19 JULY 2012. - Special law amending the special law of 8 August 1980 of institutional reforms concerning the expansion of the constitutive autonomy of the French Community, the Walloon Region and the Flemish Community (1)



ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. In article 24 of the special law of 8 August 1980 of institutional reforms, replaced by the special law of 16 July 1993, and amended by the special laws of 13 July 2001 and 27 March 2006, the following amendments are made:
1° in § 1er, paragraph 2, the first sentence is supplemented by the words ", and establish complementary rules of composition. »;
2° in § 2, paragraph 2 is supplemented by the words "and establish complementary rules of composition. »;
3° in § 3, paragraph 2, the first sentence is supplemented by the words ", and set complementary rules of composition. "
Art. 3. In section 26 of the Act, replaced by the special law of 16 July 1993 and amended by the special law of 27 March 2006, the following amendments are made:
1° it is inserted a § 2bis, written as follows:
“§ 2bis. The Walloon Parliament and the Flemish Parliament can create by decree, each with regard to it, an electoral district in the entire territory of their region from which part of their respective parliaments are elected. If they make use of this faculty, the Walloon Parliament and the Flemish Parliament define by decree, each with regard to it, the number of seats that this regional electoral district has. »;
2° § 3, paragraph 1er, is supplemented by the words ", if any, diminished the number of seats in the electoral district referred to in § 2bis. "
Art. 4. In section 28 of the Act, replaced by the special law of 16 July 1993 and amended by the special laws of 2 March 2004 and 27 March 2006, a paragraph, as follows, is inserted between paragraph 6 and paragraph 7:
"The Walloon Parliament and the Flemish Parliament can, each with respect to it, amend, complete, replace or repeal the preceding paragraphs by decree. "
Art. 5. In section 29octies of the Act, inserted by the special law of 16 July 1993 and replaced by the special law of 2 March 2004, a paragraph written as follows is inserted between paragraph 2 and paragraph 3:
"The Walloon Parliament and the Flemish Parliament may, each with respect to it, amend, supplement, replace or repeal paragraph 2. "
Art. 6. In section 29 of the Act, inserted by the special law of 16 July 1993 and amended by the special law of 2 March 2004, paragraph 4 is replaced by the following:
“The Walloon Parliament and the Flemish Parliament can, each with respect to it, amend, supplement, replace or repeal by decree paragraphs 1er 3. "
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
