12. Regulation of the Regulatory Commission of E-Control, which provides for the charging of
for the Gas-System-Use-charges-Regulation 2013 will be amended
(Gas-Systems usage charges-Ordination 2013-2. Novelle 2015, GSNE-VO 2013-2. Novelle 2015)

On the basis of § 24 and § 70 Gaswirtschaftsgesetz 2011-GWG 2011, BGBl. I n ° 107/2011 in the version of the Federal Law BGBl. II No. 211/2014 iVm § 12 Abs. 2 Z 1 Energie-Control-Gesetz-E-ControlG, BGBl. I No 110/2010 in the version of the Federal Law BGBl. I No 174/2013, shall be arranged:

The regulation of the Regulatory Commission of E-Control, which determines the charges for the use of systems in the gas industry (Gas-Systems-Use-charges-Ordination 2013, GSNE-VO 2013), BGBl. II No. 309/2012 in the version of the GSNE-VO 2013-Novelle 2015, BGBl. II No 370/2014, shall be amended as follows:

1. In accordance with § 3 (2) Z 4, the following Z 5 shall be inserted:

" 5.		Mosonmagyaróvár: 0,90 "

2. § 3 para. 4 Z 2 is deleted.

3. According to Article 3 (6), the following paragraph 6a is inserted:

" (6a) The allocation of new or additional capacities for the supply to the transmission system for contracts of a duration of one year or longer shall be carried out up to the time when this capacity is available for the first time, including: a supplement to the network usage charge as specified in paragraph 2. This supplement shall be determined for the following feed-in points, in relation to the contractually agreed feed-in power for fixed, freely accessible feed-in capacities, as follows:

1.		Mosonmagyaróvár: 3,47
2.		Overackers: 7,54 "

4. In § 3 (9), after the word order "pursuant to para. 2 to 8" the phrase "except paragraph 6a" inserted.

5. According to Article 4 (2), the following paragraph 2a is inserted:

" (2a) The allocation of new or additional capacity for the discharge from the transmission system in storage facilities for contracts with a duration of one year shall take place until the date on which this capacity is available for the first time; including a supplement to the network usage fee in accordance with para. 2. This supplement shall be allocated for the Ausspeisepunkt Speicher 7-fields for the respective duration of the contract, in relation to the contractually agreed performance for fixed, free-to-order Discharge capacity, fixed at 1.76. "

6. § 4 (6) Z 1 reads as follows:

" 1.		Memory 7-fields: 1.02 "

7. In accordance with § 8 (3), the following paragraph 4 is inserted:

" (4) In the case of the award of new or additional capacities, the surcharge in accordance with § 3 para. 6a shall be added to the starting price in accordance with § 3 para. 2 until the time when the capacity is available for the first time. The surcharge as well as the surcharge in accordance with § 3 paragraph 6a are to be paid by the network user for the respective duration of the contract in addition to the network usage fee in accordance with § 3 para. 2. If the charges in accordance with § 3 (2) change during the contract period, the total price must be adjusted accordingly. "

8. According to Article 21 (8), paragraph 9 is added:

"(9) § 3 para. 2 Z 5, § 3 para. 4 Z 2, § 3 para. 6a, § 3 para. 9, § 4 para. 2a, § 4 paragraph 6 Z 1 and § 8 paragraph 4 in the version of the GSNE-VO 2013-2. Novelle 2015 will enter into force on 1 February 2015, 6 a.m."
