251. Regulation of the Federal Minister for National Defence on the selection of the training of troop officers, on the troop of officers ' training course and on the service test for the use group M BO 2 (troop of official training regulation-TOV)

On the basis of § § 26 to 31 and 149 (5) of the Civil Service Act 1979, BGBl. No. 333, as last amended by the Federal Law BGBl. I n ° 130/2003, shall be arranged:

Scope

§ 1. (1) This Regulation shall govern

1.

the selection of the training of troop officers,

2.

the troop officers ' passage and

3.

the service test for the use group M BO 2.

It is not to be applied to music officers.

(2) The personal expressions used in this Regulation shall relate to women and men in the same way as far as content is concerned.

Construction of troop officers training

§ 2. (1) The training of troop officers is to be carried out by the Theresians Military Academy. It comprises the Diploma degree course "Military Leadership" and the troop of the officers ' training course.

(2) The University of Applied Sciences Diploma Course "Military Management" lasts eight semesters, including the necessary professional internships.

(3) The troop fecal duct shall comprise:

1.

seven sections of training with a total duration of at least 40 weeks and a maximum of 44 weeks, which take place during the semester-free period as well as outside the professional internships of the "Military Leadership" degree course, and

2.

Military trainings during the semester after Z 1 outside of the respective courses.

The training sections after Z 1 shall include those in the Appendix 1 Teaching subjects included (teaching and timetable). The first to fourth and seventh sections of training have been held at the Theresians Military Academy. The fifth and sixth parts of the training programme shall be based on the training centre eligible for the application of the applicant. Appendix 2 to be held.

Objectives of the training of troop officers

§ 3. (1) The training of troop officers shall provide the knowledge and skills necessary for the performance of the duties as commander of a subunit or as a specialist officer, as well as in each case as deputy unit commander at home and abroad. . In addition, the basic qualification for the entire professional exercise as a manager and military expert in the Federal Army is to be obtained. The necessary knowledge shall be achieved by:

1.

Transfer of the necessary expertise in the field of military leadership, military education, military policy and in the legal field on the basis of the respective state of science,

2.

Analysis of current problems in the areas after Z 1 and the independent development of solutions under networked application of the acquired knowledge,

3.

Transfer of communicative and organizational skills for the implementation of projects and work within a team,

4.

Transfer of knowledge, skills and skills to the appropriate use of information and communication technology,

5.

Teaching the ability to communicate in a foreign language in writing and orally in order to fulfil specific tasks, as well as to read foreign-language specialist literature,

6.

Placement of work-related forms of work and thought in the respective weapons degree or discipline, including their reflection in the context of comprehensive interrelationships,

7.

the integration of the experience of previous and study-related practical activities; and

8.

Practical teaching of the leadership skills required to guide military organizational elements, mainly at the level of the sub-unit.

(2) The troop officers ' training course has as a predominantly practical training

1.

to communicate and consolidate the management capacity referred to in paragraph 1 (8), and

2.

to provide the additional and complementary knowledge, skills and abilities necessary for the exercise of the profession in armed forces at the level of a sub-unit and for the coverage of specific operational requirements.

Selection procedure

§ 4. (1) The candidates for the training of troop officers are to be selected during the preparatory semester by determining their personal and professional aptitude to the troop officer. This appropriateness is to be determined by a selection committee based on the personal ability to conduct a military organization element. The places of study are to be assigned according to the free study places, taking into account the determined personal and professional competence of the applicants.

(2) The admission requirements for the selection procedure are:

1.

(a) the tyre test; or

b)

the officers ' relegation test, or

c)

the study authorization test, or

d)

the additional examination for the university of applied sciences diploma course "Military Leadership",

According to Z 13.13, paragraph 1, lit. a of Annex 1 to the Official Services Act 1979 (BDG 1979), Federal Law Gazette (BGBl). 333,

2.

(a) in the cases of Z 1 lit. a and c the successful completion of the necessary sections within the framework of the cadre training for conscripts of the militia and reserve assets, or

b)

in the cases of Z 1 lit. b and d the successful completion of the basic training for the use group M BUO 2 and a total service period of at least seven years from the start of the basic military service

and

3.

a life age of not more than 29 years in the calendar year of the preparatory semester.

(3) The maximum age pursuant to paragraph 2 Z 3 shall not apply to military pilots. In addition, the Federal Minister for National Defence shall be able to look at the exceeding of this maximum age at the request of the applicant in accordance with important personal interests.

Preparation Semester

§ 5. (1) During the preparatory semester, the following are to be evaluated:

1.

the knowledge and application of the military leadership process, as well as the guiding principles and operational principles,

2.

the ability to conduct in battle at the level of the lower military leadership,

3.

knowledge, skills and skills in the field of exerceration, weapons and equipment, as well as maps and terrain,

4.

the knowledge of the laws and regulations governing the department of the ministry of defence of the Federal Ministry of Defence, as well as of the army,

5.

physical performance and

6.

the general personal and professional aptitude for training as a troop officer.

(2) The evaluation shall be carried out

1.

in the cases referred to in paragraph 1 (1) (1) and (4), by written written exams,

2.

in the cases referred to in paragraph 1 (2), (3) and (5), by means of practical

3.

in the case of paragraph 1 Z 6, on the basis of observations, surveys and investigations by the members of the selection committee, and of interviews with the candidates with members of the Commission.

Selection Commission

§ 6. (1) A selection committee shall be established at the Theresian Military Academy for the selection of candidates for training in troop officers. This Commission shall consist of:

1.

the chairman and

2.

the required number of other members.

(2) The head of the relevant organization element of the Theresian Military Academy shall have the Chairperson and the other members from the circle of officials of the use groups M BO 1 or M BO 2 or equivalent use groups for the Duration of one year. If necessary, the selection committee for the remainder of the respective functional period shall be supplemented by additional members.

(3) Membership of the Selection Committee according to paragraph 1 shall end with the expiry of the period of order or with the final imposition of a disciplinary penalty or with the suspension of the term abroad or with the departure from the status of the service.

(4) The selection committee has to decide in senates. For reasons of expediency, the Chairman may arrange for individual assessments to be made pursuant to § 5 by a single member of the selection committee.

(5) The senate shall consist of at least three members of the selection committee. The members of the Senate are to be determined by the chairman of the selection committee from among the members of the selection committee according to the technical requirements for the respective evaluation according to § 5. A member of the Senate is to be entrusted with the chairmanship of the Council. The Senate has to decide with a simple majority of votes after non-public deliberation. A abstention is inadmissible. In the event of a tie, the vote of the chairman of the Senate shall decide.

(6) The assessment results of the selection committee and the results of an appropriate admission procedure (assessment) for admission to the university of applied sciences diploma course are for admission to the training of troop officers training. "Military Leadership" together.

(7) In the case of negative assessments, the Senate has to decide on the admission of the respective applicant to the examination for officers of the militia.

Troop officers ' walk

§ 7. (1) Only those applicants who have been admitted to the "Military Leadership" Diploma Course of Applied Sciences are to be admitted to the first section of the training of the training of the troop officers. For the second to seventh training sections of the troop officers 'course, only those applicants who have the preceding training section of the troop officers' course and the semester preceding this training section shall be admitted to the training section. of the "Military Management" degree course of the University of Applied Sciences, within the time limits laid down for this purpose.

(2) If compelling service reasons require it, the head of the responsible organizing element of the Theresians Military Academy may have individual teaching content assigned to a training section after Appendix 1 of an examination subject to an examination subject to the other training section. In any case, all teaching contents of an examination subject are to be completed by the applicant until the end of the troop official training course.

(3) A training section shall be completed if the course contents of the respective examination subjects assigned to the respective training sections have been successfully filed.

(4) In the event of an establishment case by a Commission, the further existence of the personal and professional aptitude of an applicant to the troop officer is to be determined during the troop of the officer's training course. In particular, the respective leadership competence and social competence are to be assessed. Section 6 (1) to (5) on the education, composition and decision-making of the selection committee shall apply to this Commission, subject to the proviso that the appointment of the Chairman by the Commander of the Theresianic Military Academy shall be applied. shall be made.

(5) For Applicants,

1.

who are leaving the "Military Leadership" degree course of the university of applied sciences, or

2.

whose lack of personal and professional competence has been established by the Commission in accordance with paragraph 4;

The admission to the troop officers ' course shall be issued.

Examination regulations for the troop officers ' passage

§ 8. (1) The troop training course includes the examination subjects

1.

General train commandant training,

2.

Supplementary training in the field of weapons or specialisation,

3.

Officers ' exchange rate for peace-supporting operations (OCC/PSO),

4.

physical education,

5.

Training for the Bundesheer-Sportausbilder und Lehrwart,

6.

Heeres-Hochalpineducation or specialized troop training as a qualified replacement and

7.

In-depth skirmish and shooting training.

The level of requirements arises from the teaching contents of Appendix 1.

(2) The examination subjects shall be placed in partial exams.

(3) The partial examinations are to be deposited in the examination subjects

1.

1, 1, 2, 4 and 7 before individual examiners and

2.

1 Z 3, 5 and 6 before an examination senate.

(4) The partial examinations are to be deposited in the examination subjects

1.

pursuant to paragraph 1 (1) (1) to (3) in writing, oral and practical,

2.

in accordance with paragraph 1 (4) and (7),

3.

According to paragraph 1, Z 5 and 6, oral and practical.

Written examinations are to be held in the form of a written examination and may not last longer than four hours. If a test compartment consists of more than one of the above-mentioned test parts during a training section, then the last part of the test piece gives the test piece.

(5) After completion of the course contents of an examination subject assigned to a particular section of the examination, the candidates shall be appointed by the head of the relevant organizational element of the Theresianian Military Academy for the respective partial examinations. to be assigned (audit plan). (6) The partial exams not passed in the examination subjects according to paragraph 1 Z 1 to 4 can be repeated twice. The repeat tests shall be made possible within three months. In the event of a negative assessment of the second repeat examination in a test subject pursuant to paragraph 1 (1) to (4), the applicant's admission to the troop of the training course shall be deleted.

Examination regulations for the official examination of the use group M BO 2

§ 9. (1) The admission to the service examination shall take place after completion of the

1.

"Military Leadership" and the degree course of the university of applied sciences and

2.

of all sections of the troop officers ' passage.

Applicants who have not completed the training in accordance with Z 1 and 2 may not be admitted to the service examination.

(2) The service examination shall include the examination subjects

1.

Management and use at the level of the subunit,

2.

Austrian constitutional law and administrative organisation,

3.

the right of service and remuneration of the Federal staff member, including the right of human resources representative,

4.

Administrative procedural law and

5.

Defense law.

(3) The examination subject referred to in paragraph 2 (2) (1) shall be submitted orally as an overall examination before an examination senate in the weapon or subject area eligible for the candidate in each case. Section 8 (6) of the first and second sentences on the repetition of examinations shall apply to this examination subject.

(4) The necessary knowledge in the examination subjects according to subsection 2 (2) (2) to (5) are proven by the completion of the "Military Leadership" degree course of the university of applied sciences.

Audit bodies for the troop officers ' passage and the service examination

for the use group M BO 2

§ 10. (1) The Examination Committee shall consist of:

1.

the Commander of the Theresianic Military Academy as Chairman and

2.

the required number of other members.

(2) The other members shall be from the circle of officials of the categories M BO 1 or M BO 2 or equivalent categories of use or of comparable contract staff or other persons recognised in their subject for the duration of the of five years. If necessary, the Examination Committee is to be supplemented by additional members for the remainder of the respective functional period.

(3) According to § § 8 and 9 of the examination board, the examination board shall consist of no more than four members of the examination board in accordance with the technical requirements for the respective assessment. In the event of a tie, the vote of the chairman of the Senate shall decide.

Transitional provisions

§ 11. (1) The successful completion of the basic training for the use groups M BO 2 and H 2 in accordance with the regulations in force at the time of the respective conclusion shall be considered to be a successful completion of the training of the troop officers in accordance with this Regulation.

(2) Applicants who have completed the training of troop officers before the 1. Since January 2003, the Regulation applicable until 30 June 2004 shall continue to apply.

In-and Out-of-Force Trees

§ 12. (1) This Regulation shall enter into force on 1 July 2004.

(2) At the end of June 30, 2004, the Federal Minister of State Defense's Regulation on the selection and training of the troop officers shall enter into force in the Official Journal I of the Federal Ministry of Defence, No 119/1999, in the following: Connection with BGBl. II No 138/1997, except for force.
