Posted the: 2015-12-31 Numac: 2015009849 SERVICE PUBLIC FÉDÉRAL JUSTICE 18 December 2015. -An act to amend the law with respect to the electronic fulfillment of acts outside the opening hours of the registry PHILIPPE, King of the Belgians, to all, present and to come, hi.
The House of representatives has adopted and we sanction the following: Article 1. This Act regulates a matter referred to in article 74 of the Constitution.
S. 2. article 52 of the Judicial Code, replaced by the law of August 5, 2006, is replaced by the following: 'article 52. the period is counted from midnight to midnight. It is calculated from the day following the day of the Act or event that gives courses and includes all the days, even on Saturdays, Sundays and legal holidays.
Unless it is completed electronically, an act cannot be validly accomplished in the registry to the days and hours during which this registry must be accessible to the public.
If an act could not be accomplished in the registry within the time limits, even prescribed on pain of nullity or forfeiture, due to a malfunctioning of the computer system of Justice referred to in article 32ter, this must be done no later than the first working day following the last day of the period, either in paper format or electronically, if the computer system can again be used.
The extension of time referred to in paragraph (3) applies in any case if the malfunction occurs the last day of the period. "."

3. article 882bis of the Code, inserted by the law of July 10, 2006, is repealed.
S. 4. article 26 of the law of July 10, 2006 on the procedure by electronic means is repealed.

5. article 9 of the law of 5 August 2006 amending certain provisions of the Judicial Code for the procedure by electronic means is repealed.
S. 6 this Act comes into force on January 1, 2016.
