21 DECEMBER 2013. - An Act to amend sections 1322bis and 1322undecies of the Judicial Code (1)



PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. In section 1322bis of the Judicial Code, inserted by the Act of 10 August 1998 and replaced by the Act of 10 May 2007, the following amendments are made:
1° in § 1er, it is inserted a 5° written as follows:
"5° without prejudice to § 2, requests based on the Hague Convention of 19 October 1996 concerning jurisdiction, applicable law, recognition, enforcement and cooperation in respect of parental responsibility and measures for the protection of children, for the recognition, non-recognition or enforcement of a protection measure taken in another Contracting State, including in its Article 3. »;
2° in § 2, the words "Article 26 of the Hague Convention referred to in § 1er, 5°, which tend to obtain recognition and enforcement of decisions regarding the right to visit and the right to maintain regular contacts and on" are inserted between the words "substantiated requests" and the words "Article 28 of the Council Regulation".
Art. 3. In Article 1322undecies of the same Code, inserted by the Act of 10 May 2007, the words "of 25 October 1980" are inserted between the words "The Hague Convention" and the words "or Article 11, 8, of the Regulations".
Art. 4. This Act comes into force on the day on which, pursuant to Article 61 of the 1996 Convention referred to above, the Convention will enter into force with respect to Belgium.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
