7 AVRIL 2017. - An Act to amend the Act of April 15, 1994 on the Protection of Population and the Environment from Ionizing Radiation and the Federal Nuclear Control Agency, with respect to the financing of the costs of administration, operation, study and investment resulting from the Nuclear Risk Emergency Plan (1)

To all, present and to come, Hi.
The House of Representatives adopted and sanctioned the following:
Article 1er. This Act regulates a matter referred to in Article 74 of the Constitution.
Art. 2. Section 30bis/1 of the Act of 15 April 1994 on the Protection of Population and the Environment from the Hazards of Atomic Radiation and the Federal Agency for Nuclear Control, inserted by the Act of 22 December 2008 and last amended by the Act of 15 May 2014, paragraph 4 is replaced by the following:
"Paragraph 4 To cover in whole or in part the costs of administration, operation, study and investment resulting from the nuclear and radiological emergency plan for Belgian territory, an annual fee to be charged to the State for the operators of power reactors, the amount of which is fixed as follows for the fiscal year 2017:

From the 2018 fiscal year, the amount of the dependant tax for power reactor operators is automatically revised, each year, in the course of May, on the basis of the fluctuations of the health index following the formula:
Tax Year X = [Tax of fiscal year 2017 x health index January X]/basic index.
The basic index is the health index that was applicable in January 2017 and the new index is the health index that was applicable in January prior to the revision of the tax amount.
The tax is due from the 2017 fiscal year and is collected once a year, in the course of May.
This tax ceases to be due to a nuclear reactor intended for the production of electrical energy for which a dismantling permit was issued.
It is set for the benefit of the State an annual fee for the operators of nuclear reactors for the production of electrical energy for which a dismantling permit was issued, until the dismantling of the reactors concerned is completed.
The amount of this tax is equal to that of the tax referred to in paragraph 1er on power reactors. The same indexing formula is also applied.
The tax referred to in paragraph 6 is due from the year following the issuance of the dismantling permit.
The sampling is based on the situation during the previous year.
These taxes for the benefit of the State are paid to the Federal Internal Public Service Nuclear Accident Risk Fund.".
Art. 3. This Act comes into force on the day of its publication in the Belgian Monitor.
Promulgate this Act, order that it be put on the State Seal and published by the Belgian Monitor.
