49. Regulation of the Federal Minister for Economic Affairs and Labour, the Federal Minister for Health and Women, the Federal Minister for Justice, the Federal Minister of Transport, Innovation and Technology and the Federal Minister of Finance, with which the Regulation on business cycle statistics in the service sector is amended

On the basis of § § 4 to 10 and 30 of the Federal Statistics Act 2000, BGBl. I No 163/1999, as last amended by BGBl. I n ° 71/2003, shall be assigned in agreement with the Federal Chancellor:

The Regulation of the Federal Minister for Economic Affairs and Labour, the Federal Minister for Social Security and Generations, the Federal Minister for Justice, the Federal Minister of Transport, Innovation and Technology and the Federal Minister of Finance on economic statistics in the service sector, BGBl. II No 233/2003, shall be amended as follows:

1. In § 2 (1) the word order shall be "of the Annex to Regulation (EEC) No 3037/90 on the statistical classification of economic activities in the European Community" through the phrase " The classification according to § 4 (5) Federal Statistics Act 2000 in the Federal Statistical Office of Statistics Austria and published under the Internet address www.statistik.at economic activities-ÖNACE 2003 ".

2. § 2 (2) reads:

" (2) The activities referred to in paragraph 1 are the private rooms rental pursuant to § 2 paragraph 1 Z 9 Gewerbeordnung 1994 (GewO 1994), the Buschenschank pursuant to § 2 para. 9 GewO 1994, the repairs of the consumer goods of Group 52.7 of the ÖNACE 2003 as well as the Management activities of holding companies of class 74.15 of ÖNACE 2003 are excluded. "

3. In § 3 Z 1, the word order shall be "of the Annex to Regulation (EEC) No 3037/90" through the phrase "of the ÖNACE 2003" replaced.

4. In § 4 (1), the Z 3 and 6 shall be deleted; the previous Z 4 and 5 shall be given the number of digits. "3" and "4" .

5. In § 4 (2) and (3), the phrase "the total number of persons employed" the citation "pursuant to paragraph 1 Z 2" and the phrase "total turnover" the citation "pursuant to paragraph 1 Z 3" attached and the quote "in accordance with paragraph 1 of the 5 and 6" through the citation "pursuant to paragraph 1 Z 4" replaced.

6. § 5 (1) reads:

" (1) The survey characteristics referred to in § 4 shall be collected in the following ways:

1.		The characteristics in accordance with § 4 (1) Z 1 (Identification characteristics) by using the data of the business register pursuant to Section 25 of the Federal Statistics Act 2000;
2.		the property in accordance with § 4 (1) Z 2 (total number of employees) by obtaining administrative data from the main association of Austrian social insurance institutions;
3.		the property referred to in Article 4 (1) (3) (total turnover) by the provision of administrative data by the financial authorities;
4.		the property according to § 4 (1) Z 4 (reimbursements pursuant to § 27 unemployment insurance act 1977) by the procurement of administrative data from the Austrian Labour Market Service (§ 1 para. 3 Labour Market Service Act). "

7. In § 5 (2) and § 6 (1), the quote shall be: "pursuant to § 4 (1) Z 1, 2 and 4" through the citation "pursuant to § 4 (1) Z 1 to 3" replaced.

8. The following paragraph 3 is added to § 6:

"(3) If an entrepre has commissioned a Fiscal Representative (Section 27 (7) and (8) of the VAT Act 1994), the Fiscal Representative shall be obliged to provide information."

9. In § 8 (1), the quote shall be "pursuant to § 6 (2)" the citation "and 3" .

10. In § 9, paragraph 2 and the sales designation "(1)" ; the quote "pursuant to § 5 (1)" is due to the quote "pursuant to § 5 (1) Z 2 to 4" replaced.

11. In accordance with § 10, the following § 10a and title shall be inserted:

" Publication of the results

§ 10a. (1) The Federal Statistics Office Austria has the results of the business cycle statistics in the service sector in the case of § 3 Z 1 within two working weeks and in the case of § 3 Z 2 within six working weeks according to the To publish a one-day period of time.

(2) According to Article 30 of the Federal Statistics Act 2000, the Federal Statistics Austria has data in the form of indices in the breakdown according to Annexes C (f) and (D) (f) of Regulation (EC) No 1165/98 in relation to the entire territory of the Federal Republic of Germany (Federal Statistical Office). to provide the public free of charge on the Internet, at least through

1.		the characteristics referred to in Article 4 (2), monthly,
2.		the characteristics referred to in Article 4 (3), quarterly.

(3) Data in accordance with Section 2 (2) (1) above the total turnover (Section 4 (1) (3)) shall be published in a nominally and in real terms, as well as seasonally unadjusted and adjusted form.

(4) Data in the presentation given in paragraphs 2 and 3 are to be published in addition to the electronic database in accordance with Section 30 (2) of the Federal Statistics Act 2000.

(5) The Federal Statistical Office (Bundesanstalt Statistik Österreich) has to document the calculation of the results of business cycle statistics in the service sector by means of metadata. "

12. In § 12, the sales denomination "(1)" ; the Z 4 and 7 and the word sequence "in the text as follows:" is replaced by the phrase "in the following version" ; the previous Z 5 and 6 receive the number designations "4" and "5" as well as the previous Z 8 and 9 the number designations "6" and "7" .

13. In § 12 Z 7, the point at the end of the word sequence is replaced by a stroke point and the following Z 8 is added:

" 8.		Turnover Tax Act 1994 (UStG 1994), BGBl. No. 663/1994, in the version of the Federal Law BGBl. I No 134/2003. "
