1 DECEMBER 2013. - An Act to amend the Act of 17 September 2005 relating to the launch, flight or guidance of space objects (1)



PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. In section 3 of the Act of 17 September 2005 relating to the launch, flight or guidance of space objects, the following amendments are made:
§1. The 1st is replaced by the following:
"1° by "space object",
(a) any object launched or intended to be launched on an orbital trajectory around the Earth or towards a destination beyond the Earth orbit;
(b) any equipment intended to launch an object on a trajectory referred to in point (a). Such equipment is also considered to be a space object while it is operated empty for the purposes of its development and validation phase;
(c) any component of an object referred to in point (a) or point (b); »
§ 2. The 2° is replaced by the following:
"2° by "operator", the person who conducts or undertakes the activities covered by this Act by ensuring, alone or jointly, the effective control of the space object. The activity carried out by an operator may be carried out under a business contract.
In the case of a space object that is not likely to be operated in flight or be guided once in orbit, the operator is deemed to be the person who gives the posting order of the object; »
§ 3. The 3° is replaced by the following:
"3° by "actual control", the authority exercised on the activation of the control or remote control means and, where applicable, the associated monitoring means, necessary for the execution of the launch, flight or guidance activities of one or more space objects; »
§ 4. The 5° is replaced by the following:
"5° by "flight operation" and "guiding", any operation relating to the posting, flight conditions, navigation or evolution of the space object in outer space, such as the choice, control or correction of its orbit or its trajectory; »
Art. 3. This Act comes into force on the day of its publication in the Belgian Monitor.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
