354. Regulation of the Federal Minister of Transport, Innovation and Technology with which the Civil Aviation Staff Regulation is amended

Due to § 29 of the Aviation Act, BGBl. No. 253/1957, in the version of the Federal Law BGBl. I No 73/2003, shall be assigned:

The Civil Aviation Personnel Regulation (ZLPV), BGBl. No 219/1958, as last amended by the BGBl Regulation. II No 442/2003, shall be amended as follows:

1 and 7, § 8 (4), § 9 (1) and (3), § 10 (6), § 14 (4), § 17 (1), § 21 (2), § 22 (1) first and second sentence, § 22 (2), § 112 (3) and § 156 (2), the words "the Federal Office of Civil Aviation" in each case by the words "the competent authority" In the appropriate case, the appropriate case is lower.

9. In § 10, the following paragraph 8 is added:

11. § 15 para. 1 first sentence reads:

"The Federal Minister for Transport, Innovation and Technology has to form the following audit commissions for civil aviation personnel with the competent authority:"

12. § 15 para. 2, first sentence reads:

"The Federal Minister for Transport, Innovation and Technology shall, with the competent authority, form the following examination commissions for civil aviation teachers and teachers of other civil aviation personnel:"

13. In the third sentence of § 16 (3), the citation " § 15 para. 1 under lit. i and k to r " through the citation " § 15 para. 1 under lit. k to r " replaced.

14. In § 19 (3), the words "On each test flight" by the words "In each exercise of the exam flight" replaced.

15. In § 19 (4), the third sentence and the fourth sentence are deleted.

16. § 19 (5) reads:

" (5) Simulated emergency landings shall be carried out only with single-engined aircraft. The gliding flight has to be carried out in motor aircraft with fully throttled engines. "

" Opinion on the professional competence of glider pilots, pilots of slopes and paragliders as well as parachutists

§ 23. (1) The competent authority shall obtain an opinion from two flight instructors on the professional competence of glider pilots, paratroopers and pilots of slopes or paragliders.

(2) For the examinations referred to in paragraph 1, the provisions of § § 17 to 19 as well as § § 21 and 22 apply analogously.

(3) The competent authority may, in the light of the technical requirements, order that additional and verifiable tests should be carried out only by one of the two examiners. "

22. In § 27 (4), the following sentence shall be added at the end:

"The audit compensation shall be at the same level as the examiners for the acceptance of tests to obtain a basic authorization, an extension of the basic authorization or a special authorization."

23. § 29 (1) first sentence reads:

" If you are applying for a private pilot certificate, you must prove that, within the last twelve months prior to the application, you have a total of at least 40 hours of motor flights, at least 10 hours as a single flight, with no more than 5 hours before the application. Hours of navigation flight (§ 32) can be credited. "

The first sentence of Article 29 (4) reads as follows:

26. § 31 together with headline reads:

" Practical Private Pilot Examination

(2) The examination tasks shall be carried out on a single-engine aeroplane weighing up to 5700 kg.

(3) In the case of motor aircraft, if the applicant is to face a type of weight category B, he shall take the practical test on a motor aircraft of this type.

(4) In the case of motor assistance (Annex IV-1, section 4b), the candidate shall land after a round of seats, with a target area of 50x50 m being set on the target surface.

(5) In the case of simulated emergency landing exercise (Annex IV-1 Section 5b), the applicant shall land at a height of 600 m above place after request (signal), with a target surface area of 100x50 m to be set without motor assistance. "

27. § 32 together with the title is:

" Navigation flight prior to granting a private pilot

§ 32. (1) The applicant for a private pilot certificate shall demonstrate, without prejudice to the conditions laid down in § 29, that he has carried out a navigation flight after the theoretical and practical examination has been completed.

(2) The navigation flight shall be carried out over a distance of at least 300 km of air line with two previously defined ports of call, possibly in one day. The navigation flight must be carried out within a period of at least 12 months after the completion of the private pilot examination.

(3) The navigation flight in which the applicant must be alone on board a motor aircraft shall be carried out, including the flight preparation, within the framework of a civil aviation school. "

28. In § 33 (1), the words " 2 to 4 " by the words " 2 and 3 " replaced.

29. § 33 (2) reads:

" (2) The theoretical additional examination for private pilots includes knowledge of operating limits, exceptional procedures and emergency procedures, cell, engine, systems, instrumentation and equipment of the type of motor aircraft to which the extension is based. shall be extended. "

30. § 33 (3) reads:

"(3) In the case of a practical additional examination for private pilots, the applicant shall have on a motor aircraft of that type for which the authority is sought to carry out the sections specified in Annex IV-1 in the specified tolerances."

" The flight times required for the extension of a private pilot type entitlement may be replaced by a verification flight under the appropriate application of Section 33 (3) under the supervision of an expert appointed by the competent authority. "

35. § 34 (5) reads:

" (5) If the allowances have been granted for more than three years, the applicant shall also be required to prove that, after the theoretical and practical examination referred to in paragraph 4 has been laid down, he shall fly a navigation flight in accordance with the provisions of section 32 (2) and (3). "

Article 36 (1) reads as follows:

" (1) The professional pilot licence shall be entitled, free of charge or for remuneration, for non-commercial or commercial purposes, to fly the following engine aircraft in flight (basic entitlement for professional pilots), with this entitlement within the scope of the remuneration or commercial transport as a responsible pilot to aircraft which may be carried by a pilot in the flight is restricted:

37. In § 36 (2), after the words "one or more type permissions" the words "B or" inserted.

" Theoretical Professional Pilot Examination

" Practical professional pilot examination

(2) The examination tasks shall be carried out on a motor aircraft, namely:

(3) In the case of the applicant, if the weight class D is to be given a type authorization, he shall have the practical test on a motor aircraft of this type. "

42. § 40 together with headline reads:

" Extensions of the basic entitlement for professional pilots

§ 40. (1) The basic authority for professional pilots pursuant to Section 36 (1) (1) (1) shall be extended on request to extend the eligibility of motor aircraft of weight class B and C in flight, provided that the applicant has his professional competence in the case of an additional examination after , the provisions of paragraph 2 have been established. This extended entitlement is restricted in the context of a pilot or commercial carriage as a responsible pilot on aircraft which may be carried by a pilot in the flight.

(2) The theoretical additional examination for professional pilots referred to in paragraph 1 shall include knowledge of operating limits, exceptional procedures and emergency procedures, cell, engine, systems, instrumentation and equipment of the type of motor aircraft on which the Practical additional examination. 43. § 49 (1) reads:

" (1) The line pilot licence shall be entitled, free of charge or for remuneration, non-commercial or commercial, motor aircraft of the weight categories A, B and C (Class authorizations A, B and C) and a specific type of weight classes D, E and F (Type authorizations D, E or F) in the flight, the practical test for line pilots on an aircraft of this type being to be deposited in accordance with § 51 (2) (Basic authorization for line pilots). "

Section 49 (3) reads as follows:

" (3) The line pilot also has the special authorization,

the radiotelephone service in accordance with § 127 (full speech radio authorization), and

Section 50 (1) reads as follows:

" Line piloting

48. § 52 (2) reads:

49. § 53 (1) reads:

" (1) For the extension of the basic authorization referred to in § 49, including any extension to types of classes D, E or F, the applicant has to prove that he or she has received motor flights within the last 6 months prior to the application for a total of at least 50 hours, including 10 landings. 56. § 74 with headline reads:

" Theoretical examination for professional helicopter pilots

§ 74. The contents of the theoretical test (§ 18) for professional helicopter pilots are the objects mentioned in § 67, to the extent that they are of importance for professional helicopter pilots. "

57. In accordance with § 79, the following § § 79a to 79f are inserted in each case together with the heading:

" Instrument flight authority for helicopter pilots

§ 79a. Application for an instrument flight authorization for helicopter pilots

§ 79b. (1) If you are applying for an instrument flight authorization, you have to prove that he/she is

Helicopter flights of a total duration of at least 150 hours as a responsible pilot, of which at least 20 hours have been carried out within the last twelve months prior to the application.

(2) In the flight time required in accordance with paragraph 1, must be included or must be additionally proven:

1.

Overland flights of at least 50 hours duration as a responsible pilot, of which helicopter flights are at least 10 hours,

2.

Instrument flights with helicopters under the supervision of an instrument flight instructor for helicopter pilots of at least 50 or, if the practical test is to be carried out on a multi-engined helicopter, of at least 55 hours, of which: at least 15 hours with multi-engined helicopters. The required instrument flight time shall be fully calculated on an instrument flight training device for helicopters up to the extent of 20 hours.

(3) The holder of an instrument flight authority for motor aircraft pilots (§ 59) shall have instrument flights with helicopters under the supervision of an instrument flight instructor for helicopter pilots of at least 10 hours, by way of derogation from paragraph 2 Z 2. Proof. Exercises on an instrument flight training device for helicopters cannot be counted in this case.

Theoretical instrument flight test for helicopter pilots

Extension of instrument flight authorization for helicopter pilots

§ 79e. (1) For the extension of the authorization pursuant to § 79a, the applicant has to prove that within the last period of validity (§ 10 para. 2) he/she must conduct a proper inspection flight under the supervision of the appropriate application of Annex IV-5 under the supervision of the of an instrument flight instructor for helicopter pilots.

(2) For the renewal of a dormant entitlement in accordance with § 79a, the applicant shall have his professional competence in the case of a theoretical examination according to the provisions of § § 18 and 79c and in the case of a practical examination according to the provisions of § § 19 and 79d.

Instrument flight teaching authority for helicopter pilots

§ 79f. (1) The instrument flight instruction for helicopter pilots shall be issued on request, if the applicant has a teaching qualification for helicopter pilots and instrument flights of at least 250 hours duration, of which at least 150 hours shall be Helicopters, as well as his professional competence as instrument flight instructor for helicopter pilots, has demonstrated (instrument flight instructor examination) in the case of an additional test (§ 20).

" Basic authority for slopes or paragliders

§ 111a. (1) The slope or paraglider licence entitles the person to carry one-seater, non-motorized suspension or paraglider under the guidance of an emergency screen in the flight.

(2) The holder of a hang glider is entitled to lead paragliders if, in addition to a valid school confirmation for paragliders according to § 14 para. 3 lit. 3 lit. d to carry out 15 high-altitude flights with paragliders with a difference in altitude of at least 300 metres in a civil aviation school under the direct supervision of an authorized flight instructor.

(3) The owner of a paraglider's certificate is entitled to lead hanggliders if he/she, in addition to a valid school confirmation for hang gliders according to § 14 para. 3 lit. d to carry out 15 high-altitude flights with hang-gliders with a difference in altitude of at least 300 metres in a civil aviation school under the direct supervision of an authorized flight instructor.

Application for a hangout or paraglide ticket

§ 111b. If you are applying for a suspension or paraglide ticket, you have to prove that it has completed a total of 25 high altitude flights of at least 300 m of altitude difference and 15 high altitude flights of at least 500 m in altitude difference. (2) The applicant for a double-seat qualification for hangings or paragliders must possess the basic authorization for at least 12 months as well as a flight experience to the extent of 100 high-altitude flights with an altitude difference of at least 300 m.

(3) The practical training for pilots with a double-seat entitlement for suspension or paraglider has at least 5 flights with an authorized flight instructor as pilots and 10 flights with a holder of the basic authorization according to § 111a as Passenger under the direct supervision and guidance of an authorized flight instructor, including the appropriate flight exercises provided for in the curriculum, including a special hazard briefing. § 111g. (1) The authorization for motorized hangings or paragliders shall be entitled to the guidance of single-seater motorized suspension or paragliding ladders under the guidance of an emergency parachute.

(2) In addition to a valid basic authorization in accordance with § 111a as well as an overland authority in accordance with § 111e, the applicant for a motorized suspension or paraglider shall have flights with non-motorised slopes and paragliders to the extent of of 100 take-offs and landings, including 15 routes.
