242. Regulation of the Federal Minister for Health and Women amending the Plastic Regulation 2003
On the basis of Articles 29 and 30(2). 1 of the Food Law 1975, BGBl. No 86, last amended by the Federal Law BGBl. I No. 126/2004, is prescribed:
The Plastic Regulation 2003, BGBl. II No. 476/2003, is amended as follows:
1. The following sentence is added to § 4(1):
"The Annex 2 does not yet introduce additives that are used only for the production of surface coatings from liquid, powdered or dispersed resins or polymers such as paints or paints, as well as epoxy resins, adhesives and prison intermediaries or printing colours. There are no additives used as colours or solvents. “
2. § 4(2). 2 is:
"(2) The additives referred to in Annex 2, Section B shall be subject to the specific migration values from 1. July 2006, provided that the verification of compliance with simulate proceeding D or with test media is carried out by replacement checks according to the facilities 6 to 8. “
3. The § 4 is the following paragraph. 3 added:
"(3) Additives of Annex 2, which are authorised as food additives or flavourings, must not be exceeded

2. | in food or food supplements for which their use is authorised as food additives or flavourings, in quantities exceeding the limit values laid down or set in Annex 2, while respecting the lowest limit; | |||||||||
3. | in food or food supplements for which their use as food additives or flavourings is not permitted, in quantities exceeding the limit values set in Annex 2. “ |
4. Under § 8, the following § 8a and heading is inserted:
"Conformity Statement
§ 8a. (1) Plastic items must be accompanied by a written declaration at all marketing stages, except in retail, which will certify that they conform to the rules applicable to them. This declaration is to be issued by the manufacturer or by a distributor established in the European Community.
(2) The written declaration in accordance with paragraph 1 also has to provide adequate information on the specific migration values and, where appropriate, purity criteria, which are included in the respective versions, of the sweetener Regulation (BGBl) No 541/1996, in the respective versions, of the relevant Regulation (BGBl. No. 547/1996), in the current version, of the relevant Regulation (BGBl. No. 547/1996), in the respective version, or the ZuV, BGBl. II 383/1998, in each of the current version. “
5. § 9(2). 2 Z 1 is:
"1. | Evidence from the determination of the total migration limit values shows that according to paragraph. 1 specific migration limits to be determined shall not be exceeded or" |
6. § 11 is:
" § 11. (1) Plastic items not covered by Regulation BGBl. II No 242/2005, but comply with the provisions previously in force, with the exception of paragraph No. 2, may still be until 28. which will be placed on the market by the end of February 2006.
(2) Plastic items not covered by Regulation BGBl. II No 242/2005, but to the extent that it relates to the substance of the reference number 36640 of Annex 2, Section A, and before 2. 7. The following Directives are added to § 12:
"- 2004/1/EC of the Commission amending Directive 2002/72/EC on the suspension of the use of Azodicarbonamid as a drift (OJ L 7, 13. January 2004),
- 2004/19/EC of the Commission amending Directive 2002/72/EC on plastic materials and objects intended to come into contact with food (OJ L 71, 10 March 2004). “
8. In Annex 1 General Introduction Z 8, the definition of QM is as follows:
"QM = maximum permitted ‘residual content of the substance in the material or object. In the sense of this Directive, the quantity of substance contained in the material or object is to be determined by measuring a validated analytical method. If there is currently no such method, an analytical method can be applied with appropriate sensitivity that allows the determination of the specified limit until a validated method has been developed;"
9. In Annex 1 General Introduction Z 8, the word in the definitions of QMA and QMA(T) "Consumption products" by the word "food supplements" replaced.
