57. Federal Act amending the Environmental Promotion Act
The National Council has decided:
Amendment of the Environmental Promotion Act
Federal law on the promotion of measures in the fields of water management, the environment, the remediation of contaminated sites, the protection of the environment abroad and the Austrian JI/CDM Programme for Climate Protection (Environmental Promotion Act), BGBl. No. 185/1993, as last amended by the Federal Law BGBl. I n ° 136/2004, shall be amended as follows:
1. In accordance with § 6 (2d) last sentence, the following sentence shall be added:
" The Federal Minister for Agriculture, Forestry, the Environment and Water Management will be able to make commitments on an annual basis of up to EUR 100 million per year as a anticipation of the following years; further action will be required by the Agreement with the Federal Minister of Finance. "

| a) |
In order to avoid or reduce the air pollution caused by dust emissions, as far as plants, working and tractors are used in the sense of the Kraftfahrgesetz 1967 (KFG 1967), BGBl. No 267/1967, as amended, as well as construction machinery and construction site equipment with compression-ignition engines as defined in the Regulation on measures to combat emissions of gaseous and particulate pollutants Combustion engines for mobile machinery and equipment (MOT-V), BGBl. II No 136/2005, as amended, improved or replaced; |

| b) |
in order to avoid or reduce the environmental impact of other air pollution, to the extent that installations are improved or replaced; |

| c) |
in order to avoid or reduce environmental pollution caused by noise, to the extent that installations are improved or replaced; |

| d) |
to reduce the environmental pollution caused by the treatment or storage of hazardous waste. " |

(3) In § 53, the following paragraph (11) is added:
" (11) § 24 Z 2 in the version of the Federal Law BGBl. I n ° 57/2005 enters into force on 1 July 2005. '
