179. Regulation of the Federal Minister for Agriculture, Forestry, the Environment and Water Management, which changes the Plant Protection Regulation

Due to § § 6 and 17 (3) of the Plant Protection Act 1995, BGBl. N ° 532, as last amended by the Federal Law BGBl. I n ° 83/2004, shall be arranged:

The Plant Protection Regulation, BGBl. No 253/1996, as last amended by the BGBl Regulation. II No 83/2005, shall be amended as follows:

(1) The following paragraph 7 is added to § 6:

" (7) The movement of seed of

1.		Helianthus annuus L.,
2.		Lycopersicon lycopersicum (L.) Karsten ex Farw.,
3.		Phaseolus L.,
4.		Medicago sativa L.,
as well as for the planting of certain tubers of Solanum tuberosum L. by way of derogation from § 17 of the Plant Protection Act 1995, even if an official label is attached to them, to their packaging or to the means of transport, instead of the plant passport in accordance with the 1997 seed law, BGBl. I n ° 72, which confirms that the requirements of Section 11 of the Plant Protection Act of 1995 and of solanum tuberosum L. tubers intended for planting are also subject to the requirements of § 12 of the Plant Protection Act. In any case, the Plant Protection Act (Plant Protection Act) in 1995 has been complied with, and the seed label concerned has, in any case, the indication "EC plant passport". "

2. In § 17, Z 2 and 6, the phrase "shall be the order of the word" as amended by Directive 2004 /70/EC amending Annexes I, II, III and IV to Directive 2000 /29/EC laying down measures for the protection of the Community against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community (OJ L 327, 30.4.2004, p. 3. In § 17 Z 4, 8 and 9 lit. a will be the phrase " as amended by Directive 2004 /102/EC amending Annexes II, III, IV and V to Council Directive 2000 /29/EC laying down measures for the protection of the Community against the introduction into the Community of organisms harmful to plants and harmful organisms, and Plant products (OJ L 327, 22. 4. In § 18, the point after Z 29 shall be replaced by a stroke point and the following Z 30 to 32 shall be added:

5. § 19 is added to the following paragraph 13:

" (13) § 6 (7) in the version of the BGBl Regulation. II No 179/2005 shall enter into force on 15 May 2005. '

6. In Annex 3, the word sequence shall be: "2003/46/EC and 2004 /32/EC" through the phrase "2003/46/EC, 2004 /32/EC and 2005 /18/EC" replaced.
