70. Ordinance of the Federal Minister for Economic Affairs and Labour and the Federal Minister for Agriculture, Forestry, Environment and Water Management, amending the Regulation on short-term economic statistics in the producing sector

On the basis of § § 4 to 10 and 30 of the Federal Statistics Act 2000, BGBl. I No 163/1999, as last amended by BGBl. I n ° 71/2003, shall be assigned in agreement with the Federal Chancellor:

The regulation of the Federal Minister for Economic Affairs and Labour and the Federal Minister for Agriculture, Forestry, Environment and Water Management on shortterm economic statistics in the producing sector, BGBl. II No 210/2003, shall be amended as follows:

1. In § 3 (1), the word order shall be "of the Annex to Regulation (EEC) No 3037/90 on the statistical classification of economic activities in the European Community" through the phrase " The classification according to § 4 (5) Federal Statistics Act 2000 in the Federal Statistical Office of Statistics Austria and published under the Internet address www.statistik.at Economic activities-ENACE 2003 " replaced.

2. § 3 (2), § 4 (1) (3) and (4), § 4 (2) (2) (2) and (6) (3), the term of the word shall be "of the Annex to Regulation (EEC) No 3037/90" through the phrase "of the ÖNACE 2003" replaced.

3. In § 4 (1) Z 1 and 2 lit. a and c, Z 3, 5, 6 and paragraph 2 Z 1 are deleted in the text "Annex I" the Roman numeral "I" .

4. In § 4 paragraph 1 Z 2 lit. b becomes the phrase 'according to the' Prodcom list 'of Regulation (EEC) No 3924/91 and Annex II to this Regulation' through the phrase " pursuant to the provisions of Section 4 (5) of the Federal Statistics Act 2000 in the Federal Statistical Office of Statistics Austria, and www.statistik.at published on the internet address www.statistik.at nis for the production sector-ÖPRODCOM in the version valid for the reporting period " replaced.

5. § 4 para. 1 Z 4 lit. c); § 4 para. 1 Z 4 lit. b does not use the word "and" and at the end of the sentence, a line-point is set.

6. In Section 4 (2) (2) (2), the designation "Sealing" by the name "Isolator" and the name "other extension" by the name "Expansion and construction services" replaced.

7. § 5 (1) Z 1 reads:

" 1.		the characteristics
a)			pursuant to point 1 (identifying characteristics) of the annex to this Regulation by using the data of the business register in accordance with Section 25 of the Federal Statistics Act 2000;
b)			in accordance with point 2 (employees) of the annex to this Regulation by obtaining administrative data from the Main Association of Austrian Social Security Institutions;
c)			in accordance with point 6 (turnover) of the annex to this Regulation by obtaining administrative data from the financial authorities;
d)			pursuant to point 2.1.4 and 2.1.5 (part-time employees) of the Annex to this Regulation and Article 4 (1) (4) (4) (lit). b by the procurement of administrative data from the "Labour Market Service Austria" (§ 1 para. 3 Labour Market Service Act); "

8. In § 6 (1) Z 2, after the word "Multi-business enterprise" the citation "pursuant to § 3 (3)" inserted.

9. The following paragraph 5 is added to § 6:

"(5) If an entrepre has commissioned a Fiscal Representative (Section 27 (7) and (8) of the VAT Act 1994), the Fiscal Representative shall be obliged to provide information."

10. In § 8 (1), the quote shall be: "pursuant to § 6 (4)" the citation "and 5" .

11. In § 9, paragraph 2 and the sales designation "(1)" ; the quote "pursuant to § 5 (1) Z 1" is due to the quote " according to § 5 paragraph 1 Z 1 lit. b to d " replaced.

12. In accordance with § 10, the following § 10a and title shall be " inserted:

" Publication of results

§ 10a. (1) The Federal Statistical Office of Statistics Austria shall make available to the public, free of charge at least in the following structure, the results of economic statistics in the producing sector in accordance with Section 30 of the Federal Statistics Act 2000:

1.		in the form of indices
a)			a maximum of 60 working days in accordance with the date of entry laid down in § 8: the production adjusted by working days, broken down by division of the ÖNACE 2003 and by categories of use (prepayments, energy, capital goods, long-lived consumer goods, short-lived consumer goods) as well as employees, gross earnings, volume of work, new orders and turnover broken down by sections of the ÖNACE 2003 in relation to the entire Federal territory;
b)			a maximum of 90 working days in accordance with the date of entry laid down in § 8: total production adjusted after working days in relation to the individual federal states;
2.		in the form of absolute figures for a maximum period of up to 90 working days according to the date of entry laid down in § 8, in relation to the whole of the Federal Republic of Germany,
a)			Enterprises broken down by divisions of NACE 2003: the number of enterprises, the total number of persons employed, the employees employed, the employees, including the commercial apprentices, and the workers, including the commercial apprentices, the total value of gross earnings, gross wages and gross salaries, total turnover, turnover from trade goods, turnover generated abroad (eurozone excluding Austria and non-euro area), and export intensity, the turnover per employed person employed, the gross salary per employee, the gross wage per manual worker, the special payments per employed person;
b)			Holdings broken down by divisions of NACE 2003: the number of holdings, the total number of persons employed, employed persons, employees, including commercial apprentices, manual workers, including commercial enterprises. Apprentices, total number of hours paid and hours worked, total gross earnings, gross wages and gross salaries, including apprentice compensation, total value and value of those from abroad (euro-zone without Austria and non-euro-zone), the total value of the new orders and the value of the order books coming from abroad (eurozone excluding Austria and non-euro-zone), production values of total technical production and the production of the production,
c)			Goods broken down by subcategories according to the provisions of § 4 (5) of the Federal Statistics Act 2000 in the Federal Statistical Office of Statistics Austria and published under the Internet address www.statistik.at Basic systematics of the goods-ÖCPA 2002 in the version valid for the reporting period: the value (goods approach) of the total technical production and the completed production.

(2) Weiters shall be prepared to provide the results of short-term business statistics at least to 90 working days in the form of absolute figures, at least in the following breakdown, on further electronic data carriers, in accordance with the date of entry laid down in § 8:

1.		1 (2) (2) (2) b listed statistics broken down by sections C + D, E and F as well as the departments of the ENACE 2003 in relation to each of the Länder,
2.		on the basis of paragraph 1 (2) (2). b listed statistics broken down according to sections C + D, E and F as well as the divisions of the ÖNACE 2003 related to the entire Federal territory as well as to the individual federal states: the statutory social contributions, the voluntary social benefits the employer, the paid and paid working hours as well as the orders and orders received from the country, the production value (activity approach) according to the production methods.

(3) Data are to be published in a more detailed description than in paragraphs 1 and 2 above in the electronic database according to § 30 Federal Statistics Act 2000.

(4) The Federal Statistical Office (Bundesanstalt Statistik Österreich) has to document the calculation of the results of the business cycle statistics in the producer area by means of metadata. "

13. In § 12, the sales denomination "(1)" as well as the Z 5 and 10; the previous Z 6 to 9 are given the number designations Z 5 to 8 and the previous Z 11 the number designation Z 9.

14. In § 12 Z 9, the point at the end of the word sequence is replaced by a stroke point and the following Z 10 is added:

" 10.		Turnover Tax Act 1994-UStG 1994, BGBl. No. 663/1994, in the version of the Federal Law BGBl. I No 134/2003. "

15. "Annex II-List of goods for divisions 37 and 41 to 93 of NACE Rev.1.1" No. The name "Annex I" shall be referred to as "Asset" changed.
