388. Federal Minister for Defence of the Federal Republic of Germany on the basic training for officers of the Intendanzdienst

On the basis of § § 26 to 31 and 149 (5) of the Civil Service Act 1979, BGBl. No. 333, as last amended by the Federal Law BGBl. I n ° 130/2003, shall be arranged:

Scope

§ 1. (1) This Regulation regulates the basic training for military personnel of the use group M BO 1 with use in the Intendanzdienst (Intendanzlehrgang).

(2) The personal expressions used in this Regulation shall relate to women and men in the same way as far as content is concerned.

Objectives

§ 2. The Intendanzlehrgang (Intendanzlehrgang) has to convey the knowledge and skills that are necessary for the fulfilment of tasks as leadership and professional in the fields of personnel and legal systems, logistical support at the level of the middle, upper and the highest military leadership of the Federal Army as well as the requirements of the Multinational Armed Forces Alliance are necessary. The necessary knowledge shall be achieved by:

1.

Transfer of the necessary expertise in the field of international law, the law of the European Union, the ressortrelated constitutional law, the military law, the service and remuneration law of the federal staff, including the The right of representation and the administrative procedural law,

2.

Acquisition of the necessary basic and special knowledge in fields typical of the intended purpose, in particular in the areas of revision and control, the household system, the military economy, the leadership process monitoring and Results control (controlling), national and international procurement and procurement, construction, property and forestry systems, housing, damages, administrative development, environmental protection, Economic Service, the Support of Foreign Armed Forces in Austria (Host Nation Support) and civil and military cooperation (CIMIC), each in theory and practice,

3.

Transfer of the necessary expertise in the field of tactical and operational military leadership, including the essential logistical principles in national and international bars,

4.

to provide the necessary expertise in general management training, including the knowledge required in the field of national and international security policy; and

5.

Deepening and expanding the necessary foreign language skills to fulfil tasks with international reference.

The course of basic training and forms of training

§ 3. (1) The Intendanzlehrgang (Intendanzlehrgang) lasts two semesters and comprises the training subjects (teaching and timetables) contained in annexes 1 and 2. He has to take place at the State Defense Academy and is to be held according to the official needs.

(2) The provision of training content shall also be permitted in the form of seminars or e-learning systems or trainee programmes or practical uses or self-studies or other appropriate forms.

Eligibility requirements

§ 4. Admission requirements for the Intendanzlehrgang are:

1.

(a) the successful completion of a university degree in law or the social and economic sciences; or

b)

the successful completion of the ascensus after Z 1.13. of Appendix 1 to the Civil Service Law 1979 (BDG 1979), Federal Law Gazette (BGBl). 333,

and

2.

a service of at least two years as a military person in the M BO 2 use group.

Examination Rules

§ 5. (1) The service examination shall include the examination subjects

1.

Ressortreferred to constitutional law and the law of the European Union,

2.

Defence Law,

3.

Intendantese,

4.

the right of service and remuneration of federal staff, including the right of human resources representation,

5.

Ressortated administrative procedural law and office regulations,

6.

international law, in particular war and human rights law, as well as neutrality law,

7.

Military leadership, military service and operational support,

8.

Military economy,

9.

Organization of armed forces.

The level of requirements of the examination subjects is obtained from the teaching contents of Appendix 1.

(2) The service examination shall be carried out in partial tests.

(3) The partial examinations are to be deposited in the examination subjects

1.

1 to 4 verbally before an examination senate and

2.

1 Z 5 to 9 in writing to individual examiners.

Written examinations are to be held as a written examination and must not last longer than four hours.

(4) During the course of the Intendane course, the candidates shall be responsible for the drafting of a housework. The subject of domestic work must be determined by the Chairperson of the Examination Commission in accordance with the requirements of the service.

(5) The assignment to the partial exams is carried out by the Chairman of the Examination Commission (examination plan). The prerequisite for the allocation is participation in the planned training. In any case, the assignment to the final part-examination requires the positive assessment of the housework according to paragraph 4.

(6) No partial exams may be repeated twice. The repeat exams must be made within 3 months. This also applies to unpassed housework.

Audit bodies

§ 6. (1) The Examination Committee shall consist of:

1.

an official in the category M BO 1 or H 1, with use in the management of the management as chairman, and

2.

the required number of other members.

(2) The other members shall be from the circle of officials of the category M BO 1 or equivalent groups of uses, or the comparable contract staff or other persons recognized in the appropriate examination subject for the Duration of five years. If necessary, the Examination Committee is to be supplemented by additional members for the remainder of the respective functional period.

(3) The examiners of the examination subjects referred to in § 5 (1) (1), (2) and (4) to (6) must be legally valid.

(4) The examination senate shall consist of at least three members of the examination board. Preference is preferably to be taken into account. In any case, an official of the use group M BO 1 or H 1 with use in the intensity service is to be entrusted with the senate chair. In the event of a tie, the vote of the chairman of the Senate shall decide.

Transitional provisions

§ 7. (1) The successful completion of the basic training for the use group M BO 1 and H 1, in each case for use in the intensity service, according to the regulations in force at the time of the respective conclusion is considered to be a successful conclusion of the Intended use of the intendane according to this Regulation.

(2) For professional officers, the requirement of a service of at least four years as a professional officer of the use group H 2 shall be replaced by the requirement in accordance with Section 4 (2) (2).

In-and Out-of-Force Trees

§ 8. (1) This Regulation shall enter into force on 1 November 2004.

(2) With the expiry of the 31. October 2004 the Federal Minister for National Defence of the Federal Republic of Germany enters into contact with the Federal Ministry of Defence for the basic training of officers of the Federal Ministry of Defence No. 153/1998, in connection with the Federal Ministry of Defence. BGBl. II No 138/1997.
