17 JULY 2015. - An Act to amend section 1299 of the Judicial Code with respect to the appeal of a judgment adjudicating divorce by mutual consent for reconciliation (I)



PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 74 of the Constitution.
Art. 2. In section 1299 of the Judicial Code, replaced by the Act of 2 June 2010, the following amendments are made:
1st paragraph 1er is replaced by the following:
"The appeal of the judgment that pronounced the divorce is admissible only as long as it is based on non-compliance with the legal conditions to pronounce the divorce or reconciliation of the spouses. ".
2° the article is supplemented by a paragraph written as follows:
"The call based on reconciliation must in all cases be introduced jointly by both spouses in the month of the pronouncement. This appeal is served on the King's Attorney."
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
