The House of representatives has adopted and we sanction the following: Article 1. This Act regulates a matter referred to in article 74 of the Constitution.
S. 2. article 111 of the Act of 21 December 1994 amending of social and various provisions is replaced by the following: 'article 111 § 1.
Each of the associated authorities and statistical services set up by the communities and Regions and that have the quality of statistical authority, including the conditions to be of such quality are mentioned in chapter V of the cooperation agreement of July 15, 2014, between the federal State, the Flemish Region, the Walloon Region, the Brussels-Capital Region, the Flemish community, the French community , DG Belgiens, the Brussels-capital joint Community Commission and the French Community Commission concerning the methods of operation of the Institute interfederal statistics, the Board of Directors and the scientific of the national accounts Institute committees, published in the Moniteur belge of 20 October 2014, has always the right to consult and reuse statistical tables and forecasts, even provisional, established by other authorities involved in the context of the tasks referred to in article 109.
§ 2. Each of the associated authorities has permanently the law in the performance of its tasks set out in article 109, view and reuse the confidential data collected by other authorities in the framework of such missions.
§ 3. Associated authorities and each statistical services set up by the communities and Regions that have the quality of statistical authority are liable towards third parties with the obligations resulting from the statistical confidentiality, in accordance with the provisions of the law of 4 July 1962 on official statistics as well as the conditions laid down in chapter V of the cooperation agreement referred to in the first paragraph.
§ 4. The members, observers and experts who attend meetings of the Board of Directors of the NAI or to meetings of the scientific committees are also required to comply with the obligations resulting from the statistical confidentiality in accordance with the provisions of the law of 4 July 1962 on public statistics.
S. 3. article 113 of the Act is replaced by the following: 'article 113 § 1. The ICN is managed by a Board of Directors whose composition and functioning are regulated by the cooperation agreement referred to in article 111, § 1.
§ 2. Among the twelve members who make up the Board of Directors are members of law: 1 ° the president of the Service Public fédéral économie, P.M.E., Middle Classes and energy who sits there as a representative of the Minister having the economy in his or her attributions;
2 ° the Governor of the National Bank of Belgium;
3 ° the plan;
4 ° the Director-general of the national Institute of statistics.
§ 3. The mandate of the other members of the Board of Directors is for a term of four years and may be renewed. When a member ceases to be part of the Council for any reason before the normal end of his mandate, the person designated to replace completes the current mandate.
§ 4. The Board of Directors sits properly in the presence of the majority of its members.
In the absence of consensus, decisions are taken by a majority of the votes of the members present. In the event of parity, the voice of the president is dominating.
5. The Management Board shall adopt its rules of procedure."
S. 4. article 115 of the Act is repealed.
S. 5 section 116 of the Act, as amended by laws of March 8, 2009 and March 14, 2014, is replaced by the following: 'article 116 § 1.
It is made with the ICN four scientific committees: the Scientific Committee on national accounts, the Scientific Committee of Auditors of public administrations, the Scientific Committee on the economic budget and the Scientific Committee for the observation and analysis of prices.
The Scientific Committee on national accounts is competent to pronounce on the tasks referred to in article 108, paragraph 1, a), b), c), d), e) and (h)).
The Scientific Committee on the economic budget is competent to pronounce on the mission referred to in article 108, paragraph 1, g).
The Scientific Committee for the observation and analysis of prices is competent to pronounce on the tasks referred to in article 108, paragraph 1, i).
The Scientific Committee of Auditors of public administrations is competent to pronounce on the mission referred to in article 108, paragraph 1, j). It examines requests for opinions addressed in article 32, paragraph 1 of the cooperation agreement referred to in article 111, § 1.
These four committees are responsible for issuing an opinion on the scientific value and objectivity of the methods adopted by the ICN and the results of its work. The ICN can consult these committees at any time, on matters within their respective competence.
The ICN consults these committees when it brings a significant change to the methodology used, according to their respective competences. It must also consult them after having adopted in first reading the statistical tables, analyses and economic forecasts referred to in article 108, paragraph 1, a), c), e), g), h), i) and (j)). If the Board of Directors, after having deliberated, believes not being able to respond to a notice fully or partially opposing Committee, it annex this notice to any statistical tables, analyses or forecasts that it stops.
Field tasks laid down in article 108, paragraph 1, k), publications of the results subject annually to a public debate of the House of representatives. The latter assesses the evolution of the results, as well as the distribution and complementary indicators methodology. A summary of the results is published in the annual report of the National Bank of Belgium on economic and financial developments in Belgium and abroad.
§ 2. Except for members appointed by the respective Governments of the Regions and communities, the members of the scientific committees are appointed by the King, by Decree deliberated in the Council of Ministers.
§ 3. The composition and functioning of the scientific committees are regulated by the cooperation agreement referred to in article 111, § 1.
§ 4. Members of the committees are appointed for a period of four years, renewable. When a member ceases to be part of a Committee, for any reason whatsoever, before the normal end of his mandate, the nominee to replace him, either by the King or the Government concerned regions or communities, completes its mandate."
6. the section 117 of the Act amended by the Act of March 8, 2009, is repealed.
S. 7. article 118 of the Act, as amended by the Act of February 28, 2014, is replaced by the following: 'article
118 § 1. The financing of the costs of operation of the ICN is governed by article 35 of the cooperation agreement referred to in article 111, § 1.
The ICN operating costs which are borne by the federal State, enrolled in the FPS economy, SMEs, Middle Classes and energy budget.
The federal Government pays each year and advance to the National Bank of Belgium the costs of the additional tasks arising directly from the development of the statistics referred to in article 108, paragraph 1, j. The State and the National Bank of Belgium agree to the amount of the allowance and payment terms.
2. The ICN has its secretariat sits on SPF Economie, P.M.E., Classes average and energy. "The functioning, composition and the role of the secretariat are regulated by the cooperation agreement referred to in article 111, § 1."
S. 8 this Act comes into force on January 1, 2016.
Promulgate this Act, order that it be under the seal of the State and published by le Moniteur.
