Posted the: 2014-05-28 Numac: 2014009280 FEDERAL JUSTICE PUBLIC SERVICE May 15, 2014. -Law concerning insertion in book XVII of the Code of economic law of the provisions regulating substances referred to in article 77 of the Constitution with regard to persons exercising a liberal profession (1) PHILIPPE, King of the Belgians, to all, present and to come, hi.
The Chambers have adopted and we endorse the following: Chapter 1.
-Available general Article 1. This Act regulates a matter referred to in article 77 of the Constitution.
CHAPTER 2. -The Code of economic law art. 2. in article XVII.1 of the Code of economic law, the words "and XII, referred to in chapters 3, 4 and 5 of this title" are replaced by the words ", XII and XIV, referred to in chapters 3, 4, 5 and 5/1 of this title".
S. 3. article XVII.1 of the Code is supplemented by a paragraph 2, as follows: "A against persons exercising a liberal profession and where an offence under the provisions of book XIV is concerned, the jurisdiction provided for by this chapter shall be exercised by the president of the Court of first instance."
S. 4. in book XVII of the Code, title 1, Chapter 5/1, it is inserted an article XVII. 25/1, as follows: "article
XVII. 25: 1. The president of the Court of first instance may order the prohibition of practices of the market referred to in articles XIV.59 to XIV.76 of this Code when they have not yet begun, but they are imminent."
S. 5. in book XVII, title 1, Chapter 6, of the same Code, there shall be inserted an article XVII. 29/1, as follows: "article XVII. 29/1. A against persons exercising a liberal profession and where an offence under the provisions of book XIV is concerned, the jurisdiction under this chapter is exercised by the president of the Court of first instance."
CHAPTER 3. -Amending provisions and repealing article
6. in article 587, 1st paragraph, judicial, modified Code as last amended by the Act of 2 June 2013, point 6 ° is replaced as follows: "6 ° claims laid down in articles XVII. 1, XVII. 25: 1 and XVII. 29/1 the code of economic law; "."
S. 7. in article 588, paragraph 1, of the Judicial Code, item 12 ° is repealed.
-Allocation of competencies art. 8. the laws and orders of existing execution that make reference to the provisions referred to in articles 6 to 7 are presumed to refer to the equivalent provisions of the Code of economic law, as that inserted by this Act.
S. 9. the King may replace such references in the laws or existing orders to the provisions referred to in articles 6 and 7, with references to the equivalent provisions of the Code of economic law, as inserted by the Act.
S. 10. the King can coordinate the provisions of the Code of economic law, as that inserted by this law, with provisions that would have expressly or implicitly modified at the time where the coordination will be established.
To this end, it may: 1 ° modify the order, numbering and, in general, the presentation of the provisions to coordinate;
2 ° amend the references contained in the provisions to coordinate to put them in line with the new numbering;
3 ° amend the drafting of the provisions to coordinate to ensure consistency and to unify the terminology without that it can be infringed the principles embodied in these provisions.
CHAPTER 5. -Entry into force art. 11. this Act comes into force on May 31, 2014.
Promulgate this Act, order that it be under the seal of the State and published by le Moniteur.
