PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The House of Representatives adopted and sanctioned the following:
CHAPTER 1er. - Preliminary provision
Article 1er. This Act regulates a matter referred to in Article 74 of the Constitution.
CHAPTER 2. - Amendments to the Consular Code
Art. 2. Section 64 of the Consular Code is repealed.
Art. 3. In section 65 of the same Code, paragraph 3 is replaced by the following:
"The Minister may, prior to the issuance of a Belgian passport or travel document, request at any time the competent authority to provide any additional information that may clarify the decision to issue or refuse to issue. Pending this additional information, the issuance of the passport or travel document is suspended. »
Art. 4. In the same Code, an article 65/1 is inserted as follows:
"Art. 65/1. Belgian passports and travel documents are removed and invalidated under the conditions specified in article 62.
In addition, Belgian passports and travel documents may also be withdrawn and invalidated following the reasoned opinion of a competent authority for this purpose if the applicant clearly presents a substantial risk for the maintenance of public order or the protection of national or public security.
The Minister may, prior to the withdrawal or invalidation of a Belgian passport or travel document, request the competent authority at any time to provide any additional information that may clarify the decision to withdraw or invalidate. »
Art. 5. In the same Code, an article 65/2 is inserted as follows:
"Art. 65/2. The initial decision to refuse the issue, withdrawal or invalidation of an identity card by the Minister who has the Interior in his or her powers, pursuant to Article 6, § 10, of the Act of 19 July 1991 on the registers of the population, identity cards, foreign cards and residence documents and amending the law of 8 August 1983 organizing a national register of the persons concerned, automatically results in the decision of refusal of the Minister
The decision to refuse the issuance of the Belgian passport or travel document is lifted when the initial decision to refuse to grant, withdraw or invalidate the identity card referred to in paragraph 1 is lifted.er. »
CHAPTER 3. - Entry into force
Art. 6. This Act comes into force on the day of its publication to the Belgian Monitor, with the exception of Article 5, which comes into force on the date fixed by royal decree deliberated in the Council of Ministers.
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
