25 FEBRUARY 2013. - An Act to amend the Act of April 22, 1999 on Accounting and Tax Professions (II)



ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. In section 45/1, of the Act of 22 April 1999 on Accounting and Tax Professions, inserted by the Act of 25 February 2013 amending the Act of 22 April 1999 on Accounting and Tax Professions (I), the following amendments are made:
1° Paragraph 2 is supplemented by a paragraph which reads as follows:
"Every elector may appeal against the results of the elections to the Council of State within eight days of their publication to the Belgian Monitor. As soon as it is inadmissible, the appeal is previously served by exploiting bailiffs to the president of the Professional Institute. The King determines the procedure and the parties to the proceedings. The Council of State shall rule on the appeal within sixty days. In the event of a complete or partial cancellation of the elections and in the event of an appeal against the elections, the outgoing agents assume the vacancy of the mandates concerned as long as the vacancy lasts. If the elections are partially or totally cancelled, the Government Commissioner shall determine the date on which new elections are to be held. »
2° the article is supplemented by paragraph 14 as follows:
Ҥ 14. The final decisions made by the executive chambers or the executive chambers gathered, the final decisions of the boards of appeal or the boards of appeal brought together may be referred to the Court of Cassation by the parties concerned or by the President of the National Council in conjunction with a legal assessor, for contravention of the law or for violation of the forms, or prescribed barely nullity.
It is permissible for the Attorney General near the Court of Cassation to appeal to this Court in the interest of the law.
In the event of cassation, the cause is returned to the room or rooms otherwise composed. These are consistent with the Court of Cassation ' s decision on the points of law that it considers.
The cassation procedure is regulated as in civil cases; the deadline for filing the claim is one month from the notification of the decision. »
Art. 3. This Act comes into force on the first day of the fourth month following that of its publication in the Belgian Monitor.
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
