The House of Representatives adopted and sanctioned the following:
CHAPTER Ier. - General provisions
Article 1-01-1
This Act regulates a matter referred to in Article 74, 3° of the Constitution.
Art. 1-01-2
The General Estimates for the 2007 Budget Year are adjusted:
1° with respect to the appropriations provided for the Dots, in accordance with the table annexed to this Act;
2° in respect of credits by program, in accordance with the totals of the adjusted programmes in the departmental tables annexed to this Act.
CHAPTER II. - Special provisions of departments
Section 03. - SPF Budget and Management Control
Art. 2.03.1
The deferral to the 2007 budget year of €31.300,000 of the commitment credits in the SPF Budget and Management Control for the 2006 fiscal year and for the implementation of the Fedcom project is approved.
Section 04. - Personal SPF and Organization
Art. 2.04.1
The text of section 2.04.5 of the Act of 28 December 2006 containing the General Estimates for the 2007 Budget Year is replaced by the following text:
The Minister of Public Service is authorized to use, as a matter of priority, the balance of the special fund of the SPF Personnel and Organisation set out in section 63.01.A for the payment of amounts arising out of convictions or transactions in the context of litigations concerning public procurements concluded by P♣O in favour of federal public services and for the payment of public procurements related to certified trainings by Pộ for federal public services for a maximum amount of Euro1.500,000.
Section 14. - SPF Foreign Affairs, Foreign Trade and Development Cooperation
Art. 2.14.1
Revenue transactions for order made under the organization of conferences through the SPF Foreign Affairs, Foreign Trade and Development Cooperation are carried out using Account 87.05.12.30 C of the section "Treasury Operations".
They may be used to cover similar expenses.
The operations are subject to the preliminary opinion of the Inspector of Finance, in accordance with the provisions of articles 14 and 15 of the Royal Decree of 16 November 1994 on administrative and budgetary control.
Art. 2.14.2
The text of section 2.14.6, Programme 54/2 - Non-Governmental Cooperation, of the Act of 28 December 2006 containing the General Estimates for the 2007 Budget Year is supplemented as follows:
"16) Subsides at the Royal Institute of International Relations. »
Item 1 of Article 2.14.6, Programme 54/3 - Multilateral cooperation, of the same law is supplemented with the International Foundation for Science.
Art. 2.14.3
In Article 2.14.12 of the Act of 28 December 2006 containing the general budget of the expenditures of the fiscal year 2007, the amount of "550.000.000 euros" is replaced by "700.000.000 euros".
Section 16. - Ministry of Defence
Art. 2.16.1
The text of the first paragraph of section 2.16.13 of the Act of 28 December 2006 containing the General Estimates for the 2007 fiscal year is replaced by the following text.
The Minister of Defence is authorized to use, to a maximum of 4,500,000 euros, revenues from the interest generated by the advances filed with the "Federal Reserve Bank of New York" as part of the contracts for the supply of aircraft, logistical support, ground installations and related costs for the entire fleet F-16.
Art. 2.16.2
The text of section 2.16.30 of the Act is replaced by the following text.
For the 2007 fiscal year, a commitment authority of Euro71,200,000 is allocated to the Re-employment Fund of revenues from the disposal of surplus equipment, materials or ammunition as part of the heritage entrusted to the management of the Minister of Defence and allocated to program 16-50-2.
Art. 2.16.3
The text of section 2.16.31 of the Act is replaced by the following text.
For the 2007 fiscal year, a commitment authority of up to 59.000.000 euros is allocated to the Re-employment Fund of revenues from the alienation of immovable property that is part of the heritage entrusted to the management of the Minister of Defence and allocated to program 16-50-3.
Art. 2.16.4
By derogation from Article 57 of the Laws on State Accounting, coordinated on July 17, 1991, the CSCO (Office Central d'Action Sociale et Culturelle du Ministère de la Défense) is exempted from the reimbursement to the Treasury of any excess of subsidy of the RFRO (Office de renseignements et d'aide aux familles des militaires).
Section 17. - Federal police and integrated operation
Art. 2.17.1
The text of section 2.17.3 of the Act of 28 December 2006 containing the General Estimates for the 2007 Budget Year is replaced by the following text.
Within the limits of the basic allowances concerned, the following subsidies may be granted:
PROGRAMME 90/1 - DOTATIONS AND SUBSIDES
- to multi-communal police areas and municipalities: contribution of the federal state to local police personnel, operations and investment expenses, including pay expenses of overcrowded ex-gendarmes in police areas;
- to certain multi-communal and common police zones: contribution of the federal state in the expenses for the replacement of uniform and equipment for the maintenance of order;
- to certain municipalities: contribution of the federal State in the costs of civilian personnel for the police component of security contracts;
- to the ABL "Social Service of the Integrated Police": budget allocation as a contribution to staff costs, general operating expenses and intervention expenses, including the share of these expenses required for the management of HORECA services within the federal police;
- Police Studies Centers.
PROGRAMME 90/2 - INTEGREEMENT
- to accredited police schools or other institutions: contribution of the federal state to the costs of organizing selection tests and vocational training for members of the integrated police;
- to certain organizations and ASBLs: contribution of the federal State to the financing of projects to stimulate the recruitment of people reflecting the socio-cultural diversity encountered in the population;
- to certain multi-communal and common police zones: contribution of the federal State to the financing of the operating costs incurred for the maintenance of power plants 101;
- to various agencies and ABLs that promote the integration of local and federal polices: intervention by the federal authority in the financing of their projects.
PROGRAMME 90/4 - PRESTATIONS AND CESSIONS OF MATERIALS AND PRODUCTS
- to certain organizations and ASBLs: the federal state's contribution to the financing of projects to stimulate the recruitment of people reflecting the socio-cultural diversity encountered in the population.
Section 18. - SPF Finance
Art. 2.18.1
Revenues for order made in the context of the pooling of datacenter of the SPF Finance will be made using the Account 86.05.06.15.B of the "Treasury Order Operations" section.
They may be used to cover any costs and expenses necessary to ensure the maintenance of the equipment and security of the SPF Finance data centre as part of hosting requests from other public services as well as for the rental of the SPF Finance's call centre.
Prerequisitely to any legal undertaking, these expenses are subject to the opinion of the Finance Inspectorate in accordance with the provisions of the Royal Decree of 16 November 1994 on administrative and budgetary control.
Section 19. - Buildings Regime
Art. 2.19.1
The adjusted budget of the Buildings Board for the 2007 fiscal year is approved.
This budget is for revenues at 851.972.893 euros and for expenditures at 872.129.382 euros, of which 17.656.489 euros to be carried forward from the 2006 fiscal year and 2.500.000 euros to be covered by the Fund's products in 2006. It includes, in expenditure, commitment credits in the amount of 301.257.716 euros.
Revenues and expenses for order are estimated at 107,130,000 euros.
Art. 2.19.2
In section 2.19.2 of the Act of 28 December 2006 containing the General Estimates for the 2007 fiscal year, the amount of 11.587.984 euros is replaced by 23.381.500 euros.
In addition, the table is replaced by the following table:
Art. 2.19.3
The Régie des Bâtiments is authorized to contribute at a cost of EUR 50,000 to the construction of the Belgian flag at the 2008 Universal Exhibition in Zaragoza.
Section 24. - SPF Social security
Art. 2.24.1
In section 2.24.5 of the Act of 28 December 2006 containing the General Estimates for the 2007 fiscal year, the following paragraph is inserted between paragraph 3 "PROGRAMME 58/1 - Studies of Social Policy" and paragraph 4 "PROGRAMME 59/1 - Victims of War": "PROGRAMME 58/4 - Duties and Subsides: Subside to Management SIGeDIS for Pensions". »
Section 25. - SPF Public Health, Food Chain Safety and Environment
Art. 2.25.1
In the text of section 2.25.1 of the Act containing the General Estimates for the 2007 fiscal year, the last paragraph shall be deleted:
"To the extraordinary accountant of the Centre d'Etude et de Recherches vétérinaires et agrochimiques, successive advances of funds for up to 500,000 euros can be made. »
Art. 2.25.2
In section 2.25.4 of the Act the following provision is deleted:
- PROGRAMME 53/1 - Medical Fund
Art. 2.25.3
In the text of section 2.25.4 of the Act, the following provision is adapted:
- PROGRAMME 55/3 - PRODUCTS
Subsidies to associations/organizations related to awareness-raising campaigns, days of information and awareness-raising activities in relation to energy saving products and sustainable or environmentally friendly construction.
Grants and/or awards to companies that are established in Belgium and that take into account, in the development of their products, ecological aspects such as sustainable development, eco-efficiency, IPP, LCA, ea. (Support for the development of eco-design in Belgium).
Awarding to the Label Foundation Foundation.
Art. 2.25.4
Section 2.25.5 of the Act is deleted.
Art. 2.25.5
In section 2.25.11 of the Act, the amount of 40,854,134 euros for the revenues of the Federal Agency for Drugs and Health Products is replaced by an amount of 45,854,134 euros, and the amount of 40,524,781 euros for expenses is replaced by an amount of 45,524,781 euros.
Art. 2.25.6
In section 2.25.2 of the Act, the text is replaced by the following provision:
"The expenses of any kind on the occasion of care to be given to the beneficiaries of the law of July 3, 1967 on the distribution of damages resulting from accidents of work, accidents on the way of work and occupational diseases in the public sector, regardless of the amount and within the limits of the tariff referred to in section 4 of the Royal Decree of January 24, 1969, can be made in advance of funds for a maximum amount of 3.000.000 euros. »
Art. 2.25.7
By derogation from article 34 of the State Accounting Laws, coordinated on 17 July 1991, the unincorporated portion of the 2006 unrelated credits deferred from the base allowance 25/54.02.34.79 - Third-party compensation - State responsibility - may be used during the 2007 budget year to undertake new obligations.
Art. 2.25.8
By derogation from Article 1-01-3, § 2 and 3 of the Act of 28 December 2006 containing the General Estimates for the 2007 fiscal year, the credits of the basic allowances 55.01.11.04 and 55.31.12.08, provided for the product policy and the ecological label, may be redistributed, respectively, up to 85,000 euros and 35,000 euros, to the basic allowance 55.31.41 - Label Foundation.
Section 32. - SPF Economy, SMEs, Average Classes and Energy
Art. 2.32.1
The following amendments are made to section 2.32.5 of the Act of December 28, 2006, which contains the 2007 General Estimates:
- to PROGRAMME 21/4 - SUBVENTION ÷ DES ORGANISMES EXTERNES, point 4) Grant to the International Cold Institute (IIF) is deleted.
- 3 new entries are added:
PROGRAMME 42/8 - CONTRIBUTION OF THE BELGIUM ON ACTIVITIES RELATING TO THE COMMON COMPANIES FOR ITER (INTERNATIONAL THERMONUCLEAR EXPERIMENTAL REACTOR) AND OTHER FUSION ACTIVITIES
1) Direct contribution to the Common Company for ITER.
2) Grant to the Royal Military School for support of ITER research activities.
3) Grant to AGORIA for the financing of the contact cell providing assistance to Industry.
4) Grant to the Royal Military School for the development and supply of prototypes.
PROGRAMME 46/4 SUBVENTION ÷ DES ORGANISMES EXTERNES
3) Grant to the International Cold Institute (IIF).
PROGRAMME 49/0 - SUBSISTANCE PROGRAMME
2) Grant to Bel-IDB.
Section 44. - SPP Social integration, fight against poverty and social economy
Art. 2.44.1
In section 2.44.4, programme 55/4 - Social economy, of the Act of 28 December 2006 containing the General Estimates for the 2007 fiscal year, the words Dotation to the Labelfoundation are replaced by Subside as part of the integrated approach to socially and environmentally responsible production.
Art. 2.44.2
In section 2.44.7 of the Act, the amount of 241.964.300 euros for revenues and expenses is replaced by the amount of 241.559.300 euros.
Art. 2.44.3
In Article 2.44.11 § 1 of the same Law, the amount of the authorization of commitment of 1.965,000 euros is replaced by the amount of 5.377.000 euros.
Art. 2.44.4
In Article 2.44.12 § 1 of the same Law, the amount of the authorization of commitment of 5.732,000 euros is replaced by the amount of 6.464.000 euros.
In article 2.44.12 § 2 of the same law, the amount of the debiting position in order of 14.509.000 euros is replaced by the amount of 12,212,000 euros.
CHAPTER IV. - Separate Management State Services
Art. 4-01-1
The budgets of the Separate Management State Services for the 2007 fiscal year are adjusted in accordance with the tables annexed to this Act.
CHAPTER VI. - Public bodies
Art. 6-01-1
The budgets of the public interest agencies of Class A of the 2007 budget year are adjusted in accordance with the tables annexed to this Act.
CHAPTER VII. - Final provision
Art. 7-01-1
This Act comes into force on the day of its publication in the Belgian Monitor.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
