The Chambers adopted and We sanction the following:
CHAPTER 1er. - Preliminary provision
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
CHAPTER 2. - Amendment of the Act of 29 June 1981 establishing the general principles of social security of wage workers
Art. 2. In the Act of 29 June 1981 establishing the general principles of social security for employed workers, as amended lastly by the Act of 22 June 2012, an article 39quinquies, which reads as follows:
"Art. 39quinquies. § 1er. The registered social secretariats, referred to in section 27 of the Act of 27 June 1969 revising the Decree-Law of 28 December 1944 concerning the social security of workers, are liable for a special contribution for 2012 to the National Social Security Office.
This assessment is pro-centric and is calculated on the sum of the contributions due to the National Social Security Office for the first quarter of 2012 by employers who are affiliated with the registered social secretariat, which are actually paid by the registered social secretariat to the Office, in accordance with the Agency's instructions, pursuant to section 48, § 1er, 6°, of the royal decree of 28 November 1969 taken in execution of the law of 27 June 1969 revising the decree-law of 28 December 1944 concerning the social security of workers.
The percentage of the special contribution is 0.0325 per cent. The King may, by order deliberately in the Council of Ministers, decrease this percentage.
The SONS prepares a debit notice and sends it to the social secretariats in the third or fourth quarter.
§ 2. This special contribution is considered to be a social security contribution, particularly with respect to the payment deadlines, the application of civil sanctions and criminal sanctions, the supervision, the designation of the competent judge in the event of a dispute, the legal action limitation, the privilege and the disclosure of the amount of the debt declaration of the institution responsible for the collection and collection of contributions.
CHAPTER 3. - Entry into force
Art. 3. This Act produces its effects on 1er January 2012 and ceases to produce its effects on December 31, 2012.
