Part 1

General provisions

Scope

§ 1. This Regulation shall apply to:

1.

steam boilers,

2.

pressure vessels and

3.

Piping

and regulates the safety measures for their operation.

Definitions

§ 2. For the purposes of this Regulation:

1.

Volume:

The pressure, which is surrounded by the walls of the steam boiler or the pressure vessel, in litres up to the delineation according to Z 5. The volume of non-compressible internals firmly connected to the walls during operation is not included therein.

2.

Nominal size DN:

According to ÖNORM EN ISO 6708 ( Appendix 4 ) the numerical size designation for components of a pipe system, which is only indirectly related to the production dimensions in millimetres. The nominal width is expressed by DN, followed by a dimensionless whole number. If pipes or components of a pipe system cannot be specified with the nominal width, the measure of the replacement diameter or of the clear diameter shall be used in millimeters.

3.

Print content product:

This value, which is relevant for the energy stored in the boiler or pressure vessel, is

a)

for steam boilers, the product of the highest operating pressure fixed in the bar, multiplied by the water content up to the NW mark (lowest water level), in the case of continuous boilers with the total volume content (volume), in litres;

b)

for pressure vessels, the product of the highest operating pressure fixed in the bar multiplied by the volume in litres.

The print content product is specified only as a measure (without dimension).

4.

Nominal print product:

This value, which is relevant for the hazard potential of pipelines and is formed from the product of the highest operating pressure fixed in the bar multiplied by the maximum nominal width of the pipeline. The print name product is specified only as a measure (without dimension).

5.

Delimitation of steam boilers, pressure vessels and pipelines:

Steam boilers and pressure vessels, including the directly connected piping, are valid up to the first shut-off or emptying device. Pipelines shall apply to the shut-off or emptying device or to that limit from which other monitoring measures are required, such as different risk potentials, different test stages, different specific test stages Validators. Releasable connections, such as flanges or threaded ends, also apply as a shut-off or emptying device.

6.

Steam boilers and pressure vessels at risk of overheating:

By means of flames, flue gases, other fluids, solid substances and steam boilers or pressure vessels or their components heated by radiation or other forms of energy which, in the event of a failure of the cooling (heat dissipation), adversely affect the integrity of Changes in the properties of the material, which could result in a reduction in pressure resistance, stability or the intended service life, which is not taken into account in the design. Safety devices on the steam boiler or pressure vessel itself, which reduce or interrupt the supply of heating energy when a specified temperature is exceeded, are not suitable for the purpose of this provision, and the risk of overheating to turn off.

7.

Ingredients:

The fluids present in the steam boiler, pressure vessel or in the pipeline, taken into account in their design and provided. These can be present as gases, liquids and vapors as pure phase or as mixtures. They may also contain solids.

8.

Ingredients of group 1:

Ingredients according to Z 7, which according to § 3 paragraph 1 Z 1 to 7 chemicals law 1996-ChemG 1996, BGBl. I No 53/1997, as amended, shall be classified according to its characteristics as:

a)

explosive,

b)

highly flammable,

c)

easily flammable,

d)

flammable (if the highest operating temperature is higher than the flash point),

e)

very toxic,

f)

toxic or

g)

fire-promoting.

9.

Ingredients of group 2:

All non-Z 8 ingredients according to Z 7.

10.

High quality of the pressure vessels or the pipeline:

High quality of the pressure vessels or of the pipeline is then present if, during their design, production and related testing, special measures have been set which prevent or substantially reduce possible damage caused by the operation.

11.

Increased corrosive effects:

These are available if, taking into account the interaction of the ingredient and/or the substance, External medium, temperature and pressure as well as wall material and condition corrosion species according to ÖNORM EN ISO 8044 (Appendix 4) or , according to similar standards, or similar phenomena, which have the following effects:

a)

a surface-acting corrosion which, during the service life of the steam boiler, pressure vessel or pipeline, could result in a greater corrosion loss than the corrosion surcharge carried out and documented on the walls, or

b)

A locally acting corrosion, eg mulden or hole corrosion, which could affect the tightness of the steam boiler, pressure vessel or the pipeline, or

c)

a locally occurring corrosion acting together with a mechanical load, e.g. stress cracking or vibration corrosion cracking, which could impair the integrity (pressure resistance) of the steam boiler, pressure vessel or the pipeline.

Erosion and abrasion are, if effects on the steam boiler, pressure vessel or the pipeline in the sense of the lit. a to c may give rise to an increased corrosive effect.

12.

Mode of operation of pipelines:

The operating mode of piping is determined by the following parameters:

a)

Fluid (ingredient, outer medium),

b)

pressure and pressure variations,

c)

temperature and temperature fluctuations,

d)

Flow rate,

e)

predominantly stationary or cyclic operation,

f)

above-ground/underground laying,

g)

Laying outdoors/laying in rooms,

h)

Type of insulation.

13.

Surveillance measures:

In the operating phase of the steam boiler, pressure vessel or pipeline, investigations, inspections, checks, checks and analyses to be carried out.

14.

Out-of-operation:

This is the case if the operator, or , at the instigation of the operator of the steam boiler, pressure vessel or pipeline

a)

is set to ambient temperature and, if necessary, to ambient temperature, and

b)

is emptied or filled with a substance suitable for preventing corrosion; in the case of gases, it may have a low pressure to prevent the ambient atmosphere from penetrating; and

c)

the filling fittings are secured in the closed state, so that no filling is possible, and

d)

is provided with an indication of the decommissioning.

15.

Appendix:

A pressure system in which a plurality of steam boilers, pressure vessels or pipelines are connected to form a functional unit.

16.

Competent boilers or Audit office:

Those boilers or The inspection body which has certified the operating seizure of the steam boiler, pressure vessel or pipeline under this Regulation for the period of revision.

2.Part

Danger potential of steam boilers, pressure vessels and pipelines

General

§ 3. (1) Steam boilers, pressure vessels or piping shall be differentiated according to the level of their hazard potential resulting from the operating conditions in such cases:

1.

high risk potential and

2.

low hazard potential.

The operator shall be determined in accordance with the provisions of § § 4 and 5.

(2) Steam boilers, pressure vessels or piping with a high risk potential are in principle tests for:

1.

initial operation (first operating test) by boiler test stations according to § 21 Kesselgesetz and

2.

Recurring commissioning (operating test) by boiler inspection bodies or Inspection bodies pursuant to section 22 (2) of the Kesselgesetz (German boiler law), and

3.

regular assessment during operation (monitoring of periodic inspections and inspections) by boiler inspection bodies and/or Audit offices,

, Exceptions to this are contained in paragraphs 3, 4 and 6, in § 43 (5), Appendix 3 Z 10.1.5.5 as well as for certain controls in Annex 3 Z 1, 2, 5 to 7 and 9.

(3) By way of derogation to paragraph 2, evaluations of cathodic corrosion protection systems according to § 69 (12) of this accredited testing or testing system shall be subject to the following conditions: monitoring points.

(4) By way of derogation from paragraph 2, tests for the commissioning and monitoring of existing cathodic corrosion protection systems are either of the competent boiler test stations according to § § 7 (2), 13 (4) and 13 (4) and (4) respectively. 34 (2) or accredited testing and/or testing monitoring points.

(5) For steam boilers, pressure vessels or piping with a low risk potential, the operator shall be responsible for controls for putting into service and carrying out checks during the operation.

(6) By way of derogation from (2) and (5), at the request of the operator, a steam boiler, a pressure vessel or a pipeline with a low risk potential can be equated with those with a high risk potential. In this case, the provisions of Section 4 (1) shall apply.

Steam boiler, pressure tank and pipeline with high risk potential

§ 4. (1) For steam boilers, pressure vessels or piping with a high risk potential in accordance with paragraph 2, as well as those pursuant to § 3 (6), the applicable provisions concerning the first operating examination, audit, type of monitoring, revision periods and Monitoring measures (measures in the context of recurring investigations and inspections) as well as their documentation in accordance with § § 6 to 66 and Appendix 3.

(2) The following shall be considered as a steam boiler, pressure vessel or piping with a high risk potential, as referred to in paragraphs 3 to 14 above, except those referred to in paragraph 15 and Appendix 3, point 2.1. The demarches of the areas with a high risk potential are in each case in the illustrations of the Appendix 1 .

(3) Steam boiler or pressurised containers at risk of overheating (Appendix 1, Figure 1), except for those referred to in paragraph 4, for example, rapid steam generators, with the following technical data:

a)

Volume greater than 2 litres and

b)

fixed maximum operating pressure greater than 1 bar, in addition for hot water boilers, a fixed maximum operating temperature greater than 120 ° C and

c)

Print content product greater than 200.

(4) Steam boilers at risk of overheating or pressure vessels at risk of overheating (Appendix 1, Figure 2), consisting essentially of pipes with nominal widths up to and including DN 32 (e.g. rapid steam generators), with the following technical data:

a)

Volume greater than 2 litres and

b)

fixed maximum operating pressure greater than 1 bar, in addition for hot water boilers, a fixed maximum operating temperature greater than 120 ° C and

c)

Print content product greater than 350.

(5) Pressure vessel (Appendix 1, Figure 3)

1.

filled with

a)

gases and vapours of group 1 or

b)

liquids of group 1 or group 2 superimposed on Group 1 gases, or

c)

Group 2 liquids superposed on Group 2 gases, or

d)

vapour-bearing liquids of group 1 or

e)

heated liquids of group 1, the vapour pressure of which at the maximum operating temperature is at least 1 bar above atmospheric pressure, or

f)

unstable gases.

2.

with the following technical data:

a)

Volume greater than 1 litre and

b)

fixed maximum operating pressure greater than 1 bar and

c)

Print content product greater than 300.

(6) Pressure vessels (Appendix 1, figure 4),

1.

filled with

a)

gases and vapours of group 2 or

b)

Group 2 liquids superposed on Group 2 gases, or

c)

vapour-bearing liquids of group 2 or

d)

heated liquids of group 2, the vapour pressure of which at the maximum operating temperature is at least 1 bar above atmospheric pressure,

except those referred to in paragraph 7,

2.

with the following technical data:

a)

Volume greater than 5 litres and

b)

fixed maximum operating pressure greater than 1 bar and

c)

Pressure-content product greater than 1 000.

(7) Pressure vessel (Appendix 1, Figure 5)

1.

filled with

a)

air or nitrogen, or

b)

water, superposed with air or nitrogen,

2.

with the following technical data:

a)

Volume greater than 5 litres and

b)

fixed maximum operating pressure greater than 1 bar and

c)

Print content product greater than 3 000.

(8) Pressure vessel, filled with Group 1 liquids (Appendix 1, Figure 6), except for those referred to in paragraph 5, with the following technical data:

a)

Volume greater than 5 litres and

b)

fixed maximum operating pressure greater than 1 bar and

c)

Print content product greater than 3 000.

(9) Pressure vessels filled with Group 2 liquids (Appendix 1, Figure 7), with the exception of those referred to in paragraph 5, para. 6 or par. 7, with the following technical data:

a)

Volume greater than 10 litres and

b)

fixed maximum operating pressure greater than 500 bar and

c)

Print content product greater than 10 000.

(10) Piping (Appendix 1, Figure 8)

1.

for

a)

the gases and vapours of group 1 or

b)

heated liquids of group 1, the vapour pressure of which at the maximum operating temperature is at least 1 bar above atmospheric pressure, or

c)

unstable gases,

2.

with the following technical data:

a)

Nominal width greater than DN 32 and

b)

fixed maximum operating pressure greater than 1 bar and

c)

Nominal pressure product greater than 1 000.

(11) Piping (Appendix 1, Figure 9)

1.

for

a)

heated liquids of group 2, the vapour pressure of which at the maximum operating temperature is at least 1 bar above atmospheric pressure, or

b)

Water vapour above 350 ° C,

2.

with the following technical data:

a)

Nominal width greater than DN 100 and

b)

fixed maximum operating pressure greater than 1 bar and

c)

Nominal pressure white product greater than 3 500.

(12) Piping (Appendix 1 Figure 10)

1.

for

a)

gases or vapours of group 2 or

b)

steam up to 350 ° C,

2.

with the following technical data:

a)

Nominal width greater than DN 200 and

b)

fixed maximum operating pressure greater than 1 bar and

c)

Nominal pressure product greater than 5 000.

(13) Piping (Appendix 1, Figure 11) for Group 1 liquids, other than those referred to in paragraph 10, with the following technical data:

a)

Nominal width greater than DN 100 and

b)

fixed maximum operating pressure greater than 10 bar and

c)

Nominal pressure product greater than 10 000.

(14) Piping (Appendix 1, Figure 12) for Group 2 liquids, other than those referred to in paragraph 11, with the following technical data:

a)

Nominal width greater than DN 200 and

b)

the highest operating pressure of greater than 500 bar.

(15) Regardless of the limits laid down in paragraph 13 or 14, piping in hydraulic systems containing as ingredient a hydraulic fluid with a flash point greater than 55 ° C and not operated above 55 ° C shall not be considered as piping with high risk potential. For these, the provisions of § 5 apply.

(16) Boilers for the production of hot water below 110 ° C are to be assigned to pressure vessels according to paragraph 9.

Steam boiler, pressure tank and pipeline with low risk potential

§ 5. (1) Steam boilers, pressure vessels or piping which are not covered by Section 4 (2) are those with a low risk potential. For these devices, except in the case of the application of § 3 (6), instead of the provisions of § § 6 to 66, the sections 2 to 8 apply.

(2) In accordance with Section 13 of the Kesselgesetz (Kesselgesetz) and recurring examinations and verifications within the meaning of § 15 of the Kesselgesetz (Kesselgesetz), it is not necessary to carry out the first operating examination in accordance with paragraph 1. The operator has no obligation to provide information to boiler inspection bodies.

(3) Prior to the first entry into service of such equipment, the operator or his authorised competent person shall check the proper condition of the equipment, including the suitability and functioning of the equipment, and the installation thereof.

(4) At the instigation of the operator or his authorised representative, such equipment shall be subject to periodic checks to be carried out by knowledgeable persons, which shall allow an assessment of safety in the operation of the equipment, including its equipment.

(5) The nature, extent and frequency of the checks shall be carried out in the light of the instructions for use or instructions of the manufacturer of the equipment and, in addition, on the basis of the operator's experience with the operating mode used by the operator .

(6) The implementation and evaluation of the control during the first commissioning shall be documented by the operator and shall be kept ready for inspection by the authorities with the documents for the placing on the market.

(7) The implementation and evaluation of the periodic checks shall be documented by the operator and shall be kept ready for inspection by the authorities.

(8) If the safety of the device during operation is permanent on the basis of its design for the intended operation and mode of operation, the controls may, without prejudice to the instructions of the manufacturer in respect of use and maintenance, be carried out in accordance with Paragraph 3, the periodic checks referred to in paragraph 4 and the documentation provided for in paragraphs 6 and 7 are no longer required (e.g. steam pressure cookers, steam cleaner, airbrush-containers, etc.).

3.Part

Testing for commissioning

1. Main item

General

General

§ 6. The tests for the commissioning of a steam boiler, pressure vessel, or a pipeline are distinguished in:

1.

first operating examination for the first commissioning or

2.

Audit, for recurrent commissioning, except for piping.

2. Main piece

First audit

Principles

§ 7. (1) The first operating test shall be used for the safety assessment of the functional steam boiler, pressure vessel, or the pipeline, for the first time being placed on the market in Austria, with regard to the suitability for the intended operation on the Site. It includes:

1.

A check of the documentation required for the lawful placing on the market and for the putting into service of the steam boiler, pressure vessel, or pipeline and the marking in accordance with § 8,

2.

a review of the type of installation for fixed steam boilers and pressure vessels in accordance with § 11,

3.

a check of the external condition of the steam boiler, pressure vessel or pipe according to § 10 and

4.

a check of the function of the equipment of the steam boiler, pressure vessel or pipe according to § 9.

(2) The first operating test shall be carried out for steam boilers, pressure vessels or pipelines with a high risk potential in accordance with § 4 of a boiler inspection body according to § 21 of the Kesselgesetz (boiler law). For this purpose, boiler verifiers are to be used in accordance with § 21 paragraph 2 Z 3 of the Kesselgesetz. For the purpose of testing for the commissioning or monitoring of cathodic corrosion protection systems, boiler verifiers shall be used which meet at least the requirements of the ÖVGW Directive G 21 Z 2.1.1 and 2.1.2 (Appendix 4) or equivalent and have at least one year of relevant experience. Such tests can also be carried out by accredited testing or testing methods. Monitoring points shall be carried out.

(3) The first operating test shall be carried out by the operator upon receipt of the proprove operation. It must then be carried out if, in the course of the protesting operation of the steam boiler, pressure vessel or the pipeline, the intended safety-related operating parameters have been reached. The probewise operation of the steam boiler, pressure vessel or the pipeline has to include all safety-related operating states (e.g. filling and emptying cycles).

(4) If the relevant data for the integration of the steam boiler, pressure vessel, or the pipeline are not included in an installation in the documentation referred to in paragraph 1 (1), their integration into the installation shall be at the instigation of the boiler test site of: to assess and certify an initial inspection body. Such certification procedures replace conformity assessment procedures in accordance with Section 16 (2) of the DGMO.

(5) Where the relevant data for the complete equipment of the steam boiler, pressure vessel or pipeline are not included in the documentation referred to in paragraph 1 (1), the suitability of the equipment and its integration shall be from the boiler test centre to assess and certify. Such certification procedures replace conformity assessment procedures in accordance with Section 16 (2) of the DGMO.

(6) If appropriate, the certificates referred to in paragraph 4 or 5 must be available before the end of the first audit.

(7) The first operating test, together with that of the associated steam boiler, is to be carried out on pipelines for steam and superheated liquids which are directly connected to steam boilers.

Control of documentation and labelling

§ 8. The control of the documentation and the identification of the steam boiler, pressure vessel or pipeline has to be taken into account:

1.

The lawful placing on the market of the steam boiler, pressure vessel or pipeline with regard to the type and scope of the provisions of Section 18 of the Kesselgesetz or the German boiler law the regulations applicable to the placing on the market.

2.

Where appropriate, the certificates referred to in Article 7 (4) and (5).

3.

The conformity of the documentation with the marking on the steam boiler, pressure vessel or on the pipeline.

4.

The control of the certification of the tightness of the pressure vessel or of the pipeline for toxic, corrosive or flammable substances, insofar as it is not included in the documentation referred to in Z 1 or 2.

5.

Additional protective measures of the steam boiler, pressure vessel or pipeline, in particular with regard to corrosion protection, such as cathodic corrosion protection, by checking the certificate, insofar as this is not shown in the documentation according to Z 1 or 2 is recorded.

6.

Special conditions of installation, in particular in the case of underground pressure vessels or piping, by checking the embeddeation confirmation or corresponding documentation.

Function of equipment

§ 9. (1) The equipment of the steam boiler, pressure vessel or pipeline, consisting of:

1.

safety-relevant printing equipment,

2.

display,

3.

pressure-carrying equipment with operating function (e.g. valves, slide valves, etc.),

is to be checked with regard to the function necessary for safe operation.

(2) The checking of the function of the equipment shall normally be carried out on the steam boiler, pressure vessel or on the pipe in operation.

(3) The review of the safety-related technical equipment shall include:

1.

for direct acting safety valves

a)

a check of the response pressure and of the blow-off performance during response, or

b)

if this is not technically possible or is appropriate, the control of the documentation indicating the setting and the performance of the blow-off performance.

2.

for:

a)

Bursting equipment, such as bursting discs and buckling rods,

b)

BosB-annexes,

c)

MSR systems (measuring and control systems)

a review of the relevant data on the basis of the relevant documentation.

(4) The inspection of the display devices according to paragraph 1 Z 2 for pressure, temperature and level has to be carried out by means of a control of the metrological function with respect to the correctness, reliability and suitability of the measuring range.

(5) The checking of the pressure-bearing equipment with the operating function according to paragraph 1 Z 3 shall be carried out with regard to the safe operability and the goodability of the equipment.

(6) The equipment test shall also include:

1.

Facilities relevant to fire technology in the case of steam boilers,

2.

Control and limiting devices for pressure, temperature and level, provided these are not specified in paragraph 3, Z 2 lit. b and lit. c are recorded.

(7) The requirements referred to in paragraph 1 shall be deemed to be fulfilled if the function of the equipment is proven with the documentation in accordance with § 8 (1) Z 1 or 2.

(8) In the case of steam boilers, pressure vessels or piping for which special testing procedures are necessary or are normally used, the equipment shall not have any adverse effect on the test procedures to be applied.

Outer State

§ 10. (1) The inspection of the external condition shall be used for the safety assessment of the steam boiler, pressure vessel or pipeline, including the associated equipment with regard to the effects of the delivery, installation, assembly and the proprove business. For this purpose, the external, visible walls must be checked, in particular with regard to:

1.

Transport damage,

2.

Damage as a result of incorrect installation,

3.

Damage caused by the proprove operation,

4.

Corrosion damage due to storage.

(2) The examination of the external condition shall in principle be carried out as a visual inspection of the steam boiler, pressure vessel or the pipeline which is in operation. If the safety assessment is not possible by the inspection alone or in the present state, or if there are obvious deficiencies in the steam boiler, pressure vessel or pipeline, the inspection is carried out by to complete further tests.

(3) For underground pressure vessels or piping provided with a cathodic corrosion protection system, the cathodic corrosion protection system is a test for commissioning or testing of the external walls, respectively, as a replacement for the test of the external walls. Monitoring in accordance with ÖVGW guideline G 21, section 3 or 4 (Appendix 4) or an equivalent technical rule.

Type of installation

§ 11. (1) The type of installation of steam boilers and pressure vessels shall be assessed in accordance with the following rules:

1.

For steam boilers: Regulation on the establishment and operation of steam boilers, BGBl. No 353/1995, as amended.

2.

For pressurised containers for storage of gases or gas-superposed ingredients with a print content product of more than 3 000: according to the Pressure Vesks Order Ordinance, BGBl. II No 361/1998, as amended.

3.

For steam boilers and pressure vessels, which are not below Z 1 and/or 2 fall: according to § 8 Kesselgesetz.

(2) In addition, for earth-laid pressure vessels:

1.

The laying of earth-laid pressure vessels shall be proven by means of a confir-tation confirmation.

2.

Earth-laid pressure vessels must have sufficient corrosion protection of the outer walls, either active or passive. This information is available if:

a)

materials for the external pressure-bearing walls have been used which are corrosion-resistant with respect to the surrounding media, or

b)

the outer wall of the pressure vessel with a coating in accordance with DIN 4681, part 3, para. 2 to 6 (Appendix 4) (epoxy coating), or with a delamination caused by corrosion with regard to the aspects of ageing and long-term behaviour, Impact resistance as well as surface-covering protection against corrosion of equivalent coating is provided, or

c)

the outer wall of the pressure vessel with no coating, or one that is not lit. b corresponds to the type of bitumen coating according to DIN 30673 (Appendix 4) and the cathodic corrosion protection measures are applied using galvanic anodes (sacrificial anodes) or an external current system, which is the ÖVGW guideline G 20 (Annex 4), or comparable technical rule, or

by constructive measures, eg double coat, except paints or coatings, which is not lit. b or c, a corrosive attack of the pressure-bearing outer walls by the environment over the intended service life of the pressure vessel is prevented or the outer wall can be inspected with special devices, or

e)

a non-lit. a to d is provided for corrosion protection.

Documentation

§ 12. The boiler inspection body shall document the tests and checks in accordance with § § 8 to 11 as well as their results in accordance with the provisions of § § 50 to 54. § 13. (1) The operating test shall be used for the safety assessment of the suitability of the pressure vessel or steam boiler already in use, with the exception of transportable steam boilers in accordance with Appendix 3 Z 10, for further intended operation according to:

1.

more than one year out-of-service pursuant to § 2 Z 14 or

2.

after installation at a new site.

(2) In the event of more than one year out of operation in accordance with paragraph 1, the audit shall include:

1.

a check of the external condition of the steam boiler or pressure vessel, including its equipment,

2.

a review of the function of the equipment,

3.

an internal investigation and

4.

where appropriate, a pressure or leak test.

(3) In the case of the installation of a steam boiler or pressure vessel, the operating test shall comprise a new site in accordance with paragraph 1 Z 2:

1.

the tests and investigations referred to in paragraph 2 (1) to (4),

2.

a review of the nature of the establishment and, where appropriate,

3.

a check of the integration of the steam boiler or pressure vessel into an installation.

(4) The audit shall be carried out by the competent boiler or To carry out the inspection post. For this purpose, boiler verifiers and/or Statutory auditor in accordance with § 21 paragraph 2 Z 3 of the Kesselgesetz. § 14. (1) The inspection of the external condition shall be used for the safety assessment of the steam boiler or pressure vessel with regard to the effects of the following:

1.

more than one year out of operation, in particular with regard to:

a)

corrosion,

b)

damage and

c)

State of isolation or Coating.

2.

Installation at a new location, in particular with regard to:

a)

Damage caused by disassembly and assembly and

b)

Damage caused by the transport.

(2) The provisions of Section 10 (2) and (3) shall apply to the examination of the external condition.

Function of equipment and integration

§ 15. (1) The inspection of the equipment shall be carried out with regard to the impairment of the function necessary for the safe operation of the steam boiler or pressure vessel by means of the decommissioning or the change in order.

(2) In the case of a list at a new site, a verification of the integration of steam boilers and pressure vessels into an installation with regard to safety assessment shall be carried out.

1.

the alternating effects of the steam boiler, pressure vessel and the installation, and the measures taken to take them into account,

(3) For the purpose of checking the function of the equipment in accordance with paragraph 1, the provisions of Section 9 (2) to (8) shall be applied in the light of a possible change (e.g. new valve, new blow-out direction) compared to the last test carried out.

(4) The integration of steam boilers, pressure vessels or pipelines in an installation according to paragraph 2 shall be carried out by an evaluation of the respective operating parameters, in particular with regard to pressure, temperature and content. Where appropriate, the boilers or the like, The Office of the Examination Office shall be notified of an initial inspection post.

Type of installation

§ 16. (1) After drawing up a new site in accordance with Section 13 (1) (2), the examination of the nature of the installation shall be carried out in accordance with the provisions of § 11.

(2) The same conditions of employment as in the previous site shall be taken into account in the scope of the review referred to in paragraph 1.

Internal investigation

§ 17. (1) The internal investigation is used for the safety assessment of the pressure-bearing internal walls, in particular with regard to the effects of the more than one year out-of-operation or the installation at a new site. Any damages before the decommissioning or before the installation at a new site shall be included in the assessment.

(2) The internal investigation shall be carried out for steam boilers in accordance with the provisions of § 37 and for pressure vessels according to the provisions of § 41, in which case a visual inspection shall be carried out in any case.

(3) The internal investigation according to paragraph 1 may be omitted if appropriate measures have been set and documented on the pressure vessel or steam boiler, which demonstrably prevent damage (corrosion) of the internal walls, e.g. conservation with Corrosion protection products, filling with dry gases, storage in a suitable environment, etc.

Pressure and leak testing

§ 18. (1) The results of the examination of the external condition in accordance with § 14 or the internal investigation pursuant to § 17 do not permit a sufficient safety assessment, the steam boiler or pressure vessel is a pressure test according to § 38 or § 42.

(2) When the steam boiler or the pressure vessel is installed at a new place of installation, assembly activities corresponding to a complete or partial new assembly of the boiler or pressure vessel have been carried out. in the context of the audit, a pressure test according to § 38 or § 42.

(3) When the steam boiler or pressure vessel was installed at a new site, assembly activities were carried out which did not significantly affect the safety of the pressure, or were only able to be released prior to the re-operation. A leak test according to § 43 (3) to (8), applicable to steam boilers, is to be carried out.

(4) A pressure test in accordance with paragraph 1 or 2 has been carried out on pressure vessels intended for the intake of toxic, corrosive or flammable substances, and after fitting the equipment a leak test shall be carried out in accordance with section 43 (3) to (8).

Documentation

§ 19. The relevant boiler or Examination office shall document tests and checks in accordance with § § 14 to 17, if applicable, those of the pressure or leak test according to § 18 as well as their results according to § § 50 to 54. The test of the cathodic corrosion protection system by an accredited testing or testing system. The inspection body shall be included in the assessment, the relevant test or inspection body. Part 4

Definition of the type of monitoring

Dispatch

§ 20. (1) Steam boilers, pressure vessels or pipelines with a high risk potential in accordance with § 4, which have been definitively put into service after the entry into force of this Regulation, shall be one of the following ways of monitoring the nature of the monitoring to be allocated.

1.

Surveillance in accordance with special provisions (§ 21),

2.

Monitoring according to test levels 1 to 4 (§ 22),

3.

Monitoring according to the special test programme (§ 23).

(2) For steam boilers, pressure vessels or pipelines with a high risk potential according to § 4, which have been put into service before the entry into force of this Regulation, the transitional provisions in accordance with § § 67 and 69 shall apply with regard to their type of monitoring.

(3) The allocation in accordance with paragraph 1 shall be from a boiler and/or a boiler. Examination office shall be carried out in accordance with the provisions of § § 21 to 25. With the acceptance of the allocation, the operator has a boiler or a boiler. The Office of the Examination Office shall be appointed no later than three months after the completion of the first audit. (4) During the operation of the steam boiler, pressure vessel or pipeline, it shall be carried out in the course of operating tests, periodic inspections and inspections, extraordinary tests or other monitoring measures which result from: modified operating conditions, detected damage, results of additional tests, etc., that the existing allocation is no longer justified, shall be determined by the relevant boiler or Auditor shall make a change in the allocation in accordance with the possibilities provided for in paragraph 1, taking into account the risk analysis in accordance with § 26 and the catalogue of measures pursuant to § 27.

Monitoring when allocating special provisions

§ 21. (1) Steam boilers, pressure vessels or pipelines covered by one of the special provisions referred to in paragraph 2 shall be allocated to the relevant special provision and the type and extent of the checks shall be carried out in accordance with the nature and extent of the tests and the Test rists, without prejudice to § 30 (2), pursuant to this special provision.

(2) The following types of steam boilers, pressure vessels and piping are covered by a special provision according to Appendix 3:

1.

Pressure tank for electrical equipment of high-voltage systems, filled with SF 6 -Gas or dry air (Appendix 3 Z 1),

2.

Pressure vessels and piping in refrigeration systems and heat pump systems (Appendix 3, Z 2),

3.

Liquid gas pressure vessel (Appendix 3 Z 3),

4.

Pressure vessels from austenitic steels (Appendix 3 Z 4),

5.

Vacuum insulated pressure vessels (Appendix 3 Z 5),

6.

Pressure vessels and pipelines in air-liquefaction and air separation plants (cold part) (Appendix 3 Z 6),

7.

Pressure vessels and piping in district heating systems (Appendix 3 Z 7),

8.

Pressure vessels and piping in acetylene plants (Appendix 3 Z 8),

9.

Pressure vessels for filters, separators, combinations of filters and separators, preheaters and silencers in natural gas pipelines (Appendix 3 Z 9),

10.

Transportable steam boilers (Appendix 3 Z 10).

(3) Surveillance measures shall give rise to suspicion that other damage mechanisms other than those included in the special provision shall be effective, additional investigations and verifications shall be carried out and the existing allocation shall be subject to: check.

Monitoring for allocation to audit levels

§ 22. (1) For steam boilers, pressure vessels or piping which are not covered by a special provision in accordance with Article 21 (2), the technical criteria of the operation and the damage mechanisms which may occur in the course of this are to be determined. Such steam boilers, pressure vessels or pipelines shall be allocated in accordance with the technical criteria determined for the relevant test stage referred to in paragraphs 2 to 5, and the type and scope of the tests shall be the type and extent of the tests, at Consideration of § 31, according to the 6. Part of this Regulation shall be implemented. Those steam boilers, pressure vessels or pipelines, which are to be allocated to a special test programme in accordance with the criteria of § 23 (1), are excluded.

(2) Examination level 1:

The following criteria for pressure vessels and pipelines are decisive for the test stage 1:

1.

the contents (ingredient) do not exert any corrodiating effect on the walls in design and operation,

2.

the pressure vessels or piping are adequately protected against external corrosion,

3.

the walls are not exposed to erosion or abrasion,

4.

the walls are not at risk of overheating,

5.

the walls shall not be subject to wear due to fatigue, except in the case of permanent-proof design, or to creep,

6.

the pressure vessels or piping have a high quality, and

7.

the characteristics according to Z 1 to 6 are demonstrated by appropriate documentation of the nature of the pressure vessel or of the pipeline and of the operating conditions.

(3) Examination level 2:

The following criteria for pressure vessels, steam boilers and piping are decisive for the test stage 2:

1.

The walls are at risk of overheating, or

2.

the walls are exposed to wear due to creep.

(4) Examination level 3:

The following criteria for pressure vessels, steam boilers (e.g. fluidized bed boilers, lye boilers, waste heat boiler with overheating risk) and piping are decisive for the test stage 3:

1.

The walls are exposed to increased corrosive effects or to other increased damage effects, or

2.

the walls are exposed to increased corrosive effects in connection with the risk of overheating or creep, or

3.

the walls are subjected to an increased cyclic stress without being permanently designed, or

4.

the estimation of the effect of relevant damage mechanisms during operation is limited due to the documentation of the condition of the pressure vessel, steam boiler or pipe or the intended operating conditions only in restricted Dimensions possible, so that an increased effect cannot be ruled out.

(5) Test stage 4:

The following criteria for pressure vessels, steam boilers and pipes are decisive for the test stage 4:

1.

The pressure vessels, steam boilers or piping are not to be allocated to the test stages 1 to 3.

2.

The operating-related damage or failure mechanisms are adequately covered by constructive measures or appropriate protective measures.

3.

The monitoring measures in the test rists set up for the test stage 4 shall ensure sufficient control.

(6) Steam boilers, pressure vessels or piping which, as a result of the operation, fall within the scope of several test stages, shall be assigned to that test stage for which the shortest test rists are fixed.

(7) Pressure vessels having a plurality of pressure chambers are to be divided as a whole to the testing stage of the pressure chamber for which the shortest test interval is obtained.

Monitoring for allocation to special validator

§ 23. (1) Steam boilers, pressure vessels or piping which are not covered by a special provision in accordance with Article 21 (2) and for which the technical criteria of the holding and the damage mechanisms which may occur in the course of the operation for the Steam boilers, pressure vessels or the pipeline must be identified and for technical reasons, having regard to the proportionality of the effort:

1.

the criteria for the allocation to a test level are not applicable, or

2.

the test rists associated with the test stages are not to be applied in a purposefully effective way; or

3.

the provisions relating to the monitoring measures applicable in the case of an allocation to a test stage in the context of the periodic inspections and verifications according to 6. are not applicable,

the type and scope of the tests shall be carried out, taking into account the provisions of § 32, in accordance with a special test programme drawn up for this boiler, pressure vessel or pipe.

(2) The following shall apply to the special test programme:

1.

A boiler inspection body shall, after consulting the operator, comply with

a)

the relevant technical rules,

b)

the analysis of the damage mechanisms,

c)

Conducted investigations and

d)

of operational experience;

to design a test programme to implement the objectives of the Kesselgesetz (Kesselgesetz) with regard to the recurrent investigations and verifications.

2.

The test programme shall in particular determine the type, scope and time intervals of the monitoring measures to be carried out.

3.

The test programme is to be submitted to the Federal Ministry for Economic Affairs and Labour, which can make a technical assessment within 8 weeks. The technical assessment shall be relevant for the allocation and final execution of the special test programme. If no technical assessment is made, the monitoring measures may be applied in accordance with the specific test programme submitted.

(3) In the case of the application of the special test programme by an auditor, the test programme shall be drawn up in accordance with para. 2 by the boiler test centre, which monitors the auditor's office.

Determination of the high quality of pressure vessels and pipelines

§ 24. (1) The determination of the high quality of a pressure vessel or of a pipeline according to § 2 Z 10, which is necessary in the context of the allocation, shall apply to paragraphs 2 to 6.

(2) A high quality of a pressure vessel or a pipe shall be deemed to be of a high quality if:

1.

the locally acting stresses are approximated to those of the global stresses acting in the base material, or

2.

in the walls, a state of tension is produced which, in operation, results in a favourable behaviour with regard to the avoidance of damage.

(3) In any case, a high quality of connections is present if:

1.

Welded joints, other than for children. [0100] The properties corresponding to the base material thus correspond to a weld seam factor of 1 with regard to production and testing. This is fulfilled for containers with ÖNORM EN 13445 part 5, test group 1b, for round seams with base and bead fillable test group 2b (Appendix 4) or for pipes with ÖNORM EN 13480 part 5, for longitudinal seams according to Z 8.3, table 8.3.1, weld seam factor 1 and for round and socket seams according to Z 8.2, pipe class III (Appendix 4).

2.

other insoluble compounds

a)

in accordance with a qualified procedure and

b)

of qualified personnel; and

c)

test methods suitable for the detection of possible types of faults, including:

d)

the acceptance criteria matched to the link; and

e)

Test perimeter matched to the connection

f)

of qualified personnel.

The requirements of Z 1 and 2 must be documented.

(4) The high quality of a pressure vessel or pipeline can also be determined during the operating phase by appropriate tests, if the fulfilment of the requirements referred to in paragraph 2 is thus demonstrated. A review and, where appropriate, modification of the existing allocation shall be carried out.

(5) The high quality of a pressure vessel or of a pipeline according to § 2 Z 10 shall also be given if the design, manufacture and testing of other measures as referred to in paragraph 3 have been set out in accordance with paragraph 2. This is to be assessed by a boiler inspection body, where appropriate, by means of an initial test site. The evaluation shall be submitted before its application to the Federal Ministry for Economic Affairs and Labour, which can make a technical assessment within four weeks. The technical assessment is decisive for the qualification of the pressure vessel or the pipeline. If no technical assessment is made, the equivalence of the measures with regard to the high quality is to be adopted.

(6) Proof of the adequate integrity of a pressure vessel or of a pipeline, eg by pressure testing, cannot be used for the detection of the high quality of the pressure vessel or of the pipeline.

Determination of the technical criteria for allocation

§ 25. (1) When a steam boiler, a pressure vessel or a pipeline is allocated to a test stage or to a special test programme, the technical criteria of the operation and the foreseeable and expected results which can be derived from it shall be determined. To carry out a risk analysis and to draw up a catalogue of measures to be carried out, as well as the monitoring measures necessary for the type of monitoring, to be carried out.

(2) The boiler or the boiler, which is responsible for the allocation of the steam boiler, pressure vessel or pipeline, The inspection body shall carry out the hazard analysis and compile the catalogue of measures. The experience gained with the operation and maintenance of the same or similar steam boilers, pressure vessels or pipelines shall be taken into account.

(3) During the operation of the steam boiler, pressure vessel or pipeline, it is shown that the identified hazards (damage and failure mechanisms) are inadequate or inaccurate, or if any constructive or operational changes are made to this , the risk analysis and the catalogue of measures should be changed and the allocation should be reviewed.

(4) Where there are the same criteria for allocation in respect of the damage and failure mechanisms for a number of interconnected steam boilers, pressure vessels or pipelines or groups of steam boilers, pressure vessels or pipelines, the risk analysis and the catalogue of measures for these steam boilers, pressure vessels or pipelines, or groups of steam boilers, pressure vessels or pipelines, can be prepared jointly.

Hazard analysis

§ 26. (1) The hazard analysis shall be used to detect any damage and failure mechanisms caused by the operation of the steam boiler, pressure vessel or pipelines, which will affect the integrity of the boiler, pressure vessel or of the pipes.

(2) The risk analysis shall list the mechanisms of damage and failure that are reasonably foreseeable and reasonably expected to be expected, with the relevant causes for this analysis.

(3) In particular, the risk analysis shall be taken into account:

1.

Effects on the steam boiler, pressure vessel or pipes, or individual components or sub-areas according to the pressure, temperature and content as well as external influences from outside, such as:

a)

damage due to corrosion without mechanical stress (surface corrosion, trough corrosion, hole corrosion, etc.),

b)

Damage caused by the influence of hydrogen (material embrittlement, material separation, structural changes, etc.),

c)

Change of material properties due to aging, embrittlement, operation in time-of-time or creep area;

2.

Effects due to the type, height and duration of the stress, such as:

a)

static,

b)

swellend,

c)

dynamic or

d)

shock-like stress;

3.

Corrosion in the case of additional mechanical stress (stress induced corrosion, vibration-induced corrosion, strain induced corrosion, etc.);

4.

effects caused by erosion or abrasion;

5.

the effect of the ingredient on the safety equipment;

6.

effects due to intended maintenance or operation, such as for screw connections of openings;

7.

effects of special equipment, zB atomic hydrogen damage by cathodic corrosion protection systems;

8.

Effects of non-intended, non-intended operation.

(4) The hazard analysis provided for the steam boiler, pressure vessel or piping in the course of placing on the market shall be subject to the risk analysis referred to in paragraph 1, in accordance with the effects of the operation, consideration.

(5) The above risk analyses, which have been drawn up in the course of regulatory approval procedures, shall be taken into account in the preparation of the hazard analysis as referred to in paragraph 1, in accordance with the effects on the operation.

§ 27. (1) The catalogue of measures shall be used for the purpose of determining the measures envisaged for the intended the operation of the steam boiler, pressure vessel or pipeline, in order to identify any damage or damage to the damage or damage which has already been carried out in accordance with the hazard analysis carried out at a time when the hazard analysis has been carried out; there is no impairment of the safety of the steam boiler, pressure vessel or piping. (3) The measures may be considered as specific tests and investigations, specific test methods and methods of investigation, including, where appropriate, apportionment or assessment procedures. the criteria for admissibility and the extent or Scope shall be determined. If possible, they are to be classified as external or internal investigations or as pressure or leak testing.

(4) The measures shall also include operational controls, provided that they are required in the relevant monitoring provisions.

(5) Where measures within the meaning of paragraph 1 have been laid down in the course of a regulatory authorisation procedure, these measures shall be taken into account in the preparation of the catalogue of measures, insofar as they are available.

Part 5

Revision periods

General

§ 28. The revision periods (test rists) to be applied are determined by the allocation of the steam boiler, pressure vessel or the pipeline according to the type of monitoring. These are the result of:

1.

Allocation to a special provision by applying the test rists set out in the special provision according to Appendix 3;

2.

Allocation to a test stage by application of test rists specified for steam boilers, pressure vessels or piping according to § 31;

3.

Allocation for the creation of a special test program by the test rists specified in the test program.

Principles

§ 29. (1) The safety of a steam boiler, pressure vessel or pipeline must be provided via the test rists determined in accordance with § 28. This is done by the relevant boiler and/or to certify the inspection body. Changes the boilers or boilers within the test period. (3) The external investigations are basically visual inspections. Pressure vessels intended for filling with oxygen, nitrogen oxides or compressed air must not be tested with flammable liquids.

(4) The liquid used for the filling shall not contain any coarse impurities which could impair the performance of the pressure test or its assessment. In accordance with the operating conditions, no components which act or contaminate the walls shall be included. The temperature of the filling shall not exceed 50 ° C during the test.

(5) The water used for the pressure test may remain in the pressure vessel only for the period of time strictly necessary.

(6) If, by means of other test methods or in combination with other test methods, an at least equivalent statement of the integrity and tightness of the walls of the pressure vessel can be obtained by means of a sound emission test, these can be obtained by means of a sound-emission test. Methods or their combinations shall be used instead of the pressure test. The test medium and the level of the test pressure shall be adjusted to the test method to be used.

(7) The gas pressure test may be used as a substitute for liquid pressure testing if the fluid pressure test or another equivalent test method, such as the sound emission test, is not possible or is expedient. In this case, the gas pressure test may be carried out with the application of the provisions of section 15 (4) in the cohesiveness with Section 12 (3) of the Kesselgesetz, if:

1.

an internal test, supplemented, where appropriate, by non-destructive testing without any complaint, and

2.

special protective measures have been taken, such as inspection of the container under water, installation of protective walls, or blocking of the room in which the test takes place, or the environment of the container to be tested, for persons who do not attend the test are involved.

The gas pressure test may be carried out with air or inert gases, but may not be carried out with oxygen, explosive or more than 50 ° C gases, vapours or mixtures thereof. The provisions laid down in paragraph 2 shall apply to the level of the test pressure. If no adequate protective measures are taken, paragraph 6 shall apply.

(8) A pressure test shall be carried out independently of the test rists in accordance with § 31, if:

1.

such an examination appears to be appropriate on the basis of the outcome of the internal or external investigation; or

2.

as a result of the construction of the pressure vessel, an internal investigation cannot be carried out to the required extent, taking into account the provisions of § 41 (3) and (5).

(9) In the case of the pressure test or The selection and implementation of the alternative methods in accordance with paragraph 6 shall be taken into account, where appropriate, by coatings, lining, coatings or internals of the containers.

(10) In the case of pressure tests of containers made of synthetic material (plastic) and reinforced plastic, the material and the type, the structure and the arrangement of the reinforcements must be taken into account. The pressure test shall be supplemented, if necessary, by expansion measurements, including volume-related measurements.

(11) Armaturen are generally to be included in the pressure test. Excluded from this are:

1.

Direct acting safety devices such as safety valves, bursting discs, buckling rods, etc. and

2.

Pressure-maintaining equipment with operating function, which are not tested together with the pressure vessel. A pressure test may be deemed not to be necessary on the basis of the design, size and condition of the test, the pressure test may be carried out by an internal investigation, supplemented, if necessary, with non-destructive tests and by a Tightness testing with the operating pressure is replaced.

Leak tests

§ 43. (1) The leak test is used to assess the pressure vessel, including the equipment with regard to technical tightness.

(2) A leak test shall be carried out:

1.

in the case of a set of measures,

2.

where appropriate, as a supplementary test

3.

after carrying out the pressure test on containers for toxic, corrosive or flammable substances after fitting the equipment.

(3) The leak test shall be carried out:

1.

during operation with the operating medium under operating pressure, or

2.

if this does not allow sufficient evidence to be made, in the unplaced condition, with a pressure equal to at least the operating pressure and a maximum of 1.1 times the operating pressure, with the operating medium or with a suitable medium, or

3.

for pressurised containers, intended for liquid ingredients, with a gaseous medium with a pressure of up to 5 bar.

(4) The assessment of the tightness test shall be carried out by inspection of the container and its equipment, if necessary with the aid of leaks indicating the need to indicate leaks. For this purpose, in the case of isolated containers, the insulation can be removed at relevant points.

(5) By way of derogation from Article 3 (2) (2) (2) and (3), the leak test may also be carried out by experts from the operator or by experts who are responsible for the activities of which the operator is responsible, hereinafter referred to as the investigative body, except those which constitute the sole monitoring measure or leak tests, which are used as a substitute for a monitoring measure, if the following conditions are met:

1.

The boiler inspection body shall delegate the leak test to the examining body and assess the result thereof;

2.

the examining body shall maintain quality assurance measures, which include procedural rules, work instructions, documentation, personnel qualification and staff training;

3.

the examining body has qualified personnel and facilities for carrying out the leak test; the pressure maintenance during the leak test must be carried out in a controlled manner;

4.

the boiler test site has to be convincing at random of the suitability of the test equipment and the proper performance of the leak test.

(6) The leak test can be replaced by other testing and monitoring methods if these are equally meaningful in terms of technical tightness.

(7) The kettle or The operator shall determine the preparations and arrangements to be made with the operator prior to carrying out the leak test.

(8) The leak test can be carried out in coordination between the boiler or the boiler. The inspection body and the operator are also carried out in partial investigations, in so far as there are operational reasons for this and there are no safety concerns. Monitoring measures for pipelines

General

§ 44. (1) The periodic inspections and inspections of pipelines shall include the following surveillance measures:

1.

a leak test or

2.

a print test.

(2) If tightness or pressure tests are provided for in the catalogue of measures, they shall be carried out and shall not be replaced by equivalent tests.

(3) A leak test shall be carried out on those piping for which the following technical criteria are met on the basis of the operating mode and the operational experience:

1.

no internal corrosion stress, and

2.

no external corrosion stress or Cathodic corrosion protection, or

3.

External corrosion stress and direct inspection of the outer walls of the pipeline over the entire length, and

4.

the maximum permissible operating temperature below 80 ° C, and

5.

no time-level load or increased cyclic loading.

(4) An external examination according to § 46 may be carried out on pipelines, for which the third paragraph is applicable.

(5) A pressure test shall be carried out on those piping for which the following criteria are met on the basis of the operating and operational experience:

1.

internal corrosion, erosion, abrasion, or

2.

External corrosion stress without direct inspection of the external walls of the pipeline over the entire length, or

3.

the highest permissible operating temperature above 80 ° C, or

4.

Time-of-time stress.

(6) Piping, for which paragraph 5 applies, can be used as a substitute for the pressure test:

1.

an external investigation according to § 46, and

2.

a leak test

a)

in accordance with § 45, or

b)

with the content and operating pressure of the pipeline and, where appropriate,

3.

an internal investigation according to § 48,

are carried out. For leak tests according to Z 2, the provisions of § 43 (5) can also be applied to pipelines.

(7) In accordance with paragraph 5, the pipeline to be tested is subject to special stresses, e.g. pipelines in the area of time due to temperature or load change, are subject to the application of paragraph 6 as a function of the duration of the operation and of the Operating stress additional tests (e.g. structural examinations), if not specified in the catalogue of measures.

(8) The investigations and verifications may be carried out in coordination between the boiler and/or the boiler. The inspection body and the operator shall also be carried out in parts where there is a need for operational reasons and there are no safety concerns. However, they must be completed within the specified time limit.

(9) In order to prepare the tests, the condition of the pipeline, or to discuss the adjacent installation between the boiler or the auditor's office and the operator, in the case of application of paragraph 6, in particular whether and to what extent the test steps are carried out by means of sheathing, heat and cold insulation, earth coverings or It shall be necessary to remove any defects, damage, repairs and modifications as well as exceptional incidents.

Leak tests

§ 45. (1) The leak test is used for the safety assessment of the pipeline, including its equipment with regard to technical tightness.

(2) The leak test is to be carried out in the unplaced state of the pipeline with a pressure equal to at least 1.1 times the operating pressure, with the ingredient (operating medium) or a suitable liquid or gaseous medium. In the case of pipelines which have a liquid as the ingredient, when the leak test is used with a gaseous medium, the level of the test pressure can be limited by 5 bar.

(3) The assessment of tightness has been carried out by

1.

visual inspection of the pressurised piping and the associated equipment, where appropriate, with the aid of leaks, during the leak test, or

2.

a pressure loss measurement over a suitable period of time, taking into account temperature changes,

shall be made.

(4) In the case of earth-laid piping, the tightness is due to the above-ground inspection, such as the inspection of the passages, or by electrical locating methods with measuring probes or by means of control with leakage warning devices, or by controlling the difference between the and and the to assess the flow of media or in the unfolded state by means of pressure loss measurements.

(5) In the case of earth-laid piping provided with a cathodic corrosion protection system, a monitoring of the cathodic corrosion protection in accordance with ÖVGW guideline G 21, section 4 (Appendix 4) or equivalent procedures ,

(6) For pipelines according to § 44 (6), the leak test can be replaced by other testing or monitoring procedures, as far as it is possible to make an equivalent statement.

(7) The results of the leak test shall not be subject to a safety assessment, additional tests, e.g. for piping according to § 44 (3), 4 or 6, shall be subject to a pressure test according to § 47.

External investigations

§ 46. (1) The external investigation shall be used for the safety assessment of the external state of the pipeline, taking into account the effects of the operation and the laying conditions. The external investigation shall be carried out on the application of section 44 (4) and (6). It shall include the following verifications:

1.

Inspection of the outer state of the pipeline and of the equipment in terms of quality, corrosion protection, leakage, in particular also

a)

the bearing points of the pipeline,

b)

the storage of the piping, for example hangers or sledges,

c)

of the equipment required for safety or for safe operation,

d)

the elements of the expansion compensation.

2.

Verification of the operability of the safety-related equipment (safety equipment) and other relevant pressure-bearing equipment with operational function, as well as display devices, in particular:

a)

safety devices (e.g. safety valves, bursting discs) with regard to marking, seal and functional defects,

b)

the relevant display devices and delimiters,

c)

of the relevant pressure-bearing equipment in terms of goodability and operability,

d)

the parts relevant to the piping function according to Z 1 lit. a to d.

(2) The external investigations shall normally be carried out during the operation of the pipeline.

(3) The external investigations are basically visual inspections. In any case, the tests and tests to be carried out in accordance with the catalogue of measures shall be carried out as external investigations. If the statement is not sufficient for the safety assessment, additional tests must be carried out.

(4) The function of the equipment in accordance with paragraph 1 Z 2 shall be considered in accordance with the applicable provisions of § 9 (3) to (5).

(5) Partial tests are sufficient if the results of these tests can be used to assess the safety condition of the pipes to be tested by means of an analogue flow, and representative parts of the pipeline have been recorded by the test.

(6) The examination of the state of the pipeline has, with regard to mechanically induced damage, mainly in the case of suspensions, supports, pipe branches, connection pieces, and external corrosion attack in the case of uninsulated and in the case of application of § 44 (6) in the case of isolated lines.

(7) The examination of the state of the safety-relevant printing equipment, the relevant pressure-bearing equipment with operating function and special storage elements as well as expansion compensation shall be carried out by inspection and by a Functional control in accordance with paragraph 4.

(8) Insulated (isolated) pipelines according to § 44 (6), which are known to be susceptible to corrosion due to their operating mode and previous operating experience, shall be tested at representative points on external corrosion. For this purpose, the insulation is to be removed at these points.

(9) If the insulation is removed on insulated piping for reasons other than that referred to in paragraph 8, the operator of the boiler and/or the boiler shall be responsible for the installation of the boiler. The inspection body shall be notified in order to allow external investigations to be carried out on the pressure-bearing walls.

(10) In the case of underground pipelines, the examination of the external pressure-bearing walls must be carried out as a leak test with an above-ground inspection in accordance with § 45 (4), without prejudice to the control of the equipment in accordance with paragraphs 4 and 7.

(11) In the case of earth-laid piping provided with a cathodic corrosion protection system, it is necessary to monitor the cathodic corrosion protection in accordance with the ÖVGW guideline G 21, section 4 (Appendix 4), or equivalent process. This does not apply to pipelines in which the cathodic corrosion protection together with the pipeline of the network operator is verifiably monitored by the network operator.

(12) For the external investigation of pipes larger than DN 100, calculated with time-dependent strength values, additional tests are not included in the catalogue of measures, subject to the application of technical rules, e.g. VGB guideline, VGB-R 509 L, (Appendix 4) to be carried out.

Print Checks

§ 47. (1) The pressure test shall be used for the safety assessment of the pipeline, including its equipment, with regard to the integrity and tightness of the pressure-bearing walls.

(2) The pressure test shall be carried out as a fluid pressure test, except where the provisions of paragraphs 5 and 6 are applied, provided that the design and mode of operation of the pipeline permits it. The provisions of section 42 (3) to (5) and (7) shall also apply to pipelines.

(3) The test pressure results, without prejudice to the provisions of paragraphs 5 and 6, from the product of the response pressure of the safety device (e.g. safety valve) multiplied by that factor which, during the first pressure test, shall be subject to the test pressure, referred to the highest operating pressure set, certain. This factor can be limited to 1.5.

(4) Armaturen are generally to be included in the pressure test. Excluded from this are:

(6) The pressure test may be replaced by other test methods which permit assessment of the integrity of the pipeline under the given operating conditions and the operating mode. To this end, other media, taking into account the provisions of Section 15 (4) of the Kesselgesetz, or other test pressures, may be used, in particular if the weight of the liquid is disadvantageous to the pipeline, its bearings, or to the other media. the emptying possibility of the pipeline.

(7) The assessment of the pressure test shall be carried out by a visual inspection of the deformations and leaks of the piping and of the storage facilities (bearings, supports, etc.) and of the associated equipment during the pressure test. (8) In the case of underground or non-inspected piping, the pressure test, except in the case of application of paragraph 6, shall be assessed by pressure loss measurements, supplemented, where appropriate, by the above-ground inspection of the laying mass.

Internal investigations

§ 48. (2) If internal investigations are provided for in the catalogue of measures, they shall be carried out.

(3) If other surveillance measures allow an internal investigation to be made equivalent, the internal investigation may be replaced by the same.

(4) Partial tests are sufficient if the results of these tests can be used to assess the safety condition of the pipes to be tested by means of an analogue flow, and representative parts of the pipeline have been recorded by the test.

(5) If the surveillance measures referred to in paragraphs 1 to 3 are not subject to a safety assessment, additional tests, such as a pressure test, shall be carried out.

Duties of operators and verifiers

§ 49. (1) The operator shall have the authorities, the boiler or the the auditor's office of declarations of conformity, certificates, operating instructions and findings which are necessary for the placing on the market and putting into service of the steam boiler, pressure vessel or pipeline, on the occasion of:

1.

the first audit in accordance with Articles 7 to 12, or

2.

the allocation, risk analysis or catalogue of measures in accordance with Articles 20 to 27, or

3.

of checks in accordance with Section 15 (7) of the Kesselgesetz,

shall be made available for the purpose of inspection.

(2) In the course of carrying out the first operating test of the steam boiler, pressure vessel or pipeline, the boiler inspection body shall establish a test book in accordance with § § 55 and 56, to connect the documentation to the latter and to either the operator in to make paper or electronic form available.

(3) The operator shall be responsible for the implementation of:

1.

Changes in the allocation, risk analysis or catalogue of measures in accordance with § § 20 to 27, or

2.

Operating audits according to § § 13 to 19, or

3.

Surveillance measures in accordance with 6. Part, or

4.

a change of the relevant boiler and/or auditor's office, or

5.

extraordinary exams according to § 15 para. 7 of the Kesselgesetz, or

6.

regulatory measures pursuant to Section 23 (4) of the Kesselgesetz, or

7.

Safety-related repairs or changes in accordance with § 17 paragraph 1 of the Kesselgesetz, or

8.

administrative checks in accordance with Section 15 (7) of the Kesselgesetz,

by boilers and/or Inspection bodies and, where appropriate, by public authorities, first inspection bodies or accredited testing bodies, the documentation in the form of the test book for the purpose of inspection, entry and final inspection of the documents referred to in Z 1 to 8 To make documents available to them.

(4) The operator may transfer the management and storage of the test book to organisations suitable for this purpose, provided that the conditions laid down in paragraphs 1 and 3 can be fulfilled. The operator is also responsible for the integrity, topicality and completeness of the test book. The responsibility for reporting and the timely instigation of tests and examinations remains with the operator. When the test book is conducted in electronic form, the person responsible for the management of the audit book shall ensure that the entries already made are no longer changed and only persons or bodies authorized to do so or the competent authorities responsible for the inspection of the test book are responsible for the inspection. (3) By way of derogation from paragraph 1 (2) to (4), the certificates, monitoring reports and test reports of the boiler and/or the boiler shall be subject to the application of Section 43 (5) or Annex 3 (3) (2) to (4). the inspection body shall be replaced by the test report of the examining body.

§ 51. (1) Certificates relating to:

1.

the first audit;

2.

operational audits;

3.

recurrent investigations and verifications (surveillance measures),

a)

external investigations,

b)

internal investigations,

of the steam boiler, pressure vessel or piping shall be drawn up in the form of entry in the test book on the basis of the monitoring report in respect of conformity with this Regulation.

(2) Where tests or investigations have been carried out in parts, the examinations or tests shall be certified by registration in the test book only after the completion of the partial tests.

Monitoring reports

§ 52. (1) Monitoring reports on:

1.

the first audit;

2.

Allocations;

3.

Hazard analysis;

4.

Catalogue of measures;

5.

operational audits;

6.

recurrent investigations and verifications (surveillance measures),

a)

external investigations,

b)

internal investigations,

c)

pressure tests,

d)

§ 53. (1) Audit reports on

1.

non-destructive testing, except for wall thickness measurements and visual inspection, which are not carried out with special equipment, e.g. endoscopy,

2.

Tests according to special test methods, e.g. sound emission, expansion measurements, etc. as well as testing of the cathodic corrosion protection,

3.

special examinations, e.g. for the detection of time-dependent damage, corrosion damage, etc.,

which have been carried out in the framework of surveillance measures at the steam boiler, pressure vessel or pipeline, shall contain the following information:

§ 54. (1) Control reports on the presence of

Audit Book

General

§ 55. (1) The test book shall be used to keep all written records relevant to the safety of the steam boiler, pressure vessel or pipeline in collected form. The written records shall include entries, certificates, monitoring, inspection and inspection reports and documents relating to the steam boiler, pressure vessel or pipeline.

(2) The test book shall be used in a uniform manner for all steam boilers, pressure vessels or pipelines regulated in this Regulation, with a high risk potential in accordance with § 4 (2) and those pursuant to § 3 (6).

(3) A common test book may be used for related steam boilers, pressure vessels and pipelines which are integrated in a common installation or a common pressure network, provided that the records distinguish between: to allow the collected steam boilers, pressure vessels and pipelines to be used. The documentation in accordance with § § 57 to 64 shall be drawn up for each individual steam boiler, pressure vessel or pipe covered by the test book.

(4) With the registration of the first operating examination by the boiler inspection body, the test book is given the status of a certificate within the meaning of § 18 of the Kesselgesetz (Kesselgesetz).

(5) The entries in the test book and the associated connection of related documents may only be made by:

1.

in the course of the activities referred to in this Regulation, a boiler inspection body or a factory auditor;

2.

accredited test centres in the course of the activities referred to in this Regulation,

3.

First inspection bodies in case of changes or repairs according to § 17 of the Kesselgesetz,

4.

Authorities testing bodies provided for by the authorities for extraordinary tests,

5.

Administrators of the audit book pursuant to § 49 (4) (only connection of documents),

6.

Operator in accordance with the provisions of Appendix 3 (only for the connection of documents)

shall be made.

(6) entries in the test book in the sections for the identification and placing on the market of the steam boiler, pressure vessel or the pipeline according to § 57 (2) are without prejudice to the provisions of section 69 (9) of the boiler inspection body in the course of of the entries for the first audit. Any documentaries or certificates shall be connected.

(7) Connecting within the meaning of paragraphs 5 and 6 means that the certificates, monitoring, testing and inspection reports and the associated documentation in the part of the audit book intended for this purpose shall be inserted by the bodies referred to in paragraph 5 (1) (1) to (6) in such a way, that it can be seen who carried out the connection.

(8) The attached documents must be numbered consecutively in the form of supplements, and shall be numbered consecutively in sections on the application of section 55 (3).

Requirements

§ 56. (1) The test book shall be in accordance with the requirements of paragraphs 2 to 12.

(2) The execution of the test book shall be shown:

1.

A fixed envelope,

2.

a fixed part (bound) connected to the envelope; and

3.

a part with a device for the connection (stitching) of certificates and documents.

(3) The format of the test book shall be that format which allows the proper connection of certificates and documents in the format A 4 (297x210 mm) in accordance with ISO 216 (Appendix 4).

(4) By way of derogation from (2) and (3), an electronic test book shall be shown:

1.

a cover sheet,

2.

an area for entries corresponding to the content of the bound part in accordance with paragraph 2 (2) (2), and

3.

an area for the electronic connection of certificates and documents.

(5) The envelope referred to in paragraph 2 (1) and (1) the cover sheet referred to in paragraph 4 (1) has the inscription "Checkbook in accordance with the Pressure Equipment Monitoring Regulation", the appropriate name of the "steam boiler", "pressure vessel", "pipeline", and the Ident number of the test book, consisting of the short description of the boiler test site and the number of the test book.

(6) The bound part referred to in paragraph 2 (2) or (2) the area for entries referred to in paragraph 4 (2) shall include the Ident number and the following sections:

for the identification of the steam boiler, pressure vessel or piping covered by the test book, in particular:

the type of steam boiler, pressure vessel or pipeline, ingredient, characteristics, manufacturer, year of construction, technical description, safety equipment, other equipment, reference to documentation;

2.

for the placing on the market of the steam boiler, pressure vessel or pipeline, in particular:

the placing on the market, the first inspection body or the notified body, the date of the first test, or Year of CE marking, test pressure, test medium, reference to the documentation;

3.

For commissioning (first operating test):

Location (site), operator, finding, reference to documentation, date of implementation;

4.

for the dispatch of the steam boiler, pressure vessel or pipelines:

Allocation and date of implementation, where appropriate reference to special provision or special test programme in the documentation

a)

for risk analysis (in case of allocation to a test level or special test programme):

date of implementation, reference to document,

b)

for the catalogue of measures (in the case of allocation to a test stage or special test programme):

date of implementation, reference to document;

5.

for operating audits:

The reason for the audit, the period during which the operation was carried out, or new location, date of implementation, findings and, where appropriate, reference to conditions, reference to the documentation;

6.

for the operator:

Name, address, start of operator function;

7.

for the relevant boiler inspection body or auditor's office:

the name, address of the boiler inspection body or the auditor ' s office and mark as well as the date of the appointment, reference to the certificate of acceptance;

8.

Monitoring activities in the context of recurrent investigations and verifications:

Type, date of implementation, findings (further operation) and, where appropriate, reference to conditions, reference to documentation, type and year of the next measure.

(7) The sections referred to in paragraph 6 shall also be provided with the following references:

1.

for paragraph 6 (1) and (2):

(8) By way of derogation from paragraph 7, electronically secured signatures and electronically secured check marks shall be used in the case of electronic management of the test book.

(9) The structure of the individual sections according to paragraph 6 is illustrated by way of example in Appendix 2. The explanations given in the Appendix are a specification of the list in accordance with paragraph 6. Deviations from this shall be permitted provided that the information presented is preserved and followed by the system.

(10) The sections referred to in paragraph 6 shall include space for at least the following entries, whereby the individual spaces may be separated:

(11) In the event of a paperless management of the examination book, the space provided for in paragraph 10 shall not be sufficient for the required entries to be made, the relevant section sheets shall be inserted in the stitching section and a note in this section shall be entered in the bound part of the document. .

(12) In the case of paper guidance of the test book, the stitching device must ensure the safe acceptance of perforated documents and must be suitable for the insertion of at least 100 documents.

Documentation of the first audit

§ 57. (1) The boiler inspection body shall certify the first audit carried out by it and shall attach the necessary documentation in accordance with paragraph 6 to the test book.

(2) In the test book, the boiler testing body shall complete the identification and placing on the market in accordance with the present documentation and shall, in each case, indicate the place and date of the registration and the signature of the vessel. to provide the boiler auditor and the test mark character.

(3) The boiler testing body shall have the documentation relating to identification and placing on the market connected to the test book.

(4) The existing documentation relating to the identification and placing on the market of this measure exceeds that level, which according to § 18 of the Kesselgesetz or is required in accordance with the implementing regulations for the placing on the market of steam boilers, pressure vessels or piping, and because of the extent of the existing documentation, it is not possible to connect to the test book, is only those in § 18 boiler law and/or in the implementing regulations for the placing on the market of steam boilers, pressure vessels or piping, the documentation required for the test book. This sub-documentation shall be accompanied by a note from the boiler inspection body, which shall indicate the documentation which is to be retained by the operator. If the existing documentation is completed in itself, copies of the documents, which are listed in § 18 Kesselgesetz or are required, in accordance with the implementing regulations for the placing on the market of steam boilers, pressure vessels or piping, at least, also accompanied by the endorsement of the boiler inspection body with regard to the original documentation, the test book can be connected.

(5) After carrying out the first examination, the boiler inspection body must complete the commissioning section, enter the finding and, by stating the place and date of registration, and with the signature of the boiler and the vessel, the Check point characters.

(6) The required documentation referred to in paragraph 1 shall include:

1.

the documents required for the placing on the market in accordance with § 8 Z 1 and, where applicable, those referred to in Z 2, including the control of the marking in accordance with § 8 Z 3,

2.

where appropriate, documentation of the controls referred to in § 8 Z 4 to 6,

3.

documentation of the tests in accordance with § 9 (equipment);

4.

Documentation of the tests in accordance with § 10 (external condition);

5.

where appropriate, documentation of the testing of the cathodic corrosion protection system in accordance with § 10 (3);

6.

Documentation of the performance test in accordance with § 11;

7.

, and, if applicable, documentation of the piping as referred to in § 7 (7).

Documentation of allocation, hazard analysis, policy catalogue

§ 58. (1) The boiler test site or The test station has the allocation of the steam boiler, pressure vessel or the pipeline according to 4. To issue a monitoring report and to connect it to the audit book. The allocation shall be entered in the test book.

6.

The registration of the allocation, the conduct of the risk analysis and the preparation of the catalogue of measures shall be accompanied by reference to the relevant documentation indicating the place and date of the registration and the signature of the boiler and/or the vessel. the auditor and the test mark character.

7.

The relevant boiler or The Office of the Examination Office shall be entered in the section "for the competent boiler inspection body or the auditor's office" in accordance with section 56 (6) Z 7.

(2) In the event of any necessary changes to the hazard analysis, the catalogue of measures or the allocation, the implementation of the amendment shall be entered in the test book. In the documentation, the changes to the risk analysis, the amended measures and the change in the allocation must be recorded. If, on the basis of these changes, there is a change for the test rists at the same time, these are also to be documented and the next scheduled date for the examination must be entered in the test book. The modified documentation shall be connected to the test book.

Documentation of operational audits

§ 59. (1) The boiler or The Office of the Examination Office shall certify the audit carried out by it and shall attach the necessary documentation in accordance with paragraph 8 to the test book.

(8) The documentation referred to in paragraph 1 shall include:

Documentation of the monitoring according to a special provision

§ 60. (1) Where monitoring measures are provided for in a special provision in accordance with Appendix 3 by a boiler or auditor, these authorities shall certify the surveillance measures carried out and shall attach the necessary documentation to the test book. (4) The required documentation in accordance with paragraph 1 shall be carried out analogously to the applicable provisions for the recurring investigations and inspections (monitoring measures) in accordance with § § 61 (4), 62 (5) or 63 (5). Documentation of the monitoring measures according to test stages for steam boilers

(9) The documentation for the replacement of the pressure test referred to in paragraph 1 Z 4 shall include:

1.

The documentation for the external investigation referred to in paragraph 7 above,

where appropriate

2.

Examination of external corrosion in accordance with § 46 (8) and (9),

3.

Testing of pipelines with special demands in accordance with § § 44 (7) and (46) (11),

4.

the documentation for the leak test in the parted state in accordance with paragraph 6 Z 1, or

5.

the testing of the pipeline and the associated equipment with the operating medium (ingredient) under operating pressure in accordance with § 44 (6) (2) (b),

6.

the documentation for the leak test referred to in points 6 (2) and (3),

where appropriate

7.

Replacement of the leak test by other methods pursuant to § 45 (6),

8.

Examination of the internal pressure-loaded walls of the pipeline and of the equipment pursuant to § 48 (1),

9.

Replacement of the internal investigation by other procedures in accordance with § 48 para. 3,

10.

additional examinations for the internal investigation pursuant to section 48 (5),

11.

the conduct of the internal investigation as:

a)

View Review

b)

Audits by policy catalog

c)

partial examination.

(10) When carrying out the examinations in accordance with subsection 1 Z 1 to 4 as partial examinations, the partial tests and their results are to be documented analogously to paragraphs 6 to 9 and, if necessary, in the documentation of the date of the next part-examination -note. If the partial examinations completely cover the examinations in accordance with paragraph 1, Z 1 to 4, the findings of the respective completed examination (external or internal investigation or pressure testing) with reference to the related documentation of the partial tests in the test book to be entered in analogy to paragraphs 2 and 3.

Documentation of the monitoring measures according to the special test programme

§ 64. (1) In a special test programme, monitoring measures shall be carried out by a boiler or a boiler. The inspection body shall certify the inspection measures carried out and shall attach the necessary documentation to the audit book. § 65. § 66. The boiler test centre, which is now in charge after a change, has to register the change in the intended section of the test book and to make it with the date of the complete change, the signature of the boiler tester and the test point character. Transitional provisions

Principles

§ 67. For the monitoring of steam boilers, pressure vessels and piping which have been established, operated and, where appropriate, monitored in accordance with the legislation in force before the entry into force of this Regulation, and which have now been established in the The scope of this Regulation shall apply to the monitoring of steam boilers, pressure vessels and pipelines with a low risk potential in accordance with § 5 of the provisions of § 68 and of the steam boilers, pressure vessels and pipelines with the high risk potential in accordance with § 4 of § 69.

§ 68. At steam boilers, pressure vessels and piping according to § 67, which have a low risk potential in accordance with § 5 (1), which

the documentation of the documentation shall be connected in accordance with Article 5 (6); and

c)

shall apply the provisions of Section 5 (2), (4), (5) and (7).

Steam boilers, pressure vessels and pipelines with high risk potential

§ 69. (1) For the monitoring of steam boilers, pressure vessels and pipelines according to § 67, with high risk potential in accordance with § 4 (2) and those pursuant to § 3 (6), the provisions of para. 2 to 12 shall apply.

(2) For steam boilers, pressure vessels and piping as referred to in paragraph 1, which

1.

have not previously been monitored under the terms of the kessellaw, or

2.

have so far been monitored under the terms of the kessellaw

the operator shall, in order to determine future supervision, take the allocation by one or more of the following: the competent boiler inspection body or to arrange the auditor's office in good time. The allocation shall be made according to one of the possibilities provided for in Article 20 (1) (1) to (3).

(3) The allocation shall be for steam boilers, pressure vessels and piping according to paragraph 2 (2) (1) for:

1.

Steam boilers and pressure vessels:

within 5 years

2.

Pipelines that are in operation for more than 10 years:

within 5 years

3.

Pipelines, which are not in operation for more than 10 years:

within 10 years

, The time limits shall relate to the date of entry into force of this Regulation.

(4) The allocation shall be for steam boilers, pressure vessels or pipelines referred to in paragraph 2 (2) (2),

1.

where, in the context of the periodic examinations and verifications carried out to date, a pressure test or a test for the verification of pressure has been carried out or is provided for, at the time of the scheme applied in accordance with the previous studies, the next required pressure test, or the test to be replaced,

2.

where, in the context of the recurrent surveys and verifications carried out to date, no pressure test or an examination which takes the form of a pressure test, a monitoring measure is provided for, at the time of the date of application of the checks carried out under the Scheme of next monitoring measure due,

3.

where, in the context of the repeated investigations and verifications carried out to date, monitoring measures were to be carried out only in case of approval or in the event of a starting date, at the next time or at the time of the date of application of the the next monitoring measure, but no later than 5 years after the entry into force of this Regulation,

4.

which is not lit. a to c are recorded, not later than 5 years after the entry into force of this Regulation

,

(5) Examination (surveillance measures) which are due up to the allocation under the previously applied scheme shall be carried out in accordance with the nature and revision periods in accordance with the scheme applied up to the date of entry into force of this Regulation.

(6) The examination on the occasion of which the allocation is made shall be carried out in accordance with the relevant provisions of this Regulation. If the allocation does not take place within the framework of a surveillance measure provided for, an external and internal investigation shall be carried out in accordance with the provisions of this Regulation.

(7) For the purpose of determining the monitoring, the identification of the technical criteria for the allocation, the conduct of the risk analysis and the preparation of the catalogue of measures, the future test rists and the monitoring measures to be applied, § § 21 to 48. Account shall be taken of the operator's experience with the operation and maintenance of the same or similar steam boilers, pressure vessels or pipelines.

(8) By way of derogation from paragraph 2, for steam boilers or pressure vessels referred to in paragraph 2 (2), for which an exception permit (communication) in accordance with the provisions of the provisions of the boiler law in force until now has been granted, the technical contents of the Modest in a special test program according to § 23. In so far as the provisions of this Regulation are complied with with regard to supervision, it is not necessary to carry out the risk analysis and to draw up a catalogue of measures. The approval procedure for the application of the special test programme must be complied with.

(9) With regard to the documentation of the allocation and the monitoring, the provisions of § § 49 to 66 shall apply with the following exceptions:

1.

For steam boilers, pressure vessels or piping, which are monitored by a workshop, the test book shall be provided by the boiler test site, which monitors the inspection body.

2.

In the allocation referred to in paragraph 2, the boiler or factory auditor shall enter the existing data for the identification of the steam boiler, pressure vessel or pipeline in the test book. In the section "first audit" shall be entered:

a)

for steam boilers, pressure vessels and piping according to paragraph 2 (2) (1): "hitherto not subject to supervision",

b)

for steam boilers, pressure vessels or pipelines referred to in paragraph 2 (2) (2): " previously monitored in accordance with certificate no. ....... ".

3.

For steam boilers, pressure vessels and pipelines referred to in paragraph 2 (1), the operator or operator shall be responsible for the the documentation available on the production, placing on the market (marketing authorisation) and the putting into service of the test book, taking into account, where appropriate, the provisions of Section 57 (4).

4.

If there is no documentation in accordance with Z 3 for steam boilers, pressure vessels or pipelines referred to in paragraph 2 (1), the operator shall, with at least sketches, document the steam boiler, pressure vessel or the pipeline, the available data with regard to the dimensions, materials and equipment. In the case of pipelines, the course of the pipeline, the supports or the like Hangers, etc. as well as the equipment to be identified.

5.

For steam boilers, pressure vessels and pipelines referred to in paragraph 2 (2), the previously applicable certificate shall be connected, where appropriate in the case of a reasonable application of Section 57 (4) of the test book.

(10) With the allocation, the documentation of the allocation, including the registration of the next monitoring measure, the monitoring shall be in accordance with 6. Part by application of the test rists according to 5. To perform part. The provisions of Section 20 (4) shall be taken into consideration.

(11) For steam boilers, pressure vessels or pipelines referred to in paragraph 2 (2) (1), the first monitoring measure shall be completed in the following year of the time limits which apply in accordance with paragraph 3 (1).

(12) Ground laying or partially earth-laid pressure vessels, which are coated according to § 11 paragraph 2 Z 2 lit. c) may be retrofitted with a cathodic corrosion protection system within 10 years after the entry into force of this Regulation. The provisions of the ÖVGW guideline G 20 (Appendix 4), or a comparable technical rule, must be applied for retrofitting. In accordance with the test and/or test procedure, which is accredited for this purpose Tests and tests carried out at the monitoring point shall be the possibility of retrofitting and the type of installation. If there is no possibility of retrofitting, or if no other protective measures are applied against the corrosion of the external walls, the effectiveness of which is to be assessed by a boiler test site, the container shall be used at the end of the Transitional period to the provisions of § 11 paragraph 2 Z 2 lit. e. to monitor and to monitor accordingly.

Part 9

Equivalence and final provisions

Equivalence determination

§ 70. (1) By way of derogation from the provisions of § § 3 (1) and 29 (3) apply to steam boilers, pressure vessels and pipelines with a high risk potential in accordance with § § 4 (2) and, where applicable, 3 (6), which in the EEA are subject to Community law in accordance with the common rules of law. Transport brought and put into service and operated for the first time or repeatedly in Austria, and in another EU Member State or EEA signatory State from a body recognised in the latter for recurrent investigations , the provisions of paragraphs 2 to 5 have been reviewed.

(2) A boiler test site or where applicable, a work-examination office has to carry out a first audit in accordance with § § 7 to 12 on these steam boilers, pressure vessels or piping at first commissioning in Austria and to issue a test book, or in the event of repeated commissioning, carry out an audit in accordance with § § 13 to 19, and an assignment in accordance with § 20 to a test level according to § 22 or to a special test programme according to § 23, including risk analysis and catalogue of measures, or, where appropriate, to a specific provision in accordance with § 21, and subsequently carry out the monitoring activities and their documentation in accordance with the provisions of this Regulation, in accordance with the established test reports.

(3) The surveillance measures carried out in the context of the periodic investigations referred to in paragraph 1 shall be subject to the objectives of the relevant monitoring measures provided for in this Regulation and shall be those recognised by the bodies recognised in accordance with paragraph 1 of this Article to be recognised. The equivalence shall be assessed by the boiler inspection body or the auditor's office.

(4) If the equivalence has been established in accordance with paragraph 3, the test rists for the monitoring measures in accordance with paragraph 2 shall start to run with the last monitoring measure carried out in accordance with paragraph 1.

(5) In the test book, it is necessary to document the recognition of the last monitoring measure carried out and to take into account the beginning of the test period in accordance with paragraph 4 in the definition of the next monitoring measure provided for. The appropriate documentation shall be attached to the test book.

§ 71. This Regulation has been adopted in compliance with the provisions of Directive 98 /34/EC of the European Parliament and of the Council of 22 June 1998, Directive 83 /189/EEC, in the field of technical standards and technical regulations of Directives 88 /182/EEC and 94 /10/EC of the European Commission, and notified under the notification number 2002 /311/A-I00.
