Posted the: 2014-08-25 Numac: 2014014365 FEDERAL PUBLIC SERVICE mobility and transport may 22, 2014. -Act to amend the law of 6 April 1995 on the prevention of pollution from ships and the law of 20 January 1999 on the protection of the marine environment and the Organization of the marine spaces under jurisdiction of Belgium (1) PHILIPPE, King of the Belgians, to all, present and to come, hi.
The Chambers have adopted and we endorse the following: Chapter 1. -Available general Article 1. This Act regulates a matter referred to in article 78 of the Constitution.
CHAPTER 2. -Changes of the Act of 6 April 1995 on the prevention of pollution from ships s. 2. at article 1, 2 °, of the law of 6 April 1995 on the prevention of pollution from ships, amended by the law of 20 January 1999 and December 19, 2006, the following changes are made: 1 ° A is supplemented by the words "and any incineration"(et 2° le B, a), is supplemented by the words "and the meaning of the Protocol of 1996 to the Convention". "
S. 3A article 17 bis of the same Act, inserted by the law of 20 January 1999 and amended by the laws of the May 3, 1999, December 19, 2006 and 13 March 2011, the following changes are made: 1 ° the § 1, paragraph 1, is supplemented by the sentence "the traffic control officers may be assisted by experts.";
2 ° § 2 is supplemented by the sentence "They may be assisted by experts.".
S. 4. in article 29ter of the Act, inserted by the law of 20 January 1999 and renumbered by the law of December 19, 2006, the words "being understood that the minimum transaction amount cannot be less than one-tenth of the minimum fine provided for by this Act, increased additional decimated" are repealed.
CHAPTER 3. -Amendments to the law of 20 January 1999 for the protection of the marine environment and the Organization of the marine spaces under jurisdiction of the Belgium art. 5 in article 2 of the law of 20 January 1999 on the protection of the marine environment and the Organization of the development of marine areas under jurisdiction of the Belgium, amended by the laws of the May 3, 1999, September 17, 2005, April 21, 2007 and July 20, 2012, the following changes are made: 1 ° 15 °, paragraph 2, (i) is replaced by the following : "(i) the rejection as provided for by the law of 6 April 1995 on the prevention of pollution from ships or the action to dispose of waste or other matter in accordance with the rules of international law applicable linked to or from the normal exploitation of aircraft or offshore installations;";
2 ° in 16 °, paragraph 2 is replaced by the following: "the term"incineration"does not rejection by incineration as provided for by the law of 6 April 1995 on the prevention of pollution from ships or the thermal destruction of wastes or other matter in accordance with the rules of international law applicable, products directly or indirectly during the normal aircraft or offshore installations operating;";
3 ° ° 19 is repealed.
S. 6. article 43 of the same Act, amended by the law of 3 May 1999 and September 17, 2005, is supplemented by a paragraph worded as follows: "without prejudice to the applicable rules to the agents referred to in paragraph 1, these agents may, for the purposes of this Act and its orders of execution, bear the quality of judicial police officer by the King.".
S. 7. in article 50 of the same Act, amended by the Act of April 21, 2007, it is inserted a § 1/1 as follows: "§ 1/1."
The offences in the provisions laid down by the King, binding for the litigants, in relation to the development of marine areas as referred to in article 5bis shall be punished by a fine of one hundred euros to 100,000 euros and imprisonment of two months to one year or one of those penalties only."
8. article 56 of the Act is supplemented by § 3 worded as follows: "§ § 3 3" "Without prejudice to the application of book I of the penal Code, including Chapter VII and articles 41A and 85, the identified natural person may, by way of derogation from article 5, paragraph 2, of the same Code, be sentenced for violations of this Act and its implementing orders, at the same time that the legal person responsible."
S. 9. in article 58 of the Act, the first indent is hereby repealed.
Promulgate this Act, order that it self under the seal of the State and published by le Moniteur.
