18 DECEMBER 2015. - An Act to amend the legislation with respect to the electronic performance of acts outside the opening hours of the Registry



PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The House of Representatives adopted and sanctioned the following:
Article 1er. This Act regulates a matter referred to in Article 74 of the Constitution.
Art. 2. Section 52 of the Judicial Code, replaced by the Act of 5 August 2006, is replaced by the following:
"Art. 52. The deadline is midnight to midnight. It is calculated from the day after the day of the act or event that gives it course and includes every day, even on Saturday, Sunday and legal holidays.
Unless it is electronically performed, an act may only be validly performed in the Registry for days and hours during which the Registry must be accessible to the public.
If an act could not be completed in the registry within the time limits, even if it is prescribed in a penalty of nullity or deletion, due to a dysfunction of the justice system referred to in section 32ter, it must be completed on or before the first working day after the last day of the period, either in paper or electronically, if the computer system can be used again.
The extension of the period referred to in paragraph 3 shall apply in any event if the malfunction occurs on the last day of the period."
Art. 3. Section 882bis of the same Code, inserted by the Act of 10 July 2006, is repealed.
Art. 4. Section 26 of the Act of 10 July 2006 on electronic procedure is repealed.
Art. 5. Section 9 of the Act of 5 August 2006 amending certain provisions of the Judicial Code for electronic proceedings is repealed.
Art. 6. This Act comes into force on 1er January 2016.
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
