The Chambers have adopted and we endorse the following: Chapter 1.
-Available preliminary Article 1. This Act regulates a matter referred to in article 78 of the Constitution.
CHAPTER 2. -Amendment of the law of 29 June 1981 laying down the General principles of social security for employed persons art. 2. in the law of 29 June 1981 laying down the General principles of social security for wage-earners, as amended as last amended by the Act of 22 June 2012, it is inserted an article 39quinquies, worded as follows: «art.» 39quinquies. § 1. The licensed social secretariats, referred to in article 27 of the law of 27 June 1969 revising the Decree-Law of 28 December 1944 on social security for workers, are liable to pay a special contribution for 2012 at the national Office for social security.
This contribution is percentage and is calculated on the amount of contributions payable to the national agency of social security for the first quarter of the year 2012 by employers who are affiliated with the approved social secretariat, which are actually paid by the social secretariat approved for the Agency, in accordance with the instructions of the Office, pursuant to article 48, § 1, 6 °, of the royal decree of November 28, 1969, made pursuant to the law of 27 June 1969 revising the Decree-Law of 28 December 1944 on social security for workers.
The percentage of the special assessment is maximum 0.0325%. The King may, by Decree deliberated in the Council of Ministers, reduce this percentage.
The NSSO establishes a debit advice and sends it to the social secretariats during the third or fourth quarter.
§ 2. This special assessment is considered a social security contribution, particularly as regards payment deadlines, the application of civil remedies and criminal sanctions, the monitoring, the designation of the competent court in case of dispute, the limitation period for actions to justice, privilege and communication of the amount of the statement of claim from the institution responsible for the perception and the collection of contributions.
CHAPTER 3. -Entry into force art.
3. this Act takes effect on January 1, 2012 and ceases to have effect on December 31, 2012.
Promulgate this Act, order that it self under the seal of the State and published by le Moniteur.
