238. Regulation of the Federal Minister for Agriculture, Forestry, the Environment and Water Management, amending the Regulation on accompanying documents and forms under the Wine Act 1999

Due to § § 33 and 34 of the Weingesetz 1999, BGBl. I n ° 141, as last amended by the Federal Law BGBl. I n ° 3/2004, shall be arranged:

The ordinance of the Federal Minister of Agriculture, Forestry, Environment and Water Management on accompanying documents and other forms according to the Wine Act 1999 (Weingesetz-Form Regulation), BGBl. II No 512/2002, shall be amended as follows:

1. In Section 1 (1), the word order shall be "the accompanying documents in the plant" through the phrase "The forms for the accompanying documents issued by the Federal Ministry for Agriculture, Forestry, the Environment and Water Management" replaced.

(2) the following paragraphs 3 and 4 are added:

" (3) The scope of application of this Regulation shall apply to wine-growers and winegrowers in the sense of the national wine-growing laws and, outside the scope of application of the Landesweinbaugesetzen, establishments which have a total surface area of at least 500 m 2 farming. The scope of this Regulation shall also apply to wine-making establishments which purchase wine for the purpose of resale in containers holding a nominal volume of at least 60 litres or which produce wine from grapes purchased.

(4) The location of the holding in which the wine is produced or stored in containers with a nominal volume of more than 60 litres, or the location of the vineyard, shall be declared as an operating address (permanent establishment). The delivery address is the address on which consignments of the Bundeskellereiinspektion can be delivered. This is the operating address, in the absence of a delivery possibility at the operating address, this may also be the apartment or other accommodation of the recipient. "

3. In § 4 (1), first sentence, the word order shall be "The form sheets for the accompanying document for the carriage of wine products and the transport certificate in accordance with the Wine Act 1999 pursuant to the Annex" through the phrase "The forms issued by the Federal Ministry of Agriculture, Forestry, the Environment and Water Management for the accompanying paper for the carriage of wine products and the transport certificate in accordance with the Wine Act 1999" replaced.

4. § 4 (1) last sentence reads:

" These companies have to enter the following data in detail for each individual recipient in the operating register set up by the Bundeskellereiinspektion pursuant to § 32 of the German Wine Act 1999: operational number, name and first name, The operating address and delivery address (postcode, city, street, house number), the number of pieces issued, the numbers of the issued forms and the date of the issue. 5. § 4 the following paragraph 8 is added:

" (8) The forms for the accompanying document for the carriage of wine products and the transport certificate in accordance with the Wine Act 1999 shall be at least seven after the end of the calendar year in which they have been issued or forwarded.
