S. 2. the agreement between the Governments of the Benelux States and the Government of the Republic of South Africa concerning the exemption from the visa requirement for holders of diplomatic, official passports and/or service, done in Pretoria on February 22, 2013, will release its full and complete effect.
Promulgate this Act, order that it be under the seal of the State and published by le Moniteur.

Recognizing that the Benelux States Governments act in concert under the Convention between the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands concerning the transfer of the control of the people towards the external borders of the territory of the Benelux, signed at Brussels on 11 April 1960;
Wishing to facilitate the entry, in their respective countries, citizens of the Republic of South Africa and the citizens of the Benelux States who are holders of diplomatic, official passports or valid national service;
HAVE to conclude an agreement on the exemption of visa requirement for holders of diplomatic, official passports and/or national service valid;
HAVE agreed upon the following provisions: ARTICLE 1 DEFINITIONS for the terms of this agreement, unless the context requires another interpretation, it means:-'the Benelux States': the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands;
-by the "Benelux territory": the set of territories in Europe, the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands.
ARTICLE 2 authorities competent authorities competent officials of the implementation of this agreement will be: (a) for the Government of the Republic of South Africa, the Department of the Interior; and (b) the Governments of the Benelux States: for the Kingdom of Belgium, the Federal Public Service Affairs foreign, foreign trade and Cooperation for development, for the Grand Duchy of Luxembourg, the Ministry of Foreign Affairs and immigration and for the Kingdom of the Netherlands, the Ministry of Foreign Affairs.
ARTICLE 3 EXEMPTION from the requirement of VISA (1) citizens of the Republic of South Africa who are holders of diplomatic, official passports or valid national service may enter without a visa in the territory of the States of the Benelux for a stay for a period of three (3) months.
(2) nationals of the Benelux States who are holders of diplomatic, official passports or valid national service can enter without a visa in the territory of the Republic of South Africa for a stay for a period of three (3) months maximum.
ARTICLE 4 authorised representatives (1) citizens of the State of one of the Parties assigned to the diplomatic or consular missions or missions to international organizations situated on the territory of the State of the other party, and carrying diplomatic, official passports or national service valid as well as their spouse or partner legal and their minor children bearers of diplomatic passports official and/or valid national service may enter the territory of the host Party, leave it or stay without a visa for the duration of their accreditation.
(2) the Parties shall notify each other in writing the arrival said officials and officials abide by the regulations on accreditation of the other party.
ARTICLE 5 refusal of ADMISSION Notwithstanding sections 3 and 4, each Government reserves the right to deny access to its territory to persons considered undesirable or as affecting by their presence the public order or national security.
ARTICLE 6 APPLICATION of laws except as regards provisions y related thereto, this Agreement shall not affect the laws and regulations in force in the States of the Benelux and in the Republic of South Africa concerning access to the territory, duration of residence, establishment and removal of foreigners, as well as any form of professional activity of foreigners.
ARTICLE 7 READMISSION. each party undertakes to readmit its territory at any time and without any formality, the people who have entered this territory under the guise of diplomatic, official passports or national service valid, issued by the authorities of the Kingdom of Belgium, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands or the Republic of South Africa.
ARTICLE 8 DOCUMENTATION the Parties are transmitted through the diplomatic channel specimens of their diplomatic, official passports or national service, new or altered, as well as data concerning the use of these passports and, insofar as possible, sixty (60) days prior to putting them into circulation.
ARTICLE 9 settlement of disputes any dispute arising out of the application or the interpretation of this Agreement shall be settled amicably through consultation or negotiation between the Parties.
ARTICLE 10 amendment this agreement may, at any time, subject to amendments by mutual consent between the Parties through an exchange of notes between the Parties through the diplomatic channel.
ARTICLE 11 depositary Le Service Public Federal Foreign Affairs, foreign trade and Cooperation in the development of Kingdom of Belgium ('the Belgian Government") will act as depository of this agreement. The depositary will issue to each party a copy of the original.
ARTICLE 12 entry into force, duration and termination (1) this Agreement shall enter into force the first day of the second month following the date of the last notification confirming the fulfilment of all legal and constitutional formalities for its entry into force, for a period of one (1) year. If it is has not been denounced thirty (30) days before the end of this period, the agreement will be considered to be extended for an indefinite period.
(2) the expiration of the initial period of a year, each party may denounce it with a thirty (30) days notice, addressed to the Belgian Government.
(3) the denunciation by one of the Parties will result in the termination of this agreement.
(4) the Belgian Government will notify the other Parties of the receipt of any notification referred to in this Article, as well as of the receipt of the information referred to in this Article.
ARTICLE 13 suspended the application of this agreement may be suspended by any of the other Parties. The suspension shall be notified immediately to the Belgian Government through diplomatic channels. The Belgian Government will notify the other Parties of the receipt of this notification. The same procedure will be followed when the suspension will be lifted.
ARTICLE 14 APPLICATION in the Kingdom of the Netherlands with regard to the Kingdom of Netherlands, the application of this agreement may be extended to Aruba, Curaçao, Sint Maarten and the Caribbean part of the Netherlands (Bonaire, Sint Eustatius and Saba).
IN witness whereof the signatories, duly authorised thereto by their respective Governments, have signed the present agreement in French, Dutch and English. In case of divergence of interpretation, the English text shall prevail.
