29 MAY 2017. - An Act to amend the Civil Security Act of 15 May 2007 to establish training councils and a Higher Training Council (1)



PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The House of Representatives adopted and sanctioned the following:
Article 1er. This Act regulates a matter referred to in Article 74 of the Constitution.
Art. 2. In the Civil Security Act of 15 May 2007, a title VIII/2, entitled "Title VIII/2. - Training councils and the Higher Training Council".
Art. 3. In Title VIII/2, inserted by Article 2, an article 175/2 is inserted as follows:
"Art. 175/2. A training council is established in each province and in the administrative district of Brussels-Capital. ".
Art. 4. In the same title VIII/2, an article 175/3 is inserted as follows:
"Art. 175/3. Training boards are composed of:
1° of the provincial governor or authority of the Brussels agglomeration competent under section 48 of the special law of 12 January 1989 relating to the Brussels Institutions, or his delegate;
2° of the person who coordinates the formation of each provincial or administrative emergency area;
3° of a volunteer staff member and a professional staff member designated jointly by the provincial emergency areas;
4° of the director of the training centre of the province or the administrative district of Brussels-Capital or its delegate;
5° of a pedagogue from the training centre of the province or the administrative district of Brussels-Capital. ".
Art. 5. In the same title VIII/2, an article 175/4 is inserted as follows:
"Art. 175/4. The missions of the training councils are as follows:
1° to determine the training needs of emergency areas located in their territory;
2° ensure the coordination of training in the province or in the administrative district of Brussels-Capital;
3° make proposals for the improvement of the content and organization of the trainings;
4° provide advice to the Higher Training Council, referred to in section 175/5, on the organization of training;
5° to cooperate with the Federal Knowledge Centre for Civil Safety for standardised operational procedures, training, training and exercises, and to support this service."
Art. 6. In the same title VIII/2, an article 175/5 is inserted as follows:
"Art. 175/5. It is created within the Federal Interior Public Service a Higher Council of Training, below referred to as the "Superior Council".
Art. 7. In the same title VIII/2, an article 175/6 is inserted as follows:
"Art. 175/6. The High Council is composed of:
1° of the Director General of the Directorate General of Civil Security or his delegate, who chairs it;
2° of a Minister's delegate as an observer;
3° of a person responsible for the coordination of training in the emergency zone by training council;
4° of the person who coordinates the trainings in the Service d'Incendie et d'Aide médicale urgente de la Région de Bruxelles-Capitale;
5° of two delegates from voluntary staff and part of a training board, each of which has a different linguistic role, and two professional staff delegates and a training board, each with a different linguistic role;
6° of two delegates of the Civil Protection operational units, each of which has a different linguistic role;
7° of a director of a training centre located in the Flemish Region;
8° of a director of a training centre located in the Walloon Region;
9° of the director of the training centre located in the Brussels Capital Region;
10° of a French-speaking pedagogue and a Dutch-speaking pedagogue associated with a training centre and part of a training council;
11° from a representative of the Federal Knowledge Centre for Civil Security. ".
Art. 8. In the same title VIII/2, an article 175/7 is inserted as follows:
"Art. 175/7. § 1er. The High Council is mandated to:
1st to submit to the Minister proposals for the training of public emergency services with regard to:
(a) objectives and purposes of courses;
(b) organization of training;
(c) new training courses to be organized;
(d) educational standards;
2° to advise on any proposed training regulations submitted by the Minister;
3° to give the Minister an opinion on any matter he submits to him in the matter of training;
4° to report on the quality of training organized by the various training centres;
5° to approve the contents of the syllabi relating to the formation of public emergency services and their adaptations;
6° to provide the Minister with an opinion on requests for equivalence of diplomas, courses or patents and requests for exemption from courses or examinations and to submit proposals to the Minister on equivalencies or training exemptions.
§ 2. Decisions referred to in paragraph 1er, 5°, are taken by absolute majority of votes.
The President shall communicate to the Minister the opinions, proposals, decisions and reports of the Superior Council. "
Art. 9. In the same title VIII/2, an article 175/8 is inserted as follows:
"Art. 175/8. The King sets out the terms of the composition, functioning and procedures of the Superior Council and the training councils."
Art. 10. This Act comes into force on the first day of the month following the expiration of a period of ten days beginning on the day after its publication in the Belgian Monitor.
Promulgate this Act, order that it be put on the seal of the state and published by the Belgian Monitor.
