20 MARCH 2007. - An Act to amend the co-ordinated Acts of 16 March 1968 relating to the Road Traffic Police and the Act of 22 February 1965 allowing municipalities to establish parking fees for motor vehicles (1)



ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. In the co-ordinated Acts of 16 March 1968 concerning the Traffic Police, as amended by the Acts of 9 June 1975, 9 July 1976, 14 July 1976, 2 July 1981, 29 February 1984, 21 June 1985, 18 July 1990, 20 July 1991, 4 August 1996, 16 March 1999, 5 August 2003, 5 August 2003 and 20 July 2005, a new title IIIbis, as follows, is inserted:
« Title IIIbis. - General rules of behaviour for road users.
Art. 27 bis. It is prohibited for any user to behave in such a way that:
- it creates a danger or can create a danger on the public highway;
- it's embarrassing or embarrassing other users.
Art. 27ter. Every driver must be in a position to drive, present the required physical qualities and possess the necessary knowledge and skill.
It must be constantly in a position to perform all the manoeuvres that it is responsible for, and must be constantly controlled by, the vehicle or animals it conducts.
Art. 27quater. § 1er. Drivers must be more cautious about the categories of more vulnerable users, such as cyclists and pedestrians, especially when it comes to children, the elderly and persons with disabilities.
§ 2. Each user must adapt their behaviour to the disposal of the premises, their congestion, the density of traffic, the field of visibility, the state of the road, the climatic conditions, the nature, the state and the loading of the vehicle and the presence of other users.
§ 3. The driver shall maintain a sufficient safety distance between the driver and the other users in the light of his speed.
§ 4. The driver must at all times be able to stop at a foreseeable obstacle. »
Art. 27quinquies. It is prohibited to incite or cause a user to contravene the provisions of this Act or its enforcement orders.
Art. 3. In title IV of the same coordinated laws, a chapter Ibis is inserted, which reads as follows:
“Chapter Ierbis - Offences to general rules of behaviour
Art. 28bis. Offences to articles 27bis to 27quinquies are punished by a fine of 10 euros to 250 euros. »
Art. 4. - Article 29, § 2, paragraph 2 of the same coordinated laws, replaced by the law of 20 July 2005 and amended by the law of 1er April 2006, replace the word "waterfronts" with the words "holding a communal parking card".
Art. 5. In the single article of the Act of 22 February 1965 allowing municipalities to establish parking fees for motor vehicles, replace the words "reserved to residents" with the words "on the sites reserved for the holders of a communal parking card".
Art. 6. With the exception of sections 4, 5 and 6, the King sets out the effective date of this Act.
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
