197. Regulation of the Federal Minister for Economic Affairs and Labour on the Structure of Structure Statistics in the Production Sector and in parts of the Services Division (Structural Statistics Regulation)

On the basis of § § 4 to 10 and 30 of the Federal Statistics Act 2000, BGBl. I No 163/1999, as last amended by BGBl. I n ° 71/2003, shall be assigned in agreement with the Federal Chancellor:

Arrangement for the compilation of statistics

§ 1. The Bundesanstalt Statistik Österreich (Bundesanstalt Statistik Österreich) has been responsible for the fulfilment of Austria's obligations on the basis of

1.

Regulation (EC) No 530/1999 on statistics on the structure of earnings and labour costs,

2.

Regulation (EC) No 1916/2000 implementing Regulation (EC) No 530/1999 as regards the definition and transmission of information on the structure of earnings and on the implementation of Regulation (EC) No 530/1999

3.

of Regulation (EC) No 72/2002 implementing Regulation (EC) No 530/1999 as regards the quality assessment of the structure of earnings statistics

to carry out, in accordance with this Regulation, a survey for the reference year 2002 and to produce the corresponding earnings structure statistics.

Definitions

§ 2. For the purposes of this Regulation:

1.

Social position: Distinction between workers, employees, civil servants, apprentices.

2.

Normal working time: Weekly working time according to § 68 (4) of the Income Tax Act 1988 (EStG 1988).

3.

Contractually agreed working time: Weekly working time, which differs from the normal working hours.

4.

Overtime: Hours worked over the normal working hours and paid with surcharge.

5.

Multi-hour: On the basis of the contractually (part-time) or pursuant to § 68 (4) (2) to 6 EStG 1988, reduced working time, and hours paid without a supplement.

6.

Missing days: Working days paid by the company for absence from the workplace due to illness, nursing leave, spa stay and training and other events, but with the exception of holiday days and time equalisation days.

Reporting Period

§ 3. (1) The survey shall be carried out for the reference year 2002 and the reporting month of October 2002.

(2) The characteristics referred to in Annex , point 1 (enterprises), item 2.1. to 2.14. and 2.17. are to be collected over the calendar month of October (month of reporting) 2002.

(3) The characteristics according to Appendix, point 2.15. and 2.16., point 2.18. to 2.20. are to be collected over the calendar year (reference year) 2002.

Statistical units, survey mass

§ 4. Statistical units within the meaning of this Regulation shall be:

1.

Undertakings referred to in Articles 1 and 2 of Regulation (EEC) No 696/93 concerning the statistical units for the observation and analysis of the Community economy with ten or more non-self-employed persons on the date of 31 December 1993. October 2002, which focuses on an activity under Division 10 to 74 of the Annex to Regulation (EEC) No 3037/90 on the statistical classification of economic activities in the European Community independently and with the intention of: -to obtain a yield or other economic benefits;

2.

non-self-employed persons in enterprises according to Z 1.

§ 5. (1) It is necessary to collect:

1.

on the statistical units referred to in Article 4 (1) of the Annex, the characteristics according to Annex, point 1;

2.

on the statistical units according to § 4 Z 2 the characteristics according to Appendix, point 2.

Survey types

§ 6. (1) The survey characteristics shall be collected in the following ways:

1.

the characteristics according to Appendix, point 1.1 to 1.3. and point 1.7. by using the data of the business register in accordance with § 25 of the Federal Statistics Act 2000;

2.

the characteristics in accordance with Appendix, point 1.6. and 1.8, points 2.1 to 2.5, and points 2.17 and 2.18 by the procurement of administrative data to the main association of the Austrian social insurance institutions;

3.

the characteristics according to Appendix, point 2.6 by using the data of the educational status register in accordance with § 10 of the Education Documentation Act;

4.

the characteristics according to Appendix, point 1.4. and 1.5. and points 2.15 and 2.16 by the procurement of administrative data to the financial authorities;

5.

the other characteristics (Appendix points 1.9 to 1.11, points 2.7 to 2.14 and points 2.19 and 2.20) by survey of the company.

(2) The survey of the characteristics referred to in paragraph 1 (1) (1) to (3) shall be carried out in the manner of a full survey, with the exception of the characteristics set out in points 2.1 and 2.2 of Appendix. In addition, the survey should be carried out in the form of a sample survey (§ 7).

Sample Selection

§ 7. (1) The Federal Institute has in a random procedure

1.

first of all from the business register according to § 25 of the Federal Statistics Act 2000 the enterprises (§ 4 Z 1), stratified by size classes, economic activities and regions, and

2.

Then the employees employed by these enterprises (§ 4 Z 2)

.

(2) For the selection of the enterprises and the employed persons employed in accordance with paragraph 1, the Bundesanstalt has to use the data transmitted by the main association of social insurance institutions in accordance with § 8 (1).

(3) In the selection and determination of the size of the sample, the Bundesanstalt has to take into account that the quality requirements laid down in the regulations in accordance with § 1, in particular the requirements of Article 10 of Regulation (EC) No 530/1999.

Implementation of the survey

§ 8. (1) The main association of the Austrian social security institutions has the Bundesanstalt the data in accordance with the Appendix, point 2.3. to 2.5., point 2.17. and 2.18. of all employees in October 2002 linked to the data according to point 1.6. of their Employer for the determination of the population of the enterprises with ten or more employees, for the implementation of the sampling, for the estimation of missing values and for the calculation of the sample to the To transmit the population.

(2) The Bundesanstalt has the social security numbers of the non-self-employed persons employed in the sample in accordance with § 7 (2) and (3) of the Austrian Social Insurance Institutions (Hauptverband der Austrian Sozialversicherbearer) for the procurement of the data according to Appendix 2.1. and 2.2. to be made available. The main association of the Austrian social insurance institutions has linked this data to the social security number of the respective employee of the Federal Institute.

(3) The Bundesanstalt has to submit the social security numbers of the non-self-employed persons employed in the sample in accordance with § 7 (2) and (3) to the financial authorities for the purpose of obtaining the data in accordance with points 2.15. and 2.16. The financial authorities have to transmit this data to the Federal Agency's employer, linked to the social security number of the employee concerned and to the data referred to in point 1.4. and 1.5. of his/her employer.

(4) The survey according to § 6 (1) Z 5 shall be carried out by written means. The Federal Institute has to apply the survey documents (questionnaires and explanations) in a uniform manner for the Federal Republic of Germany and to ensure delivery to the parties responsible for providing information. With regard to the collection of data on employees, the Bundesanstalt has to deliver a questionnaire in which the characteristics of the statistical units included in the sample are identified in accordance with § 4 (2) (2) (2). Appendix, points 2.1 to 2.3 are pre-printed. In addition, the Bundesanstalt has to make provision that the exchange of information and the transmission of the data can also be carried out electronically. Questions and questions can also be made by the Federal Institute by telephone.

Obligations of the holders of administrative data

§ 9. (1) The main association of Austrian social insurance institutions and the financial authorities shall make the data available free of charge on electronic data carriers in accordance with § § 6 and 8 upon request of the Bundesanstalt within eight weeks. The data are to be provided with the data descriptions and feature definitions required for processing.

(2) The data transfer in accordance with § 6 paragraph 1 Z 4 shall be carried out by the Bundesrechenzentrum GmbH as a service provider in accordance with § 10 of the Data Protection Act 2000 for the financial authorities.

Obligation to provide information to the parties responsible for providing information

§ 10. (1) In the case of the survey pursuant to § 6 (1) Z 5, the obligation to provide information is to provide information pursuant to § 9 of the Federal Statistics Act 2000.

(2) For the purpose of providing information, those natural or legal persons as well as partnerships of commercial law shall be obliged to lead a company in its own name to which a statistical unit is assigned, selected according to § 7. .

(3) The parties responsible for providing information in accordance with paragraph 2 shall be obliged to complete the survey forms laid down by the Bundesanstalt in full and to the best of their knowledge and to ensure that they are completed within three weeks after receipt of the survey documents. to the address given there.

(4) If an entreptier does not reside in the country or place of residence or place of business, the Fiscal Representative (pursuant to Section 27 (8) of the VAT Act 1994) shall be obliged to provide information for the exchange of information.

Information on the purpose of collection, data protection and information and co-action obligations

§ 11. (1) The Federal Statistical Office (Bundesanstalt Statistik Österreich) has to inform the parties responsible for providing information in accordance with § 10 on the purpose of the survey and the data protection measures taken.

(2) The Federal Institute of Statistics Austria has the right to provide information and to cooperate on the legal consequences in accordance with Section 66 of the Federal Statistics Act 2000 in the event of refusal of participation or information and in the case of knowingly incomplete or non-compliance with the law. to provide the best knowledge of the relevant information.

Publication

§ 12. Within two years from the end of the reference year, the Federal Statistical Office of Statistics Austria has to publish the main results of the survey in printed form and at the same time to make it available to the public free of charge on the Internet. The volume of the printed publication as well as the Internet version available free of charge has to comply with the standards customary in 2003 in the field of international and social statistical publications of the Federal Labour Office and, moreover, to include a detailed report on the evaluation of the quality of the data, including the concepts of concept and concept of the concept (metadata) needed to understand it.

Use of gender-specific form

§ 13. To the extent that personal terms are used in this Regulation, they do not have a gender-specific meaning. They are to be used in the application to specific persons in the gender-specific form.
