The Chambers adopted in We sanction the following:
CHAPTER I^er. - General provision
Article 1^er. This Act regulates a matter referred to in Article 78 of the Constitution.
CHAPTER II. - Amendment to the General Act of July 21, 1844 on Civil and Ecclesiastical Pensions
Art. 2. In section 8, § 2, 35°, of the General Act of July 21, 1844 on civil and ecclesiastical pensions, replaced by the law of April 11, 2005, the word "Council" is replaced by the word "Parliaments".
CHAPTER III. - Amendment of the Act of 4 March 1870 on the Time of Religions
Art. 3. In section 19ter of the Act of 4 March 1870 on the temporality of worship, inserted by the Act of 10 March 1999, the word "Council" was replaced by the word "Parliament".
CHAPTER IV. - Amendment of the Act of 2 April 1962 on the Federal Investment Corporation and Regional Investment Corporations
Art. 4. In article 3ter of the Act of 2 April 1962 on the Federal Investment Corporation and regional investment companies, inserted by the Royal Decree of 20 July 1994, the words "Council of Communities and Regions" are replaced by the words "Community and Region Parliaments".
CHAPTER V. - Amendment of the Judicial Code
Art. 5. In section 1389bis/7 of the Judicial Code, the words "Community and Regional Councils" are replaced by the words "Community and Region Parliaments".
CHAPTER VI. - Amendment of the Act of 19 July 1976 establishing leave for the exercise of a political mandate
Art. 6. In Article 2, § 1^er, from the law of 19 July 1976 establishing leave for the exercise of a political mandate, as amended by the laws of 4 May 1999 and 23 March 2001, the words "Council of the German-speaking Community" are replaced by the words "Parliament of the German-speaking Community".
CHAPTER VII. - Amendments to the Act of 15 December 1980 on access to territory, residence, establishment and removal of aliens
Art. 7. In section 31 of the Act of 15 December 1980 on access to territory, residence, establishment and removal of aliens, as amended by the Act of 6 May 1993, the following amendments are made:
1° the words "Community or Region Councils" are replaced each time by the words "Community or Region Parliaments";
2° in paragraph 2, the word "Executive" is replaced by the word "Governments".
CHAPTER VIII. - Amendment of the Programme Law 1981 of 2 July 1981
Art. 8. In Article 77, § 1^erB, 1, of the 1981 Program Law of 2 July 1981, the words "regional councils and community councils" are replaced by the words "community and region parliaments".
CHAPTER IX. - Amendment of the Act of 12 July 1985 on the protection of humans and the environment from harmful effects and nuisance caused by non-ionizing radiation, infrasound and ultrasound
Art. 9. In section 2 of the Act of 12 July 1985 on the protection of humans and the environment from harmful effects and nuisance caused by non-ionizing radiation, infrasound and ultrasound, the words "regional executives" are replaced by the words "regional governments".
CHAPTER X. - Amendments to the Act of 18 September 1986 establishing political leave for public service personnel
Art. 10. In section 3, 2°, of the Act of 18 September 1986 establishing political leave for members of public service staff, replaced by the Act of 4 February 2003, the word "Council" is replaced by the word "Parliament".
Art. 11. In section 5, 6°, of the same law, as amended by the law of 25 May 1999, the word "Council" is replaced by the word "Parliament".
Art. 12. In section 6, paragraph 1 of the Act, the following amendments are made:
1° in the 4th, first draw, the word "Council" is replaced by the word "Parliament";
2° in 5°, c, replaced by the Act of 4 February 2003, the words "community or region council, with the exception of the Council" are replaced by the words "community or region parliament, with the exception of Parliament".
CHAPTER XI. - Amendment of the law of 23 January 1989 relating to the tax jurisdiction referred to in article 110, §§ 1^er and 2 of the Constitution
Art. 13. In Article 1^er of the law of 23 January 1989 relating to the tax jurisdiction referred to in article 110, §§ 1^er and 2, of the Constitution, as amended by the Act of 16 July 1993, the word "Council" is replaced by the words "Community and Region Parliament".
CHAPTER XII. - Amendments to the Act of 23 March 1989 on the election of the European Parliament
Art. 14. In Article 10 of the Act of 23 March 1989 on the election of the European Parliament, replaced by the Act of 16 July 1993 and amended by the Act of 5 March 2004, the word "Council" is replaced each time by the word "Parliament".
Art. 15. In Article 21, § 2, paragraph 4, of the same Act, as amended by the Act of 16 July 1993, the words "regional councils or community councils" are replaced by the words "community or region parliaments".
Art. 16. In section 27, paragraph 2, of the Act, replaced by the Act of 16 July 1993, the words "Regional Councils or Community Councils" are replaced by the words "Community or Region Parliaments".
Art. 17. In Article 42, paragraph 2, of the same Act, the words "Flemish Council, the Council of the French Community or the Council of the Brussels-Capital Region, that of a member of a Regional Council, that of a member of an Executive" are replaced by the words "Flemish Parliament, the Parliament of the French Community or the Parliament of the Brussels-Capital Region, that of a member of a Region Parliament, that of the Government
CHAPTER XIII. - Amendment of the Act of 15 January 1990 on the institution and organization of a Social Security Bank
Art. 18. In Article 39, § 1^er, paragraph 1 of the Act of 15 January 1990 on the institution and organization of a Crossroads Social Security Bank, replaced by the Act of 26 February 2003, the words "Community or Regional Council" are replaced by the words "Community or Region Parliament".
CHAPTER XIV. - Amendments to the Act of 6 August 1990 on mutuality and national mutuality unions
Art. 19. In Article 51, § 3, paragraph 1, of the Act of 6 August 1990 on mutualities and national mutuality unions, the words "Community or Regional Council" are replaced by the words "Community or Region Parliament".
CHAPTER XV. - Amendment of the Act of 13 August 1990 to establish an assessment board of the Act of 3 April 1990 on the interruption of pregnancy, amending articles 348, 350, 351 and 352 of the Criminal Code and repealing article 353 of the same Code
Art. 20. In Article 1^er§ 1^er, the Act of 13 August 1990 to establish a commission to evaluate the Act of 3 April 1990 on the interruption of pregnancy, amending sections 348, 350, 351 and 352 of the Criminal Code and repealing section 353 of the same Code, the words "of government or executive" are replaced by the words "of a government".
CHAPTER XVI. - Amendment of the Act of 21 March 1991 on reform of certain economic public enterprises
Art. 21. Article 22, § 1^er, 4°, of the Act of 21 March 1991 on reform of certain economic public enterprises, is replaced by the following:
"4° member of Parliament or government of a Community or Region; "
CHAPTER XVII. - Amendment of the Consumer Credit Act of 12 June 1991
Art. 22. In Article 72, § 4, paragraph 1, 4, of the Act of 12 June 1991 on consumer credit, the words "Community or Regional Council" are replaced by the words "Community or Region Parliament".
CHAPTER XVIII. - Amendments to the Privacy Protection Act of 8 December 1992 with respect to personal data processing
Art. 23. In Article 24, § 5, 3°, of the Act of 8 December 1992 on the protection of privacy with respect to personal data processing, the words "Community Council or Regional Council" are replaced by the words "Community Parliament or Region Parliament".
Art. 24. AA Article 29, § 1^erthe following amendments are made:
1° the words "Community or Regional Executives" are replaced by the words "Community or Region Governments";
2° the words "Community or Regional Councils" are replaced by the words "Community or Region Parliaments".
Art. 25. AA Article 30, § 1^erthe following amendments are made:
1° the words "Community or Regional Executives" are replaced by the words "Community or Region Governments";
2° the words "Community or Regional Councils" are replaced by the words "Community or Region Parliaments".
CHAPTER XIX. - Amendment of the Act of 30 March 1994 on social provisions
Art. 26. In article 68, § 6, 9°, of the Act of 30 March 1994 on social provisions, replaced by the Royal Decree of 16 December 1996, the words "Regional and Community Councils" are replaced by the words "Community and Region Parliaments".
CHAPTER XX. - Amendment of the Act of 15 April 1994 on the Protection of Population and the Environment from the Hazards of Atomic Radiation and the Federal Nuclear Control Agency
Art. 27. Section 38, paragraph 1, 4, of the Act of 15 April 1994 on the protection of the population and the environment from the hazards resulting from ionizing radiation and related to the Federal Nuclear Control Agency, is replaced by the following:
"4° member of a Parliament or community or region government; »
CHAPTER XXI. - Amendments to the Act of 19 May 1994 regulating the electoral campaign, concerning the limitation and reporting of the election expenses incurred for the elections of the Council of the Walloon Region, the Flemish Council, the Council of the Brussels Capital Region and the Council of the German-speaking Community, and setting the criterion for the control of the official communications of the public authorities
Art. 28. In the title of the law of 19 May 1994 regulating the electoral campaign, concerning the limitation and declaration of the election expenses incurred for the elections of the Council of the Walloon Region, the Flemish Council, the Council of the Brussels-Capital Region and the Council of the German-speaking Community, and setting the criterion of control of the official communications of the public authorities, replaced by the law of 25 April 2004, the words "Council of the Walloon Region,
Art. 29. In Article 1^er, 2°, of the same law, as amended by the laws of 10 April 2004 and 25 April 2004, the words "Council of the Walloon Region, the Flemish Council, the Council of the Brussels Capital Region and the Council" are replaced by the words "Ball Walloon Parliament, the Flemish Parliament, the Parliament of the Brussels Capital Region and the Parliament".
Art. 30. In the title of Chapter II of the same law, inserted by the law of 25 April 2004, the words "Council of the Walloon Region, the Flemish Council, the Council of the Brussels-Capital Region and the Council" are replaced by the words "Ball Walloon Parliament, the Flemish Parliament, the Parliament of the Brussels-Capital Region and the Parliament".
Art. 31. AA section 2 of the Act are made the following amendments:
1° to § 1^er the following modifications are made:
(a) in paragraph 1, as amended by the Act of 10 April 1995, the words "Council of the Walloon Region, the Council of the Brussels-Capital Region and the Council of the German-speaking Community, on the one hand, and for the Flemish Council and the Council" are replaced by the words "Balloon Parliament, the Parliament of the Brussels-Capital Region and the Parliament of the German-speaking Community, on the one hand, and the Flemish Parliament and
(b) in paragraph 2 are the following amendments:
(i) in the 1st, as amended by the law of 25 April 2004, the words "Belgian Regional Council, Flemish Council" are replaced by the words "Ball Walloon Parliament, Flemish Parliament";
(ii) in 2°, amended by the law of 25 June 1998, the word "Council" is replaced by the word "Parliament";
(iii) in the 3rd, inserted by the Act of 10 April 1995, the word "Council" is replaced by the word "Parliament";
2° in § 2, introductory sentence, the words "Council of the Walloon Region and the Council" are replaced by the words "Ball Walloon Parliament and Parliament";
3° in § 3, introductory sentence, the word "Council" is replaced by the word "Parliament";
4° in § 4, amended by the Act of 2 March 2004, the word "Council" is replaced by the word "Parliament";
5° in § 5, amended by the laws of 25 June 1998 and 2 March 2004, the word "Council" is replaced each time by the word "Parliament".
Art. 32. In section 4bis of the Act, inserted by the Act of 25 April 2004, the word "Council" is replaced by the words "Community or Region Parliament".
Art. 33. AA Section 6 of the Act, replaced by the Act of April 25, 2004, are amended as follows:
1° in paragraph 1, 2°, the word "Councils" is replaced by the words "Community or Region Parliaments";
2° in paragraph 2, the word "Council" is replaced by the words "Community or Region Parliament".
Art. 34. The following amendments are made to section 7 of the Act:
1° in paragraph 1, replaced by the Act of 10 April 1995, the words "Council of the Walloon Region, the Flemish Council, the Council of the Brussels-Capital Region and the Council" are replaced by the words "Ball Walloon Parliament, the Flemish Parliament, the Parliament of the Brussels-Capital Region and the Parliament"
2° in paragraph 2, the word "Council" is replaced each time by the words "Community or Region Parliament".
Art. 35. In section 7bis of the Act, inserted by the Act of 25 April 2004, the word "Council" is replaced by the words "Community or Region Parliament".
Art. 36. In section 9 of the Act, replaced by the Act of 25 April 2004, the word "Council" is replaced each time by the words "Community or Region Parliament".
Art. 37. In section 10 of the Act, the word "Council" is replaced each time by the words "Community or Region Parliament".
Art. 38. In section 11bis of the Act, inserted by the Act of 25 April 2004, the words "the Council" are replaced by the words "the Parliament of Community or Region".
Art. 39. Article 12, § 1^erthe same Act, replaced by the Act of 25 April 2004, is amended as follows:
1° the word "Council" is replaced by the words "Community or Region Parliament".
2° the words "community or region councils" are replaced by the words "community and region parliaments".
CHAPTER XXII. - Amendments to the Act of 19 May 1994 on the limitation and control of election expenses incurred for the election of the European Parliament
Art. 40. In Article 4bis of the Law of 19 May 1994 on the limitation and control of election expenses incurred for the election of the European Parliament, inserted by the Law of 25 April 2004, the word "Council" is replaced by the words "Community Parliament or Region".
Art. 41. In section 6, paragraph 1, 2°, of the same Act, replaced by the Act of 25 April 2004, the word "Council" is replaced by the words "Community and Region Parliaments".
CHAPTER XXIII. - Amendments to the coordinated law of 24 December 1996 on the organization of the public sector of credit and the detention of public sector participation in certain private financial companies
Art. 42. Article 73, § 1^er1°, of the coordinated law of 24 December 1996 on the organization of the public sector of credit and the detention of public sector participation in certain private-law financial companies, the following amendments are made:
1° the words "Community and Region Councils" are replaced by the words "Community and Region Parliaments";
2° the words "Community or Region Executive" are replaced by the words "Community or Region Government".
CHAPTER XXIV. - Amendment of the Act of 22 February 1998 establishing the organic status of the National Bank of Belgium
Art. 43. In article 25 of the Act of 22 February 1998 establishing the organic status of the National Bank of Belgium, the words "Community and Region Councils" are replaced by the words "Community and Region Parliaments".
CHAPTER XXV. - Amendments to the Act of 2 June 1998 establishing an Information and Opinion Centre on Harmful sectarian organizations and an Administrative Unit for the Coordination of the Fight against Harmful sectarian organizations
Art. 44. In Article 4, § 3, 2°, of the Act of 2 June 1998 establishing a Centre for Information and Opinion on Harmful sectarian organizations and an Administrative Unit for the Coordination of the Fight against Harmful sectarian organizations, the words "Community or Regional Council" are replaced by the words "Community Parliament or Region Parliament".
Art. 45. In section 11 of the Act, the words "Council and Government of Regions and Communities" are replaced by the words "Parliaments and Governments of Community and Region".
CHAPTER XXVI. - Amendment of the Act of 21 December 1998 establishing "Belgian Technical Cooperation" in the form of a public law society
Art. 46. Article 22, § 7, 4°, of the Act of 21 December 1998 establishing the "Belgian Technical Cooperation" in the form of a public law society, is replaced by the following:
"4° member of a Community or Region Parliament; "
CHAPTER XXVII. - Amendment of the Act of 7 May 1999 establishing the Palais des Beaux-Arts in the form of an anonymous society of public law with a social purpose and amending the Act of 30 March 1995 concerning broadcasting distribution networks and the exercise of broadcasting activities in the bilingual region of Brussels-Capital
Art. 47. Article 11, § 7, 4°, of the Act of 7 May 1999 establishing the Palais des Beaux-Arts in the form of an anonymous society of public law with a social purpose and amending the Act of 30 March 1995 concerning broadcasting distribution networks and the exercise of broadcasting activities in the bilingual region of Brussels-Capital, is replaced by the following:
"4° member of a Community or Region Parliament; "
CHAPTER XXVIII. - Amendment of the law of 1^er July 1999 on the protection of economic competition
Art. 48. In Article 18, § 4, paragraph 2, last dash, of the law of 1^er July 1999 on the protection of economic competition, the words "Regional or Community Council" are replaced by the words "Community or Region Parliament".
CHAPTER XXIX. - Amendment of the Act of 25 May 2000 on the Envelope in Military Personnel
Art. 49. In Article 3, 2°, of the Act of 25 May 2000 on the envelope of military personnel, the words "Community or Region Councils" are replaced by the words "Community or Region Parliaments".
CHAPTER XXX. - Amendment of the Act of 19 April 2002 on the rationalization of the operation and management of the National Lotterie
Art. 50. Article 12, § 1^er, 4°, of the Act of 19 April 2002 on the rationalization of the operation and management of the National Lotterie, is replaced by the following:
"4° member of a Parliament or community or region government; "
CHAPTER XXXI. - Amendments to the Act of 21 June 2002 on the Central Council of Non-denominational Philosophical Communities of Belgium, delegates and institutions responsible for the management of the material and financial interests of recognized non-denominational philosophical communities
Art. 51. In article 8, paragraph 1, 6, of the Act of 21 June 2002 on the Central Council of Non-denominational Philosophical Communities of Belgium, delegates and institutions responsible for the management of the material and financial interests of recognized non-denominational philosophical communities, the word "advice" is replaced by the word "Parliament".
Art. 52. In Article 54, § 1^er, 2°, of the same law, the words "regional and community councils" are replaced by the words "community and region parliaments".
CHAPTER XXXII. - Amendment of the Financial Sector Supervision and Financial Services Act of 2 August 2002
Art. 53. In Article 53, § 1^er, of the Act of 2 August 2002 on financial sector oversight and financial services, as amended by the Royal Decree of 25 March 2003, the words "community and regional councils" are replaced by the words "community and region parliaments".
CHAPTER XXXIII. - Amendment of the Programme Law (I) of 24 December 2002
Art. 54. In Article 455 of the Programme Law (I) of 24 December 2002, the words "Council of Communities and Regions" are replaced in Article 12, § 3, paragraph 1, proposed by the words "Community and Region Parliaments".
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
