The Chambers adopted in We sanction the following:
CHAPTER Ier. - General provision
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
CHAPTER II. - Amendments to the special law of 8 August 1980 of institutional reforms
Section 1re. - General provisions
Art. 2. The following amendments are made to the special law of 8 August 1980:
A) the names "the Flemish Council", "the Council of the French Community", "the Walloon Regional Council", "the Council of the Brussels-Capital Region" and "the Council of the German-speaking Community" are replaced each time, respectively, by the names "the Flemish Parliament", "the Parliament of the French Community", "the Walloon Parliament", "the Parliament of the Brussels-Capital Region" and
B) the word "Council" is replaced each time by the word "Parliament", except in the words "Council of State", "Council of Ministers", "Federal Council of Science Policy", "Council of Social Assistance", "Council of Administration" and "Council of European Communities" and in Articles 6, § 1erVIII, 5°, and 37bis, § 2, second paragraph;
C) the word "Councils" is replaced each time by the word "Parliaments", except in the words "Provincial Councils" and "Common Councils";
D) Article 31ter, § 1erbis, the word "advisor" is replaced by the words "member of Parliament" in paragraph 1er and by the word "member" in paragraph 4.
Section 2. - Special provisions
Art. 3. Article 31, § 6, of the same special law is replaced as follows:
“§ 6. Parliaments are competent with regard to the supplementary financing of political parties, as defined by Article 1er, 2°, of the law of 19 May 1994 regulating the electoral campaign, concerning the limitation and declaration of the election expenses incurred for the elections of the Walloon Parliament, the Flemish Parliament, the Parliament of the Brussels-Capital Region and the Parliament of the German-speaking Community, and setting the criterion for the control of the official communications of the public authorities. »
Art. 4. In the French text of article 54 of the same special law, the words "De Vlaamse Raad" are replaced by the words "Het Vlaams Parliament".
CHAPTER III. - Amendments to the special law of 12 January 1989 on Brussels Institutions
Section 1re. - General provisions
Art. 5. The following amendments are made to the special law of 12 January 1989 concerning the Brussels Institutions:
A) the words « Council of the Brussels-Capital Region », « Walloon Regional Council », « Flemish Council », « Council of the French Community » and « Regional Councils » are replaced each time, respectively, by the words « Parliament of the Brussels-Capital Region », « Walloon Parliament », « Flemish Parliament », « Parliament of the French Community » and « Regional Parliaments »;
B) except in the words "Council of State", "Council of Ministers", "Council of Agglomeration" and "Provincial Council" as well as in the phrase "Council powers" in Article 48, the word "Council" is replaced each time by the word "Parliament".
Section 2. - Special provisions
Art. 6. Article 22, § 6, of the same special law is replaced as follows:
“§ 6. Parliament has jurisdiction over the supplementary financing of political parties, as defined in Article 1er, 2°, of the law of 19 May 1994 regulating the electoral campaign, concerning the limitation and declaration of the election expenses incurred for the elections of the Walloon Parliament, the Flemish Parliament, the Parliament of the Brussels-Capital Region and the Parliament of the German-speaking Community, and setting the criterion for the control of the official communications of the public authorities. »
Art. 7. In section 23 of the same special law, the words "advisors" and "advisor" are replaced each time by the words "members" and "member".
Art. 8. In the French text of article 32 of the same special law, the words "De Brusselse Hoofdstedelijke Raad" are replaced by the words "Het Brussels Hoofdstedelijk Parliament".
CHAPTER IV. - Amendments to the special law of 16 January 1989 on the financing of the Communities and Regions
Art. 9. Article 1er, § 3, of the special law of 16 January 1989 on the financing of the Communities and Regions, the words "Flemish Council" are replaced by the words "Flemish Parliament".
Art. 10. In article 9bis of the same special law, the words "the council concerned" are replaced by the words "the parliament concerned" and the words "of the council in question" by the words "of the parliament in question".
Art. 11. In Article 50 of the same special law, the words "Every Council" and "the Council" are replaced respectively by the words "Every Parliament" and "the parliament".
Art. 12. Article 77, § 1er, last paragraph, of the same special law, the words "to the competent Council" are replaced by the words "to the competent parliament".
CHAPTER V. - Amendments to the special law of 16 July 1993 to complete the federal structure of the State and to supplement the electoral legislation relating to the Regions and Communities
Art. 13. The following amendments are made to the special law of 16 July 1993 to complete the federal structure of the State and to supplement the electoral legislation relating to the Regions and Communities:
A) the words "Ball Walloon Regional Council" are replaced by the words "Ball Walloon Parliament" and the words "Flemish Council" by the words "Flemish Parliament";
B) the words "Brussels-Capital Region Council" are replaced by the words "Brussels-Capital Region Parliament";
C) the words "regional and community councils" are replaced each time by the words "community and region parliaments".
CHAPTER VI. - Amendments to the special law of 16 July 1993 to complete the federal structure of the State
Art. 14. Section 63 of the Special Act of 16 July 1993 to complete the federal structure of the State is amended as follows:
A) the words "the Walloon Regional Council" and "the Flemish Council" are replaced each time, respectively, by the words "the Walloon Parliament" and "the Flemish Parliament";
B) in § 3, 2, b, the words "of the Council concerned" are replaced by the words "of the Parliament concerned".
CHAPTER VII. - Amendments to the special law of 6 January 1989 on the Court of Arbitration
Art. 15. Article 34, § 1er, 2°, of the special law of 6 January 1989 on the Court of Arbitration, the words "a Council of Community or Region" are replaced by the words "a parliament of community or region".
Art. 16. In article 41, first paragraph, 2°, g, of the same special law, the words "Community and Region Councils" are replaced by the words "community and region parliaments".
Art. 17. Under articles 62 and 113 of the same special law, the words "Council of the Brussels-Capital Region", "Council of the French Community", "Council of the German-speaking Community", "Council of the Flemish Community" and "Flemish Council" are replaced each time, respectively, by the words "Parliament of the Brussels-Capital Region", "Parliament of the French Community", " Walloon Parliament".
CHAPTER VIII. - Amendments to the special law of 25 June 1998 regulating the criminal responsibility of members of community or regional governments
Art. 18. In the special law of 26 June 1998 regulating the criminal responsibility of members of community or regional governments, the word "counsel" is replaced each time by the word "parliament", except in Article 12, § 2, second paragraph, in the phrase "the minister and his council" and Article 19, in the phrase "the member and his council".
CHAPTER IX. - Amendments to the special law of 2 May 1995 on the obligation to file a list of mandates, duties and occupations and a declaration of heritage
Art. 19. Article 1er, 2°, of the special law of 2 May 1995 on the obligation to deposit a list of mandates, functions and professions and a declaration of heritage, the words "of the Flemish Council, the Council of the Walloon Region, the Council of the French Community and the Council of the Brussels-Capital Region" are replaced by the words "of the Walloon Parliament, the Flemish Parliament, the Parliament of the French Region and the Parliament of the Parliament of the
CHAPTER X. - Amendments to the special law of 26 June 2004 executing and supplementing the special law of 2 May 1995 on the obligation to deposit a list of mandates, functions and professions and a declaration of heritage
Art. 20. Article 6, paragraph 1er, 2°, of the special law of 26 June 2004 executing and supplementing the special law of 2 May 1995 on the obligation to deposit a list of mandates, functions and professions and a declaration of heritage, the word "advices" is each time replaced by the word "parliaments".
Art. 21. In Article 7, § 2, of the same special law, the word "Council" is replaced each time by the word "parliament".
Art. 22. In Article 8 of the same special law, the word "Council" is replaced each time by the word "parliament".
CHAPTER XI. - Amendments to article 32 of the ordinary law of 9 August 1980 of institutional reforms
Art. 23. Section 32 of the ordinary law of 9 August 1980 of institutional reforms, replaced by the law of 16 June 1989 and amended by the special law of 7 May 1999 and the law of 2 April 2003, are amended as follows:
A) to § 1erthe words "and by Council: the Council of the Flemish Community, the Council of the French Community, the Council of the German-speaking Community, the Walloon Regional Council, the Council of the Brussels-Capital Region" are replaced by the words "and by Parliament: the Parliament of the French Community, the Flemish Parliament, the Parliament of the German-speaking Community, the Walloon Parliament, the Parliament of the Brussels-Capital Region;
B) to § 1erbis, the word "Council" is replaced each time by the word "Parliament";
C) to § 1erter, the word "Council" is replaced each time by the word "Parliament";
D) in §§ 2 and 3, the word "Government" is replaced each time by the words "federal government" and the word "executive" by the words "a Government of Community or Region";
E) in §§ 4, 6 and 8, the word "executive" is replaced each time by the word "government".
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
