12 MARCH 2007. - An Act to amend the Act of 3 April 1953 of a judicial organization in respect of the Court of Appeal of Mons and the Court of First Instance of Ghent and to temporarily authorize the appointment of supernumerable magistrates with respect to the Court of Appeal of Mons (1)

To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. To the table in section 1er of the Act of 3 April 1953 of judicial organization, replaced by the Act of 20 July 1998 and amended by the Acts of 29 November 2001, 11 March 2004, 14 December 2004, 10 August 2005 and 20 December 2005, are amended as follows:
1° from 1er April 2007, the figures "18" and "6" in the columns "Advisors" and "Deputies of the Attorney General" in relation to the headquarters of Mons, are replaced respectively by the figures "19" and "7";
2° from 1er January 2008, the figures "19", "7", "7" and "10" in the columns "Counsors", "Attorneys General", "Deputies of the Attorney General" and "Registries" in respect of Mons' headquarters, are replaced respectively by the figures "20", "8", "6" and "11".
Art. 3. In Table III, "Tribunals of First Instance", annexed to the same Act, replaced by the Act of 20 July 1998 and amended by the Acts of 28 March 2000, 16 July 2002, 11 March 2004 and 14 December 2004, the figures "7" and "31" in the columns " Vice-Presidents" and "Tribunals" in relation to Ghent's headquarters are replaced respectively by the figures "8" and "32".
Art. 4. The appointment of an adviser to the Court of Appeal of Mons and a deputy to the Attorney General near the Court may be made over a period beginning on 1er January 2008 and expiring on 31 December 2010.
Art. 5. It may be provided to over-numbered places referred to in Article 4, beyond December 31, 2010, by a decision of the King in that direction, by order deliberately in the Council of Ministers, taken on the basis of an assessment based on the measurement, by means of a uniform registration system, of the workload of the appeal courses and no later than before the expiry of that period. In the absence of a decision, overnumbers are resorbed as vacancies occur.
The royal decree referred to in the preceding paragraph ceases to produce its effects at the end of the sixth month following its entry into force if it has not been confirmed by law before that date.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
