Due to the federal law on regulations for the facilitation of electronic traffic with public authorities (E-Government Law-E-GovG), BGBl. 1, in particular § § 9 (1) and (2), 10 (2) and 13 (1), as well as § § 16 to 22 of the Federal Act on the Protection of Personal Data (Data Protection Act 2000-DSG 2000), BGBl. I n ° 165/1999, in the version of the Federal Law BGBl. I n ° 136/2001, shall be:
Data application mapping
§ 1. Each data application (§ 4 Z 7 DSG 2000) of a contracting authority of the public sector (§ 5 sec. 2 DSG 2000) is to be assigned to a state activity area within the meaning of § 9 paragraph 2 E-GovG, if within the scope of this application area-specific Person tags should be used. The purpose of the data application is the purpose of the assignment, which the client pursues with the data application.
Setting the mapping
§ 2. (1) The assignment of a data application to a public sphere of activity within the meaning of Section 9 (2) of the E-GovG is to be determined in the registration of this data application in the data processing register in accordance with § § 16 to 22 DSG 2000. For standard and sample applications, the assignment is to be shown in the Standard and Pattern Ordinance.
(2) The assignment is to be made clear by the fact that the data type "area-specific person identification" indicates the name of that activity area, together with the area identifier, to which the data application was assigned.
Areas of activity
§ 3. (1) For the purpose of a uniform approach in the allocation of data applications to government activities, the areas of activity apparent from the Annex are distinguished and for the formation of the area-specific areas of activity. (2) The areas of activity referred to in Part 2 of the Appendix to paragraph 1 shall be used if cross-cutting data applications, in particular for the provision of central services, are set up in the case of a contracting authority.
(3) If the prohibition of using incompatible data uses in the same field of activity requires, individual data applications or categories of data applications shall be subject to further breakdown of the data referred to in the annex to paragraph 1. To assign areas to their own area of activity and thus to provide them with their own area-specific personal identification. The guidance of a data application with its own area-specific person identification can be required, in particular, as a result of the sensitivity of the content or the purpose of the data application. The designation of such areas of activity and their scope identifier are to be made clear in accordance with § 2 (2).
Duties of the Data Protection Commission
§ 4. (1) The Data Protection Commission shall, as the register authority of the data processing register, ensure that in those cases which are not covered by Section 3 (3), the name of the activity area used in the registration and the name of the Scope identifier corresponds to the substantive and formal requirements of § 3 (1) and (2) and the annex thereof.
(2) On the admissibility and, if necessary, necessity of the assignment of a data application to a further breakdown of the areas of activity listed in the annex in accordance with § 3 paragraph 3, the Data Protection Commission shall have in the proceedings according to § § 16 bis 22 DSG 2000.
Person identification for organ walters
§ 5. By way of derogation from § § 2 to 4, for persons who are affected by a data application in their role as an organ walter, the area-specific person identifier-irrespective of the assignment of the data application to an activity area-is to form a uniform manner in accordance with Section 13 (1) of the last sentence of the E-GovG.
Master Number Register Authority Access
§ 6. For the purpose of generating area-specific personal identifiers according to § 10 para. 2 E-GovG, the root-number register authority has access to the range identifiers registered in the data processing register in the data applications.
