18 DECEMBER 2015. - An Act to amend the Public Statistics Act of July 4, 1962 (1)



PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The House of Representatives adopted and sanctioned the following:
Article 1er. This Act regulates a matter referred to in Article 74 of the Constitution.
Art. 2. Article 1 of the Law of 4 July 1962 on Public Statistics, inserted by the Law of 22 March 2006, is supplemented by the 17th and 18th, as follows:
"17° Statistical Authority: the National Institute of Statistics, shortens the INS, and other statistical authorities charged by law, decree or order, the collection and processing of data for the purpose of carrying out public statistics. The conditions to be met by the statistical authorities are mentioned in Chapter V of the Agreement of Cooperation between the Federal State, the Flemish Region, the Walloon Region, the Brussels-Capital Region, the Flemish Community, the French Community, the German-speaking Community, the Joint Community Commission of Brussels-Capital and the French Community Commission concerning the modalities of operation of the National Institute of Statistics, the Board of Directors of Brussels
18° Public statistics: statistics produced and disseminated by statistical authorities or other public authorities that are accessible to the public and are used to ensure the development, execution, monitoring and evaluation of public policies. "
Art. 3. Chapter V of the Act, including sections 14 and 14 bis, is replaced by a chapter comprising section 14 as follows:
"CHAPITRE V. - Provisions concerning the Belgian statistical system
Art. 4. § 1er. It is created a public institution with legal personality, known as the "Interfederal Institute of Statistics", hereafter referred to as the "IIS".
The headquarters of the IIS is established in the administrative district of Brussels-Capital.
The composition, missions and operation of the SII, on the one hand, and the responsibilities and obligations of the parties, on the other, are defined in the cooperation agreement referred to in Article 1er17°.
§ 2. The SII is managed by a board of directors whose composition and mode of operation are set out in the cooperation agreement referred to in section 1er17°.
§ 3. Are members of the ISI Board of Directors
1° The President of the Federal Public Service Economy, P.M.E., Average Classes and Energy;
2° The officer of the National Statistics Institute;
3° A member of the Board of Directors of the National Bank of Belgium.
The Office of the Plan may designate a representative to attend the Board of Directors of the IIS as an observer.
§ 4. The ISI Secretariat has its headquarters at INS. The operating mode and funding of the secretariat are set out in the cooperation agreement referred to in Article 1er17°. "
Art. 5. In chapter VI of the Act, an article 15ter is inserted, as follows:
"Art. 15ter. The transmission of confidential data may take place between statistical authorities, provided that it is necessary for the effectiveness of the development, production and dissemination of public statistics, or to improve the quality of public statistics, and in accordance with the terms set out in Chapter V of the cooperation agreement referred to in Article 1er17°. "
Art. 6. This Act comes into force on 1er January 2016.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
