7 DECEMBER 2006. - Act to amend the excise rates of certain energy products

The Chambers adopted and We sanction the following:
Article 1^er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. Section 419 of the Program Act of 27 December 2004, as amended by the Program Act of 27 December 2005, is amended as follows:
(a) (g) is replaced by the following provision:
"(g) heavy fuel under NC codes 2710 19 61 to 2710 19 69:
professional consumption:
• large consumer companies with environmental agreement or permit (excluding consumption to produce electricity):
- right to excise: 0 euro per 1,000 kg;
- special excise fee: 0 euro per 1,000 kg;
- energy contribution: 0 euro per 1,000 kg;
• companies with environmental agreement or permit (excluding consumption to produce electricity):
- excise fee: 6.50 euros per 1,000 kg;
- special excise fee: 1 euro per 1,000 kg;
- energy contribution: 0 euro per 1,000 kg;
• other companies (excluding consumption to produce electricity):
- excise fee: 13 euros per 1,000 kg;
- special excise fee: 2 euros per 1,000 kg;
- energy contribution: 0 euro per 1,000 kg;
• consumption to produce electricity:
- excise fee: 13 euros per 1,000 kg;
- special excise fee: 2 euros per 1,000 kg;
- energy contribution: 0 euro per 1,000 kg;
non-professional consumption:
excise fee: 13 euros per 1,000 kg;
special excise fee: 2 euros per 1,000 kg;
Energy contribution: 0 euro per 1,000 kg. »
"(j) coal, coke and lignite of NC codes 2701, 2702 and 2704:
- right to excise: 0 euro per 1,000 kg;
- special excise fee: 8.6526 euros per 1,000 kg;
- Energy contribution: 3 euros per 1,000 kg. »
Art. 3. Article 429, § 1^er, e), of the same programme law, is replaced by the following provision:
"(e) energy products, excluding heavy fuel, coal, coke and lignite, and electricity used to produce electricity and electricity used to maintain the capacity to produce electricity; "
Art. 4. This Act comes into force on the day of its publication in the Belgian Monitor.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
