22 MAI 2014. - An Act to combat sexism in public space and to amend the Act of 10 May 2007 to combat discrimination between women and men in order to penalize the act of discrimination



PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
CHAPTER 1er. - General provision
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
CHAPTER 2. - Repression of sexism
Art. 2. For the purposes of this Act, sexism means any act or behaviour that, in the circumstances referred to in section 444 of the Criminal Code, is clearly intended to express a contempt of a person, because of his or her sexual affiliation, or to consider it, for the same reason, as being less or as being reduced essentially to his or her sexual dimension and which results in a serious violation of his or her dignity.
Art. 3. Is punishable by imprisonment from one month to one year and a fine of fifty euros to one thousand euros, or one of these penalties only, anyone who adopts a behaviour referred to in Article 2.
CHAPTER 3. - Amendments to the Act of 10 May 2007 to combat discrimination between women and men in order to penalize the act of discrimination
Art. 4. In the Act of 10 May 2007 to combat discrimination between women and men, article 28/1 is inserted as follows:
"Art. 28/1. Whoever, in the field referred to in Article 6, § 1er, 1°, commits discrimination, within the meaning of Article 5, 5°, 6°, 7° or 8°, in respect of a person because of his sex, is punishable by imprisonment from one month to one year and a fine of fifty euros to a thousand euros, or one of these penalties only.
The same penalties apply where discrimination is committed against a group, community or members because of sex.".
Art. 5. In the same Act, an article 28/2 is inserted as follows:
"Art. 28/2. Anyone who, in the field of labour relations, commits discrimination within the meaning of Article 5, 5, 6, 7 or 8°, in respect of a person because of his or her sex is liable to imprisonment from one month to one year and to a fine of fifty euros to one thousand euros, or only one of these penalties.
The same penalties apply where discrimination is committed against a group, community or members because of sex. ".
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
