil element for use, and to determine the financial implications of such restitution after negotiations with the State of residence.
The net financial consideration of these restitutions, determined on the basis of Article 52 of the Agreement supplementing the Convention between the States Parties to the North Atlantic Treaty on the status of their forces, with respect to the foreign forces stationed in the Federal Republic of Germany and the Protocol of signature to the Complementary Agreement, signed in Bonn on 3 August 1959 and approved by the law of 6 May 1963, will be the subject of a global discount
Partial payments may be made by the Federal Republic of Germany.
Any balance and/or partial payments will/will be the subject of an imputation either to the budget of the departments and agencies of public interest concerned, or to the Budget of the Ways and Means of Article 16.76.01 for, after counting with the organizations mentioned above, to be used for expenses resulting from infrastructure and/or remediation work in the areas in Belgium and/or Germany, managed by the Armed Forces or which are returned.
Art. 2.16.20
The Minister of Defence is authorized to provide support to the Civil Social Service.
Art. 2.16.21
The very urgent costs to be incurred in foreign operations can be carried out in the context of contracts that may be awarded according to the negotiated procedure. The basic principles of public procurement legislation will be applied for the conclusion of the aforementioned markets unless local circumstances permit it.
Art. 2.16.22
The Minister of Defence is authorized, with the approval of the Minister of Budget and by Royal Decree deliberated in the Council of Ministers, within the limits of the appropriations of Section 16 - National Defence, to carry out transfers for the benefit of programme 16-50-5, "Implementation", in order to meet the specific needs of humanitarian operations and peace support.
Such transfers of credit will be communicated without delay to the House of Representatives and the Court of Auditors.
Art. 2.16.23
By derogation from the provisions of Article 28, 2nd paragraph, of the laws on State accounting, coordinated on 17 July 1991, the Minister of Defence is authorized to enter into agreements with other public bodies in the context of the provision of mutual benefits. The financial regulation of these transactions may be effected by compensation, either when the agreement has ceased its effects, or at the expiry of an agreed period or by the common will of the parties involved. The potential balance will be compensated in kind either from an imputation to the Defence Budget (General Estimates), or the Ways and Means Budget for the benefit of the budget for benefits against payment.
Art. 2.16.24
By derogation from the provisions of Article 28, 2nd paragraph of the coordinated laws on State accounting, the Minister of Defence is authorized to acquire a mine control simulator through a joint financial participation of the Kingdom of Belgium and the Kingdom of the Netherlands.
By derogation from the provisions of section 19 of the Act of 24 December 1993 on public procurement and certain contracts of work, supplies and services, the Minister of Defence is authorized to enter into a single market, awarded in accordance with the provisions of the Act of 24 December 1993 referred to above and for the joint acquisition of a mine control simulator with the Netherlands that mandate it.
Expenditure transactions under this contract are subject, prior to any legal undertaking, to the advice of the inspector of Finance in accordance with the provisions of the Royal Decree of 16 November 1994 on administrative and budgetary control and to the visa of the Court of Accounts within the meaning of Article 14 of the Act of 29 October 1846 on the organization of the Court of Accounts.
Art. 2.16.25
The outstanding balances as at 31 December 2002 of accounts 87.07.04.28 B, 87.07.06.30 B, 87.07.09.33 B, 87.07.10.34 B and 87.07.12.36 A of the "Treasury Order Operations" section must be transferred to the respective budgetary funds.
In order to ensure continuity of service and for administrative simplification, the Minister of Defence is authorized to pay outstanding claims arising from existing commitments as of December 31, 2002, in charge of these accounts of the section "Treasury Operations".
Art. 2.16.26
By derogation from Article 143 of the State Accounting Laws, coordinated on 17 July 1991, the Minister of Defence is authorized to use the revenues realized from 2002 from timber sales in the areas that are part of the real estate property entrusted to his management, collected and recorded in Article 16.7601 of the Voies and Averages Budget, in accordance with Article 41 of the Programme Law of 19 July 2001.
Art. 2.16.27
Pursuant to section 43 of the Program Act of 19 July 2001, the Minister of Defence is authorized to extend the Life and Disability Insurance contract to persons who are not part of the Defence. The insurance premium is fully covered by the Defence budget if, upon request from the Defence and as part of the operational implementation of the Armed Forces or humanitarian assistance, these persons accompany military personnel or civilian personnel abroad.
Art. 2.16.28
By derogation from Article 143 of the State Accounting Laws, co-ordinated on 17 July 1991, and within the framework of a sales contract for F-16 aircraft to be concluded by the negotiated procedure pursuant to Article 41 of the Programme Law for the 2001 Budget Year, of 19 July 2001, the Minister of Defence is authorized:
- for sale of non-surplus assets as part of its management
- as part of the delivery of logistical support and related services to make commitments on an expensive basis to the buyer
- to give the buyer a pre-financing.
Prerequisitely to any legal undertaking as part of the conclusion of a sales contract, including any unilateral undertaking arising from the above-mentioned provisions, the opinion of the Inspectorate of Finance and the agreement of the Minister of Budget are requested in accordance with the Royal Decree of 16 November 1994 on administrative and budgetary control.
Expenditures and revenues for the sale of non-surplus equipment and the benefits described above are equivalent to transactions for order within the meaning of section 2.16.12 of this Act.
Art. 2.16.29
In derogation from section 13 of the Public Procurement Act of 24 December 1993 and from certain contracts of work, supplies and services, public contracts for strategic maritime and air transport can be concluded through the procedure negotiated without advertising.
Section 17. - Federal police and integrated operation
Art. 2.17.1
The Minister of the Interior is authorized to liquidate advances on the State's dependant compensation for damages suffered by staff members or by third parties.
Art. 2.17.2
Foreign health care expenses may be paid through provisions.
Art. 2.17.3
Within the limits of the applicable basic allowance, the following subsidy may be granted:
PROGRAMME 44/1 - COORDINATION AND FUNCTIONING
- to the A.S.B.L. "Social Service of the Integrated Police": budget allocation as a contribution to staff costs, general operating expenses and intervention expenses, including the share of these expenses required for the management of HORECA services within the federal police;
- Police Studies Centers.
PROGRAMME 90/1 - FEDERAL DOTATION
- to multi-communal police areas and municipalities: contribution of the federal state to the costs of local police personnel, operations and investment; including over-numbered ex-gendarme pay expenses in police areas;
- to certain multi-communal and common police zones: contribution of the federal state in the expenses for the replacement of uniform and equipment for the maintenance of order;
- to certain municipalities: contribution of the federal state in the costs of civilian personnel for the police component of security contracts.
PROGRAMME 90/2 - FEDERAL SUPPORT AND INTEGREEMENT
- to accredited police schools or other institutions: contribution of the federal state to the costs of organizing selection tests and vocational training for members of the integrated police;
- to some agencies and A.S.B.L.: contribution of the federal state to the financing of projects to stimulate the recruitment of people reflecting the socio-cultural diversity encountered in the population;
- to certain multi-communal and common police zones: contribution of the federal State to the financing of the operating costs incurred for the maintenance of power plants 101;
- to various agencies and A.S.B.L. that promote the integration of local and federal police: intervention by the federal authority in the financing of their projects;
- the European Police College (CEPOL) and other European institutions: Belgium's contribution to the operating costs of these institutions.
Art. 2.17.4
Expenditures on prior year receivables may be charged against current year credits in the following cases:
1. compensation for occupational accidents;
2. compensation to State personnel for material damage;
3. supplies made by civilian or licensed pharmacists and dental and surgical prosthetics.
Art. 2.17.5
The Consolidated Revenue Fund is authorized to make advances where the transactions relating to Account 87.07.50.74.B of the "Treasury Order Operations" section - Current account of payment and reimbursement of remuneration for other departments or services, foreign or international organizations, or other third parties - create a debiting position of this account.
Art. 2.17.6
Expenses to be incurred by Federal Police liaison officers who are stationed abroad may be incurred in accordance with the rules in force in the countries concerned and may be liquidated on funds obtained by an appropriation order, regardless of the amounts.
By derogation from the provisions of Articles 3, 28 and 143 of the State Accounting Laws, coordinated on 17 July 1991, the assets made available to a liaison officer and which are disserviced, may be sold by him according to the negotiated procedure and according to the rules in force in each country.
This may be done in the same way for the equipment and goods in stock at the time when a representation of the Federal Police abroad is definitively lifted, unless the stocks concerned are free of charge or subject to the equivalent compensation condition of the receiving party, to the services of the Foreign Affairs, Foreign Trade and Development Cooperation SPF.
In cases where an on-site sale is made, the product will be paid to the Ways and Means Budget.
However, if the equipment can be delivered to the supplier of new similar properties, compensation may be made by subtracting the value of the alienated property from the amount charged for the purchase of the new equipment.
Art. 2.17.7
The Consolidated Revenue Fund is authorized to make advances where the transactions relating to Account 87.07.51.75.B of the Treasury Order Operations Section - Current account of payment and reimbursement of compensation transactions for multi-communal police areas and municipalities, as part of the protocol with the transport companies regarding the payment of the employer's intervention in the transportation costs of personnel for travel to and from the workplace, create a debiting position of the account.
Art. 2.17.8
The Minister of the Interior is authorized to make revenue and to affect payments made by staff members or other third parties:
1° in repair of unfit use, loss or degradation of federal police equipment;
2° in payment of their share in invoices in obligations contracted by the federal police, but which cannot be charged directly to these third parties by the contractor.
The revenues covered are included in section 16.01 of the Ways and Means Budget and are allocated to the Organic Budget 17-1 " Third-party benefits against payment" that is linked to Program 17-45.
Art. 2.17.9
During the year 2006, on the organic budget fund 17-2 "Funds for the delivery of clothing and equipment against payment to police personnel", is authorized, in commitment and ordering, a debt balance that cannot exceed, respectively 14.532.400 euros and 5.531.400 euros.
Section 18. - SPF Finance
Art. 2.18.1
§ 1er. By derogation from amended section 15 of the Act of 29 October 1846 on the organization of the Court of Auditors, advances of funds may be made:
(1) to the Extraordinary Accountants of the Directorate Accounting and Budget of the Management Service Budget and Management Control, for a maximum amount of 5.000.000 euros;
(2) to the extraordinary accountant of the Mass of Customs and Excise Administration personnel, to the extraordinary accountant of the Social Service and to the extraordinary accountants of the tax administrations for the expenses of the foreign services, for a maximum of 1,000,000 euros;
3) to the extraordinary accountants of the Public Debt Service, for a maximum amount of 20,000 euros.
§ 2. Extraordinary accountants of tax administrations for the expenses of external services are allowed to pay, by way of advances of funds, all service costs not exceeding 5,500 euros (excluding T.V.A.), allowances of any kind and, no matter how much, maintenance and cleaning expenses, water consumption costs, gas, electricity, telephone, telefax, fuel for cars.
§ 3. Extraordinary accountants of the Accounting and Budget Division of the Management Service Budget and Control of the relevant Management are allowed to pay, by way of advances of funds, all service charges not exceeding 12,500 euros (excluding T.V.A.), allowances of any kind as well as, regardless of the amounts, maintenance and cleaning costs, the operating costs of the strategic organs,
§ 4. The Extraordinary Accountant of the Directorate Accounting and Budget of the Supervisory Service Budget and Control of Management responsible for the payment of remuneration and the reimbursement of the costs of State control bodies to public bodies is authorized to pay these expenses through advances of funds.
§ 5. To the Extraordinary Accountant of the Accounting and Budget Division of the Management Service Budget and Control of Management responsible for the payment of mission fees abroad, authorization is given to consent to the required advances to the public servants on mission abroad.
§ 6. To the extraordinary accountant of the Mass of Customs and Excise Personnel, authorization is given to pay all the expenses of the Mass of Peace, regardless of the amounts.
§ 7. To the special accountant of the Social Service, authorization is given to pay relief and social allowances, regardless of the amounts.
§ 8. The Regular Accountant of the Accounting and Budget Branch of the Management Budget and Control Service, responsible for the "miscellaneous revenue" account, is authorized to make expenditures exclusively within and within the financial limits of the programmes pre-financed on this account by the European Union or other international organizations.
Prior to payment, invoices and claims relating to these programs must be subject to the visa of the delegated coordinator of the Budget and Management Supervisory Service.
§ 9. By derogation from Article 25 and by application of Article 25bis and Article 229 of the Royal Decree of 10 December 1868 concerning General Regulation on State Accounting, the ordinary accountants of the restaurants of the Social Service are allowed to hold a cash of up to 400 euros for each restaurant or cafeteria for which they are accountants.
Art. 2.18.2
The Minister of Finance may provide loans and assistance to Department Agents in active service, former agents, pensioned or non-resident, persons entitled to finance agents and their family members. It can grant grants to Department Agent Associations and existing meeting centres and to create FPS Finance staff.
Art. 2.18.3
§ 1er. By derogation from section 1-01-3 § 2 of this Act, the basic allowance for remuneration and allowances generally "80.61.11.09 - Personnel of the Customs Administration and accises made available to other administrations of the SPF Finance and other SPFs and public services" may be redistributed to or from the basic allowance "80.61.11.03 - Statutory staff and public services".
§ 2. By derogation from Article 1-01-3, § 3 of this Act, the undivided credits from the basic allowances referred to in the above-mentioned paragraph concerning the operating expenses and the disconnected credits from the basic allowances 40.02.12.08 - Operating costs under Coperfin and 40.02.74.08 - Investment expenditures under Coperfin can be redistributed within the program 40/0 - Management bodies, section 18 - SPF Finance.
§ 3. By derogation from section 1-01-03, § 3 of this Act, the basic allowances referred to in the above-mentioned paragraph concerning operating expenses may also be redistributed to the basic allowance 34.41- Losses resulting from deficits of State accountants as well as extraordinary events within programs 70/0 and 80/0 of section 18 - SPF Finance.
Art. 2.18.4
The Minister of Finance may make advances for urgent payments arising out of Belgium's obligations as part of its participation in international financial institutions and which are addressed to the Treasury Office responsible for international relations.
Art. 2.18.5
Within the limits of the relevant basic allowance, the following contribution may be granted:
PROGRAMME 61/1 INTERNATIONAL FINANCIAL RELATIONS
Financing Belgium's participation in the Chernobyl Shelter Implementation Plan (SIP).
Art. 2.18.6
The following five-year limitation applies to the payment documents. They will again be payable and payable in the year following the date of the coming into force of this Act.
These prescribed payment securities cannot be the subject of a late interest claim unless their payment has taken place after the sixtieth day after their new introduction. The payment period of sixty days shall be counted as soon as possible from the effective date of this Act.
The expenses caused by these prescribed payment securities are attributable to the budgetary means of the basic allowance 18.61.06.16.01 of the current year.

Art. 2.18.7
By derogation from Article 45 of the Acts on State Accounting, coordinated on 17 July 1991, the Organic Fund "Funds for Payment of Advances in Maintenance Claims" is authorized to present a debiting position, which cannot exceed the amount of EUR 10.000.000 in commitment and order.
Art. 2.18.8
By derogation from Articles 3 and 28 of the State Accounting Laws, coordinated on 17 July 1991, the Minister of Finance is authorized to use revenues from the tax arrears securitization operation, up to 1.5 per cent of the objective, in order to cover the expenses resulting from the execution of this transaction.
Section 19. - Regulation of buildings
Art. 2.19.1
The Buildings Board budget for 2006, annexed to this Act, is approved.
This budget is for revenues of 816.270.649 euros and for expenditures of 828.906.107 euros, of which 12.635.458 euros to defer previous budgetary years. It includes, in expenditure, commitment credits for an amount of 352,366,704 euros.
Revenues and expenses for order are estimated at 6,130,000 euros.
Art. 2.19.2
The Minister who has the Régie des buildings in his responsibilities is authorized to contract, apart from the amount of the commitment credits of the investment programs, set out in sections 533.01, 533.03, 533.10, 533.11, 533.12, 533.13, 533.14, 536.02 and 536.11 of the budget of the Régie des buildings jointed to this Act, obligations of investment-vent
The accounting commitment of these transactions is limited in 2006 to Euro135.868.057, as follows:

Art. 2.19.3
The Minister who has the Régie des buildings in his powers is authorized to increase the amount of the financing of the new Ghent courthouse from 115.000.000 euros to 128.500.000 euros.
Art. 2.19.4
The Minister who has the Régie des buildings in his office is authorized to incur and order, in charge of the budget of the Régie des buildings, the expenses arising from the consumption of water, electricity and heating of the royal palaces of Brussels and Laeken.
Art. 2.19.5
The Buildings Authority is authorized to make expenditures for first-time work in buildings leased by it for the use of services to which it must provide housing under the Act of 1er April 1971, establishing a Buildings Board.
If it is installation work that can be considered as standard completions or equipment, these costs are borne by the Régie des buildings budget.
If, on the other hand, it is installation work that comes from the needs of the current or future occupant and cannot be considered as standard completions or equipment, the costs are borne by the occupant. In this case, the Buildings Regime receives, prior to the payment of expenses, advances from the occupying services. It will not be possible for the Buildings Board to make any pre-financing of these expenses.
Art. 2.19.6
The Régie des buildings is authorized to carry out expenses, regardless of the nature, necessary for the operation of certain buildings where several occupants are housed but considered to be entities for their effective management (e.g., some administrative centres of the State and the palaces of the " Fifty-year" in Brussels, some large leased complexes).
The Buildings Authority is authorized to charge the amount of these expenses to the occupants of the buildings in question, either by recovering the payments made, or by using an order account. In these two cases, the Régie receives pre-payment of the expenses of these occupants.
Art. 2.19.7
The Buildings Authority is authorized to cover certain expenses relating to fixed rental costs of personal secretariats and strategic bodies of ministers and state secretaries housed in state buildings or in leased buildings that do not cohabit with their administration. The amount of these expenses is limited to 49,579 euros per minister and 24,789 euros per secretary of state for the buildings of the state and 99,157 euros per minister and 49,579 euros per secretary of state for the leased buildings. The guidelines for the distribution and use of this credit are set together by the Minister of Budget and the Minister who has the Buildings Board in his or her duties.
Must be considered to be rental charges, such as central heating and air conditioning maintenance costs, window washing fees, lawn maintenance fees and telephone exchanges, elevators and other lifting facilities, electrical and safety facilities, expenses related to common areas, maintenance fees for parks, parks and gardens, management fees, and management fees
Art. 2.19.8
The Régie des buildings is authorized to use actual revenues, the proceeds of the sale of real estate and other real estate transactions. The proceeds of these transactions will be paid to the Fund established under section 335 of the Program Act of 22 December 1989.
The availability of the Unused Fund at the end of a fiscal year is deferred to the following fiscal year in which they are confused with its own revenues.
By derogation from paragraph 1, the Buildings Regulations are authorized to pay to the Treasury the proceeds of the sale of buildings, up to an amount to be decided by the Council of Ministers.
Art. 2.19.9
By derogation from section 2 of the law of 1er April 1971, establishing a Buildings Board, the Buildings Board is authorized to make a financial contribution to the renovation (including studies) of the "ACADEMIA BELGICA" building in Rome.
Art. 2.19.10
By derogation from articles 19 and 20 of the law of 1er April 1971, establishing a Buildings Board, the Buildings Board is authorized to make expenditures for the execution of ordinary and extraordinary maintenance work, studies and other miscellaneous work in certain well-defined buildings that are not owned by the State, when these expenses are explicitly borne by the Buildings Board by contracts, conventions or other agreements.
Art. 2.19.11
The Régie des buildings is authorized to make expenditures for the security of the royal estates of Laeken, Belvédère, Stuyvenberg and Châteauneuf.
Art. 2.19.12
By derogation from section 2 of the law of 1er April 1971, establishing a Buildings Board, the Buildings Board is authorized to support the housing costs of the Federal Agency for Food Chain Safety.
Art. 2.19.13
By derogation from section 2 of the law of 1er April 1971, establishing a Buildings Board, the Buildings Board is authorized to contribute to the implementation of a technical review and to the development of an annual report on the general state and compliance with the legislation and regulations (French) in force, of the renovated building "Belgian and Luxembourg Student House" in Paris (Biermans-Laposto Foundation). The costs associated with these activities will be borne by the federal public programming service Scientific Policy.
Art. 2.19.14
The Régie des buildings is authorized to pre-finance the transformation work of Block A of the "Residence Palace" complex in Brussels for the needs of the Council of the European Union, either via a loan from the European Investment Bank or via a line of credit from the Treasury, provided that the Council of the European Union takes over the entire costs associated with it.
Section 21. - Pensions
Art. 2.21.1
Expenditures on prior year receivables may be charged on the current year's credits or, where applicable, on the credits of the organic funds in the following cases:
(1) Civil, ecclesiastical and military pensions:
- Pensions, advances on these pensions and other benefits:
. to the staff of the State, the Regions, the Communities, La Poste, Belgacom, the Régie des transports maritimes et de l'enseignement de l'État et des Communautés, des magistrats et avoués;
to ministers of worship;
. military and ex-gendarmerie personnel;
to former career staff members in Africa;
. to provincial, communal and free subsidized education staff.
- Survival pensions and pensions, advances on these pensions and benefits to beneficiaries of former career staff in Africa.
- Transfers of contributions to be made by the State pursuant to the Act of 5 August 1968 establishing certain relations between public-private pension plans; repayments of unduly perceived transfers.
- Transfers to the European Community of pension amounts pursuant to the Act of 21 May 1991 establishing certain relations between Belgian pension plans and institutions of public international law.
- Relief taking place of pension.
- Family allowances to former career staff in Africa.
- Amounts to be made available to the National Office of Family Allowances for Employees in order to enable it to provide for the State, pursuant to Article 101, 2° to 4°, the texts of the Act of 4 August 1930 on Family Allowances for Employees, the payment of the allowances for the current year and the previous years, as well as the coverage of the administrative costs associated with this payment, including
(2) Pensions and war rents
- Pensions of disabled soldiers of the peacetime and their rightful persons. Go back to national orders.
- Rents for physical damage suffered by civilian and military personnel of Technical Cooperation during disturbances and riots or civil war.
- Reparation pensions to disabled soldiers of the peacetime and assimilated as well as their rightful persons.
- Pensions, allowances and annuities for military victims of war 1914-1918 and their beneficiaries.
- Pensions, allowances and annuities attributed to military victims of war 1940-1945 or assimilated as well as to those entitled to them.
- Get into the German army.
- Rents, allowances, advances on annuities and allowances as well as late interest to victims of a work accident, an accident on the way to work or a professional illness in the public sector and their beneficiaries.
- Family allowances to large disabled persons and widows of peacetime soldiers.
- Family allowances to large disabled persons and widows of war 1940-1945.
- Amounts to be made available to the National War Pension Fund for the payment of pensions, rents, allowances and allowances for civil victims of war 1914-1918 and their beneficiaries.
- Amounts to be made available to the National War Pension Fund to ensure payment of pensions, rents, allowances and allowances for civil victims of war 1940-1945 and their beneficiaries.
- Amounts to be made available to the National War Pension Fund in order to ensure the enforcement of the Act of 6 July 1964 extending the application of the laws relating to compensation pensions for the civilian victims of the War 1940-1945 and their beneficiaries entitled to the consequences of certain events in the territory of the Congo (Kinshasa), Rwanda and Burundi.
- In favour of marine fishermen for wartime services.
- Implementation of the belgo-German agreement of 21 September 1962 on compensation for war victims.
(3) Social pensions:
- Provision to the National Pension Board for the financing of expenditures under the Act of 1er April 1969 establishing a guaranteed income for older persons and the Act of 22 March 2001 establishing income guarantee for older persons.
Art. 2.21.2
The following expenses may be paid out of advances of funds, the maximum amount of which may not exceed one-third of the credit allocated on basic allowance 51.10.11.37 "Provisional pensions and miscellaneous rents to pensioners of all FPS".
These are expenses related to:
- Provisional military pensions, rents and subsidies;
- Relief provided for in the absence of a pension to former magistrates, civil servants, employees, agents without appointment or employees of temporary and final executives, as well as to former auxiliary personnel, their widows or their family members who are in an unhappy situation and whose support they were, whether there is a maintenance obligation or not;
- Relief provided, in exceptional circumstances, to those of those persons who have only a pension or a minimum benefit treatment, taking place of pension, by application of article 29 of the royal decree of 30 March 1939 relating to the laying-off of the agents of the State (including possibly granting to persons entitled to a compensatory allowance equal to the difference between the cumulative amount of the pension

Relief provided as a supplement to a pension or a minimum availability treatment will be paid by monthly payments. Only the liquidation of the first term will be carried out on a prior visa from the Court of Accounts, in the light of the Royal Decree or the Ministerial Allocation Order.
Art. 2.21.3
Pursuant to section 61 of the Act of May 15, 1984 on measures of harmonization in pension plans, the excess of the proceeds of the personal contribution to the financing of the registered survival pensions in the Survival Pension Fund (Organization Fund of Division 51) is earmarked for the financing of the retirement pension expenses of State, army, ex-gendarmerie and education staff.
This surplus is estimated at 287.000.000 euros for the fiscal year 2006.
Art. 2.21.4
The Treasury is authorized to make advances when the current accounts of the operations of Treasure 80.07.02.00.B (work accident compensation for the staff of certain bodies of public interest), 82.01.02.60.B (the costs of the municipal staff - Common system), 82.01.03.61.B (the costs of the municipal staff - the regime of the new affiliates), 86.08.12.30 (the expenses of the public institutions which have

By derogation from Article 45 of the laws on State accounting, coordinated on 17 July 1991, the organic fund "Pool des parastataux" is authorized to present during the fiscal year a debiting position, which cannot exceed in commitment and order the amount of 50 million euros.
Art. 2.21.6
The liquidation of the dependant funeral allowances of the basic allowance 12.34.25 of Division 51, granted under Article 6 of the Act of 30 April 1958 to the pensioners of the State, shall be held on advances of funds in accordance with Article 15 of the Act of 29 October 1846 relating to the organization of the Court of Accounts. By derogation from the law of 29 October 1846 mentioned above, the amount of each of these advances can reach a maximum of 991.600 euros.
Art. 2.21.7
The Minister of Finance may make advances on the compensation provided for in section 6 of the Act of 30 April 1958 establishing a funeral allowance in favour of state pensioners.
Art. 2.21.8
The treasury account on which the expenses of new integrated police pension and survival are charged from 1er April 2001, may present a debtor balance up to 130,000 euros.
Art. 2.21.9
By derogation from Article 45 of the State Accounting Laws, coordinated on 17 July 1991, the "Sustainment Pension Fund" organic fund is authorized to present in the fiscal year a debiting position, which cannot exceed in commitment and order the amount of 200 million euros.
Art. 2.21.10
The proceeds of the deductions referred to in section 68 of the Act of 30 March 1994 relating to social provisions, which pursuant to section 68ter, § 5 of the Act are paid to the Equilibre of Pension Plans Fund, is used for the payment of retirement pensions and benefits:
- State and community teaching staff;
- staff of autonomous public institutions;
- the former Maritime Transport Authority;
- POSTE;
- ministers of worship;
- Army;
- former executives of Africa;
- subsidized official education;
- subsidized free education;
- Belgacom;
and also survivors' pensions from former African executives.
Art. 2.21.11
In accordance with section 14 of the Public Sector Pensions Service Act, "Organizational Division 55 - Public Sector Pension Service" is open, a program 21.55.1 entitled "Fire to Public Sector Pensions Service", which includes the following basic allocations and undivided credits:
- A.B. 55.11.41.01 - Provision for the exercise of statutory public sector pension missions: 5.702.392.000 euros;
- A.B. 55.11.41.02 - Provision for the exercise of legal missions in respect of compensation pensions and war rents: 186.063.000 euros;
- A.B. 55.11.41.03 - Provision for the exercise of legal duties in relation to work accident rents: 28.420,000 euros;
- A.B. 55.12.41.04 - Service management fee: Euro277,000.
Art. 2.21.12
The Public Sector Pension Service (PSSP) budget for 2006, annexed to this Act, is approved.
This budget amounts to 8.826.157.000 euros for revenues, of which 8.798.184.000 euros for revenues relating to legal missions and 27.973.000 euros for the management revenues of the Service. It also amounts to 8.826.157.000 euros for expenses, including 8.798.184.000 euros for expenses relating to legal missions and 27.973.000 euros for the management expenses of the Service.
Section 23. - SPF Employment, Labour and Social Concertation
Art. 2.23.1
By derogation from section 15 of the Act of 29 October 1846 on the organization of the Court of Accounts, funds may be made available:
(1) a maximum amount of Euro18,600 to the Departmental Accountants, other than those referred to in 2,3, 4, 5, 6 and 7 below, who are authorized to pay, by means of these advances, expenses not exceeding Euro2,500;
(2) a maximum of 12,400 euros, to the Social Service Accountant who is authorized to liquidate, by means of these advances, the expenses, regardless of the amount, for social actions in programme 40/0 - "President's services - subsistence";
3) in a maximum amount of 372,000 euros, to the accountant of the Department - Management bodies, to the effect of paying - possibly through advances - the receivables not exceeding 5,500 euros, excluding VAT, as well as, regardless of the amounts, the consumption of water, gas and electricity and telephone charges;
4) in a maximum amount of 310,000 euros, to the accountant responsible for financing the missions, which is authorized to make the necessary advances available to persons charged with a mission abroad; these advances will be used, among other things, to pay a lump sum of expenses;
(5) a maximum of Euro99,200 to the accountant of the Bilateral Social Collaborative Service who is authorized to pay claims of receivables relating to delegations staying in Belgium in the context of bilateral social collaboration, as well as the lump-sum allowances granted to delegations and staff of the department and public bodies subject to their guardianship;
6) of a maximum amount of 120,000 euros to the accountant of the General Directorate Control of social laws that are authorized to pay, through these advances, the amounts necessary for the internal consolidation of the consignments of the Central Administration and the external services;
7) in a maximum amount of 74,400 euros to accountants responsible for spending under the programme of activities 40/6 - Belgian public federal contribution to the European Social Fund - that is the amount of these expenses.
Art. 2.23.2
Fund advances such as referred to in Article 15, 2° of the Law of 29 October 1846 on the organization of the Court of Accounts, may be made to the competent accountant for the expenses of the organic fund "Belgian European Social Fund" (programme 56/9). None of these advances are subject to a maximum amount, except for programming 1994-1999, for which they cannot exceed the available variable credits
Art. 2.23.3
Within the relevant basic allowances, the following subsidies may be granted:

PROGRAMME 56/3 - PREPENSIONS
(1) Subsidies to the Workers Allowance Fund terminated in the event of business closures to cover the expenses of a supplementary allowance to workers prepensioned in 1993 from customs agencies and shipping offices.
(2) Subsidizes the Merchant Marine Life Security Fund to pay the additional allowances of the sector's prepensions.
Art. 2.23.4
Formal allowances may be granted to members of delegations staying in Belgium as part of bilateral social collaboration, as well as to staff of the Department and public bodies subject to its accompanying guardianship, to cover their small expenses.
In addition to an amount set by the Minister of Employment, the social partners designated by the Minister may obtain reimbursement for the theoretical and practical training they organize in the context of bilateral social collaboration.
Art. 2.23.5
By derogation from Article 45 of the laws on State accounting, coordinated on 17 July 1991, the Organic Fund "Belgian European Social Fund" is authorized to present in order a debiting position, which cannot exceed the amount of 6.440,000 euros.
Art. 2.23.6
The organic budget fund "European Social Fund" has a commitment authorization of 9.624.000 euros.
Any undertaking under this Article shall be subject to the visa of the Registrar of Commitments and the Court of Accounts.
Prior to the 10th of each month, the Comptroller of Commitments shall forward to the Court of Accounts, together with supporting documents, a statement in three copies and mentioning, on the one hand, the amount of the commitments covered in the past month and, on the other hand, the amount of the commitments covered since the beginning of the year.
Art. 2.23.7
The Minister of Employment, after agreement with the Minister of Budget, is authorized to transfer, on the basis of a reasoned opinion from his department, within the framework of the debts of the promoters of projects prior to 1990 relating to the expenses of the past arising from the management of the European Structural Funds and in particular the European Social Fund for which the European Commission has operated under the Regulation (EC,Euratom) Council No. 1605/2002 of 25 June 2002 regulating the general budget of the European Communities and Regulation (EC,Eurotom) Commission No. 2342/2002 of 23 December 2002 establishing the terms and conditions for the execution of the above-named regulation, ex officio compensation.
Section 24. - SPF Social security
Art. 2.24.1
By derogation from section 15 of the law of 29 October 1846 relating to the organization of the Court of Accounts, advances of funds of up to 250,000 euros can be made to the extraordinary accountants of the department, to the effect of paying claims for all service costs, allowances and allowances of any kind not exceeding 7,000 euros, as well as, no matter how much
Authorization is given to these accountants to consent, to officials and experts on mission abroad, the necessary advances, even if these advances are greater than 3,000 euros.
Payment of expert fees from other countries and fees resulting from arrangements with foreign countries may also be made in advance of funds, regardless of the amount.
Art. 2.24.2
The Consolidated Revenue Fund is authorized to make advances where transactions relating to Account 87.02.05.14 B - Treasury Operations - Treasury Fund for the Financial Service of Pensions, Pensions or Allowances for the benefit of persons residing in Belgium and, in accordance with the international agreements reached, benefit granted by foreign social legislation - create a debiting position of the Account.
Art. 2.24.3
Credits for various expenses of the social service and credits for the supplement pensions can be used as a subsidy to the A.S.B.L. "Social Service of the SPF Social Security and the SPF Public Health, Food Chain and Environment".
Art. 2.24.4
Expenditures related to prior-year claims in the course of procedural compensation and medical expertise related to allowances to persons with disabilities may be charged against these credits of the current year.
Art. 2.24.5
Within the limits of the basic allowances concerned, the following subsidies may be awarded:

Art. 2.24.6
The Treasury is authorized to make advances where basic allowance transactions 55.22.3406 - payment of allowances to persons with disabilities under the Act of February 27, 1987 - create a debiting position of that account.
Art. 2.24.7
The available balance of previous years under the Act of 27 February 1987 on Disability Allowances may be used to cover the expenses inherent in the current fiscal year.
Art. 2.24.8
Expenditures on prior year receivables may be charged on the current year's credits or, where applicable, on the credits of the organic funds in the following cases:
(1) War pensions and pensions
- Pensions of disabled soldiers of the peacetime and their rightful persons. Go back to national orders.
- Rents for physical damage suffered by civilian and military personnel of Technical Cooperation during disturbances and riots or civil war.
- Reparation pensions to disabled soldiers of the peacetime and assimilated as well as their rightful persons.
- Pensions, allowances and annuities for military victims of war 1914-1918 and their beneficiaries.

- Family allowances to large disabled persons and widows of peacetime soldiers.
- Family allowances to large disabled persons and widows of war 1940-1945.
- Amounts to be made available to the National War Pension Fund for the payment of pensions, rents, allowances and allowances for civil victims of war 1914-1918 and their beneficiaries.
- Amounts to be made available to the National War Pension Fund to ensure payment of pensions, rents, allowances and allowances for civil victims of war 1940-1945 and their beneficiaries.

Expenditures of any kind on the occasion of care to be given to the beneficiaries of the Act of July 3, 1967 on the distribution of damages resulting from industrial accidents, occupational accidents and occupational diseases in the public sector, may be made in advance of any amount, within the limits of the tariff referred to in section 4 of the Royal Decree of January 24, 1969.

Credits for various expenses of the social service may be used as a subsidy to the A.S.B.L. "Social Service of the SPF Public Health, Safety of the Food and Environment Chain and SPF Social Security".

Art. 2.25.5
Payments to the variable credits of program 53/1 for the application of the Medicines Act (Act of January 5, 1976, art. 152), may be made in advance of funds.
To this end, and by derogation from section 15 of the Act of 29 October 1846, relating to the organization of the Court of Accounts, advances of funds of up to 248.000 euros may be made to the extraordinary accountants of the Department designates to this effect in order to pay claims not exceeding 3,000 euros.
Art. 2.25.6
The budget of the Federal Agency for the Safety of the Food Chain for 2006 is approved, annexed to this Act.
This budget is for revenues of 176,729,829 euros and for expenditures of 178,370,829 euros.
Art. 2.25.7
The credits for the marine environment and registered with the Science Policy PPS, may be transferred to section 25 at the same pace of the transfer of skills throughout the year.
Art. 2.25.8
Expenditures relating to prior budgetary years may be charged against current year appropriations in the following cases:
- Miscellaneous costs (rental charges, personnel, consumption expenses, ) related to the operation of the administration and strategic organs of the Minister.
- Expenditures on attendance tokens and travel and residence allowances awarded to the chairs and members of the boards and boards installed in the department.
Art. 2.25.9
The provision in program 58/0 (A.B. 58.02.01.01 - Interdepartmental provision for expenses of any kind related to environmental management in federal institutions) may be apportioned, as appropriate, between the appropriate programs of the budgets of the various federal institutions, by Royal Decree and with the Minister of Budget's agreement.
Section 32. - SPF Economy, P.M.E., Average Classes and Energy
Art. 2.32.1
§ 1er. By derogation from section 15 of the Act of 29 October 1846 on the organization of the Court of Accounts, advances of funds may be made:
- for a maximum of 2,000,000 euros to the Department's extraordinary accountants;
- for a maximum of 1,000,000 euros to the extraordinary accountant of the National Botanical Garden of Belgium.
The extraordinary accountant of the Department responsible for payment of advances on foreign mission charges is authorized to make the necessary advances to officials sent on mission abroad, even if these advances are greater than 5,500 euros.
Advances of funds may be made to the relevant extraordinary accountants, designated as part of Belgium's participation in international exhibitions, up to the level of the budgetary allocations provided for this purpose and up to the level of the variable credits available for this purpose on the Fund for the Organization of International Exhibitions.
§ 2. Under the control of the Minister or his representative, subject to further justification by the Department and within the limits of budgetary appropriations, advances may be made available to the Treasures, designated by the Minister, to the International Exhibitions for the execution of expenditures.
Dependant payments of funds available on the variable credits of program 43/4 (International Exhibition Organization Fund) may be made, regardless of the amount, in advance of funds.
The potential balance of these advances as at December 31, 2005 may be used for 2006 expenditures.
Art. 2.32.2
Expenditures on prior year receivables may be charged against current year credits with respect to subsidies to coal-fired personnel affected by closure measures.
Art. 2.32.3
The budget of the Federal Office of the Plan for 2006 annexed to this Act is approved.
This budget is for revenues at 8.886.870 euros and for expenditures at 8.886.870 euros.

Art. 2.32.5
By derogation from Article 15 of the Organic Law of the Court of Accounts of 29 October 1846, the accountant responsible for the liquidation of relief and social allowances may receive successive advances in an amount not exceeding 12,500 euros, which will be justified at a later date.
Art. 2.32.6
By derogation from section 14 of the Organic Law of the Court of Accounts of 29 October 1846, it may be directly disposed of to have it from the organic fund "Agricultural Fund" (Program 44/2) through the intervention of the Minister of Finance.
Art. 2.32.7
It is planned for program 44/0 of the permanent advances for the payment of expenses to the state sold to the intervention of agents of the services abroad.
These permanent advances are intended to ensure the payment of expenses that are subject to a post facto regulation, within existing budgetary allocations.
Section 33. - SPF Mobility and Transport
Art. 2.33.1
§ 1er. By derogation from Article 15 of the Organic Law of the Court of Accounts of 29 October 1846, advances of funds may be made to the extraordinary accountants of the services that are part of the SPF Mobility and Transport for a maximum amount of 175,000 euros to the effect of paying claims that do not exceed 2.500 euros concerning:
- the purchase of unsustainable goods and services;
- the purchase of heritage furniture;
- the fees of lawyers and doctors and the remuneration of foreign experts to the SPF and third-party benefits as well as the tokens of presence that are due to them, the costs of road and residence;
- expenditure on water, gas and electricity consumption, telephone costs and fuel consumption expenses for vehicles;
- compensation to third parties arising from State responsibility;
- the various allowances of State staff and Strategic Organs for real expenses and property damages as well as the transportation costs for the travel of service and insurance premiums of SPF delegates who travel abroad, including the intervention of the employer State in the price of the social subscription.
However, the accountants of the Budget and Management and Logistics Service Supervision Service will be able to have advances of funds in a maximum amount of 500,000 euros as a result of paying the above claims.
Accountants of the Management Budget and Control Service may also have advances of funds up to 75,000 euros for the payment of receivables not exceeding 2.500 euros and which relate to:
- various social relief and allowances for pensioned personnel, former agents and law holders for the entire SPF;
- special relief to certain categories of victims of occupational accidents.
With advances in funds, these extraordinary accountants are allowed to pay expenses not exceeding 2,500 euros; accountants are nevertheless allowed to pay phone and postage expenses up to 5,000 euros.
§ 2. Authorization is given to the Accountants of the Management Budget and Control Service to make necessary advances to officials and experts on mission abroad, even if these advances are greater than 2.500 euros.
Art. 2.33.2
By derogation from the provisions of Articles 5 and 34 of the coordinated laws on State accounting, may be used for the payment of expenses created in previous fiscal years, the following undivided credits relating to:
1) the remuneration of Cabinet members and especially the reimbursement of salaries to government and institutions of origin;
(2) the staff costs of the SNCB under the authority of the General Directorate of Land Transport;
(3) at the operational costs of the Department General Road Mobility and Safety Service responsible for the application of the regulations on the driver's licence and the reimbursement to municipalities of costs related to the issuance of permits;
4) the participation of Belgium in the operating costs of the International Civil Aviation Organization and the European Civil Aviation Commission;
(5) to Belgium's contribution to the Intergovernmental Maritime Organization;
6) the participation of Belgium resulting from the organization of a patrol service for the observation of icebergs in the North Atlantic Ocean;
7) the contribution of Belgium in the expenses of the Central Office of International Rail Transport in Bern;
(8) Reimbursement of the treatment of former gtr personnel delivered to work.
Art. 2.33.3
The Minister of Mobility is authorized to grant compensation or relief under the conditions that he or she will determine, to former pensioners or not as a result of accidents in service or occupational accidents or for health reasons, as a result of not treating them less favourably than workers in similar conditions, and notwithstanding the provisions of the Civil Pension Act of 21 July 1844.

The portion of the revenues received by the Directorate General Air Transport exceeding the amount of 1.850,000 euros is allocated to the Fund for the Financing and Improvement of the Control, Inspection and Investigation Means and the Aeronautics Prevention Programs, which is resumed in program 33.52.5.
Art. 2.33.6
§ 1er. The amount of 100.000.000 euros taken from the proceeds of the tax of the natural persons to be allocated to the Fund of Financing of the International Role and the Brussels Capital Function pursuant to Article 481 of the law programme of 22 December 2003, is increased by 1.190.000 euros (programme 33.56. 22).
Art. 2.33.7
Fund advances such as referred to in Article 15 of the Organic Law of the Court of Accounts of 29 October 1846 of a maximum amount of 75,000 euros, may be granted to the extraordinary accountants of the SPF designated to pay the receivables not exceeding 2.500 euros in charge of the variable credits of personnel and operations listed in Program 33.52.5 - "Funds for the Financing and the Improvement of Control Means,
The claims concerned relate to:
- the purchase of unsustainable goods and services,
- the purchase of household property,
- the fees of lawyers and doctors, the remuneration of foreign experts to the SPF, the benefits of third parties as well as the tokens of presence due to them, the costs of road and residence,
- expenditure on water, gas and electricity consumption, telephone costs, fuel consumption expenses for vehicles,
- the various allowances to State staff and Strategic Organs for real expenses and property damages, the transportation costs for service trips, the insurance premiums of SPF delegates who travel abroad, the intervention of the State - employer in the price of the social subscription.
Similarly, such advances of funds of up to 75,000 euros can be made to the extraordinary accountants of the Management Budget and Control Service in order to be able to grant the necessary advances, even more than 2,500 euros, to officials and experts sent on mission abroad.
Art. 2.33.8
The land remediation costs of the airport land will be offset by revenues from the proceeds of the sale of the said land.
Art. 2.33.9
After the restructuring of the SNCB, the credits listed in programme 51.1 "Rail transport" for the benefit of the railway sector are paid to the anonymous public law companies resulting from the restructuring of the former SNCB, according to the provisions of the management contracts between the State and each of these companies
Section 44. - SPP Social integration, poverty reduction and social economy
Art. 2.44.1
By derogation from section 15 of the law of 29 October 1846 relating to the organization of the Court of Accounts, advances of funds of up to 100,000 euros can be made to the extraordinary accountants of the department, to the effect of paying claims for all operating expenses, allowances and allowances of any kind not exceeding 5,500 euros, as well as, no matter how much
Authorization is given to these accountants to consent, to officials and experts on mission abroad, the necessary advances, even if these advances are greater than 3,000 euros.
Payment of expert fees from other countries and fees resulting from arrangements with third countries may also be made in advance of funds, regardless of the amount.
Art. 2.44.2
Expenditures relating to prior budgetary years may be charged against current year appropriations in the following cases:
PROGRAMME 55/1 - EXISTENCE SECURITY
Subsidies to CPAS on the right to social integration/ subsistence minimum.
Payment of medical care given in Belgium to the victims of the Heysel incidents that took place on 29 May 1985 in execution of the royal decree of 30.08.1985 regulating the procedure of State intervention, as a solidarity for the victims of the Heysel events.
Grants to CPAS on child support.
Payment of relief expenses granted by CPAS to indigent persons, including refugee candidates and recognized refugees.
PROGRAMME 55/3 - ACCUEIL REFUGIES
Miscellaneous fees (lease charges, personnel, consumer expenses, medical expenses, etc.) related to the operation of the reception of asylum seekers organized by the Agency.
Art. 2.44.3
Credits for various expenses of the social service can be used as a subsidy to the A.S.B.L. "Social Service of the SPF Social Security and the SPF Public Health, Food Chain and Environment Security".

Subsidies to organizations promoting the reintegration of former drug addicts.
Subsidies to private organizations for the relief they provide to special target groups, such as victims of human trafficking and repatriated Belgians.
PROGRAMME 55/3 - REFUGIES
Subsidies to organizations and communes that support the first reception and distribution of refugees.
Subsidies to organizations for the individual assessment of the specific needs of vulnerable people and adaptation of their accommodation.
Subsidies to organizations supporting psychological assistance initiatives (individual care, prevention tools, information and training).
Subsidies to organizations to make the stay in reception structures more useful to everyone by acquiring a transposable know-how (e.g., basic learning, literacy, national language learning, qualifying training, etc.), regardless of the outcome of the asylum procedure.
Subsidies to organizations for individualized information on the rights and obligations of asylum seekers, in particular with regard to the right to social assistance and conditions of reception, procedure and legal assistance, institutional landscape, living conditions in Belgium and assistance in return.
Subsidies to organizations carrying out social Interpretation missions.
Subsidies to organizations for the development of local communication policies and strengthening general means of communication on the reception of asylum seekers.

Subsidies for support of innovative initiatives in the social economy.

Subsidies to municipalities to enable the training, supervision and employment of staff members, assigned to revitalization programmes for neighbourhoods in crisis.
Subsidies to local authorities to encourage investments that meet specific priorities for revitalization of neighbourhoods in crisis.
Subsidies to local authorities for the execution of pilot experiments within the framework of rental joint commissions.
Subsidies to non-profit associations or institutions to support the organization by these associations or conference institutions, seminars or other events dealing with the policy of major cities.
Subsidies to CPAS for the additional workload resulting from regularized support.

Art. 2.44.5
The amounts paid to the C.P.A.S. in previous years under the Act of 2 April 1965 on the Care of Relief granted by the Public Social Assistance Centres, the Act of 7 August 1974 establishing the right to a minimum of means of existence and the law of 26 May 2002 on the right to social integration may be considered for the 2006 fiscal year as advances for the 2006 fiscal year.
Art. 2.44.6
Expenses relating to claims of prior years under the Royal Decree of 22 August 1989 regulating the State's intervention in respect of advances on maintenance and recovery of such pensions may be charged against the credits of the current year.
Art. 2.44.7
The budget of the Federal Agency for the reception of asylum seekers for 2006 is approved, annexed to this Act.
This budget amounts to 243.478.030 euros and for expenditures to 243.478.030 euros.
Art. 2.44.8
The available balance of previous years under the law of 7 August 1974 establishing the right to a minimum of means of existence, and the law of 26 May 2002 concerning the right to social integration, may be used to cover the expenses inherent in the current fiscal year.
The available balance of previous years under the Act of 2 April 1965 on the care of relief provided by public welfare centres can be used to cover the expenses inherent in the current fiscal year.
Art. 2.44.9
The maximum amount of commitment authority for the year 2006 available to the "Social Economy Fund" organic fund under social programming 2000-2006 is set at €658,000.
Any undertaking under this Article shall be subject to the visa of the Registrar of Commitments and the Court of Accounts.
Prior to the 10th of each month, the Comptroller of Commitments shall forward to the Court of Accounts, together with supporting documents, a statement in three copies and mentioning on the one hand the amount of the commitments covered in the past month and, on the other hand, the amount of the commitments covered since the beginning of the year.
The organic fund "Social Economy Fund" is allowed to present a debiting position that cannot exceed in order the amount of 8.000.000 euros.
Art. 2.44.10
By derogation from Article 15 of the State Accounting Laws, coordinated on July 17, 1991, the basic allowances "55.11.4316 - Subside CPAS Right to social integration" and "55.42.4303 - Subside to public services under the ES Spring Programma" can be redistributed only between them.
Section 46. - SPP Scientific policy
Art. 2.46.1
By derogation from Article 15 of the Organic Law of the Court of Accounts of 29 October 1846, advances of funds may be made up for a maximum of 37,000 euros, to the extraordinary accountant of the SPP Scientific Policy and to the extraordinary accountants of the institutions that fall under it.
By means of these advances, the extraordinary accountants of the PPS can make the payment of claims of any kind, including the purchase of heritage furniture, not exceeding 5,500 euros.
Art. 2.46.2
By derogation from Article 15 of the Organic Law of the Court of Accounts of 29 October 1846, advances of successive funds in an amount not exceeding 2,500 euros may be made to the accountant responsible for the liquidation of relief and social allowances.
Art. 2.46.3
Within the limits of the basic allowances concerned, the following subsidies may be granted:
PROGRAMME 21/0 - DIRECTION AND MANAGEMENT
Grant to the Social Service of the Science Policy PPS.
PROGRAMME 60/1 - RESEARCH AND DEVELOPMENT IN THE NATIONAL FRAMEWORK
1. Funding for R & D government impulse programs within the national framework.
2. Financing interuniversity attraction poles.
3. Financing of the technological attraction poles.
4. Financing studies, research and missions on behalf of third parties.
5. Grants to Academia Belgica in Rome and the Belgian Historical Institute in Rome.
6. Heritage Grant of the Academy of Sciences of Outre-Mer.
7. Grant to the National Commissions under the joint auspices of the Academy of Sciences, Letters and Fine Arts of Belgium and the Koninklijke Academie voor Wetenschappen, Letteren en Schone Kunsten van België.

9. Grant for the recruitment of additional researchers at federal universities and scientific institutions as part of the measures to support the research policy in the multi-year employment plan.
10. Coverage of R-D expenditures of Airbus aircraft.
11. Provision to the Scientific and Technical Information Service (S.I.S.T.).
12. The Belgian telematic network "Belnet".
13. Funding for scientific support to federal drug policy.
14. Financing of the programme for the return of Belgian scientific competence.
15. Grant to the A.S.B.L. "Prince Laurent Foundation".
PROGRAMME 60/2 - RESEARCH AND DEVELOPMENT IN INTERNATIONAL FRAMEWORK
1. Funding for R & D government impulse programs in the international framework.
2. Belgian participation in the activities of the European Space Agency.
3. Belgian participation in bilateral or multilateral space projects (excluding ASE).
4. Grants to intergovernmental scientific research and public service organizations.
5. Grants to international scientific research and public service organizations, groups and centres.

8. Grant to the von Karman Institute.

5. Purchases of publications and works of art for cultural promotion abroad.
PROGRAMME 61/4
FORMATION (excluding Scientific Policy) AND SCOLAN INVESTMENTS
Grant to the SHAPE International School.
Art. 2.46.4
The commitment credits for the following expenses are allocated by decision of the Council of Ministers:
- Government impulses of R & D within the national framework (programme 60/1);
Interuniversity amusement poles (Program 60/1);
- Technology attraction poles (Program 60/1);
- coverage of R & D expenditures of Airbus aircraft (programme 60/1);
- Belgian participation in non-ASE bilateral or multilateral space projects (programme 60/2).
Art. 2.46.5
In addition to the Belgian contribution to the budget of the EUREKA Secretariat "Technology", the Minister of Science Policy is authorized, in accordance with the commitments made by Belgium, to bear, at the expense of its budget, the costs of rent and the rental expenses (including the expenses of electricity and heating) of the EUREKA Secretariat "Technology" and half the costs of rent of the EUREKA Secretariat AUDIOVISUEL
Art. 2.46.6
The Minister of Science Policy is authorized to waive, in accordance with the unanimous commitments of the member countries of the European Space Agency, the recovery of national fees and taxes affecting the cost of the work and supplies carried out in Belgium for this organization and whose payment in national currency or euro has been advanced to the dependant of its budget, and to repay to this organization in addition to the Belgian contribution, the amount of any national fees and taxes paid in national currency or euro by the aforementioned Agency.
Art. 2.46.7
By derogation from Article 15 of the Acts on State Accounting, coordinated on 17 July 1991 and Article 1-01-3, § 2 of this Act, the credits of basic allowances 60.11.11.16, 60.21.11.18, 60.22.11.20 and 61.11.41.16 may be, by means of redistributions of basic allowances, transferred to the basic allowance 21.01.11.03, up to the amounts corresponding to the amounts
Art. 2.46.8
By derogation from Article 15 of the State Accounting Laws, coordinated on 17 July 1991, the credits of the basic allowances 60.11.11.11.16, 60.21.11.18 and 60.22.11.20 may be, by means of redistributions of basic allowances, transferred between them.
Art. 2.46.9
The credits of Program 5 of Division 61 (Education and Culture) can be used to pay the fees of lawyers representing the State in the disputes related to the "loads of the past" of the former Ministry of Education/Onderwijs.
Art. 2.46.10
By derogation from section 1-01-3, § 2 of this Act, the credits of the basic allowances 60.31.41.10, 60.31.41.11, 60.32.41.14, 60.32.41.15, 60.32.41.16, 60.33.41.17, 60.33.41.18, 60.34.41.19, 60.34.41.20 and 60.34.41.22 may
Section 51. - Public debt
Art. 2.51.1
By derogation from section 14 of the Organic Law of the Court of Accounts of 29 October 1846, it may be disposed directly by the Minister of Finance to have it from the budgetary fund "Preparations on proceeds of borrowings to cover:
1° expenses incurred in public debt management operations;
2° advance payments;
3° disbursements resulting from exchange rate fluctuations. »
Art. 2.51.2
The Minister of Finance is authorized to pay in advance, within the limits of the budgetary and subsequent regularization appropriations, all expenses in this section of the budget, with the exception of the following basic allocations:
- 45.40.11.10 "Salaries relating to the issue of borrowing";
45.40.12.21 "Non-financial costs related to the activity of the Public Debt Service";
- 45.40.12.04 "Different costs of computer function and function";
- 45.40.74.01 "Expense for the acquisition of durable furniture";
- 45.40.74.04 "Investment costs related to computing";
- 45.30.41.02 "Different costs arising from the creation and operation of the Aging Fund".
Art. 2.51.3
The treasury is authorized to make advances where, as a result of transactions on securities of the Belgian state referred to in article 107 of the royal decree of execution of the Code of Taxes on Income 1992, the restitution of the pre-payment of furniture, carried out anticipateably by the State for the benefit of non-resident savers, creates a debiting position of the account 84.01.02.78.B "Arrerages de Rentes" of the section
Art. 2.51.4
The Consolidated Revenue Fund is authorized to make advances where the transactions relating to Account 84.01.01.77.B "Fire to be made available to the Capital Fund" create a debiting position of the Account.
Art. 2.51.5
Emission premiums for linear obligations issued prior to December 31, 2001, recorded on the cash account 10.65.01.06 and split per fiscal year, prorata temporis based on the duration of the borrowings that generated them, are allocated to the budgetary expenditures of public interest or dependants of the budget, in addition to interest expenditures, as they constitute a gain or loss for the Consolidated Revenue Fund.
Art. 2.51.6
Expenditures on prior budgetary year receivables may be charged against the current year's credits in the case of credits for establishments in the customizable material sector that fall within the Brussels-Capital Region of the jurisdiction of the Federal Parliament and the Federal Government (Program 43/1)
Art. 2.51.7
As part of the participation of the Belgian State in a society whose main social purpose is the operation of an electronic system of trading securities of the debt of the Belgian State and their derivatives, the Minister of Finance is authorized to pay in advance, within the limits of the budgetary and the charge of subsequent regulation, the expenses relating to the taking of participation and the redemption or resale of the securities as well as the expenses relating to any costs related to them. The above-mentioned expenditures as well as any revenue related to the recovery of advances are recorded on a specific cash account. The amount of expenses, if any after deduction of the compensatory income related thereto, shall be borne on the basis of the basic allowance 45.40.81.11 or dependent on the basic allowance 45.10.12.06 of section 51 "Public debt" of this budget.
Art. 2.51.8
By derogation from Article 15 of the Acts on State Accounting, coordinated on 17 July 1991, all credits in the various programs of this section of the budget may, at the request of the Minister of Finance and with the agreement of the Minister of Budget, be transferred by way of redistributions of basic allowances to other programs in the same section of the budget.
Art. 2.51.9
§ 1. By derogation from amended section 15 of the Act of 29 October 1846 on the organization of the Court of Auditors, advances may be made to the extraordinary accountants
§ 2. To the extraordinary accountants of the Debt Service, authorization is given:
to provide, to officials and members of the Debt Agency in charge of missions in the context of public debt management, advances of funds required to carry out these missions;
(b) to pay by way of advances of funds expenses that require direct payment on site and that are mainly related to the printing activity of the Debt Service.
Section 52. - Financing of the European Union
Art. 2.52.1
The Minister of Finance may make advances for urgent payments resulting from Belgium's obligations at the European level and which are addressed to the Treasury Office responsible for European affairs.
CHAPTER 3. - Restitution and allocation funds
Art. 3-01-1
The transactions carried out on the restitution and allocation funds during the 2006 fiscal year are assessed in accordance with the table annexed to this Act.
Art. 3-01-2
The method of disposition of each of the funds mentioned in the tables annexed to this Act is set out next to the number of the article pertaining to each of them:
- the funds, which are subject to the prior visa of the Court of Accounts, are indicated in letter A;
- the funds and accounts, which are prepared by the Minister of Finance, are indicated in letter B;
- the funds and accounts, which are directly disposed of by the accountants who made the revenues, are indicated in letter C.
Art. 3-01-3
By derogation from Article 38 of the Acts on State Accounting, coordinated on 17 July 1991, an allocation fund is opened, which provides the means necessary to the rights holders covered by the law to grant an allocation for the acquisition of the heating gasoil of a private dwelling.
Art. 3-01-4
In accordance with Article 38 of the Acts on State Accounting, coordinated on 17 July 1991, an allocation fund is opened, which makes the necessary resources available to the Caisse nationale des Calamités.
This fund is powered by a portion of the tax on insurance contracts.
CHAPTER 4. - Separate Management State Services
Art. 4-01-1
The budgets of the Separate Management State Services for the 2006 fiscal year are approved in accordance with the tables annexed to this Act.
Art. 4-01-2
The method of payment of the expenses of each of the Separate Management Services, as set out in the tables annexed to this Act, is indicated next to the number of the article pertaining to each of them:
- services, whose expenses are subject to the prior visa of the Court of Accounts, are indicated by letter A;
- services, whose expenses are incurred by the Minister of Finance, are indicated in letter B;
- services, whose expenses are incurred directly by the accountants who made the revenues, are indicated in letter C.
Art. 4-01-3
By derogation from Article 16 of the Act of 28 June 1989 amending the Act of 28 June 1963 amending and supplementing the laws on State accounting, the provisions of Articles 1er and 5 of the Act are not applicable in the 2006 fiscal year in respect of the Separate Management State Services that have no legal basis and whose operations are estimated in the budgetary tables annexed to this Act.
CHAPTER 5. - State enterprises
Art. 5-01-1
The budget for the 2006 fiscal year of the state enterprise "The Royal Mint of Belgium", annexed to this Act, is approved.
Revenue is estimated at 23.105.203 euros and costs at 24.506.037 euros.
Order revenues are estimated at 6.033.529 euros and expenses for order to 6.033.529 euros.
Art. 5-01-2
By derogation from Article 112 of the Acts on State Accounting, coordinated on 17 July 1991, expenses resulting from the provision of goods or services are charged to the budget of the year in which the invoice is dated.
Art. 5-01-3
By derogation from Article 114 of the State Accounting Laws, coordinated on 17 July 1991, the capital transactions budget may include non-limitative credits. In this case, the wording mentions it. This option is limited to refunds and payments (articles 91.11 to 94.11 of the budget of the Royal Mint of Belgium).
Art. 5-01-4
The Royal Mint of Belgium is authorized in 2006 to offer coins or medals for a maximum amount of 14.873.61 euros.
