PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. The purpose of this Act is to:
- to establish the penalties applicable in the event of a violation of the provisions of Regulation (EC) No. 1007/2009 of the European Parliament and of the Council of 16 September 2009 on the trade in seal products, as provided for in Article 6 of the Regulations;
- to designate the competent authority for the control and preservation of certificates accompanying products derived from imported seal, as provided for in Article 9 of Regulation (EU) No. 737/2010 of the Commission of 10 August 2010 on the modalities for the application of Regulation (EC) No. 1007/2009 of the European Parliament and of the Council on the trade of seal products.
Art. 3. Without prejudice to the application of stricter sanctions under the Criminal Code, a penalty of one to three months is imposed and a fine of 35 to 500 euros, those who violate the provisions of Regulation (EC) No 1007/2009 of the European Parliament and of the Council of 16 September 2009 on the trade of seal products.
Art. 4. The provisions of Book Ier the Criminal Code, including Chapter VII and section 85, shall apply to offences referred to in section 3.
Art. 5. Without prejudice to the powers of judicial police officers, customs and access officials are also competent to investigate and report offences under Regulation (EC) No 1007/2009.
Art. 6. Any natural or legal person is required to provide the designated agents with their commission and to conduct a check or inquiry relating to the application of Regulation (EC) No 1007/2009 of the European Parliament and of the Council of 16 September 2009 on the trade of products derived from seals and Regulation (EU) No 737/2010 of the Commission of 10 August 2010 on the modalities of application of the Regulation (EC) No 1007/2009
The data stored on computer supports shall be communicated in a readable and intelligible form.
When required by the administration, the person referred to in the first paragraph has the obligation to make free copies of the material in the presence of the designated officer in the form requested by the administration of all or part of the aforementioned data, books and documents, as well as the computer processing deemed necessary for the conduct of the investigation.
Art. 7. The SPF Economie, P.M.E. Licenses Service is designated as the competent authority for the performance of the tasks listed in Article 9 of Regulation (EU) No. 737/2010 referred to above.
Art. 8. The Act of 16 March 2007 on the prohibition of the manufacture and marketing of seal-derived products is repealed.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
