ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. This Act partially transposes Directive 2008/104/EC of the European Parliament and the Council of 19 November 2008 on interim work.
Art. 3. In the Act of 24 July 1987 on temporary work, interim work and the provision of workers to users, an article 10bis is inserted as follows:
"Art. 10bis. During the period during which the acting worker works with the user, he or she is entitled, under the same conditions as the permanent workers of the user, to access existing infrastructures or services in the user's enterprise, such as catering services, child reception facilities and transportation services, unless a differential of treatment is justified by objective reasons. ".
Art. 4. Section 19, paragraph 2, of the Act, as amended by the Act of 24 December 1999, is replaced by the following:
"For the purposes of paragraph 1er, are considered to be applicable to the workplace, the provisions relating to the fight against discrimination, equal treatment of men and women, the duration of work, holidays, Sunday rest, work of women, protection of maternity, protection of nursing mothers, work of young people, night work, work regulations, provisions relating to the control of benefits of part-time workers as provided for in 1989
Art. 5. In chapter 2, section 3 of the Act, an article 20bis is inserted as follows:
"Art. 20bis. The user informs the acting worker who is made available to him of vacant jobs in his business. This obligation may be met by means of a general announcement at an appropriate place in the company. ".
Art. 6. The King is responsible for the execution of this Act.
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
