PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. In section 47 of the Act of 21 March 1991 on reform of certain economic public enterprises, paragraph 4, inserted by the Act of 30 December 2009, is repealed.
Art. 3. In the same Act, last amended by the Act of 29 January 2013, an article 47/1 is inserted as follows:
"Art. 47/1. § 1er. It is established an advisory committee for rail travellers, referred to as "the committee", with the Federal Public Service Mobility and Transport. This committee is competent for rail passenger transport services that are the subject of public service missions. The King regulates the composition and operation of the advisory committee for rail passengers.
§ 2. The committee shall issue notices at the request of the public carriers providing rail transportation services for travellers in public service missions, at the request of the Minister for which these public carriers operate, at the request of the Minister who has the regulation of rail transport in his or her duties or on the committee's own initiative.
The committee may issue notices on any matter relating to rail passenger transport services that are the subject of public service missions by a public railway company. These opinions reflect the diversity of the positions of its members.
It is consulted on the projects of multi-year investment plans and on transport plans that concern travellers. These documents are communicated to the committee by the railway infrastructure manager and public companies providing rail transportation services for public service missions.
No later than six months before the expiry of the management contracts, the committee forwards its recommendations on management contracts to the Legislative Chambers.
The committee may organize consultations involving public enterprises providing rail transport services for travellers subject to public service missions and public authorities.
§ 3. The committee reports annually on its activities to public rail carriers providing passenger transportation services for public service missions, to the Minister of State-owned enterprises, to the Minister who has the regulation of rail transport in its duties, to the Federal Legislative Chambers and to the regional executives.
§ 4. The King may award compensation for fees incurred by members of the executive board of the committee and related to the exercise of their mandate since 2009. The maximum total amount of this compensation is twelve thousand five hundred euros per year.
§ 5. The public railway company shall, upon request of the chair or vice-chair, provide information relevant to the proper functioning of the committee's mission.
Art. 4. The King shall determine the effective date of this Act.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
