The Chambers have adopted and we endorse the following: Article 1. This Act regulates a matter referred to in article 78 of the Constitution.
S. 2. in article 7 of the royal decree of 23 December 1996 implementing articles 15, 16 and 17 of the Act of 26 July 1996 on the modernization of social security and ensuring the viability of the statutory schemes of pensions, amended by the royal decree of 23 April 1997, the following changes are made: 1 °, paragraph 2 is replaced by the following :
«
§ 2. When the spouse is died after the effective date of course of his pension, the survivor's pension is equal to 80% of the amount of the pension payable to the deceased spouse the month of death, which it was granted in accordance with the law of 20 July 1990, by royal decree No. 50 or under this order and which (as appropriate, is converted to the amount laid down in article 5, § 1, paragraph 1, has), and without that is optionally applied the reduction due to anticipation. »;
2 ° paragraph 3 is repealed;

4 ° paragraph 5 becomes paragraph 4;

S. 3. article 2 is applicable to survivor's pensions taking courses effectively and for the first time in the earlier July 1, 2013.
S. 4 this Act comes into force on July 1, 2013.
