Amendment of the Official Services Act 1979

The Civil Service Law 1979, BGBl. No. 333, as last amended by the Federal Law BGBl. I No 176/2004, is amended as follows:

1. In § 37 (3) (2), § 50d (2), § 56 (4) (2), § 66 (1) (2) (c), § 78a (3) (2) and § 169 (5) (2), the citation shall be: "according to § § 15h and 15i MSchG" in each case by the expression "according to the MSchG" and the quote "in accordance with § § 8 or 8a VKG" in each case by the expression "after the VKG" replaced.

(2) The following sentence is added to section 65 (9):

"In determining the amount of holiday in accordance with para. 2 or 3, or in accordance with § 66, a remainder of holiday hours which cannot be used on a daily basis, can also be used for hours."

Section 73 (7) reads as follows:

"(7) § 65 (8), (9) and (10), § 66, § 67, § 68 (1), § § 69 to 72 and § 77 shall also apply to the home holiday."

4. In accordance with § 125a, the following § 125b and title shall be inserted:

" Interrogation of underage witnesses

§ 125b. (1) At the request of an underage witness, a person of his confidence shall be allowed to be present at the hearing. The questioning of a not yet fourteen-year-old is, in so far as it is appropriate in the interests of the latter, to assist a person of his confidence in any case. These rights shall be referred to in the summons. As a confidant, it is possible to rule out who the participation in the breach of duty is suspicious or involved in the proceedings or whose presence could influence the witness in the deposition of a free and complete statement.

(2) The Chairman may, in the interests of the minor witness, restrict the opportunity to take part in the hearing of the witness in such a way that the parties and their representatives, where necessary, use the hearing of the witness technical equipment for the transmission of words and images, and can carry out their questionnaials without being present during the interview. "

5. In § 145b (11), last sentence, the word order is deleted "that post office" .

6. § 145c is repealed with headings.

7. In § 152c (14), last sentence, the word order is deleted "that post office" .

7a. § 160 para. 2 third sentence reads:

" This period is increased by the time in which A university lecturer in a working relationship as a university professor in accordance with § 97 (1) of the University Act 2002 to a university, but at the latest to 15 years. "

8. In Section 201, the following words shall be deleted in paragraph 2. " or Universities of the Arts " as well as in paragraph 3, the following "or universities of the arts" and "and universities of the arts" .

9. § 236b (5) reads:

"(5) For each full month, the special pension contribution shall be the percentage of the tax base resulting from § 22 (2) of the salary law of 1956 in the version in force on 31 December 2004, as set out in paragraph 3 of this article."

10. In § 236b (7), the date shall be: "31 December 1954" by the date " 1. Jänner 1955 " replaced.

11. In § 248a the phrase "have been fulfilled" through the phrase "will be fulfilled" replaced.

12. § 266 reads:

" § 266. Disciplinary proceedings pending at the Disciplinary Commission of the Federal Ministry of the Interior on 30 June 2005 concerning persons who were officials of the Federal Gendarmerie on 30 June 2005 are subject to the provisions of § 145c and § 266, in each case up to the 30 June 2005, to continue with the senates formed. The non-rightist Senate Chairmen shall be deemed to be further members for the remainder of their term of order for procedures pending before 1 July 2005 for the Disciplinary Commission of the Federal Ministry of the Interior. "

13. § 277a is given the name " § 243a. " .

14. § 284 (51) Z 5 reads:

" 5.

Section 13 with 31 December 2016. "

15. § 284 (55) in the version of the Federal Law BGBl. I n ° 151/2004 shall be replaced by the sales designation "(54)" .

16. § 284 (53) to (55) in the version of the Federal Law BGBl. I n ° 176/2004 receives the sales names "(55)" to "(57)" .

19. Appendix 1 Z 1.3.1 reads:

The contribution basis for calendar months in which the regular weekly service period is reduced in accordance with Section 78d (1) Z 2 BDG 1979 shall be at least EUR 1 350 if the reduction comprises more than half the days of a calendar month. 2. § 11 lit. d is repealed.

3. § 15 para. 4 Z 1 reads:

Article 9
Amendment of the Federal Theatterpensionsgesetz

The Federal Theatre Pensions Act, BGBl. No 159/1958, as last amended by the Federal Law BGBl. I n ° 142/2004 and the BGBl agreement. I n ° 4/2005, shall be amended as follows:

(1) The following paragraph 3 is added to Section 5a:

" (3) The basis of contribution for the period of a total exemption against the removal of paid employment in the context of a family hospice carency within the meaning of § 29 of the unemployment insurance act 1977 (AlVG), BGBl. No 609, for each full calendar month of exemption, EUR 1 350 shall be the proportionate part of the exemption for each remaining day of the exemption. The contribution basis for the remaining days shall be added to the contribution basis in accordance with Section 1 (1) (1). The contribution basis for calendar months in which the normal working time is reduced in accordance with § 29 of the AlVG shall be at least EUR 1 350 if the reduction comprises more than half the days of a calendar month. "

Section 5b (7) and (8) reads as follows:

" (7) In the event of a service period of at least 396 months completed as a ballet member, the basis of the pension shall not be less than or equal to 71% of the basis for calculating the rest of the pension. This percentage is reduced by one percentage point for twelve months missing as a ballet member for 396 months, but may not be less than 62.

(8) The period of service referred to as a ballet member within the meaning of paragraph 7 shall be counted

1.

each month of the service for which the ballet member has made an increased pension contribution pursuant to Article 10 (2) (1) (3) (1) or (3) (3) (1), and

Amendment of the Bundesbahn-Pension Act

The Federal Railways Pension Act, BGBl. No 86/2001, as last amended by the Federal Law of the Federal Republic of Germany (BGBl). I No 176/2004, is amended as follows:

1. § 4 receives the sales designation "(1)" . The following paragraph 2 is added:

" (2) The basis of contribution for the period of a total exemption against the removal of paid employment in the context of a family hospice carency within the meaning of § 29 of the unemployment insurance act 1977 (AlVG), BGBl. No 609, for each full calendar month of exemption, EUR 1 350 shall be the proportionate part of the exemption for each remaining day of the exemption. if the death of the official has occurred earlier than before the end of a year following the legal force of the annulment, annulment or divorce of the marriage, from the date of the entry of the legal force until his death

the divorce judgment contains the sentence in accordance with Section 61 (3) of the marriage law,

a)

the former spouse has been incapacitated since the date of the entry of the legal force of the divorce judgment; or

b)

from the divorced marriage a child has been born or a child has been legitimized by this marriage, or the spouses have jointly accepted an electoral child and the child belongs to the household of the former spouse on the day of the official ' s death; and Entitlement to orphan benefits; the requirement of household membership is no longer necessary in the case of children born after birth.

(5) The supply of a number of former spouses shall not exceed 60% of the retirement pension to which the deceased official would have been entitled. Where appropriate, the supply of supplies shall be reduced in the same proportion. "

Section 37 (1) reads as follows:

" (1) Amendments to this Federal Act, which do not alter the amount of benefits under this Federal Act nor change the eligibility conditions for these benefits, shall also apply to persons who at the time of their In-power-Tretens are entitled to monthly recurring cash benefits under this federal law. Changes to the provisions of assessment or eligibility conditions to benefits shall apply to persons who are entitled to benefits under this Federal Act at the time of their entry into force, only if this is expressly determined. (9) The abolition of § § 38 to 41 shall apply to deaths from 1 July 2005. "

Earning income: the sum of the income earned in one calendar year on the basis of an employment and the income tax deducted pursuant to § 2 (3) Z 1 to 4 of the Income Tax Act 1988, BGBl. Amendment of the Constitutional Court Act 1953
