The Chambers adopted and We sanction the following:
CHAPTER 1er. - General provisions
Art. 1-01-1
This Act regulates a matter referred to in Article 74, 3° of the Constitution.
Art. 1-01-2
The 2010 General Estimates are approved:
1° with respect to the appropriations provided for the holdings, in accordance with the table annexed to this Act;
2° with respect to appropriations by programme, in accordance with the totals of the programmes contained in the budgets by section and by base allowance, annexed to this Act.
Art. 1-01-3
The outstanding obligations as at 31 December 2009 of the undivided credits and credits for receivables of prior years of the 2008 fiscal year may be liquidated against the corresponding liquidation credits for the 2010 fiscal year.
Art. 1-01-4
By derogation from article 19, third paragraph, 2°, b, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state, the liquidation credits cover the amounts that may be ordered during the fiscal year in accordance with the obligations previously incurred.
This exemption does not apply to sections 02 - SPF Chancellery of the Prime Minister, 03 - SPF Budget and Management Control, 04 - SPF Personnel and Organisation, 05 - SPF Information and Communication Technology, 23 - SPF Employment, Labour and Social Concertation, 24 - SPF Social Security, 25 - SPF Public Health, Food Chain and Environment Security, 32 - SPF Economie, P.M.E.
Art. 1-01-5
§ 1er. - Provision for programmes related to administrative costs, known as subsistence programmes, includes:
1. Generally any remuneration and allowances of active and lay-off staff, the remuneration or wages of auxiliary staff, the allowances for higher and special duties, the intervention in public transit subscriptions, the compensation for occupational accidents - including the payment of these allowances to family members of the victim in the event of death - as well as the reduced remuneration or wages of temporary or auxiliary personnel, accidented in service.
2. Other expenses of the social service.
3. Permanent costs for non-expendable property and services:
- Lawyers and doctors fees - Civil, Administrative and Criminal Affairs Justice Expenses - Attendance fees, travel and residence fees for persons outside the State administration - Remunerations of foreign experts to the Administration and third-party benefits;
- Consumption expenses related to occupancy of premises - including energy consumption expenses "mazout, gas, petrol, electricity, coal" - and maintenance expenses - Office fees, transport, taxes, retributions, department publications, vocational training, clothing and other small administrative expenses;
- Generally any allowances to State personnel for real expenses and material damage, transportation costs for service trips and insurance premiums from departmental delegates travelling abroad.
4. Miscellaneous operating expenses related to computing.
5. Exceptional expenses for the purchase of non-expendable goods and services, such as work and supplies for the development of new premises and moving expenses.
6. Real property rents and related taxes from the various departments of the department, paid without the intervention of the Buildings Board.
7. Other costs related to the operation of services that are detailed in the subsistence programmes.
8. Expenditures for the acquisition of non-expendable furniture: machinery, furniture, equipment and means of land transport.
9. Investment expenditures related to IT.
§ 2. By derogation from section 52, paragraph 1er, 1°, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state, the appropriations for the basic allowances relating to remuneration and generally any allowances " 11.00.03 - Statutory staff and interns" and " 11.00.04 - Non-statutory staff" and the basic allowances 12.00.48 and 12.21.48, may be reassigned only between them within the same section.
This exemption does not apply to the basic allowances for the expenses of the strategic bodies of ministers and state secretaries.
§ 3. By derogation from section 52, paragraph 1er, 1°, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state, the appropriations of the basic allowances 1100.05 and 1140.05 - Social service expenses - and basic allowances for operating and investment expenses provided by economic codes 12 and 74, specific or non-specific and non-subject to a subsistence program, may be redistributed to each other and exclusively within the same section of the budget.
This exemption does not apply to basic allowances for the expenses of the strategic bodies of ministers and state secretaries, nor to basic allowances 12.00.48 and 12.21.48.
§ 4. By derogation from paragraph 3, the y-base allocations may be redistributed, within the same section of the budget, also to basic allocations 21.00.01 and 21.40.01.
§ 5. By derogation from Article 52 of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state and without prejudice to the provisions of §§ 2 to 4, the chair of the relevant steering committee may, after the agreement of the chair of the steering committee of the SPF Budget and Management Control, redistribute the commitment credits on the one hand and the liquidation credits on the other hand of the basic allowances. However, the proposed increases cannot exceed a maximum amount of 50,000 euros per basic allowance. Where the same basic allowance is subject to successive increases, the amounts are added for the purposes of this provision.
This exemption does not apply to the basic allowances for the expenses of the strategic bodies of ministers, state secretaries and the government commissioner.
Art. 1-01-6
By derogation from Article 40 of the Acts on State Accounting, coordinated on 17 July 1991, the payment of birth allowances and burial allowances shall be made in accordance with the rules laid down in Article 41, paragraph 1erSame laws.
Art. 1-01-7
Provision can be made to lawyers, experts and judicial officers acting on behalf of the State.
Art. 1-01-8
By derogation from Article 48, paragraph 3 of the Act of 22 May 2003 on the organization of the budget and accounting of the Federal State, subsidies may be granted, pursuant to Article 43 of the special law of 12 January 1989 on the Brussels Institutions, and in charge of the Fund for the Financing of the International Role and the Capital Function of Brussels.
CHAPTER 2. - Special provisions of departments
Section 02. - SPF Chancellery of the Prime Minister
Art. 2.02.1
Derogation from art. 66 of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state, advances of up to 250,000 euros can be made to the accountant of the SPF Chancellery of the Prime Minister.
By means of these advances, the accountant may make the payment of claims of any kind, including the purchase of tangible property, not exceeding 1,000 euros.
Art. 2.02.2
Within the limits of the basic allowances concerned, the following subsidies may be granted:
PROGRAMME 31/1 - EXTERNAL COMMUNICATION
1. Subsides the International Press Centre "Residence Palace";
2. Subsides to the ABL "Museum of Europe";
3. Any subsidies in the context of the information and communication missions approved by the Council of Ministers;
4. Subsides to the Belgian Vocation Foundation f.u.p. and the ASBL Belgian Vocation Fund;
5. Subsidy of the European Movement - Belgium;
6. Subordinate to the ABL Beltomundial;
7. Various subsidies to institutions and associations within the framework of the Belgian Presidency of the European Union in 2010.
PROGRAMME 31/2 - BI-CULTURAL INSTITUTIONS
1. Subside to the Royal Theatre of the Mint;
2. Subsides to the National Orchestra of Belgium;
3. Subside at the Palais des Beaux-Arts.
PROGRAMME 32/3 - SOCIAL PROVISIONS
Trade union bonuses.
Art. 2.02.3
The Prime Minister is authorized to pass, in the interest of the Treasury and provided that public procurement legislation is respected, exchange agreements to encourage the renewal of the ITC Shared Services equipment.
Art. 2.02.4
Within the limits of the credits listed in program 21/1 "Network ICT", can also be adjusted - in addition to the recurring operating costs and investments - of any kind related to presumed services, as well as to the installation and maintenance of the software and equipment of the various user services connected to the ITC network.
Art.2.02.5
The External Communications Branch is authorized to make expenditures for information and communication missions to federal and programmatory public services. To this end, the External Communications Branch, through the CPI, receives advances from the SPF and SPPs concerned prior to the payment of these expenses.
Art. 2.02.6
By derogation from Article 1-01-5, § 2 and 3 of this Act, a further breakdown of the commitment credits of Basic Allowance 31.11.1211.27 may be carried out by means of a redistribution - "Different expenditures relating to external communication", within Program 31/1 - "External communication".
Art.2.02.7
By derogation from art.18, § 1er, 2° of the law of 19 April 1963 creating a public establishment known as the Royal Theatre of the Mint, amended in particular by Royal Decree No. 545 of 31 March 1987 relating to the Royal Theatre of the Mint, the 2010 subsidy to the Royal Theatre of the Mint (AB 31.20.41 40.21) is paid for 75% in the first quarter.
The balance will be transmitted each time in 3 equal instalments for October, November and December.
Art.2.02.8
By application of art. 18 of the Act of 22 April 1958 on the status of the National Orchestra of Belgium, the 2010 subsidy to the National Orchestra of Belgium (AB 31.20.41.40.22) is paid for 75% in the first quarter.
The balance will be transmitted each time in 3 equal instalments for October, November and December.
Art. 2.02.9
In execution of art. 13, 3° of the Act of 7 May 1999 establishing the Palais des Beaux-Arts in the form of an anonymous society of public law with a social purpose and amending the Act of 30 March 1995 concerning broadcasting distribution networks and the exercise of radio distribution activities in the bilingual region of Brussels-Capital and by derogation of art. 32 of the management contract between the Belgian State and the anonymous society of public law with social purpose " Palais des Beaux-arts" of 18/11/2002, approved by the AAR of 2/12/2002 (M.B. 21/12/2002) subsidies 2010 to SA of public law with social purpose Palais des Beaux-arts' (AB 31.20.4140.25) is paid for 75% in the first quarter.
The balance will be transmitted each time in 3 equal instalments for October, November and December.
Section 03. - SPF Budget and Management Control
Art. 2.03.1
By derogation from section 66 of the Act of 22 May 2003 on the organization of the federal budget and accounting, advances of up to 500,000 euros can be made to the accountants of the SPF Budget and Management Control.
By means of these advances, the accountant is authorized to pay receivables of any kind, including the acquisition of movable property, the amount of which does not exceed 5.500 euros.
Can be paid through these advances regardless of the amounts:
(1) Social expenditure;
(2) costs for foreign missions and for the posting of correspondence, as well as advances related thereto.
The Accountant responsible for the payment of foreign mission fees is authorized to make the necessary advances to officials sent on mission abroad.
Art. 2.03.2
The provision under program 41/1 may, after agreement of the Minister of Budget, be apportioned as required, by Royal Order, between the appropriate programs of the budgets of the departments concerned.
By derogation from Article 5, paragraph 2, of the Act of 16 March 1954 on the control of certain public interest bodies, the distribution by royal decree of this provisional credit may also increase the State's financial intervention in favour of public interest bodies.
Section 04. - Personal SPF and Organization
Art. 2.04.1
By derogation from Article 66 of the Act of 22 May 2003 on the organization of the budget and accounting of the Federal State, advances of up to 250,000 euros can be made to the accountants of the services and institutions whose expenses are recorded in this section.
By means of these advances, accountants are allowed to pay all service fees not exceeding 5,500 euros, as well as, regardless of the amounts, the costs of water consumption, gas, electricity, telephone, fuel and fuel for motor cars as well as any allowances and allowances of any kind allocated to the budget.
Can be paid in advances, regardless of the amounts:
(1) Social expenditure;
(2) costs for foreign missions and for the posting of correspondence, as well as advances related thereto.
Accountants charged with payment of foreign mission fees are authorized to make advances to officials sent on mission abroad.
Art. 2.04.2
Within the limits of the basic allowances concerned, the following subsidies may be granted:
PROGRAMME 21/0 - DIRECTION AND MANAGEMENT
Subsides to the ABL "Social Service of the Ministry of Public Service" on the basic allowance 04.21.01.1140.05.
PROGRAMME 31/1 - PERSONNEL AND ORGANIZATION
Grants relating to the promotion or study of the public service in general, the improvement of the staff culture, the policy of equal opportunities and diversity within the federal state can be awarded to the basic allowance 04.31.10.3300.01.
PROGRAMME 31/2 - TRAINING
1° Contributions to the International Institute of Administrative Sciences on Basic Allocation 04.31.20.33.00.24;
2° Contributions to the European Institute of Public Administration in Maastricht on the basic allowance 04.31.20.33.00.24;
3° Intervention for training activities organized by representative trade union organizations on the basic allowance 04.31.20.33.00.23.
Art. 2.04.3
The provision for the basic allowance 04.31.10.01.00.02 may, after agreement of the Minister of Budget, be apportioned as required by royal decree between the appropriate programmes of the budgets of the departments concerned.
By derogation from Article 5, paragraph 2, of the Act of 16 March 1954 relating to the control of certain public bodies, the distribution by royal decree of this provisional credit may also increase the State's financial intervention in favour of these public bodies.
Art. 2.04.4
The treasury account on which the remuneration and various allowances are charged for the final and intern statutory staff and the contractual staff of the Federal Administration Selection Office (SELOR), Separate Management Status Service, may present a debtor balance of up to 450,000 euros. In the event that this amount exceeds, the Minister of Budget may decide an exemption, in agreement with the Minister of Finance, on the basis of a reasoned record.
Art. 2.04.5
The Minister of Public Service is authorized, in litigation, to make transactions and make payments to the Caisse des Dépôts et Consignations.
Section 05. - SPF Information and Communication Technology
Art. 2.05.1
By derogation from Article 66 of the Act of 22 May 2003 on the organization of the budget and accounting of the Federal State, advances of up to 250,000 euros can be made to the accountants of the services and institutions whose expenses are recorded in this section.
By means of these advances, accountants may make the payment of claims of any kind, including the purchase of personal property, not exceeding 5,500 euros, as well as, regardless of the amounts, the costs of water consumption, gas, electricity, telephone, fuel and fuel for motor cars, as well as the allowances and allowances of any kind allocated to the budget.
Can be paid through these advances regardless of the amounts:
(1) Social expenditure;
(2) costs for foreign missions and for the posting of correspondence, as well as advances related thereto.
Accountants charged with payment of foreign mission fees are authorized to make advances to officials sent on mission abroad.
Art. 2.05.2
By derogation from Article 1-01-5, § 2 and § 3, of this Act, the basic allowances for remuneration and allowances generally referred to as "1100.03 - Final and internary statutory staff" and "1100.04 - Non-statusary staff", as well as the basic allowance "1211.20 - Contracts for the provision of services by the ABL Egov" may be reassigned only between them
Art. 2.05.3
Within the limits of the basic allowances concerned, the following subsidies may be granted:
PROGRAMME 21/0 - DIRECTION AND MANAGEMENT
Subsides to the ABL "Social Service of the Ministry of Public Service" on the basic allowance 05.21.01.11.40.05
PROGRAMME 31/1 - TECHNOLOGY FOR INFORMATION AND COMMUNICATION
- ASBL Egov allocation on basic allowance 05.31.1.033.00.01.
- ASBL Problématique ICT allocation on basic allowance 05.31.10.33.00.02.
Grants through collaboration between FEDICT and national and international organizations for projects of general interest in ITC relating to citizens.
Section 12. - SPF Justice
Art. 2.12.1
By derogation from section 15 of the Act of 29 October 1846 on the organization of the Court of Auditors:
(a) advances of funds of up to 2,500,000 euros may be made to the Department's extraordinary accountants. By means of these advances, the Department's extraordinary accountants are allowed to pay all service charges not exceeding 12,500 euros, as well as, regardless of the amounts, the costs of water consumption, gas, electricity, telephone, fuel and fuel for motor cars, as well as the allowances of any kind allocated to the budget and the costs incurred when the civil liability of the State is incurred;
(b) advances of funds of up to 875,000 euros may be made to the extraordinary accountants of the Management Service Budget and Control of Management responsible for the payment of lump sum allowances to members of the State Security and Houses of Justice;
(c) advances of funds of up to 2,500,000 euros may be made to the extraordinary accountants of the Department responsible for the payment of assistance to victims of intentional acts of violence granted by the ad hoc Commission.
Extraordinary Accountants of the Department responsible for payment of advances on mission charges abroad are authorized to make the necessary advances to officials sent on mission abroad.
Art. 2.12.2
In application of art. 15, § 1er, of the Act of 29 October 1846 on the organization of the Court of Auditors, appropriations may be granted:
(a) the Criminal Justice Fees Service for the payment of fees to judicial experts and judicial officers, as well as all other legal fees, including claims of receivables relating to international judicial cooperation;
(b) to the Directorate-General Corrections, for the payment of urgent expenses relating to:
- food and maintenance of inmates and internees;
- energy consumption, water and related taxes, and telephone bills.
Art. 2.12.3
By derogation from section 15 of the Act of 29 October 1846 on the organization of the Court of Auditors, advances of funds may be made, within the limits set out in section 2.12.1 of this Act, for the payment of social relief and allowances, as well as allowances for cultural and sporting circles created among the staff of the SPF Justice.
The recovery of advances made to staff members in the form of a loan may, if any, be made in accordance with section 23, 4°, of the Act of 12 April 1965 on the protection of workers' wages.
Art. 2.12.4
Within the limits of the basic allowances concerned, the following subsidies may be granted:
PROGRAMME 40/2 - TUTELLE MINEURS ETRANGER
Subsidies to public bodies and associations responsible for the guardianship of unaccompanied foreign minors.
PROGRAMME 40/3 - STUDIES AND DOCUMENTATION
1) Subsidies to publications and scientific institutions.
2) Subsides to the ABL "Litizen Travel Commission".
3) Subsides at the Kinderrechten Coalitie Vlaanderen and the NGO Coordination for the Rights of the Child.
4) Subsides to the ABL "Compilation Commission - Construction".
PROGRAMME 40/4 - INTERNATIONAL COLLABORATION
Quote-part of Belgium in the operating costs of the International Criminal Police Organization in Lyon (O.I.P.C.), the European Police Service (EUROPOL) in The Hague and the Schengen Information System in Strasbourg (S.I.S.).
Intervention by Belgium in the operating costs of international bodies.
PROGRAMME 51/3 - MEDICAUX AND PARAMEDICAUX
Subsidies to bodies responsible for the therapeutic support of sexual assault authors.
PROGRAMME 52/0 - JUSTICE MAYS
(1) Subsidies to organizations allocated for the organization of work of general interest and training activities in the context of judicial proceedings, restorative mediation, support for the right to visit and legal assistance of victims.
2) Subsidies to "ASBLs" responsible for supporting victims of intentional acts of violence.
(3) Subsidies to local authorities to finance the supervision of alternative legal measures and penalties.
PROGRAMME 56/0 - SUBSISTANCE
Subsides for the use by judicial services of bar libraries in certain courthouses.
PROGRAMME 59/2 - ISLAMIC CULT
Subside for the recognition of Islamic worship.
PROGRAMME 59/3 - BOUDDHISME
Grant to the ABL Belgian Buddhist Union for the Recognition of Buddhism.
Art. 2.12.5
The Minister of Justice is authorized to grant financial intervention to inmates under electronic surveillance, which will be charged to AB 52.13.33.00.01.
Art. 2.12.6
The proceeds of receipts for order carried out under the partial financing by the city of Brussels of the security corps, created in the penitentiary establishments, will be carried out using account 87.09.68.98.B+ of the section "Treasury Operations".
They may be used to cover the staff costs of the Security Corps.
This account may present a debtor balance for a maximum period of six months, up to a maximum of 4,100,000 euros.
These expenses are subject, prior to any legal undertaking, to the opinion of the Finance Inspectorate in accordance with the provisions of articles 14 and 15 of the Royal Decree of 16 November 1994 on administrative and budgetary control.
Art. 2.12.7
Revenues for order made under the cooperation agreement establishing a National Commission for the Rights of the Child will be recorded on the accounts 85.01.04.89 C and 87.09.74.07 - of the section "Cash-order Operations".
Such income may be used to cover the operating and staff costs of the Commission, respectively.
Art. 2.12.8
The treasury is authorized to make advances where the transactions relating to the account 85.01.06.91 - section "Treasury Order Operations" - Payment and reimbursement transactions in respect of costs arising out of the missions of staff members in the context of the management of civil crises in the European Union - create a debiting position of this account and this up to 250,000 euros maximum.
Section 13. - Inside SPF
Art. 2.13.1
By derogation from section 15 of the Act of 29 October 1846 relating to the organization of the Court of Auditors, advances of funds of up to 375,000 euros may be made to the extraordinary accountants of the services and institutions whose expenses are listed in this section.
By means of these advances, extraordinary accountants are allowed to pay all service fees, allowances and allowances of any kind allocated to the budget as well as water, gas, electricity, telephone, fuel and fuel for cars, subscriptions, lawyers and experts not exceeding 10,000 euros.
Can be paid through these advances, regardless of the amounts:
(1) Social expenditure;
(2) expenses related to the training and occupation of full-time and reduced-time civil security personnel;
3) costs for foreign missions and for the deregistering of correspondence, travel costs for home - place of work, interpreting fees, and advances in respect of them; Extraordinary accountants charged with payment of foreign mission fees are authorized to make advances to officials sent on mission abroad;
(4) all operating expenses and allowances and allowances of any kind of provincial governments within the limits of the basic allowances of Program 58/0, with the exception of expenditures for the acquisition of non-expendable movable property;
(5) all expenses of Program 55/0 for repatriation and removal of undesirable persons;
6) all program expenses 40/7 and 56/6 for litigation allowances and fees.
Art. 2.13.2
Within the limits of the basic allowances concerned, the following subsidies may be granted:
PROGRAMME 51/3 - PROTOCOL
1° Allowances for the perpetrators of acts of courage, victims of their dedication or the rights of the heroes who have lost their lives by carrying out such acts or obvious follow-ups of these acts, as well as compensation for funeral expenses.
2° Subside to the Brussels Union of Initiative and Promotion, as an intervention in the fees of the festivities organized each year in the Brussels Park on the occasion of the national holiday.
PROGRAMME 51/9 - POPULATION AND ELECTIONS
Subsides as part of the development of applications for the electronic identity card.
PROGRAMME 54/0 - SUBSISTANCE PROGRAMME
1° Subside to the Fire Services Training Council.
2° Intervention in civil security information, documentation and public relations costs.
PROGRAMME 54/1 - Project 112
1° Subside to SA ASTRID to cover the operating costs of the common infrastructure.
2° Subside to SA ASTRID to cover the investment costs of the common infrastructure.
PROGRAMME 54/2 - OPERATIONS OF THE CIVILE SECURITY; EQUIPMENT AND TRAINING FOR CIVILE PROTECTION, SERVICES AND THE CENTRES "100"
1° Subside to the Brussels-Capital Region, to the municipalities, and intercommunal for the purchase of special equipment for fire services.
2° Interventions for fire services in fire prevention campaign fees, support of local initiatives.
3° Subsides to the Higher Council of Training for Public Services in Incendie, the Programming Commission, the Equivalences and Dispenses Commission, the Drafting Committee, the French- and German-speaking supraprovincial Council, and the Dutch-speaking supraprovincial Council.
PROGRAMME 54/6 - DIRECTION OF FINANCIAL INTERVENTIONS TO THE PROFIT
1° Intervention in laboratory fees conducting fire prevention research.
2° Subsides to the Royal Federation of Firefighters of Belgium, French-speaking and German-speaking wings, subsidies to the Flemish Association of Incendie Services and the Caisse nationale d'entraide des sapeurs-pompiers.
3° Interventions in the funding of courses organized by provincial training centres for fire service members.
PROGRAMME 55/2 - PROJECTS IN THE FRAMEWORK OF THE POLICY
1° Subsides to third parties to carry out projects within the framework of foreign policy on the basis of the variable credits of the Office of Foreigners (activity 1 of programme 2 of organic division 55) and on the basis of its own means (activity 2 of programme 2 of organic division 55 )
2° Subsides with third parties to carry out actions and initiatives for the prevention of illegal immigration of certain countries (Activity 3 of Programme 2 of Organic Division 55).
PROGRAMME 56/1 - GENERAL ADMINISTRATIVE FORMATION, PREVENTION AND EQUIPMENT
1° State intervention in spending for initiatives to promote contacts of police services with the public.
2° Achievement of expenditures, in the area of police and crime prevention, including for the realization or acquisition of common-use infrastructure, equipment, equipment and software and for the financing of campaigns and study fees.
3° Subsides to provide Belgian universities or other organizations, concerned with the study or control of crime, public or private initiatives in the field of crime prevention, including hooliganism, integrated local crime initiatives and the investigation into the presence of certain criminal phenomena.
4° An allocation for ABLs and other organizations as an intervention in the organization fees for the drafting of courses with the aim of integrating in the ongoing training of police personnel training on relations with immigrants.
5° Intervention in laboratory fees conducting fire prevention research.
PROGRAMME 56/5 - CELLULE FOOTBALL
Subsides to stimulate projects from the world of football for the security of matches.

Art. 2.13.3
The amounts to be recovered, for the years 2001, 2002 and possibly the arrears 2003, from the authorities that use the services of a regional receiver or a regional inspector, under the cooperation agreement concerning the method of apportioning the costs of the regional receivers and the method of debiting the contribution in these costs, concluded in Brussels on 9 December 1997 between the Federal State, the Flemish Community and the Walloon Region, are exempted from the five-year provisions
Art. 2.13.4
The Federal Inland Public Service shall pay, within the limits of the allocation of staff, the salary, allowances and allowances, plus the employer's contribution, to the municipalities that have continued the payment of the salary, allowances and allowances to their personnel, seconded as part of the project "Electronic Identity Card" to the Federal Inland Public Service.
The claim must be made at the beginning of each year for the previous year, on the basis of an annual survey, transmitted by the municipalities concerned to the Federal Interior Public Service.
Art. 2.13.5
The "Financing of the Correction Mechanism created during the transfer of buildings from the former gendarmerie to the municipalities and to the multi-communal police zones" can present a maximum debt balance of 2.913.000 euros.
Art. 2.13.6
By derogation from article 52, first paragraph, 1° of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state, the department is authorized to make redistributions between the commitment credits of the basic allowances 56.60.34.00.01 and 40.70.34.00.01 (contentious).
Art. 2.13.7
The social service accountant, who is competent on behalf of cultural activities, is authorized to collect contributions from participants in cultural activities and is also authorized to pay expenses on the part of the income received, to the organizers of these cultural activities.
Art. 2.13.8
The social service accountant, who is competent on behalf of childcare, is authorized to collect parents' income for the registration of children at the nursery and is also authorized to pay the costs of the nursery on the portion of the income received.
Art. 2.13.9
The organic fund "Fund as part of the migration policy" has a commitment authorization of 7.689.000 euros.
Any undertaking under this Article shall be subject to the visa of the Registrar of Commitments and the Court of Accounts.
Prior to the 10th of each month, the Comptroller of Commitments shall forward to the Court of Auditors, together with supporting documents, a statement in three copies, indicating, on the one hand, the amount of the commitments covered in the past month and, on the other hand, the amount of the commitments covered since the beginning of the year.
Art. 2.13.10
The Minister of the Interior is authorized to withdraw from the specific budget section provided for in section 1er§ 2quater, paragraph 2, of the law of 1er August 1985 bringing social provisions, as amended by the Act of 30 March 1994 on social provisions, funds for coordination and supra-local actions in the areas referred to in Article 69 of the Act of 30 March 1994 referred to above.
These funds are paid to the Special Accountant of the Policy and Prevention Branch, which justifies their employment with the Court of Auditors.
Section 14. - SPF Foreign Affairs, Foreign Trade and Development Cooperation
Art. 2.14.1
By derogation from section 15 of the Act of 29 October 1846, relating to the organization of the Court of Accounts, advances of up to EUR 500,000 may be made to the accountants of the SPF Foreign Affairs, Foreign Trade and Development Cooperation.
Using these advances, accountants are allowed to pay receivables not exceeding 5,500 euros excluding VAT.
Art. 2.14.2
By derogation from Article 1-01-05, § 2 of this Law, Basic Allowances 42.01.11.00.13, 42.01.11.00.14 and 42.01.11.00.15 and Basic Allowances 21.01.11.00.03 and 21.01.11.00.04 of Section 14 may also be redistributed between them.
Art. 2.14.3
Some expenditures outside the Royal Decree of 19 November 1996 relating to emergency assistance and short-term rehabilitation in favour of developing countries may be charged to Basic Allowance 54.5.2.35.00.83 of Program 54/5. These are the following expenses:
- funding of studies and evaluations related to disaster prevention and preparedness, broad-based emergency assistance, short-term rehabilitation both material and psychological;
- training of nationals from low-income countries, specifically related to the issue of humanitarian assistance and provided by specialized international organizations such as the Office of the High Commissioner for Refugees (UNHCR) and the International Committee of the Red Cross (ICRC);
- costs related to the provision of personnel and the provision of goods and services where such expenditures are an essential element of actions deemed necessary to meet the priority needs of affected populations.
Art. 2.14.4
The credits in programme 42/0 (A.B. 42.0.4.03.00.50) are intended to provide permanent working capital for the payment of expenses related to the operating and investment costs of Belgian diplomatic and consular posts and permanent representations from international organizations. Expenditures on these advances are regulated by imputation on the budgetary appropriations provided for this purpose. For the same purpose and with the application of the same budgetary regulation procedure, the Treasury is also authorized to replenish these working capitals abroad.
Art. 2.14.5
Public contracts for pre-work studies (base allocation 42.11.12.00.44) and works (base allowances 42.04.72.00.01 and 42.11.72.00.02) that are awarded abroad and that remain below the European thresholds, may be awarded by negotiated procedure provided that the necessary announcement is made to ensure effective competition and that the equality of bidders, the essential provisions of the general terms and conditions of the general terms of reference

With respect to subsidies and allocations,
- on the one hand, under programme 53/4 - Humanitarian assistance - in conflict prevention, peacebuilding and human rights,
- and on the other hand, under program 54/5 - Humanitarian programmes -, as part of the transition, reconstruction and consolidation of society, in the context of short-term food aid and food security, as well as in the context of prevention, emergency assistance, short-term rehabilitation assistance and humanitarian action, the assignment of goods or services free of charge is permitted. Legislation and regulation in public procurement are applicable in the procurement of goods and services to be disposed of.
PROGRAMME 55/1 - EUROPEAN RELATIONS

Art. 2.14.7
Within the limits of basic allowances 53.4.1.12.00.31 and 53.4.1.35.00.22, in programme 53/4 "Humanitarian aid", expenses of any kind may be made, with prior agreement of the Council of Ministers, as interventions and initiatives of Belgium in the field of preventive diplomacy.
Art. 2.14.8
The provision under programme 53/5 (AB 51.01.00.01) - Provision for the payment of compensation to members of the military, members of the Federal Police, representatives of the judiciary and members of the Justice, Foreign Affairs, Finance and other public bodies responsible for foreign missions and reimbursement to the departments of origin of the allowances and costs related to the deployment and operation of the military
Art. 2.14.9
For the year 2010, the Belgian Survie Fund (base allocation 54.4.0.35.00.50) has a commitment authorization of 4.230.000 euros.

Art. 2.14.10
Subsidies attributed to an indirect actor, as part of a multi-year programme, must be justified on the date provided for in the relevant orders or conventions. The unused balance of such an annual subsidy, attributed to a previous fiscal year, may be deducted from the dependant subsidy of this fiscal year to the same indirect actor.
As a result, the approved annual plan of action or programme for the new fiscal year will be funded with new means to be undertaken, and with means still available to the indirect actor, as a result of amounts not used as part of previous annual action plans or programmes.
This article concerns the following basic allowances: 54.2.0.35.00.70, 54.2.0.35.00.71, 54.2.0.35.00.72, 54.2.0.35.00.73, 54.2.1.35.00.68, 54.2.1.35.00.69, 54.2.2.4.37, 54.2.2.4.38, 54.2.2.4.39, 54.2.3.45.00.01, 54.2.3.45.00.02, 54.2.4.45.00.52, 54.2.4.45.00.
The second paragraph of this article also concerns the basic allowance 54.4.4.35.00.45.
Art. 2.14.11
In principle, subsidies for projects and programmes of international organizations must be justified in accordance with the terms and conditions set out in the relevant decrees and arrangements. However, subsidies granted in previous fiscal years, as well as unused balances, may be redirected on a due basis and with the agreement of the Minister of Development Cooperation or, with respect to basic allocations 53.4.1.35.00.24 - Conflict prevention, peacebuilding and human rights, of the Minister of Foreign Affairs.
The approved amendments will be forwarded on a regular basis to the Accounts Court and the Minister of Budget and/or the Secretary of State in Budget.
Art. 2.14.12
In 2010, the State can enter into new multi-year commitments with partner countries for a total amount of 250.000.000 euros. In addition, the stock of bilateral commitments, to be carried out by the CTB, cannot exceed 750.000.000 euros. These are projects and programs to be carried out by the CTB on the basic allowance 54.1.0.54.00.02.
Any undertaking under this section shall be subject to the Comptroller of the commitments that will verify the application of administrative and budgetary control procedures and the compliance of the cap.
Prior to the 10th of each month, the Comptroller of Commitments shall forward to the Court of Auditors, for information, a statement in three copies, together with supporting documents, which shall include both the amount of commitments entered in the past month and the amount of commitments entered since the beginning of the year.
Art. 2.14.13
The provision for the basic allowance 54.3.3.54.00.09 will be transferred by the Minister of Development Cooperation or by his or her delegated sponsor on a cash account managed by the Minister of Finance or by his or her delegated sponsor.
Art. 2.14.14
§ 1er. For the year 2010, a loan program for foreign states can be negotiated up to 55,600,000 euros.
In view of the budgetary resources for this purpose, the loan programme must be approved by the Council of Ministers. It mentions, on the one hand, loans to be made as a priority and, on the other, priority replacement loans as a multi-year program.
Replacement loans may be substituted at any time for the original loans that are deleted.
The liability controller records the accomplishments and replacements of a program's loans.
§ 2. Loans to foreign States are made by the Comptroller of the commitments prior to the notification of the loan agreement, at the time the Minister of Finance agrees on the loan to be granted by signing a proxy or loan agreement.
Art. 2.14.15
In the event that the total amount of the justification for expenditures by benefit, certified as "compliant and faithful to the law, this management contract and annual accounts", by the auditors of the Belgian Technical Cooperation (CTB), exceeds the advances received, the CTB will introduce, no later than 1er September of the year following the year to be funded, a claim for the balance. After approval of this declaration of debt by the Minister of Development Cooperation, the State will pay this balance to the credits of the current year, registered in the basic allowance 54.1.0.54.00.02 - Coverage of the operational costs of the CT- and supply of the accounts co-ordinated or managed by the partner.
Art. 2.14.16
The provision in programme 21/0 (A.B. 01.01.00.01) - an interdepartmental provision to cover expenses of any kind relating to the Belgian Presidency of the European Union - may, on the proposal of the Minister of Foreign Affairs and the Minister of Budget or Secretary of State to the Budget, be apportioned, as necessary, between the appropriate programmes, by means of a royal decree taken after deliberation in the Council of Ministers.
Art. 2.14.17
The treasury is authorized to make advances when the current account of Treasury operations 83.05.11.90 B+ (Contribution of Belgium to the European Development Fund (EDF)) is in debit position. Unless agreed by the Minister of Budget and the Minister of Finance, the debiting position cannot exceed a sum of 100.000.000 euros.
Art. 2.14.18
The Consolidated Revenue Fund is authorized to make advances where transactions relating to Account 83.01.04.71 B+, an open-order account on behalf of B.I.T.D. (International Customs Tariff Office), create a debiting position of this account.
Art. 2.14.19
Revenue transactions for order made as part of the parcel and mail shipment through the FPS Foreign Affairs, Foreign Trade and Development Cooperation are carried out using Account 86.01.01.95 C of the "Treasury Order Operations" section.
They may be used to cover similar expenses.
Art. 2.14.20
The proceeds for order made under the management of the nursery established within the FPS Foreign Affairs, Foreign Trade and Development Cooperation are carried out using Account 87.05.07.25 C of the "Treasury Order Operations" section.
They can be used to cover all the management costs of this nursery.
Art. 2.14.21
Revenue and order transactions, carried out under the agreements relating to delegated cooperation, are carried out using Account 83.05.12.91 of the "Treasury Order Operations" section.
The execution modalities will be included in the agreements with the various partners.
The transactions are subject to the preliminary opinion of the Inspector of Finance, in accordance with the provisions of articles 14 and 15 of the Royal Decree of 16 November 1994 on administrative and budgetary control, as well as to the visa of the Court of Accounts within the meaning of article 14 of the Act of 29 October 1846 on the Court of Accounts.
Art. 2.14.22
The department is authorized to supply the Treasury Order Account 87.05.11.29 - by imputation on the credit in the basic allowance 21.0.1.12.00.10. This account is intended to cover the additional bank charges supported by the National Bank of Belgium for payments and transfers of funds abroad. The National Bank of Belgium is authorized to debit this account to repay itself.
Art. 2.14.23
Revenue transactions for order made in the context of the organization of conferences through the FPS Foreign Affairs, Foreign Trade and Development Cooperation are carried out using Account 87.05.12.30 C of the section "Treasury Order Operations".
They may be used to cover similar expenses.
The operations are subject to the preliminary opinion of the Inspector of Finance, in accordance with the provisions of articles 14 and 15 of the Royal Decree of 16 November 1994 on administrative and budgetary control.
Art. 2.14.24
Revenue and order transactions in Benin's assistance for MONUC operations are recorded on account 87.05.10.28 B+ opened for this purpose in the section "Treasury Order Operations". Payments charged to this order account are executed via the 100-0086139-37 bank account opened to the National Bank of Belgium on behalf of the "SPF Foreign Affairs - Working Capital Fund for Diplomatic Posts".
This account may present a debtor balance pending reimbursement by the United Nations.
Art. 2.14.25
Revenue and order transactions carried out under the joint development cooperation agreements conducted under the responsibility of Belgium are carried out using account 83.05.13.92 of the "Treasury Operations" section.
The execution modalities will be included in the agreements with the various partners.
The transactions are subject to the preliminary opinion of the Inspector of Finance, in accordance with the provisions of articles 14 and 15 of the Royal Decree of 16 November 1994 on administrative and budgetary control and the visa of the Court of Accounts within the meaning of article 14 of the Act of 29 October 1846 on the Court of Accounts.
Art. 2.14.26
Revenue transactions for order carried out, under the External Border Fund, through the Foreign Affairs, Foreign Trade and Development Cooperation SPF are carried out using Account 87.05.15.33 C of the "Treasury Operations" section.
They may be used to cover similar expenses.
Art. 2.14.27
Revenue transactions for order made under the Schengen House, through the Foreign Affairs, Foreign Trade and Development Cooperation SPF, are carried out using Account 87.05.14.32 C of the Treasury Order Operations Section.
They may be used to cover similar expenses.
Section 16. - Ministry of Defence
Art. 2.16.1
By derogation from amended section 15 of the Act of 29 October 1846, relating to the organization of the Court of Accounts, advances of funds of up to 20,000 euros can be made to the extraordinary accountants, to the effect of paying expenses not exceeding 2.500 euros.
Art. 2.16.2
By derogation from Article 41 of the State Accounting Laws, coordinated on 17 July 1991, fixed expenditures relating to the civilian personnel of the Ministry of National Defence may be subject to credit opening orders.
Credit opening orders may also be issued in the same way as fixed expenditures: funeral allowances, birth allowances, and expenses resulting from foreign air operations and travel, long-term cruises or immediate action in the event of a land, air and naval accident, regardless of the amount of such expenses.
Art. 2.16.3
By derogation from the provisions of Article 143 of the Acts on State Accounting, coordinated on 17 July 1991, the Minister of Defence is authorized, both in the context of technical cooperation and emergency assistance to third countries, and in the case of mutual assistance provided for in Article 3 of the North Atlantic Treaty, to make ex gratia payments for service and/or to dispose of equipment and/or materials granted to the Forces of the countries
Art. 2.16.4
The Minister of Defence is authorized to liquidate advances on:
(a) compensation to the State of the head of damages suffered by personnel or by third parties;
(b) expenses related to hospitalization costs in civilian establishments, long-term treatments and supplies of pharmaceuticals by civil informals;
(c) costs of using foreign facilities.
Art. 2.16.5
The funds required for the payment of contract expenditures to be made by the Department of National Defence in the United States of America and Canada can be obtained through credit opening orders. These contracts may be concluded under the negotiated procedure.
These funds may also be used after the fiscal year to charge the expenses resulting from the above-mentioned contracts.
The excess funds are transferred to the Consolidated Revenue Fund as soon as the accountant has submitted to the Court of Accounts the management account with the final account of the contracts for which these funds were allocated.
Can also be concluded in accordance with the negotiated procedure, the contracts and exchange agreements with the NATO Maintenance and Supply Organization (NATO Agency for Maintenance and Procurement and its subordinate agencies), as well as those with a NATO member country under an international agreement, with the objective of supplying spare parts, maintenance of the work of the NATO member country, and the maintenance of the ammunition
Art. 2.16.6
Withdrawal of the Minister of Defence's exclusive decision to resolve the disputes arising from the receipt of supplies resulting from contracts passed by the Ministry of National Defence:
- in the United States of America, Canada, with the NATO Supply and Repair Agency and its subordinate agencies;
- with the Government of the Federal Republic of Germany, as a result of the agreement on the supply of spare parts for the LEOPARD weapon system and its derivative versions.
Art. 2.16.7
Expenditures to be made in Germany may be made in accordance with the rules in force in the Federal Republic and be subject to credit opening orders, regardless of their amount.
The funds obtained can also be used at the end of the fiscal year to charge the aforementioned expenses.
The excess funds are transferred to the Consolidated Revenue Fund as soon as the accountant has submitted to the Court of Accounts the management account with the final account of the contracts for which these funds were allocated.
Art. 2.16.8
For markets subject to liquidations for NATO infrastructure, bids or offers, depending on the type of market, will be compared without taking into account the value added tax, or the tariffs applied in the countries of the European Union.

Art. 2.16.10
The Consolidated Revenue Fund is authorized to make advances where the transactions relating to Account 87.07.01.25.B+ of the "Treasury Order Operations" section - Current account of payment and reimbursement of remuneration for other departments or services, foreign or international organizations, or other third parties - does not exceed a debiting position of 55.000.000 euros on this account.
Art. 2.16.11
Revenue and order transactions in international and national treaties or agreements will be carried out using Account 82.04.01.68.A+ of the "Treasury Order Operations" section.
This account cannot exceed a debiting position of 10.000.000 euros. The flow position is limited to a maximum period of six months
The law of the markets on behalf of the State and the corresponding delegation system are applied to the expenditure transactions.
The latter are subject, prior to any legal undertaking, to the opinion of the Inspector of Finance in accordance with the provisions of Articles 14 and 15 of the Royal Decree of 16 November 1994 on administrative and budgetary control and to the visa of the Court of Accounts within the meaning of Article 14 of the Act of 29 October 1846 on the Court of Accounts
Art. 2.16.12
The Minister of Defence is authorized to use, up to EUR 2.000,000, revenues from interest generated by advances filed with the Federal Reserve Bank of New York as part of the contracts for the supply of aircraft, logistical support, ground facilities and related costs for the entire F-16 fleet.
These interests will be charged to Account 87.07.03.27.C of the Treasury Order Operations Section. They will be used to cover the costs resulting from the above-mentioned markets.
The Minister of Defence is authorized to use available assets relating to ongoing contracts and exchange agreements with the NATO Maintenance and Supply Organization (NATO Agency for Maintenance and Supply and its subordinate agencies) in the context of the supply of spare parts, maintenance and withdrawal of equipment on the credits of Section 16 - National Defence Program 16-50-1, "Rolling Equipment and Related Equipment" also for the destruction or demilitarization of large quantities of surplus and unspeakable ammunition or equipment in the aforementioned NATO bodies.
Art. 2.16.13
By derogation from Article 143 of the State Accounting Laws, coordinated on 17 July 1991, the Minister of Defense is authorized to sell the furniture made available to the families occupying the housing managed by the Belgian military authority in Germany. This furniture will be sold on site by the said authority to the families concerned who, as a result of the restructuring of the Armed Forces will return to Belgium.
The proceeds of this sale will be charged to the Ways and Means Budget for the general Treasury needs.
Art. 2.16.14
By derogation from section 151 of the Program Act of 02 August 2002, benefits to the Central Office for Social and Cultural Action of the Ministry of Defence (OCASC) and to various public bodies belonging to the civil element in order to ensure the repatriation of their heritage, following the final withdrawal of the Armed Forces in Germany, are carried out in a free manner.
By derogation from section 61, 2e paragraph of the Act of 22 May 2003 on the organization of the federal government's budget and accounting, these benefits for the benefit of public bodies may be carried out in a gratuitous manner. The Minister of Defence is responsible for setting out the terms of this gratuity.
Art. 2.16.15
The Central Office for Social and Cultural Action of the Ministry of Defence (OCASC) is authorized to carry out missions as provided for in section 1er of the Royal Decree of 10 January 1978, as amended by the Royal Decree of 7 December 1998, determining the mission and regulating the organization and operation of this body, for the benefit of the Federal Police personnel.
Members of the Defence Staff who, pursuant to Article 11, § 2, of the Act of 10 April 1973 establishing the Central Office for Social and Cultural Action of the Ministry of Defence (OCASC) for the benefit of members of the military community, are made available to the CSCO, remain in charge of the Defence budget.
Art. 2.16.16
By derogation from section 61, 2e paragraph of the Act of 22 May 2003 on the organization of the budget and accounting of the federal State, the Minister of Defence is authorized to value the benefits provided to the Federal Police, with the exception of those relating to staff permanently available to the Federal Police, and to compensate the benefits provided by the Federal Police, on the basis of the additional costs incurred.
Apart from occasional benefits, the financial coverage of benefits whose volume is known priori is subject to a provision of credits whose amount is determined by the estimate of benefits to be realized and the count of those actually carried out previously.
Art. 2.16.17
The Minister of Defence is authorized, within the framework of an international integration of the Armed Forces, or in order to deal with emergency cases, to conclude agreements with foreign countries on mutual benefits of services.
The financial regulation of these transactions may be made by means of compensation, either when the agreement has ceased its effects, or at the expiry of an agreed period or by the common will of the parties involved. The potential balance will be the subject of an imputation, either in the National Defence Budget or in the Ways and Means Budget for the benefit of the budget fund for benefits against payment.
Finally, the Minister of Defence is authorized, with regard to materials, materials, weapons and ammunition, to pass conventions of mutual assignments, exchange and loan with other departments, Belgian or foreign companies and third countries, provided that this is favoured by the renewal of the relevant stocks to the Armed Forces.
Art. 2.16.18
The Minister of Defence or the delegated official is authorized to return, in whole or in part, real property or other property intended to be returned as a result of the restructuring, which is owned by the Federal Republic of Germany or a Land and which has been made available to the force or civil element for use, and to determine the financial implications of such restitution after negotiations with the State of residence.
The net financial consideration of these restitutions, determined on the basis of Article 52 of the Agreement supplementing the Convention between the States Parties to the North Atlantic Treaty on the status of their forces, with respect to the foreign forces stationed in the Federal Republic of Germany and the Protocol of signature to the Complementary Agreement, signed in Bonn on 3 August 1959 and approved by the law of 6 May 1963, will be the subject of an overall deposit to the other property
Partial payments may be made by the Federal Republic of Germany.
Any balance and/or partial payments will/will be the subject of an imputation either to the budget of the departments and agencies of public interest concerned, or to the Budget of the Ways and Means of Article 16.7600.01, for, after counting with the above bodies, to be used in the coverage of expenses resulting from infrastructure and/or remediation work in the fields in Belgium and/or Germany, managed by the Armed Forces or
Art. 2.16.19
The very urgent costs to be incurred in foreign operations can be carried out in the context of contracts that may be awarded according to the negotiated procedure. The basic principles of public procurement legislation will be applied for the conclusion of the aforementioned markets unless local circumstances permit it.
Art. 2.16.20
The Minister of Defence is authorized, with the approval of the Minister of Budget and by Royal Decree deliberated in the Council of Ministers, within the limits of the appropriations of Section 16 - National Defence, to carry out transfers for the benefit of programme 16-50-5, "Implementation", in order to meet the specific needs of humanitarian operations and peace support.
Such transfers of credit will be communicated without delay to the House of Representatives and the Court of Auditors.
Art. 2.16.21
By derogation from section 61, 2e paragraph of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state, the Minister of Defence is authorized to enter into agreements with other public bodies in the context of the provision of mutual benefits. The financial regulation of these transactions may be effected by compensation, either when the agreement has ceased its effects, or at the expiry of an agreed period or by the common will of the parties involved. The potential balance will be compensated in kind either from an imputation to the Defence Budget (General Estimates), or the Ways and Means Budget for the benefit of the budget for benefits against payment.
Art. 2.16.22
By derogation from section 61, 2e paragraph of the Act of 22 May 2003 on the organization of the federal budget and accounting, the Minister of Defence is authorized to acquire a mine control simulator through a joint financial participation of the Kingdom of Belgium and the Kingdom of the Netherlands.
By derogation from the provisions of section 19 of the Act of 24 December 1993 on public procurement and certain contracts of work, supplies and services, the Minister of Defence is authorized to enter into a single market, awarded in accordance with the provisions of the Act of 24 December 1993 referred to above and for the joint acquisition of a mine control simulator with the Netherlands that mandate it to do so.
Expenditure transactions under this contract are subject, prior to any legal undertaking, to the advice of the inspector of Finance in accordance with the provisions of the Royal Decree of 16 November 1994 on administrative and budgetary control and to the visa of the Court of Accounts within the meaning of Article 14 of the Act of 29 October 1846 on the organization of the Court of Accounts.
Art. 2.16.23
Balances not allocated as at December 31, 2002 of accounts 87.07.06.30 A and 87.07.09.33 A of the "Treasury Order Operations" section must be transferred to the respective budgetary funds.
In order to ensure continuity of service and for administrative simplification, the Minister of Defence is authorized to pay outstanding claims arising from existing commitments as of December 31, 2002, in charge of these accounts in the section "Treasury Order Operations".
Art. 2.16.24
By derogation from section 61, 2e paragraph of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state, the Minister of Defence is authorized to use the revenues realized from 2002 from the sale of wood in the areas that are part of the real estate entrusted to his management, collected and recorded in section 16.7600.01 of the Voies and Averages Budget, in accordance with section 41 of the Program Law of 19 July 2001.
Art. 2.16.25
By derogation from Article 143 of the State Accounting Laws, coordinated on 17 July 1991, and in the context of a sales contract for F-16 aircraft to be concluded by the negotiated procedure, pursuant to Article 41 of the Programme Law of 19 July 2001, the Minister of Defence is authorized:
- for sale of non-surplus assets as part of its management
- as part of the delivery of logistical support and related services to make commitments on an expensive basis to the buyer
- to give the buyer a pre-financing.
Prerequisitely to any legal undertaking as part of the conclusion of a sales contract, including any unilateral undertaking arising from the above-mentioned provisions, the opinion of the Finance Inspectorate and the agreement of the Minister of Budget are requested in accordance with the Royal Decree of 16 November 1994 on administrative and budgetary control.
Expenditures and revenues for the sale of non-surplus equipment and the benefits described above are equivalent to order transactions within the meaning of section 2.16.11 of this Act.
Art. 2.16.26
By derogation from section 52, 1er, 1° of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state and by derogation from Article 1-01-5, paragraph 2 of the Act presents the commitment credits of the basic allowances relating to the operating expenses provided by economic codes 12 can be redistributed between them and exclusively between them within the budget of the Defence.
Art. 2.16.27
By derogation from section 60 of the Federal State Budget and Accounts Act of 22 May 2003, the Minister of Defence is authorized to use the amounts collected for the repair of damage to the HERCULES C-130 aircraft destroyed in the fire that occurred on the night of 4-5 May 2006 at the facilities of the SABENA TECHNICS firm. These amounts will be recorded in section 16.1700.01 of the Ways and Means Budget and will be used in accordance with section 41 of the Program Act of July 19, 2001.
Art. 2.16.28
For the 2010 fiscal year, a commitment authority of up to Euro14,400,000 is allocated to the Re-employment Fund of revenues from the disposal of surplus equipment, materials or ammunition as part of the heritage entrusted to the management of the Minister of Defence and allocated to program 16-50-2.
Art. 2.16.29
For the 2010 fiscal year, a commitment authority of up to 15.000.000 euros is allocated to the Re-employment Fund of revenues from the alienation of immovable property that is part of the heritage entrusted to the management of the Minister of Defense and allocated to program 16-50-3
Section 17. - Federal police and integrated operation
Art. 2.17.1
The Minister of the Interior is authorized to liquidate advances on the State's dependant compensation for damages suffered by staff members or by third parties.
Art. 2.17.2
Foreign health care expenses may be paid through provisions.
Art. 2.17.3
Within the limits of the applicable basic allowance, the following subsidy may be granted:
PROGRAMME 90/1 - DOTATIONS AND SUBSIDES
- to multi-communal police areas and municipalities: contribution of the federal state to local police personnel, operations and investment expenses, including pay expenses of overcrowded ex-gendarmes in police areas;
- to certain multi-communal and common police zones: contribution of the federal state in the expenses for the replacement of uniform and equipment for the maintenance of order;
- to the ABL "Social Service of the Integrated Police": budget allocation as a contribution to staff costs, general operating expenses and intervention expenses, including the share of these expenses required for the management of HORECA services within the federal police;
- Police Studies Centers.
PROGRAMME 90/2 - INTEGREEMENT
- to some institutions: the federal government's contribution to costs for the organization of selection tests and professional training for the benefit of members of the integrated police;
- to certain organizations and ASBLs: contribution of the federal State to the financing of projects to stimulate the recruitment or promotion of people reflecting the socio-cultural diversity encountered in the population;
- to various agencies and ABLs that promote the integration of local and federal polices: intervention by the federal authority in the financing of their projects.
PROGRAMME 90/4 - PRESTATIONS AND CESSIONS OF MATERIALS AND PRODUCTS
- to certain organizations and ASBLs: the federal state's contribution to the financing of projects to stimulate the recruitment of people reflecting the socio-cultural diversity encountered in the population.
Art. 2.17.4
The Consolidated Revenue Fund is authorized to make advances where the transactions relating to Account 87.07.50.74.B of the "Treasury Order Operations" section - Current account of payment and reimbursement of remuneration for other departments or services, foreign or international organizations, or other third parties - create a debiting position of this account.
This debiting position may not exceed 3.500.000 EUR.
Art. 2.17.5
Expenses to be incurred by federal police liaison officers who are stationed abroad may be incurred in accordance with the rules in force in the countries concerned and may be liquidated on funds obtained by an appropriation order, regardless of the amounts.
By derogation from the provisions of articles 60 and 61 of the Act of 22 May 2003 on the organization of the budget and accounting of the Federal State and 143 of the laws on State accounting, coordinated on 17 July 1991, the assets made available to a liaison officer, and which are put out of service, may be sold by him according to the negotiated procedure and according to the rules in force in each country.
This may be done in the same way for the equipment and goods in stock at the time when a representation of the federal police abroad is definitively lifted, unless the stocks concerned can be sold, free of charge or under the condition of compensation equivalent to the receiving party, to the services of the FPS Foreign Affairs, Foreign Trade and Development Cooperation.
In cases where an on-site sale is made, the product will be paid to the Ways and Means Budget.
However, if the equipment can be delivered to the supplier of new similar properties, compensation may be made by subtracting the value of the alienated property from the amount charged for the purchase of the new equipment.
Art. 2.17.6
The Consolidated Revenue Fund is authorized to make advances where the transactions relating to Account 87.07.51.75.B of the Treasury Order Operations Section - Current account of payment and reimbursement of compensation transactions for multi-communal police areas and municipalities, as part of the protocol with the transport companies regarding the payment of the employer's intervention in the transportation costs of personnel for travel to and from the workplace, create a debiting position of the account. This debiting position may not exceed 1.000.000 EUR.
Art. 2.17.7
By derogation from section 1-01-5 § 2, of this Act, the commitment credits of the basic allowances referred to in respect of staff costs may also be redistributed to basic allowances 11.00.02 - salaries, allowances and allowances for SAT members - and 11.00.13 - compensation to public transport companies for unpaid benefits - of section 17 - Federal Police and integrated operation.
Art. 2.17.8
For the fiscal year 2010, the organic budget fund 17-4 referred to in section 11 of the Act of 21 December 2007 on various provisions (I) has a commitment authority of EUR 1.098.000
Any undertaking to be made under this Article shall be subject to the visa of the Comptroller of Commitments and the Court of Accounts.
Prior to the 10th of each month, the Comptroller of Commitments shall forward to the Court of Auditors, together with supporting documents, a statement in three copies, on the one hand, the amount of the commitments covered in the past month and, on the other hand, the amount of commitments that have been covered since the beginning of the year.
By derogation from Article 62, § 2, paragraph 4, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state, during the fiscal year 2010, on the same organic budget fund, is authorized a debiting position in order which cannot exceed 1.624.000 EUR.
Art. 2.17.9
The Consolidated Revenue Fund is authorized to make advances where transactions relating to Account 87.07.55.79.B of the "Treasury Order Operations" section - Federal Police: Payment ONSSB Cotizations create a debiting position of this account. This debiting position may not exceed 4.500.000 EUR.
Section 18. - SPF Finance
Art. 2.18.1
§ 1er. By derogation from amended section 15 of the Act of 29 October 1846 on the organization of the Court of Auditors, advances of funds may be made:
(1) to the Extraordinary Accountants of the Directorate Accounting and Budget of the Management Service Budget and Management Control, for a maximum amount of 5.000.000 euros;
(2) to the extraordinary accountant of the Mass of Customs and Excise Administration personnel, to the extraordinary accountant of the Social Service and to the extraordinary accountants of the tax administrations for the expenses of the foreign services, for a maximum of 1,000,000 euros.
§ 2. Extraordinary accountants of tax administrations for the expenses of external services are allowed to pay, by way of advances of funds, all service costs not exceeding 12,500 euros (excluding T.V.A.), allowances of any kind and, no matter how much, maintenance and cleaning expenses, water consumption costs, gas, electricity, telephone, telefax, fuel for cars.
§ 3. To the Extraordinary Accountant of the Accounting and Budget Division of the Management Service Budget and Control of Management responsible for the payment of mission fees abroad, authorization is given to consent to the required advances to the public servants on mission abroad.
§ 4. To the extraordinary accountant of the Mass of Customs and Excise Personnel, authorization is given to pay all the expenses of the Mass of Peace, regardless of the amounts.
§ 5. To the special accountant of the Social Service, authorization is given to pay relief and social allowances, regardless of the amounts.
§ 6. The Regular Accountant of the Accounting and Budget Branch of the Management Budget and Control Service, responsible for the "miscellaneous revenue" account, is authorized to make expenditures exclusively within and within the financial limits of the programmes pre-financed on this account by the European Union or other international organizations.
Prior to payment, invoices and claims relating to these programs must be subject to the visa of the delegated coordinator of the Budget and Management Supervisory Service.
§ 7. By derogation from Article 25 and by application of Article 25bis and Article 229 of the Royal Decree of 10 December 1868 concerning General Regulation on State Accounting, the ordinary accountants of the restaurants of the Social Service are allowed to hold a cash of up to 400 euros for each restaurant or cafeteria for which they are accountants.
Art. 2.18.2
The Minister of Finance may provide loans and assistance to Department Agents in active service, former agents, pensioned or non-resident, persons entitled to finance agents and their family members. It can grant grants to Department Agent Associations and existing meeting centres and to create FPS Finance staff. Voluntary subsidies and voluntary contributions may also be granted to national and international bodies.
Within the relevant core allocations, the following grants and contributions may be granted:

1. Subsides at ASBL INTER NOS
2. Subsidies to the ABL Harmony Royale of Finance
3. Interventions for the Amicale of the Finance Cultural and Sports Circles

5. Interventions in support of the Finance Staff Meeting Centres in Antwerp and Kapellen (O.P.F.) and Liège (C.A.R.A.F.)
Within the basic allowance 80.03.35.00.41, the following voluntary grants and contributions may be granted to international organizations.
PROGRAMME 80/0 - IMPOTS AND SUBSISTANCE
1. Belgium's contribution to the financing of OECD tax and public finance programs
2. Annual contribution from Belgium to the IOTA (Intra-European Organisation of Tax Administrations)
3. Contributions from Belgium to the World Customs Organization
4. Grants and contributions to national and international organizations for joint tax initiatives
5. Belgium share in operating costs of international organizations
Art. 2.18.3
§ 1. By derogation from section 1-01-5, § 2 of this Act, the commitment credit for the basic allowance "80.61.11.00.09 - Personnel of the Customs and Access Administration made available to other FPS Finance and other FPS and Public Services" may be redistributed to or from the basic allowance "80.61.11.00.03 - Final and Intern Staff. »
§ 2. By derogation from section 1-01-5, § 3 of this Act, the basic allowances with economic code 12 of section 18- SPF Finance may also be redistributed to the basic allowance "40.03.34.00.40 - Third-party allowances".
§ 3. By derogation from article 52, first paragraph, 2°, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal State and by derogation from article 1-01-5, § 3 of this Act, the appropriations of commitments and the liquidation credits of the basic allowances 40.02.12.09 and 40.02.74.09 may be redistributed only to them.
Art. 2.18.4
The Minister of Finance may make advances for urgent payments arising out of Belgium's obligations as part of its participation in international financial institutions and which are addressed to the Treasury Office responsible for international relations.
Art. 2.18.5
The following five-year limitation applies to the payment documents. They will again be payable and payable in the year following the date of the coming into force of this Act.
These prescribed payment securities cannot be the subject of a late interest claim unless their payment has taken place after the sixtieth day after their new introduction. The payment period of sixty days shall be counted as soon as possible from the effective date of this Act.
The expenses caused by these prescribed payment securities are attributable to the budgetary means of the basic allowance 18.61.06.16.01 of the current year.

Art. 2.18.6
By derogation from Article 62 of the Act of 22 May 2003 concerning the organization of the budget and accounting of the Federal State, the Organic Fund "Fund for the payment of advances in respect of food claims" is authorized to present a debiting position, which cannot exceed the amount of 58,500,000 euros.
Art. 2.18.7
By derogation from sections 60 and 61 of the Act of 22 May 2003 on the organization of the federal government's budget and accounting, the Minister of Finance is authorized to use revenues from the tax arrears securitization operation, up to 1.5 per cent of the objective, in order to cover the expenses resulting from the execution of this transaction.
Art. 2.18.8
By derogation from article 52, first paragraph, 1° of the Act of 22 May 2003 on the organization of the budget and accounting of the federal State and by derogation from article 1-01-5, § 3 of this Act, a redistribution is permitted from the basic allowance 40.02.74.00.01 to the basic allowance 40.04.41.00.30 within section 18, for the necessary investments.
Section 19. - Regulation of buildings
Art. 2.19.1
The Buildings Board budget for the year 2010, annexed to this Act, is approved.
This budget is for revenues of 926.456.075 euros and for expenditures of 926.960.301 euros, of which 504.226 euros to defer from previous budgetary years. It includes, in expenditure, commitment credits in the amount of 289,384,959 euros.
Revenues and expenses for order are estimated at 19,130,000 euros.
Art. 2.19.2
The Minister who has the Régie des Bâtiments in his responsibilities is authorized to contract, apart from the amount of the limiting commitment credits of the investment programs, set out in sections 533.01, 533.03, 533.11, 533.12, 533.13, 533.14, 533.16, 536.02, 536.11 and 536.13 of the budget of the Régie des Bâtiments annexed to this Act,
The accounting commitment of these transactions is limited in 2010 to 5.548.262 euros, as follows:

Art. 2.19.3
The Minister who has the Régie des buildings in his responsibilities is authorized to incur and liquidate, according to the budget of the Régie des buildings, the expenses arising from the consumption of water, electricity and heating of the royal palaces of Brussels and Laeken.
Art. 2.19.4
The Buildings Authority is authorized to make expenditures for first-time work in buildings leased by it for the use of services to which it must provide housing under the Act of 1er April 1971, establishing a Buildings Board.
If it is installation work that can be considered as standard completions or equipment, these costs are borne by the Régie des buildings budget.
If, on the other hand, it is installation work that comes from the needs of the current or future occupant and cannot be considered as standard completions or equipment, the costs are borne by the occupant. In this case, the Buildings Regime receives, prior to the payment of expenses, advances from the occupying services. It will not be possible for the Buildings Board to make any pre-financing of these expenses.
Art. 2.19.5
The Régie des buildings is authorized to make expenses, regardless of the nature, necessary for the operation of certain buildings where there are simultaneously several public services but which are considered to be entities for their effective management (e.g. some State Administrative Centres, the Fifty-year Palaces in Brussels, some large leased complexes).
The Buildings Authority is authorized to charge the amount of these expenses to the occupants of the buildings in question, either by recovering the payments made, or by using an order account. In these two cases, the Régie receives pre-payment of the expenses of these occupants.
Art. 2.19.6
The Régie des buildings is authorized to cover certain expenses relating to fixed occupancy charges of the personal secretariats and strategic bodies of ministers and state secretaries housed in state buildings or in leased buildings that do not cohabit with their administration. The amount of these expenses is limited to 49,579 euros per minister and 24,789 euros per secretary of state for the buildings of the state and 99,157 euros per minister and 49,579 euros per secretary of state for the leased buildings. The guidelines for the distribution and use of this credit are set together by the Minister of Budget and the Minister who has the Régie des buildings in his powers.

Art. 2.19.7
The Régie des buildings is authorized to use actual revenues, the proceeds of the sale of real estate and other real estate transactions. The proceeds of these transactions will be paid to the Fund established under section 335 of the Program Act of 22 December 1989.
The availability of the Unused Fund at the end of a fiscal year is deferred to the following fiscal year in which they are confused with its own revenues.
By derogation from paragraph 1, the Buildings Regime is authorized to pay to the Treasury or other beneficiaries, decided by the Council of Ministers, the proceeds of the sale of buildings, up to an amount to be decided by the Council of Ministers.
Art. 2.19.8
By derogation from articles 19 and 20 of the law of 1er April 1971, establishing a Buildings Board, the Buildings Board is authorized to make expenditures for the execution of ordinary and extraordinary maintenance work, studies and other miscellaneous work in certain well-defined buildings that are not owned by the State, when these expenses are explicitly borne by the Buildings Board by contracts, conventions or other agreements.
Art. 2.19.9
The Buildings Authority is authorized to make expenditures for the security of the royal estates of Laeken, Belvédère, Stuyvenberg and Châteauneuf.
Art. 2.19.10
By derogation from section 2 of the law of 1er April 1971, establishing a Buildings Board, the Buildings Board is authorized to support the housing costs of the Federal Agency for Food Chain Safety.
Art. 2.19.11
By derogation from section 2 of the law of 1er April 1971, establishing a Buildings Board, the Buildings Board is authorized to contribute to the implementation of a technical review and to the development of an annual report on the general state and compliance with existing legislation and regulations (French) of the renovated building "Belgian and Luxembourg Students' House" in Paris (Biermans-Lieuwe Foundation). The costs associated with these activities will be borne by the federal public programming service Scientific Policy.
Art. 2.19.12
The Régie des buildings is authorized to pay contractors the transformation work (including studies) of Block A of the Residence Palace complex in Brussels for the needs of the Council of the European Union, via funds made available by the Treasury.
In the 2010 fiscal year, these expenditures will be limited to Euro16,827,863 in commitment and Euro62,176.097 in liquidation.
Reimbursement of the entire investment of the project will be paid directly by the Council of the European Union to the Treasury.
Art. 2.19.13
The Régie des buildings is authorized to make expenditures for various investment works and studies in buildings that are not owned by the State but are used for the housing of the services of the State, the public services managed by the State or for certain categories of the staff paid by the State, provided that these expenses are explicitly borne by the Régie des Bâtiments by the provisions of a lease contract or by a decision of the councils
Art. 2.19.14
By derogation from section 2 of the law of 1er April 1971, establishing a Buildings Regime, the Buildings Regime is authorized to take charge of investment and maintenance work in open reception centres, for the needs of the Federal Agency for the reception of asylum seekers.
Art. 2.19.15
By derogation from section 2 of the law of 1er April 1971, establishing a Buildings Regime, the Buildings Regime is authorized to cover the housing costs of the Federal Agency for Drugs and Health Products.
Art. 2.19.16
As part of the construction of the new penitentiary infrastructure, the Buildings Authority is authorized to pre-finance the fees of external experts on section 560.08 of its budget, until the sponsor is appointed.
Section 21. - Pensions
Art. 2.21.1
The initial budget of the Public Sector Pension Service for 2010, annexed to this Act, is approved.
This budget is for revenues of 11.701.401.000 euros, of which 11.662.493.000 euros for revenues relating to legal missions and 38.908.000 euros for the management revenues of the Service. It amounts to 11.701.401.000 euros, of which 11.662.493.000 euros for expenses relating to legal missions, and 38.908.000 euros for expenses relating to the management of the Service.
Art. 2.21.2
Cash account no. 87.09.76.09 B - "FPS Finance - Treasury - SCDF - Pensions and other benefits - Public Sector Pension Service (PSPS)" - on which are charged from 1er January 2006 the pension and survival expenses that are managed by the Public Sector Pension Service, may present a debtor balance of up to 20% of the expenses related to the legal missions of that Service.
Art. 2.21.3
Cash order account no.87.09.75.08 B - "FPS Finance - Treasury - SCDF - Salaries and other fixed expenses for public sector pension service staff (PSPSS)" - on which are charged from 1er January 2006 the salaries of staff appointed on a final and contractual basis by the Public Sector Pension Service may be charged up to 20% of the management costs of that Service.

Art. 2.23.3
Formal allowances may be granted to members of delegations staying in Belgium as part of bilateral social collaboration, as well as to staff of the Department and public bodies subject to its accompanying guardianship, to cover their small expenses.
In addition to an amount set by the Minister of Employment, the social partners designated by the Minister may obtain reimbursement for the theoretical and practical training they organize in the context of bilateral social collaboration.
Art. 2.23.4
The Minister of Employment, after agreement with the Minister of Budget, is authorized to transfer, on the basis of a reasoned opinion from his department, within the framework of the debts of the promoters of projects prior to 1990 relating to the expenses of the past arising from the management of the European Structural Funds and in particular the European Social Fund for which the European Commission has operated under the Regulation (EC,Euratom) Council No. 1605/2002 of 25 June 2002 regulating the general budget of the European Communities and Regulation (EC,Eurotom) Commission No. 2342/2002 of 23 December 2002 establishing the terms and conditions for the execution of the above-named regulation, ex officio compensation.
Section 24. - SPF Social security
Art. 2.24.1
By derogation from Article 66 of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state, advances of up to 10,000 euros may be made to the accountants of the department, to the effect of paying claims for all service costs, allowances and allowances of any kind not exceeding 1,000 euros.
Authorization is given to these accountants to consent, to officials and experts on mission abroad, the necessary advances, even if these advances are greater than 1,000 euros.
Payment of expert fees from other countries and fees resulting from arrangements with foreign countries may also be made in advance of funds, regardless of the amount.
Art. 2.24.2
Credits for various expenses of the social service and credits for the supplement pensions can be used as a subsidy to the ABL "Social Service of the SPF Social Security and the SPF Public Health, Safety of the Food Chain and Environment".

The provision in program 58/1 (A.B. 58.11.01.00.01 - Interdepartmental provision for expenses of any kind related to environmental management in federal institutions) may be apportioned, as appropriate, between the appropriate programs of the budgets of the various federal institutions, by Royal Order and with the agreement of the Minister of Budget.
Art. 2.25.6
The provision in program 58/2 (A.B. 58.21.01.00.01 - Provisional Energy Savings Investments) may be apportioned, as appropriate, between the appropriate programs of the budgets of the departments concerned, by Royal Order and with the agreement of the Minister of Budget.

The budget of the Federal Agency for Drugs and Health Products for 2010 is approved, annexed to this Act.

By derogation from section 52, paragraph 1er, 1°, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal State and by derogation from paragraph 3 of Article 1-01-5 of this Act, the commitment credits of the basic allowances referred to therein may also be redistributed with the basic allowance 56/42.72.00.01.
Art. 2.25.9
By derogation from the provisions of Article 117 of the Act of 22 May 2003 on the organization of the federal government's budget and accounting, the Minister of Public Health is empowered to give the WHO 10% of the A/H1N1 influenza vaccines ordered by the Belgian State and the injection equipment necessary to use them.
Section 32. - SPF Economy, P.M.E., Average Classes and Energy
Art. 2.32.1
§ 1er. By derogation from Article 66 of the Act of 22 May 2003 on the organization of the budget and accounting of the Federal State, advances may be made.
Advances may be made to the relevant accountants, designated as part of Belgium's participation in international exhibitions, up to the level of the budgetary appropriations provided for this purpose and up to the level of the variable credits available for this purpose on the Fund for the Organization of International Exhibitions.
§ 2. Under the control of the Minister or his representative, subject to further justification by the Department and within the limits of budgetary appropriations, advances may be made available to the Treasures, designated by the Minister, to the International Exhibitions for the execution of expenditures.
Dependant payments of funds available on the variable credits of program 44/7 (International Exhibition Organization Fund) may be made, regardless of the amount, in advance of funds.
The potential balance of these advances as at December 31, 2009 may be used for 2010 expenditures.
Art. 2.32.2
The budget of the Federal Office of the Plan for the year 2010 annexed to this Act is approved.
This budget amounts to 9.685.660 euros and to 9.685.660 euros.
Art. 2.32.3
By derogation from Article 62 of the Act of 22 May 2003 on the organization of the budget and accounting of the General State, the Debt Control Fund is authorized to present a debiting position in commitment and liquidation which cannot exceed 5 million euros.

Section 33. - SPF Mobility and Transport
Art. 2.33.1
By derogation from Article 15 of the Organic Law of the Court of Accounts of 29 October 1846, advances of funds may be made to the extraordinary accountants of the services that are part of the Federal Public Service Mobility and Transport for a maximum amount of EUR 175,000 to the effect of paying claims not exceeding EUR 2.500 concerning:
- the purchase of unsustainable goods and services;
- the purchase of heritage furniture;
- the fees of lawyers and doctors and the remuneration of foreign experts to the Federal Public Service and third-party benefits as well as the tokens of presence due to them, the costs of road and residence;
- expenditure on water, gas and electricity consumption, telephone costs and fuel consumption expenses for vehicles;
- compensation to third parties arising from State responsibility;
- the various allowances of State staff and the Minister's Strategic Organs for real expenses and property damages, as well as the transportation costs for the travel of service and insurance premiums of the Federal Public Service delegates who travel abroad, including the intervention of the employer state in the price of the social subscription.
However:
- accountants are allowed to pay phone and postal expenses up to 5,000 euros.
- the accountants of the Management Budget and Control Service will be able to have advances of funds of up to EUR 1,000,000 as a result of paying such claims.
In addition, the accountant of the Budget and Management Control Service responsible for Account 679-2009813-70 is authorized to:
- have advances of funds up to EUR 75,000 for the payment of receivables not exceeding EUR 2.500 and related to:
- various social relief and allowances for pensioned personnel, former agents and beneficiaries for the federal public service as a whole;
- special relief to certain categories of victims of occupational accidents;
- to make advances to officials and experts on mission abroad, even if these advances are greater than EUR 2.500.

By derogation from section 62 of the Act of 22 May 2003 on the organization of the federal budget and accounting, the funds listed below may present in 2010 a debtor balance of:

The claims concerned relate to:
- the purchase of unsustainable goods and services;
- the purchase of heritage property;
- the fees of lawyers and doctors, the remuneration of foreign experts to the Federal Public Service, third-party benefits as well as the tokens of presence that are due to them, the costs of road and residence;
- expenditure on water, gas and electricity consumption, telephone costs, fuel consumption and fuel costs for vehicles;
- the various allowances to State personnel for real expenses and property damages, the transportation costs for travel of service, the insurance premiums of the Federal Public Service delegates who travel abroad, the intervention of the State - employer in the price of the social subscription.
Such advances of funds of up to 75,000 euros can be made to the extraordinary accountant of the Supervisory Service Budget and Control of Responsible Management of Account 679-2009813-70 in order to be able to grant the necessary advances, even beyond 2,500 euros, to officials and experts sent on mission abroad.
Art. 2.33.7

Section 44. - SPP Social integration, poverty reduction and social economy
Art. 2.44.1
By derogation from Article 66 of the Act of 22 May 2003 concerning the organization of the budget and the accounting of the federal state, advances of up to 100,000 euros can be made to the accountants of the department, to the effect of paying the claims for all the operating costs, the allowances and allowances of any kind not exceeding 5,500 euros, as well as, no matter what amounts, the consumption costs
Authorization is given to these accountants to consent, to officials and experts on mission abroad, the necessary advances, even if these advances are greater than 3,000 euros.
Payment of expert fees from other countries and fees resulting from arrangements with third countries may also be made in advance of funds, regardless of the amount.
Art. 2.44.2
Expenditures relating to prior budgetary years may be charged against current year appropriations in the following cases:

PROGRAMME 55/3 - HOME OF ASILE DEMANDERS
Subsidies to organizations and communes that support the first reception and distribution of refugees.
Subsidies to organizations for the individual assessment of the specific needs of vulnerable people and adaptation of their accommodation.
Subsidies to organizations supporting psychological assistance initiatives (individual care, prevention tools, information and training).
Subsidies to organizations to make the stay in reception structures more useful to everyone by acquiring a transposable know-how (e.g., basic learning, literacy, national language learning, qualifying training, etc.), whatever the outcome of the asylum procedure.
Subsidies to organizations for individualized information on the rights and obligations of asylum seekers, in particular with regard to the right to social assistance and conditions of reception, procedure and legal assistance, institutional landscape, living conditions in Belgium and assistance in return.
Subsidies to organizations carrying out social Interpretation missions.
Subsidies to organizations for the development of local communication policies and strengthening general means of communication on the reception of asylum seekers.
Subsidies to organizations for the development of voluntary return programmes or projects.

Art. 2.44.5
The amounts paid to the C.P.A.S. in previous years under the Act of 2 April 1965 on the Care of Relief granted by the Public Social Assistance Centres, the Act of 7 August 1974 establishing the right to a minimum of means of existence and the law of 26 May 2002 on the right to social integration may be considered for the year 2009 as advances for the year.
Art. 2.44.6
The budget of the Federal Agency for the reception of asylum seekers for 2010 is approved, annexed to this Act.
This budget is for revenues of 306.488.750 euros and for expenditures of 306.488.750 euros.
Art. 2.44.7
The available balance of previous years under the law of 7 August 1974 establishing the right to a minimum of means of existence, and the law of 26 May 2002 concerning the right to social integration, may be used to cover the expenses inherent in the current fiscal year.
The available balance of previous years under the Act of 2 April 1965 on the care of relief provided by public welfare centres can be used to cover the expenses inherent in the current fiscal year.
Art. 2.44.8
By derogation from Article 66 of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state, advances may be made to the appropriate accountant for the expenses of the organic fund "Belgian Social Fund". None of these advances are subject to a maximum amount, except for programming 1994-1999, for which they cannot exceed the available variable credits.
Art. 2.44.9
§ 1er. The organic fund "Federal European Social Fund - Programming 2007-2013" has a commitment authorization of 7.502.000 euros.
Any undertaking under this Article shall be subject to the visa of the Registrar of Commitments and the Court of Accounts.
Prior to the 10th of each month, the Comptroller of Commitments shall forward to the Court of Auditors, together with supporting documents, a statement in three copies and mentioning, on the one hand, the amount of the commitments covered in the past month and, on the other hand, the amount of the commitments covered since the beginning of the year.
§ 2. By derogation from Article 62 of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state, the organic fund "Federal European Social Fund, Programming 2007-2013" is authorized to present in liquidation a debiting position, which cannot exceed the amount of 3.000.000 euros.
Art. 2.44.10
The organic fund "European Third Country Integration Fund" has a commitment authorization of 347.000 euros.
Any undertaking under this Article shall be subject to the visa of the Registrar of Commitments and the Court of Accounts.
Prior to the 10th of each month, the Comptroller of Commitments shall forward to the Court of Accounts, together with supporting documents, a statement in three copies and mentioning, on the one hand, the amount of the commitments covered in the past month and, on the other hand, the amount of the commitments covered since the beginning of the year.
Section 46. - SPP Scientific policy
Art. 2.46.1
By derogation from Article 15 of the Organic Law of the Court of Auditors of 29 October 1846, advances of funds may be made for a maximum amount of money
- 400,000 euros, to the Extraordinary Accountants of the SPP Scientific Policy and to the Extraordinary Accountants of the Institutions under its control;
- 1.000.000 euros to the extraordinary accountant of the National Botanical Garden of Belgium
Through these advances, the extraordinary accountants of the SPP and the National Botanical Garden of Belgium can make the payment of claims of any kind, including the purchase of heritage furniture goods, not exceeding 5,500 euros.

PROGRAMME 61/4 - ENSEIGNMENT-FORMATION (excluding Scientific Policy) AND SCOLARIAN INVESTMENTS
Grant to the SHAPE International School.
Art. 2.46.4
The commitment credits for the following expenses are allocated by decision of the Council of Ministers:
- Government impulses of R & D within the national framework (programme 60/1);
Interuniversity amusement poles (Program 60/1);
- Technology attraction poles (Program 60/1);
- coverage of R & D expenditures of Airbus aircraft (programme 60/1);
- Belgian participation in non-ASE bilateral or multilateral space projects (programme 60/2).
Art. 2.46.5
In addition to the Belgian contribution to the budget of the EUREKA Secretariat "Technology", the Minister of Science Policy is authorized, in accordance with the commitments made by Belgium, to bear, at the expense of its budget, the costs of rent and rental expenses (including electricity and heating expenses) of the EUREKA Secretariat "Technology" and half of the costs of rent of the EUREKA Secretariat AUDIOVISUEL, as well as
Art. 2.46.6
The Minister of Science Policy is authorized to waive, in accordance with the unanimous commitments of the member countries of the European Space Agency, the recovery of national fees and taxes affecting the cost of the work and supplies carried out in Belgium for this organization and whose payment in national currency or euro has been advanced to the expense of its budget, and to reimburse the organization in addition to the Belgian contribution, the amount of any national fees and taxes paid in national currency or euro by the aforementioned Agency.
Art. 2.46.7
By derogation from section 52, paragraph 1er, 1°, of the Act of 22 May 2003 concerning the organization of the budget and accounting of the federal State, and of Article 1-01-5, § 2 of this Law, the appropriations of the basic allowances 60.11.11.00.16, 60.21.11.00.18, 60.22.11.00.20 and 61.11.41.00.16 may be, by means of redistributions of basic allowances, transferred to the base allowance 21.01.
Art. 2.46.8
By derogation from section 52, paragraph 1er, 1°, of the Act of 22 May 2003 on the organization of the budget and accounting of the Federal State, the appropriations of the basic allowances 60.11.11.00.16, 60.12.11.00.17, 60.21.11.00.18 and 60.22.11.00.20 may be redistributed between them.
Art. 2.46.9
The credits of Program 5 of Division 61 (Education and Culture) can be used to pay the fees of lawyers representing the State in the disputes related to the " charges of the past" of the former Ministry of Education/Onderwijs.
Art. 2.46.10
By derogation from Article 1-01-5 §2 of this Law, the commitment credits of the basic allowances 60.31.41.00.10, 60.31.41.00.11, 60.32.41.00.14, 60.32.41.00.15, 60.32.41.00.16, 60.33.41.00.17, 60.33.41.00.18, 60.34.41.00.19, 60.34.41.00.20 and 60.34.41.00.22
Section 51. - Public debt
Art. 2.51.1
By derogation from section 14 of the Organic Law of the Court of Accounts of 29 October 1846, it may be disposed directly by the Minister of Finance to have it from the budget fund "Preparations on proceeds of borrowing to cover:
1° expenses incurred in public debt management operations;
2° advance payments;
3° disbursements resulting from exchange rate fluctuations. »
Art. 2.51.2
By derogation from section 15 of the Organic Law of the Court of Accounts of 29 October 1846, the Minister of Finance is authorized to pay in advance, within the limits of the budgetary and subsequent regularization charges, all expenses listed in this section of the budget, with the exception of the following basic allocations:
- 45.40.11.00.10 "Pays relating to the issue of borrowing";
- 45.40.12.00.21 "Non-financial costs related to the activity of the Public Debt Service";
- 45.40.12.00.04 "Different operating expenses related to computing";
- 45.40.74.00.01 "Expense for the acquisition of non-expendable movable property";
- 45.40.74.00.04 "Investment expenditures on computing";
- 45.30.41.00.02 "Different expenses arising from the creation and operation of the Aging Fund".
Art. 2.51.3
The treasury is authorized to make advances where, as a result of transactions on securities of the Belgian state referred to in article 107 of the royal decree of execution of the Income Tax Code 1992, the restitution of the movable pre-account, carried out anticipateably by the State for the benefit of non-resident savers, creates a debiting position of the account 84.01.02.78.B "Arrerages de Rentes" of the section
Art. 2.51.4
The Consolidated Revenue Fund is authorized to make advances when Account transactions 84.01.01.77.B create a debiting position of the Account.
Art. 2.51.5
By derogation from section 52, first paragraph, 1° of the Act of 22 May 2003 on the organization of the budget and accounting of the federal State, all commitment credits listed in this section of the budget may, at the request of the Minister of Finance and with the agreement of the Minister of Budget, be redistributed between them.
Art. 2.51.6
§ 1er. By derogation from amended section 15 of the Act of 29 October 1846 on the organization of the Court of Accounts, advances may be made to the extraordinary accountants of the public debt service for a maximum amount of 100,000 euros.
§ 2. To the extraordinary accountants of the Public Debt Service, authorization is given:
(a) to provide, to officials and members of the Public Debt Agency responsible for missions in the context of public debt management, advances of funds required for the execution of such missions;
(b) to pay by way of advances of funds expenses that require direct payment on site and that are mainly related to the printing activity of the Debt Service.
Art. 2.51.7
The balance available on the budget fund "Different Non-tax Rebates for the Aging Fund" is disbursed up to EUR 738.230.251.07.
Section 52. - Financing of the European Union
Art. 2.52.1
The Minister of Finance may make advances for urgent payments resulting from Belgium's obligations at the European level and which are addressed to the Treasury Office responsible for European affairs.
CHAPTER 3. - Restitution and allocation funds
Art. 3-01-1
The transactions carried out on the restitution and allocation funds during the 2010 fiscal year are assessed in accordance with the table annexed to this Act.
Art. 3-01-2
The method of disposition of each of the funds mentioned in the tables annexed to this Act is set out next to the number of the article pertaining to each of them:
- funds, whose expenses are subject to the prior visa of the Court of Auditors, are indicated in letter A;
- the funds and accounts, which are prepared by the Minister of Finance, are indicated in letter B;
- the funds and accounts, which are directly disposed of by the accountants who made the revenues, are indicated in letter C.
CHAPTER 4. - Separate Management State Services
Art. 4-01-1
The budgets of the Separate Management State Services for the 2010 fiscal year are approved in accordance with the tables annexed to this Act.
Art. 4-01-2
The method of payment of the expenses of each of the Separate Management Services, as set out in the tables annexed to this Act, is indicated next to the number of the article pertaining to each of them:
- services, whose expenses are subject to the prior visa of the Court of Accounts, are indicated by letter A;
- services, whose expenses are incurred by the Minister of Finance, are indicated in letter B;
- services, whose expenses are incurred directly by the accountants who made the revenues, are indicated in letter C.
Art. 4-01-3
By derogation from Article 16 of the Act of 28 June 1989 amending the Act of 28 June 1963 amending and supplementing the laws on State accounting, the provisions of Articles 1er and 5 of the same Act are not applicable in the 2010 fiscal year in respect of the Separate Management Services that do not have a legal basis and whose estimation of operations is resumed in the budgetary tables annexed to this Act.
CHAPTER 5. - State enterprises
Art. 5-01-1
By derogation from Article 112 of the Acts on State Accounting, coordinated on 17 July 1991, expenses resulting from the provision of goods or services are charged to the budget of the year in which the invoice is dated.
Art. 5-01-2
By derogation from Article 114 of the State Accounting Laws, coordinated on 17 July 1991, the capital transactions budget may include non-limitative credits. In this case, the wording mentions it. This option is limited to refunds and payments (sections 91.11 to 94.11 of the budget of the Royal Belgian Mint).
Art. 5-01-3
The Royal Mint of Belgium is authorized in 2010 to offer coins or medals for a maximum amount of 14.873.61 euros.
