28 AVRIL 2016. - An Act to amend the Road Traffic Police Act, coordinated on March 16, 1968, and the Act of May 19, 2010 establishing the Bank-Carrefour des véhicules (1)

To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
CHAPTER 1er. - General provisions
Article 1er. This Act regulates a matter referred to in Article 74 of the Constitution.
Art. 2. This Act partially transposes Directive 2015/413/EU of the European Parliament and the Council of 11 March 2015 facilitating the cross-border exchange of information on road safety offences.
CHAPTER 2. - Amendment of the Act of 16 March 1968
on Road Traffic Police
Art. 3. Section 62, paragraph 8, of the Road Traffic Police Act, coordinated on 16 March 1968, amended by the Act of 7 February 2003, is supplemented by the following sentence:
"If the offender does not have a fixed domicile or residence in Belgium, the copy of the report may be replaced by the notification letter referred to in Article 5 of Directive 2015/413/EU of the European Parliament and of the Council of 11 March 2015 facilitating the cross-border exchange of information concerning road safety offences. ".
CHAPTER 3. - Amendments to the Act of 19 May 2010
establishing the Banque-Carrefour des véhicules
Art. 4. Section 2 of the Act of 19 May 2010 establishing the Bank-Carrefour des véhicules is supplemented by the 16th, as follows:
"16° National contact point: the authority designated by a EU Member State under Directive 2015/413/EU of the European Parliament and of the Council of 11 March 2015 facilitating the cross-border exchange of information on road safety offences or designated by a Contracting State in the framework of an international treaty on the cross-border exchange of data for the identification of persons suspected of having committed offences in the framework of the road map ".
Art. 5. In the same Act, an article 4/1 is inserted as follows:
"Art. 4/1. The Management Service referred to in Article 2, 11°, (a), is designated as a Belgian national contact point within the meaning of Article 2, 16°. ".
Art. 6. Article 9, § 1erParagraph 2 of the Act is supplemented by the 10°, which reads as follows:
"10° the execution of Directive 2015/413/EU of the European Parliament and of the Council of 11 March 2015 facilitating the cross-border exchange of information on road safety offences and international treaties on the cross-border exchange of data for the identification of persons suspected of having committed offences under the use of the road. ".
Art. 7. Section 22 of the Act is supplemented by a paragraph written as follows:
"With respect to data exchanges under Directive 2015/413/EU of the European Parliament and the Council of 11 March 2015 facilitating the cross-border exchange of information on road safety offences, any person concerned has the right to obtain information on the personal data recorded that have been transmitted to the national contact points of the Member States of the offence, including the date of the application and the name of the Member State of the offence. ".
CHAPTER 4. - Final provision
Art. 8. This Act is effective November 7, 2013.
