27 MAI 2014. - Act to approve certain amendments to various international acts adopted under the auspices of the International Maritime Organization (1)



PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. The following changes in the following international acts will come out their full effect:
1° the amendment of the 1966 International Convention on Lines of Charge, adopted on the basis of Article 29 of the 1966 Convention referred to in Chapter 1er the Appendix;
2° the amendments to the 1988 Protocol relating to the 1966 International Convention on Lines of Charge, adopted on the basis of Article VI of the 1988 Protocol listed in Chapter 2 of the Annex;
3° the amendment to the 1969 International Convention on the Measurement of Ships and Annexes, made in London on 23 June 1969, adopted on the basis of Article 18 of the 1969 Convention referred to in Chapter 3 of the Annex;
4° the amendments to the 1974 International Convention for the Protection of Human Life at Sea, adopted on the basis of Article VIII of the 1974 Convention referred to above and listed in Chapter 4 of the Annex;
5° the amendments to the 1978 Protocol relating to the 1974 International Convention for the Protection of Human Life at Sea, adopted on the basis of Article VIII of the 1974 Convention referred to in Chapter 5 of the Annex;
6° the amendments to the 1988 Protocol relating to the 1974 International Convention for the Protection of Human Life at Sea, adopted on the basis of Article VI of the 1988 Protocol referred to in Chapter 6 of the Annex;
7° the amendments to the 1978 International Convention on Standards of Training of Seafarers, Granting of Patents and Watchkeeping, adopted on the basis of Article XII of the 1978 Convention referred to above and listed in Chapter 7 of the Annex;
8° the amendments to the 1972 International Convention on the Safety of Containers, adopted on the basis of Articles 9 and 10 of the 1972 Convention referred to in Chapter 8 of the Annex;
9° the amendments to the 1978 Protocol relating to the 1973 International Convention for the Prevention of Pollution by Ships, adopted on the basis of Article 16 of the 1973 Convention referred to in Chapter 9 of the Annex;
10° the amendments to the 1997 Protocol amending the 1973 International Convention for the Prevention of Pollution by Ships as amended by the 1978 Protocol thereto, adopted on the basis of Article 16 of the 1973 Convention referred to in Chapter 10 of the Annex;
11° the amendment of the 1992 Protocol amending the 1969 International Convention on Civil Liability for Oil Pollution Damage, adopted on the basis of Article 15 of the 1992 Protocol referred to in Chapter 11 of the Annex;
12° the amendment of the 1992 Protocol amending the 1971 International Convention for the Establishment of an International Fund for Compensation for Oil Pollution Damage, adopted on the basis of Article 33 of the 1992 Protocol referred to in Chapter 12 of the Annex.
Art. 3. In the single article of the Act of 27 December 1968 approving the 1966 International Convention on Lines of Charge and Annexes, made in London on 5 April 1966, the words "including the amendments adopted on the basis of Article 29 of the 1966 Convention referred to above, without Belgium opposing their adoption and which come into force with respect to Belgium under the same article," are inserted between the words "April 1966 and"
Art. 4. In the single article of the Act of 7 April 1975 approving the 1969 International Convention on the Measurement of Ships, and the Annexes, made in London on 23 June 1969, the words "including the amendments adopted on the basis of Article 18 of the 1969 Convention referred to above, without Belgium opposing their adoption and which enter into force with respect to Belgium under the same article," are inserted between the words "June and ".
Art. 5. In the Act of 10 August 1979 approving the 1974 International Convention for the Protection of Human Life at Sea and the Annex, made in London on 1er November 1974 and the 1978 Protocol on this Convention, and the Annex, made in London on 17 February 1978, the words "including the amendments adopted on the basis of Article VIII of the 1974 Convention referred to above, without Belgium opposing their adoption and which enter into force with respect to Belgium under the same article," are inserted between the words "February 1978" and "go forth".
Art. 6. In the single article of the Act of 16 August 1982 approving the International Convention on Standards for the Training of Seafarers, the Granting of Patents and Watches, and the Annex, made in London on 7 July 1978, the words "including the amendments adopted on the basis of Article XII of the 1978 Convention referred to above without Belgium having to oppose their adoption and which enter into force in respect of Belgium under the same article" shall be inserted between Belgium and
Art. 7. In Article 1er of the Act of 20 August 1981 approving the International Convention on the Safety of Containers, and the Annexes made in Geneva on 2 December 1972, the words "including the amendments adopted on the basis of articles 9 and 10 of the 1972 Convention referred to above, without Belgium opposing their adoption and which enter into force with respect to Belgium under the same articles," are inserted between the words "December 1972" and "output".
Art. 8. In section 2 of the Act, paragraph 2 is deleted.
Art. 9. In the Single Article of the Act of 17 January 1984 approving the following International Acts: (a) 1973 International Convention for the Prevention of Pollution from Ships, and Annexes, made in London on 2 November 1973, (b) 1978 Protocol on the 1973 International Convention for the Prevention of Pollution by Ships, and Annex, made in London on 17 February 1978, the following amendments are made:
1° the provision under (a) is supplemented by the words "including the amendments adopted on the basis of Article 16 of the 1973 Convention referred to above without Belgium opposing their adoption and which enter into force with respect to Belgium under the same article";
2° the provision under (b) is supplemented by the words "including the amendments adopted on the basis of Article 16 of the 1973 Convention referred to above without Belgium opposing their adoption and coming into force with respect to Belgium under the same Article".
Art. 10. In Article 2 of the Act of 10 August 1998 enacting the 1992 Protocol amending the 1969 International Convention on Civil Liability for Damage Caused by Hydrocarbons, and Annex, made in London on 27 November 1992, the words "including the amendments adopted on the basis of Article 15 of the 1992 Protocol referred to above, without Belgium having to oppose their adoption and which enter into force in respect of Belgium",
Art. 11. In Article 2 of the Act of 10 August 1998 enacting the 1992 Protocol amending the 1971 International Convention on the Establishment of an International Fund for Compensation for Damage Due to Hydrocarbon Pollution, made in London on 27 November 1992, the words "including the amendments adopted on the basis of Article 33 of the 1992 Protocol referred to above, without Belgium having to oppose their adoption and which shall enter into force in Belgium".
Art. 12. In Article 2 of the Act of 6 October 2005 on assent to and implementation of the 2003 Protocol to the 1992 International Convention on the Establishment of an International Compensation Fund for Damage Due to Hydrocarbon Pollution, made in London on 16 May 2003, the words "including the amendments adopted on the basis of Articles 24 and 25 of the 2003 Protocol referred to above, without Belgium's objection to their adoption and which enter into force"
Art. 13. In Article 2 of the Act of 15 June 2004 enacting the Protocol of 1997, amending the 1973 International Convention for the Prevention of Pollution by Ships, as amended by the 1978 Protocol thereto, and the Annex, made in London on 26 September 1997, the words "Includes these amendments adopted on the basis of Article 16 of the 1973 Convention referred to above, without Belgium having objected to their adoption and inserted into force in Belgium"
Promulgate this Act, order that it be clothed with the seal of the State and published by the Belgian Monitor.
