223. Regulation of the Federal Minister of Transport, Innovation and Technology with which the Act implementing the Act on Driving Licensees is amended (4). Novelle to the FSG-DV)

Pursuant to Section 4b (4), Section 13 (3) and Section 31 (6) of the German Federal Law Gazette (BGBl). I No 120/1997, idF BGBl. I No 129/2002 shall be prescribed:

The Implementing Regulation, BGBl. II No 320/1997, idF BGBl. II No 42/2004 shall be amended as follows:

1. In Section 2 (1) (3), the word order shall be deleted "In addition, the date stamp and the official seal of the authority shall be affixed if medical check-ups are prescribed at short intervals as a condition;" .

5. § 3 (5) second sentence is replaced by the following sentences:

7. § 9 (1) (1) and (2) are:

" 1.

8. In § 10, third sentence, after the word " Regulation " the phrase " in the version BGBl. II No 223/2004 " inserted.

10. § 13a (4) reads:

" (4) The journey of perfection may also be carried out with others as a school vehicle and must be held within the framework of the operation of a driving school. The journey of perfection may only be carried out by the following persons:

Driving instructor or driving school teacher within the meaning of Section 7 (1) of the Regulation on the early steering authority for class B (FSG-VBV, BGBl. II No 54/1999, as amended by the BGBl version. II No 496/2002)

Driving instructors who meet the following requirements:

a minimum of one year's practical activity as a driving instructor; and

b.

the completion of eight hours of training (of which six hours on the subject-specific content and legal basis and two hours on the psychological basis for discussion, which also in groups of up to three hours) Participants may have been completed). "

11. § 13b (5) and (6) are:

" (5) The driving safety training may only be carried out on a training site situated in the federal territory, the protection of which is a danger to persons who are not connected to the practice operation or damage to such things. and which, in terms of size and equipment, complies with the following minimum criteria:

1.

Presence of a square with a length of at least 150 metres and a width of at least 40 metres (usable area of at least 6000 m) ² );

2.

Presence of a permanent sliding surface with a length of at least 40 metres and a width of at least four metres, in order to be able to carry out braking exercises at a speed of at least 50 km/h at the beginning of the sliding surface. In front of the sliding surface, there must be a starting track of at least 50 metres in length and at least 3 metres wide, the 30 metres of the starting track located immediately before the sliding surface having to constitute a straight extension of the latter. From the start of this sliding surface, there must be a fixed (asphalted or concreted) fall space of at least 3 metres in width on both sides, which widens after a maximum of 15 metres to at least 8 metres and has a width of at least 8 metres in width. (the width of the sliding surface and the space on both sides) extends along the sliding surface and up to 30 metres after the end of the sliding surface;

3.

Presence of a sliding surface in a circular path in a sector of at least 90 °, an external radius of at least 20 metres and a width of at least four metres, at a speed of at least 30 km/h at the start of the Sliding surface to be able to carry out cornering and curve braking exercises. From the start of this sliding surface, there shall be a fixed (asphalted or concreted) fall space of at least 2 metres in width on both sides, broadened to at least 8 metres on the outside of the curve after a maximum of 10 metres, and in the whole width (width of the sliding surface and of the space on both sides) along the sliding surface and up to 15 metres after the end of the sliding surface. This sliding surface is not required if the exercises according to paragraph 2 Z 2 lit. e and f can be carried out with a Skid-car;

4.

For the holding of class A driving safety training, a non-slip, paved or concreted area of at least 1,500 m² with a minimum length of 120 metres shall be required within the training place, which shall be the minimum length of the training place. without the use of the exercises laid down in paragraph 3 (2), without any risk;

5.

the presence of an irrigation system which allows the continuous irrigation of the surface of the slide, where the use of chemical lubricants is not permitted;

6.

Presence of a speedometer with a large display which allows the participant and the instructor to read the speed at the beginning of the sliding surface;

7.

presence of speech radio in each participating vehicle and for the instructor;

8.

Presence of a seminar room and corresponding sanitary facilities for the realization of the theoretical part and the traffic-psychological group discussion for a total of 14 people, set up to present stand-and-move images;

9.

the presence of appropriate training materials; and

10.

Presence of at least 30 guide cones, tipping rods or the like

During the practical exercises of the driving safety training, no further activity may take place on the surface intended for this training.

(6) The Commission has to decide on the authority to act as an instructor and on the suitability of the implementing body for the performance of driving safety training in accordance with Section 4a (6) of the FSG. In this context, the Commission has

the existence of the conditions laid down in paragraph 4,

2.

the existence of the conditions set out in paragraph 5 concerning the size and equipping of the training place for driving safety training,

3.

The number of groups that can carry out the practical part on the practice site at the same time

to decide. In addition, the contents of the driving safety training referred to in paragraphs 2 and 3 shall be determined by this Commission. If the requirements of Z 1 and 2 no longer exist, the competent authority shall be notified. This has the right to revoke the respective authorization by a communication. The Commission shall decide by a majority of votes, with the associations referred to in Article 4a (6) (1) of the FSG having only one vote. "

12. In § 13c (3), before the word "Psychologists" the phrase "without prejudice to the provisions of paragraph 4" inserted and the phrase "or complete" No.

13. In § 13c, the following paragraphs 4 and 5 are added:

" (4) Psychologists who are in training as instructor in accordance with § 7 paragraph 1 FSG-NV or traffic psychologists according to § 20 (1) and (2) FSG-GV are authorized to conduct the traffic-psychological group interview if they

14. In § 14, the following paragraph 5 is added:

" (5) § 2 (3) to (5) in the version BGBl. II No 223/2004 shall enter into force on 1 July 2004. '
