96. Ordinance of the Federal Minister for Social Security, Generations and Consumer Protection and the Federal Minister for Health and Women on the granting of functional fees, compensation and meeting fees to members of Administrative bodies of the social insurance institutions, the controlling group and the Social and Health Forum Austria of the Austrian Social Insurance Institutions ' Association (Function fee-VO)

Pursuant to § § 32f (2) and (3), 420 (5), 42b (3) and (4) of the ASVG, BGBl. No. 189/1955, as last amended by the Federal Law BGBl. I n ° 179/2004, Section 197 (5) of the GSVG, BGBl. Subject-matter

§ 1. (1) This Regulation regulates the granting of functional fees, compensation and meeting allowances to the members of the administrative bodies of the social insurance institutions, the controlling group and the Social and Health Forum Austria of the Main association for the time of the performance of their duties.

(2) As members of administrative bodies of social insurance institutions, the members of the administrative bodies of the main association of the Austrian social insurance institutions shall also be considered in accordance with the provisions of this Regulation.

§ 2. The members of the administrative bodies of the social insurance institutions shall be granted, for the duration of the performance of their duties, functional fees or session allowances in accordance with the following provisions:

Session allowance (§ 8).

§ 3. The members of the controlling group and of the Social and Health Forum Austria shall be granted compensation or part-session benefits in accordance with the following provisions for the duration of the performance of their duties:

2.

Session allowance (§ 8).

Extent of functional charges

§ 4. (1) The chairman of the association, the vice-chairman of the association and the members of the board of directors of the main association of the Austrian social insurance institutions, the obwiders/obwives and the obmann/obwomen alternates, the Chairperson and the Chairperson-Delegates of the Supervisory Assemblies and the Landesstellencommittees and the Chairmen of the Regional Performance Committees shall be subject to a monthly functional fee in accordance with the following provisions: . The extent of the functional fee depends on the relevant group (paragraph 1). 2).

(2) The administrative bodies eligible for a functional fee shall be classified in the following groups:

Group Administrative Body

1.

a) Administrative body of the Main Association of Austrian Social Security Institutions

b)

Administrative body of the General Accident Insurance Institution, pension insurance institution, social security institution of the commercial economy, social security institution of the farmers, insurance institution in the public service, insurance institution for railways and mining

c)

Administrative body of a health insurance institution whose average total insurance level is more than 400 000

2.

Administrative body of a health insurance institution whose average total insurance level is more than 250 000

3.

Administrative body of a health insurance institution whose average total insurer is more than 100 000

4.

Administrative body of a health insurance institution whose average total insurance level is more than 50 000

5.

Administrative body of a health insurance institution, whose average total insurance is more than 10 000

6.

a) Administrative body of the Insurance Office of the Austrian Notariate

b)

The administrative body of a health insurance institution whose average total insurance level is 10 000 or less.

For the calculation of the average total insured stock, the annual average of the second preceding calendar year shall be used.

(3) The maximum amount of the functional fee amounts to 40% of the annual fee due to a member of the National Council (Art. 2 Section 2 (1) of the Law on the Limitation of the Law of Limitation of the Law in force in each This amount shall be rounded off to full euro.

(4) The extent of the functional fee shall be for the chairperson of the association and the obmen/obwives of administrative bodies to be classified

Group 1 ........... 100%,

Group 2 ........... 88%,

Group 3 ........... 76%,

Group 4 ........... 64%,

Group 5 ........... 52% and

to

Group 6 ........... 40%

the maximum amount of the functional fee referred to in paragraph 3. The extent of the functional fee is to be rounded off to the full euro.

(5) The extent of the functional fee shall be

1.

for the chairmen of the control meetings half,

2.

two-fifths for the chairpersons of the Landesstellencommittees of the General Accident Insurance Institution, the Pension Insurance Institution, the Social Insurance Institute for the Industrial and Commercial Economy and the Insurance Institution for the Public Service of the State Department of Public Employment;

3.

for the chairpersons of the regional power committees of the social security institution of the peasants three tenths,

for the members of the board of the association according to § 441b para. 1 ASVG, with the exception of the chairman of the association and the deputy chairperson of the association, three tenths of a

Extent of functional fees in the exercise of a number of functions

§ 5. (1) In the case of a number of social security institutions, a person is entitled to one of the functions mentioned in section 4 (4), (5) and (6), the higher (highest) functional fee shall be due to the full extent. The remaining functional fees are to be granted in half the amount. If, in application of the provision in § 4, the admissibility to grant several equal function fees is granted by various social security institutions, only the provision of the functional fee for the number of insured persons shall be granted in the case of the number of insured persons. (2) In the case of a social security institution, if a person does not have more than one of the functions referred to in Article 4 (4), (5) and (6), only the granting of the higher functional fee shall be permitted.

Extent of compensation

§ 6. (1) The extent of the compensation shall be:

1.

for the chairman/chairman of the controlling group half,

2.

One tenth for the chairperson of the Social and Health Forum Austria

the extent of the functional fee which is eligible for the chairperson of the association pursuant to section 4 (4). The extent of the compensation is to be rounded off to the full euro.

(2) The extent of the compensation to the deputists of the chairpersons referred to in paragraph 1 shall be half of the extent of the compensation to be taken into account for the latter. The extent of the compensation is to be rounded off to the full euro.

Disbursements of functional fees and compensation

§ 7. The annual amount (§ § 4 and 6) shall be divided equally between the calendar months of the year (including the aliquots ' special payments) and shall be paid out in retrospect.

Session Money

§ 8. (1) The members of the administrative bodies of the social insurance institutions (the main association), the controlling group and the social and health forum shall be responsible for each day on which they shall attend meetings of one or more administrative bodies of the same In accordance with § § 419 and 441 ASVG, 196 GSVG, 184 BSVG, 130 B-KUVG and 66 NVG 1972, or in meetings of the controlling group and the Social and Health Forum Austria, insurance carriers shall be granted a meeting fee. The same shall apply to members of control meetings if they are acting in the exercise of their control function with the individual examination of the security of the insurance carrier.

(2) In addition to a functional fee in accordance with § 4 or a compensation in accordance with § 6, a session allowance according to paragraph 1 shall not be granted.

(3) The daily session allowance according to para. 1 shall be 0.85 per mille of the annual maximum amount of the functional fee in accordance with § 4 (3). The size of the session money is to be rounded off to full euro.

Final destination

§ 9. The BGBl Regulation. II No 230/1997, as amended by the BGBl Regulations. II No 19/2001 and BGBl. II No 360/2001 shall not enter into force with the entry into force of this Regulation.
