PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. An ISI+ card is issued:
1° to persons identified by means of an identifier referred to in section 8 of the Act of 15 January 1990 relating to the institution and organization of a Bank-Carrefour de la sécurité sociale, which cannot have a Belgian electronic identity card, an electronic foreign card or an electronic residence document, which is valid for registration in the registers of the population, as referred to in the Act of 1983
2° to all children under the age of twelve who can benefit from social benefits under compulsory health care and allowances insurance.
Art. 3. Any social insured person referred to in section 2 is required to present his or her ISI+ card whenever he or she is required to produce proof of his or her identity under legal and regulatory obligations within social security.
Any social insured person, other than the one referred to in Article 2, is required to present his or her Belgian electronic identity card, electronic foreign card or electronic residence document whenever he or she must, within the framework of legal and regulatory obligations within social security, produce proof of his or her identity.
Art. 4. The Banque-Carrefour de la sécurité sociale manages the central file of ISI+ cards, which will be supplemented by the data of the producer and insurers.
The central file of ISI+ cards is designed to deliver, renew, replace and use ISI+ cards in a secure manner and contains the information necessary for this purpose.
Art. 5. The King determines the terms and conditions for the content of the data to be used for the identification of social insured persons and for the protection of ISI+ cards. It also determines the terms and conditions of delivery and the cases in which a contribution is requested to the social insured for the replacement of its ISI+ card.
Art. 6. Section 41 of the Act of 26 July 1996 on social security modernization and sustainability of legal pension schemes is repealed.
Art. 7. Article 53, § 1er, of the Compulsory Health Care and Compensation Insurance Act, coordinated on July 14, 1994, last amended by the Act of March 19, 2013, the following amendments are made:
1° Paragraph 8 is supplemented by the following phrases: "The King may, by order in the Council of Ministers and after the advice of the Insurance Committee, subordinate, for the care benefits it determines, the third-party plan paid to the verification of the beneficiary's identity. The King sets out the terms and conditions of this audit and may provide for exceptions to it."
2° In paragraph 13, the words "that they have used the social identity card of the social insured in accordance with the provisions of the Royal Decree of 18 December 1996 on measures to establish a social identity card for the use of all social insured persons, pursuant to sections 38, 40, 41 and 49 of the Act of 26 July 1996 on social security modernization and ensuring the viability of the legal pension schemes
Art. 8. Section 165, paragraph 16, of the Act, inserted by the Act of 15 January 1999, is repealed.
Art. 9. Section 191, 24° and 25°, of the same law, inserted by the law of 25 January 1999 is repealed.
Art. 10. The Royal Decree of 18 December 1996 on measures to establish a social identity card for the use of all social insured persons, pursuant to sections 38, 40, 41 and 49 of the Act of 26 July 1996 on social security modernization and the sustainability of legal pension schemes is repealed.
Art. 11. The valid social identity cards issued under the above-mentioned Act of 26 July 1996 and the above-mentioned Royal Decree of 18 December 1996 remain valid for identification in accordance with the existing procedures until a date to be determined by the King.
Until that date, no ISI+ card is issued to people with a valid social identity card.
Art. 12. For the verification of the validity of a Belgian electronic identity card, an electronic foreign identity card, an electronic residence document or an ISI+ card, for the verification of the need for the issuance of an ISI+ card and for the payment of costs for medical care in the context of compulsory or supplementary insurance and in accordance with the provisions of the law of 8 December 1992 relating to the protection of
1° the Banque-Carrefour de la sécurité sociale;
2° the eHealth platform;
3° the National Institute for Health and Disability Insurance;
4° the National Intermutualist College;
5° insurers;
6° care providers and care institutions;
7° approved pricing offices.
Art. 13. This Act comes into force on 1er January 2014.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
