ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. Article 633 of the Judicial Code, replaced by the Act of 30 December 2009, is supplemented by a § 3 written as follows:
Ҥ3. Subject to Article 46 of Title XVII of Book III of the Civil Code, the judge of the seizures of the domicile of the security grantor is competent for applications relating to security rights and the security rights registry.
If the owner's domicile is located abroad or is unknown, the judge of seizures of the gagiste's domicile is competent. "
Art. 3. Section 1395 of the same Code, last amended by the Act of 31 January 2009, is supplemented by a paragraph written as follows:
"Subject to Article 46 of Title XVII of Book III of the Civil Code, all applications relating to security rights and to the security rights register are brought before the court of seizures. "
Art. 4. This Act comes into force on the day of the coming into force of the Act of 11 July 2013 amending the Civil Code with respect to security rights and repealing various provisions in this regard.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
