The Chambers have adopted and we endorse the following: Chapter 1. -Available general Article 1. This Act regulates a matter referred to in article 77 of the Constitution.
CHAPTER 2. -Changes of the Special Act of 16 January 1989 on the financing of the communities and Regions arts. 2. at article 63 of the special law of 16 January 1989 on the financing of the communities and the Regions, replaced by the law of 16 July 1993, the following changes are made: 1 ° in § 3, paragraph 1, the words "at 72% at least" shall be replaced by the word "entirely";
2 ° in § 3, paragraph 2, first indent, the words 'adopted at the date of 1 January 1993' shall be replaced by the words 'adopted on 1 January of the previous year';
3 ° article is supplemented by a paragraph 4 as follows: "§ § 4 4» A special appropriation is entered annually in the budget of the Interior SPF for the regions in the territory of which are immune properties from real estate tax. This credit, calculated in the manner laid down in paragraphs 1 to 3, fully covers the non-collection of the property tax by the regions. For the Brussels-Capital Region, this compensation also fully covers the non-imposition of the surcharges of agglomeration audit check-off orders on 1 January of the previous year. ».
S. 3. in the Special Act, inserted an article 64bis as follows: «art.» 64bis. from the fiscal year 2012, a special grant is paid in the Brussels-Capital Region due to the mobility policy. This endowment is 45 million euros in 2012, EUR 75 million in 2013, EUR 105 million in 2014 and 135 million euros in 2015.
From the fiscal year 2016, the amount of the previous year is adapted annually to the rate of the average index of prices to the consumer as well as 50% of the real GDP of the budgetary year concerned growth, according to the procedures laid down in article 47, § 2. ».
S. 4. in the Special Act, it an is inserted 64ter as follows: «art.» 64ter. § 1. A levy on the proceeds from the tax of physical persons is assigned to the second subfund referred to in article 2, paragraph 2, of the law of August 10, 2001 creating a Fund for financing the international role and the function of capital of Brussels and amending the organic law of 27 December 1990 creating budgetary funds.
This levy amounts to EUR 55 million from the fiscal year 2012.
Expenditures, including grants to areas of local police and in the Commons, which can be made to the Fund referred to in paragraph 1, are expenses related to security arising from the organisation of the European summits in Brussels, and the costs of security and prevention in relation to the function of capital nationally and internationally in Brussels.
§ 2. The regional members of the cooperation Committee referred to in article 43 of the Act of January 12, 1989 related to the Brussels Institutions, following the opinion of the Federal members of this Committee, decide the use of the means referred to in paragraph 1.
S. 5. in the Special Act, it an is inserted 65ter as follows: «art.» 65ter. the amount determined annually pursuant to rule 65bis is added every year in 2012, 2013, 2014 and 2015 an additional amount of EUR 10 million. Such additional amounts are cumulatively in addition to the amounts as calculated on the basis of article 65bis for the years 2012, 2013, 2014 and 2015 and evolving according to the mechanisms provided for in that article, from the year following their addition to the basic amount. ».
CHAPTER 3. -Entry into force art. 6 section 2 comes into force on the date fixed by the King, by deliberate order in Council of Ministers, and no later than 1 January 2016.
For the fiscal years during which section 2 has not yet entered into force, a lump sum grant is given to the Region of Brussels - capital equal to EUR 24 million for 2012, EUR 24 million for 2013, EUR 25 million for 2014 and EUR 25 million for 2015.
