Article 1
Amendment of the Official Services Act 1979

The Civil Service Law 1979, BGBl. No. 333, as last amended by the Federal Law BGBl. I No 176/2004, is amended as follows:

1. In § 37 (3) (2), § 50d (2), § 56 (4) (2), § 66 (1) (2) (c), § 78a (3) (2) and § 169 (5) (2), the citation shall be: "according to § § 15h and 15i MSchG" in each case by the expression "according to the MSchG" and the quote "in accordance with § § 8 or 8a VKG" in each case by the expression "after the VKG" replaced.

(2) The following sentence is added to section 65 (9):

"In determining the amount of holiday in accordance with para. 2 or 3, or in accordance with § 66, a remainder of holiday hours which cannot be used on a daily basis, can also be used for hours."

Section 73 (7) reads as follows:

"(7) § 65 (8), (9) and (10), § 66, § 67, § 68 (1), § § 69 to 72 and § 77 shall also apply to the home holiday."

4. In accordance with § 125a, the following § 125b and title shall be inserted:

" Interrogation of underage witnesses

§ 125b. (1) At the request of an underage witness, a person of his confidence shall be allowed to be present at the hearing. The questioning of a not yet fourteen-year-old is, in so far as it is appropriate in the interests of the latter, to assist a person of his confidence in any case. These rights shall be referred to in the summons. As a confidant, it is possible to rule out who the participation in the breach of duty is suspicious or involved in the proceedings or whose presence could influence the witness in the deposition of a free and complete statement.

(2) The Chairman may, in the interests of the minor witness, restrict the opportunity to take part in the hearing of the witness in such a way that the parties and their representatives, where necessary, use the hearing of the witness technical equipment for the transmission of words and images, and can carry out their questionnaials without being present during the interview. "

5. In § 145b (11), last sentence, the word order is deleted "that post office" .

6. § 145c is repealed with headings.

7. In § 152c (14), last sentence, the word order is deleted "that post office" .

7a. § 160 para. 2 third sentence reads:

" This period is increased by the time in which A university lecturer in a working relationship as a university professor in accordance with § 97 (1) of the University Act 2002 to a university, but at the latest to 15 years. "

8. In Section 201, the following words shall be deleted in paragraph 2. " or Universities of the Arts " as well as in paragraph 3, the following "or universities of the arts" and "and universities of the arts" .

9. § 236b (5) reads:

"(5) For each full month, the special pension contribution shall be the percentage of the tax base resulting from § 22 (2) of the salary law of 1956 in the version in force on 31 December 2004, as set out in paragraph 3 of this article."

10. In § 236b (7), the date shall be: "31 December 1954" by the date " 1. Jänner 1955 " replaced.

11. In § 248a the phrase "have been fulfilled" through the phrase "will be fulfilled" replaced.

12. § 266 reads:

" § 266. Disciplinary proceedings pending at the Disciplinary Commission of the Federal Ministry of the Interior on 30 June 2005 concerning persons who were officials of the Federal Gendarmerie on 30 June 2005 are subject to the provisions of § 145c and § 266, in each case up to the 30 June 2005, to continue with the senates formed. The non-rightist Senate Chairmen shall be deemed to be further members for the remainder of their term of order for procedures pending before 1 July 2005 for the Disciplinary Commission of the Federal Ministry of the Interior. "

13. § 277a is given the name " § 243a. " .

14. § 284 (51) Z 5 reads:

" 5.		Section 13 with 31 December 2016. "

Amendment of the salary law in 1956

The salary law in 1956, BGBl. N ° 54, as last amended by the Federal Law BGBl. I n ° 23/2005, is amended as follows:

1. In § 8 (3), the turn-of-the-turn "by the Federal Government" .

§ 22a. No 282/1990, and Section 3 (1) of the Pensionskassengesetz (Pensionskassengesetz, PKG), BGBl. No 281/1990. (5) The sections (1) to (3) are based on Section 17 (1a) of the Postal Structure Act (PTSG), BGBl. No 201/1996, to apply to officials assigned to the service with the measures that:

1.		can also be granted by the respective company a supplementary pension scheme,
2.		to replace the Federal Chancellor referred to in paragraph 3 by the Chairman of the Management Board of the respective company; and
3.		the regulations of the Collective Contract of the Federation on the involvement of civil servants in the pension fund, on the right of contributions and on the right to power also apply to the officials assigned to the service pursuant to § 17 paragraph 1a PTSG. "

6b. According to § 113g, the following § 113h with headline is inserted:

Implementation of new elections

4. § 21 para. 1 lit. b is repealed.

5. In section 25a, paragraph 4, the quote shall be: "§ 607 para. 13 ASVG" by quoting "§ 607 para. 12 ASVG" replaced.

7. § 35 (1) last sentence is deleted.

(a), (d), (k) and (l) shall not apply for periods to be calculated in accordance with Article 53 (2) (a), (d), (k) and (l) if, for such periods, a transfer amount is to be paid in accordance with the provisions of the social insurance legislation; "

15. In accordance with § 54 (4), the following paragraph 5 is inserted:

" (5) para. 2 lit. a second half-sentence shall apply only to civil servants to which Article 88 (1) is not to be applied. If, for such periods, no transfer amount is to be paid because the official has been reimbursed in accordance with Section 308 (3) of the ASVG, Section 172 (3) of the GSVG or Section 164 (3) of the Federal SVG Act, in each case in the version valid until 30 June 1996, Nevertheless, these periods are to be counted as rest periods. (3) The repeal of Section 42 (1) Z 3 by Art. 7 Z 19 of the Federal Law BGBl. I No 71/2003 shall apply to deaths from 1. Jänner 2004.

(4) The cancellation of § § 42 to 45 shall apply to deaths from 1 July 2005. "

19. The heading to § 108 reads:

20. § 108 receives the sales designation "(1)" . The following paragraph 2 is added:

Article 9
Amendment of the Federal Theatterpensionsgesetz

The Federal Theatre Pensions Act, BGBl. No 159/1958, as last amended by the Federal Law BGBl. I n ° 142/2004 and the BGBl agreement. I n ° 4/2005, shall be amended as follows:

(1) The following paragraph 3 is added to Section 5a:

" (3) The basis of contribution for the period of a total exemption against the removal of paid employment in the context of a family hospice carency within the meaning of § 29 of the unemployment insurance act 1977 (AlVG), BGBl. No 609, for each full calendar month of exemption, EUR 1 350 shall be the proportionate part of the exemption for each remaining day of the exemption. The contribution basis for the remaining days shall be added to the contribution basis in accordance with Section 1 (1) (1). The contribution basis for calendar months in which the normal working time is reduced in accordance with § 29 of the AlVG shall be at least EUR 1 350 if the reduction comprises more than half the days of a calendar month. "

Section 5b (7) and (8) reads as follows:

" (7) In the event of a service period of at least 396 months completed as a ballet member, the basis of the pension shall not be less than or equal to 71% of the basis for calculating the rest of the pension. This percentage is reduced by one percentage point for twelve months missing as a ballet member for 396 months, but may not be less than 62.

(8) The period of service referred to as a ballet member within the meaning of paragraph 7 shall be counted

1.		each month of the service for which the ballet member has made an increased pension contribution pursuant to Article 10 (2) (1) (3) (1) or (3) (3) (1), and
2.		Periods of employment prohibition according to the MSchG or a Karenz (a Karenzurlaubes) according to the MSchG or the VKG or corresponding regulations. "

§ 9 together with headline:

" Special sterer fee

§ 9. The federal regulations applicable to federal civil servants concerning the special death fee contribution shall apply in a reasonable way. "

4. § 18a (1) Z 4 reads:

" 4.		Section 5b (7) shall apply with the proviso that, in the event of a service period of 336 months completed as a member of the ballet member, the basis for the pension shall not be less than 71% of the basis for the determination of the rest, and that the basis for the pension shall not be less than Percentage for a total of twelve to 336 missing months by one percentage point, but 62 must not be less than. Article 10
Amendment of the Bundesbahn-Pension Act

The Federal Railways Pension Act, BGBl. No 86/2001, as last amended by the Federal Law of the Federal Republic of Germany (BGBl). I No 176/2004, is amended as follows:

1. § 4 receives the sales designation "(1)" . The following paragraph 2 is added:

" (2) The basis of contribution for the period of a total exemption against the removal of paid employment in the context of a family hospice carency within the meaning of § 29 of the unemployment insurance act 1977 (AlVG), BGBl. No 609, for each full calendar month of exemption, EUR 1 350 shall be the proportionate part of the exemption for each remaining day of the exemption. The contribution basis for the remaining days shall be added to the contribution basis in accordance with Section 1 (1) (1). 2.		if the death of the official has occurred earlier than before the end of a year following the legal force of the annulment, annulment or divorce of the marriage, from the date of the entry of the legal force until his death
it has been proven to have made regular maintenance payments. "

3. In § 18 (2), second sentence, the expression "within three months" by the expression "within six months" replaced.

4. The following provisions shall be replaced by the provisions of section 18 (4) and (5):

" (4) The supply cover, with the exception of the supplementary allowance, may:

1.		the maintenance on which the former spouse, in the case referred to in paragraph 1, has been entitled to the death of the deceased official, or
2.		the average monthly maintenance payments made by the deceased official, in the case referred to in paragraph 1a, on a regular basis in the last three years preceding his death,
do not exceed.

(4a) (4), however, it shall not apply where:

1.		the divorce judgment contains the sentence in accordance with Section 61 (3) of the marriage law,
2.		the marriage lasted at least 15 years and
3.		the former spouse at the time of the entry of the legal force of the divorce judgment the 40. Year of life has been completed. This condition shall not apply if:
a)			the former spouse has been incapacitated since the date of the entry of the legal force of the divorce judgment; or
b)			from the divorced marriage a child has been born or a child has been legitimized by this marriage, or the spouses have jointly accepted an electoral child and the child belongs to the household of the former spouse on the day of the official ' s death; and Entitlement to orphan benefits; the requirement of household membership is no longer necessary in the case of children born after birth.

(5) The supply of a number of former spouses shall not exceed 60% of the retirement pension to which the deceased official would have been entitled. Where appropriate, the supply of supplies shall be reduced in the same proportion. "

Section 37 (1) reads as follows:

" (1) Amendments to this Federal Act, which do not alter the amount of benefits under this Federal Act nor change the eligibility conditions for these benefits, shall also apply to persons who at the time of their In-power-Tretens are entitled to monthly recurring cash benefits under this federal law. Changes to the provisions of assessment or eligibility conditions to benefits shall apply to persons who are entitled to benefits under this Federal Act at the time of their entry into force, only if this is expressly determined. "

6. In § 37 (3), the quote shall be "§ 617 para. 10 ASVG" by quoting "§ 617 para. 9 ASVG" replaced.

7. § 37a shall be repealed with the title.

" (6) The following provisions shall also apply to persons who, at the time of the entry into force of the respective change, are entitled to cash benefits recurring on a monthly basis under this Federal Act:

1.		§ 16 (3) and (4) in the version of Art. 9 Z 4 of the Federal Law BGBl. I No 130/2003,
2.		§ § 14b and 14c in the version of Art. 2 Z 2 of the Federal Law BGBl. I No 134/2004 and
3.		Section 37 (2) and (3) in the version of Art. 17 Z 3 and 4 of the Federal Law BGBl. I No 142/2004.

(7) The repeal of Section 38 (1) Z 3 by Art. 9 Z 5 of the Federal Law BGBl. I No 71/2003 shall apply to deaths from 1. Jänner 2004.

(8) The repeal of § 37a also applies to persons who were entitled to cash benefits recurring on a monthly basis pursuant to this Federal Act on 31 December 2004.

(9) The abolition of § § 38 to 41 shall apply to deaths from 1 July 2005. "

11. § 62 (10) in the version of the Federal Law BGBl. I n ° 142/2004 shall be replaced by the sales designation "(11)" .

12. § 62 (11) Z 1 reads as follows:

" 1.		Section 64 (3) with 1. Jänner 2004, "

(13) The following paragraph 12 is added to § 62:

" (12) In the version of the Federal Law BGBl. I n ° 80/2005 enter into force:

Article 11
Amendment of the Federal Railways Act

The Federal Railways Act, BGBl. No 825/1992, as last amended by the Federal Law BGBl. I No 180/2004, shall be amended as follows:

1. The following provisions shall be replaced by the last sentence of section 52 (5):

" The pension contribution and the pension security contribution in the above mentioned amount shall also be paid by the official from the parts of the special payment, which is the amount of the cash benefits referred to in paragraph 3 (b). Amendment of the Federal Teacher's Teacher Training Act

The Federal Teacher's Teacher's Teacher's Teacher's Act, BGBl. No 244/1965, as last amended by the Federal Law BGBl. I No 176/2004, is amended as follows:

1. In Section 9 (2d), the expression " 2b and 2c " by the expression " 2a, 2b and 2c " replaced.

2. In § 15 (13) second sentence, the date shall be: "31 August 2005" by the date "31 August 2006" replaced.

(3) The following paragraph 22 is added to § 15:

" (22) § 9 paragraph 2d in the version of the Federal Law BGBl. I n ° 80/2005 enters into force on 1 September 2005. "

Article 15
Change of the Watchkeeping Service-Help Act

The Wachebediensteten-Hilfeleistungsgesetz, BGBl. No. 177/1992, as last amended by the Federal Law BGBl. I n ° 130/2003, shall be amended as follows:

1. § 3 (1) reads:

" (1) Guard officials within the meaning of this Federal Act are civil servants and contract staff, to whom a security allowance according to § 81 or § 143 of the salary law 1956, BGBl. No 54, or a similar allowance due to contractual arrangements. "

Section 10a (1) reads as follows:

" (1) The Federal Government has special assistance in accordance with § 2

1.		Staff of the defusing and demining service,
2.		Staff of the legal service of the security authorities, who are entitled to an executive order according to § 40a or a similar provision of the salary law in 1956 or a similar provision of the contract law of 1948,
3.		Customs bodies responsible for the enforcement of the lawful arrest or the prevention of the occurrence of a legally detained person in accordance with Section 14 (1) and (2) of the Customs Law-Implementing Act for the exercise of a life-threatening weapons use and have the power to
4.		Soldiers who are in assistance in accordance with § 2 para. 1 lit. b or c des Wehrgesetz 2001 (WG 2001), BGBl. I n ° 146, in order to maintain public order and security or to provide assistance in the event of elemental events and accidents of exceptional circumstances,
as well as to survivors of such persons in accordance with the following provisions. "

Article 16
Amendment of the Part-Pensions Act

The partial pensive law, BGBl. I n ° 138/1997, as last amended by the Federal Law BGBl. I n ° 142/2004, is amended as follows:

1. § 1 Z 4 reads:

" 4.		Earning income: the sum of the income earned in one calendar year on the basis of an employment and the income tax deducted pursuant to § 2 (3) Z 1 to 4 of the Income Tax Act 1988, BGBl. No. 400 (EStG 1988), with the exception of the references cited in § 67 para. 3 to 8 EStG 1988, if they are fourteen times the same as in § 5 paragraph 2 Z 2 of the General Social Security Act, BGBl. No 189/1955, referred to above. "

2. The following provisions shall be replaced by the provisions of Section 3 (2) and (3):

" (2) For monthly earned income, one twelfth of the income earned in the same calendar year shall apply in accordance with § 1 Z 4. As long as the earned income of the calendar year in question is not fixed, the last fixed earned income is to be used for the time being.

(3) If a self-employed activity is re-recorded, the calculation of the part-pension shall be based on a provisional monthly income of 833 Euro, provided that the person engaged in an activity in a self-employed capacity is not credible to the effect that, in the calendar year in question, no income or lower income from self-employment is likely to be achieved. "

3. The following paragraph 9 is added to § 9:

" (9) § 1 (4) and (3) (2) and (3) shall enter into force 1. Jänner 2006 in force. "

Article 17
Amendment of the Landescontractual lehrergesetz 1966

The State Contract Teachers Act 1966, BGBl. No 172/1966, as last amended by BGBl. I n ° 23/2005, is amended as follows:

1. In § 2 para. 1, the point at the end of the lit. b replaced by a dash and the following lit. c is added:

" (c)			§ § 109 and 110 as well as § 121 paragraph 1 Z 2 and 3 of the Landeslehrer-Dienstrechtsgesetz-LDG 1984, BGBl. No. 302. "

Article 18
Change of the foreign allowance and assistance law

The foreign allowance and assistance law, BGBl. I n ° 66/1999, as last amended by the Federal Law BGBl. I No 176/2004, is amended as follows:

(1) The following paragraph 4 is added to § 29:

"(4) (1) shall not apply if the lack of suitability has been established pursuant to Section 25 (4) (2) (2) on the basis of a service accident."

(2) The following paragraph 9 is added to § 32:

" (9) § 29 (4) in the version of the Federal Law BGBl. I n ° 80/2005 enters into force on 1 July 2005. '

Article 19
Change in travel fee rule 1955

The travel fee rule 1955, BGBl. N ° 133, as last amended by the Federal Law BGBl. I No 176/2004, is amended as follows:

1. The following provisions, together with the headline, shall be replaced by sections 39 to 44 of the above and the headings:

" Organs of the Guard Federal Police and
Right-handed bodies at the Federal Police Directorates

§ 39. (1) Members of the Guard Federal Police of the District Police Commons, Police Inspections and their external offices, specialist inspections and external offices of the transport departments are due for the service allocations related to the Executive Service Up to 24 hours and service trips in the political district, but if a surveillance rayon going beyond the political district is fixed, in the surveillance rayon, in place of the daily fees according to the I. If the fees are paid in accordance with § § 22 and 34 only for one part of the month, the remaining part of the month shall be due to the proportional part of the flat-rate payment. In addition, the claim and the suspension of this flat-rate compensation should be applied to § 15 (5) of the pay law in 1956.

§ 40. For civil servants of the Federal Police, who take part in events for the purpose of their own initial and further training or are used for the regular recurring performance of statutory tasks, it may, unless § 39 applies, of the In agreement with the Federal Chancellor for reasons of convenience, the Federal Minister responsible shall establish a flat-rate compensation in place of the fees payable against any revocation. This flat-rate payment shall be calculated on the basis of individual fees or for their entirety, subject to the proviso that, under no circumstances shall they exceed the extent of the fees payable under this Federal Act. If the travel fees of the amount or entitlement are changed, the flat-rate compensation shall be subject to the same effect.

§ 41. Officials of the guard body Federal Police, who have to use the railway or a ship in the case of a delivery or a show, have to do so in the lowest wagon or ship class. The travel allowance for the return journey after the delivery or presentation shall be paid in accordance with the classification in the fee levels. In all cases, § § 7 and 8 are to be considered.

§ 42. In the case of participation in a basic training course of the E 2c group for the executive service at an educational centre or at a provincial police command, only the travel allowance and the travel allowance for a non-married civil servant shall be paid to an official who is not married. the journey from the place of residence to the place of residence and for the journey after the completion of the basic training course from the place of school to a new place of employment. This shall not apply if the official is entitled to at least one child allowance.

§ 43. Reasons for the service in the place of employment

Article 20
Amendment of the Constitutional Court Act 1953

The Constitutional Court Act 1953, BGBl. No. 85, as last amended by the Federal Law BGBl. I n ° 142/2004, is amended as follows:

1. The § § 5f and 5g are:

" § 5f. If a member of the Constitutional Court dies during the term of office, or if the recipient of a retirement pension dies in accordance with § 5b, his survivors are given a supply. The supply shall be subject to the same provisions applicable to federal officials and their survivors. The assessment of the pension benefits shall be based on the rest reference in accordance with § 5b and the allowance in accordance with § 5c. A death fee may be granted to the surviving dependants of a deceased recipient of a retirement pension pursuant to § 5b on the basis of the similar provisions applicable to federal officials and their surviving dependants.

§ 5g. § § 5b to 5f shall also be applied to former members of the Constitutional Court and to their survivors. "

(2) The following paragraph 21 is added to § 94:
