315. Regulation of the Federal Minister for the Interior, amending the Regulation on the basic training of the Executive Service and the categories of use E 2a and E 1 in the gendarmerie, security guard and crime service

On the basis of § § 25 to 31, 144 and 275 of the Civil Service Act 1979 (BDG 1979), BGBl. No. 333, as last amended by the Federal Law BGBl. I No 80/2005, shall be:

The Regulation of the Federal Minister of the Interior on the basic training of the Executive Service and the groups of uses E 2a and E 1 in the Gendarmerie, Security Guard and Crime Service, BGBl. II No 433/1999, as last amended by Regulation BGBl. II No 330/2004, shall be amended as follows:

1. The title is:

"Regulation of the Federal Minister of the Interior on the basic training of the Executive Service and the use groups E 2a and E 1"

2. § 1 (1) reads:

" (1) This Regulation regulates the area of the Federal Ministry of the Interior

1.

the basic training for the executive service,

2.

the basic training for the Working Group E 2a (Service-leading officials) in the Executive Service; and

3.

the basic training for the E 1 use group in the Executive Service. "

3. § 5 (2) to (4) are:

" (2) The admission to basic training courses for the use group E 2a, apart from the fulfilment of the requirements of Z 9.11 of Appendix 1 to the BDG 1979, depends on the result of the selection test to be carried out in accordance with § 7.

(3) The admission to basic training courses for the E 1 use group, apart from the fulfilment of the requirements of Z 8.16 of Appendix 1 to the BDG 1979, depends on the result of the selection test to be carried out in accordance with § 7.

(4) The one for admission to the basic training course for the use group E 1 according to Z 8.16 para. 1 lit. (c) and (2) of Annex 1 to the BDG 1979 required practical use must have been completed on services with executive external service. In exceptional cases of exceptional circumstances, other uses may also be recognised if this is necessary in order to obtain specific qualified personnel. This is the case in particular with technical and analytical personnel. "

4. In § 5 (5) the number shall be: "10a" by the number "11" replaced.

5. § 7 (4) reads:

" (4) A civil servant admitted to a basic training course shall be provided by:

1.

an employment ban under the maternity protection law 1979 (MSchG), BGBl. 221,

2.

A Karenz according to the MSchG, the Fathers-Karenzgesetz, BGBl. No 651/1989, or in accordance with § 75 (1) BDG 1979 in conjunction with Section 10 (4) (1) of the salary law in 1956, BGBl. 54,

3.

a part-time job according to the MSchG or the Fathers Karenz Act, or

4.

A reduction in the weekly service period according to § 50b BDG 1979

, the official shall be allowed to attend the basic training course immediately following the completion of the obstacles periods referred to in Z 1 to 4. "

6. § 13 deleted.

Section 14 (1) reads as follows:

" (1) Officials of the Working Group E 2b, E 2a or E 1 of the judicial service or guard officers of municipalities appointed to a post of Executive Service in the field of the Federal Ministry of the Interior shall have at least one six months of training. "

8. § 14 (3) deleted

9. In § 15, the phrase in paragraph 1 shall be followed by the following: "Security Guard and Crime Service" by the word "Executive Service" is replaced and paragraph 2 is deleted.

10. § 16 deleted.

11. § 17 (2).

12. § 26 reads:

" Conclusion and transitional provisions

§ 26. (1) The provisions of this Regulation shall apply to officials who are members of the remuneration scheme and who participate in basic training courses for the use groups W 2 (service-leading security officers) and W 1; to apply:

1.

The admission to basic training courses for service-leading security officers is, apart from the result of the selection test to be carried out in accordance with § 7, of the fulfilment of the requirements of the Z 56.1. lit. a and 56.3. of Appendix 1 to the BDG 1979.

2.

The admission to basic training courses for the use group W 1 is, apart from the result of the selection test to be carried out in accordance with § 7, of the fulfilment of the requirements of the Z 55.1. lit. a and 55.2. of Appendix 1 to the BDG 1979. With regard to the approval of the basic training course for the use group W 1 in accordance with Z 55.2. Par. 1 lit. c and section 2 of Appendix 1 to the BDG 1979 required practical use applies to § 5 (4).

(2) Basic training for the Executive Service or for guard officers in the field of the Federal Ministry of the Interior, which has been successfully concluded before the entry into force of this Regulation, shall be considered as basic training within the meaning of this Regulation. "

13. In accordance with § 26, the following § 26a and heading is inserted:

" Transitional provisions for civil servants in special use

§ 26a. (1) Officials of the Working Group E 2a which, on the basis of paragraph 1 of Article 16 of the Regulation of the Federal Minister of the Interior, on the basic training for the Executive Service and the groups of uses E 2a and E 1 in the gendarmerie, security guard and Crime service, BGBl. II No 433/1999, as amended by the BGBl version. II No 333/2004, which are in special use and who wish to function outside their special use, have to attend a supplementary course lasting a maximum of four months, with an additional examination to be carried out in Annex 2 to the Annex II. lit. C) has to be completed. The provisions of § § 6 and 7 shall apply.

(2) The supplementary course referred to in Article 16 (1) shall comprise the teaching articles of Appendix 2 as a whole. These courses must be designed to meet the needs of the individual. "

14. The following paragraphs 4 and 5 shall be added to Article 27:

" (4) § § 1 (1), 5 (2) to (5), 7 (4), 14 (1), 15 (1), 26, 26a, the title of this Regulation as well as the annexes 1, 2 and 3 shall enter into force 1. October 2005, in force. § § 13, 14 (3), 15 (2), 16, 17 (2) shall expire at the end of 30 September 2005.

(5) References to federal laws shall refer to the version which is in force at the time of the adoption of this Regulation. "

15. Annex 1 shall be given the heading "BASIC TRAINING FOR THE EXECUTIVE SERVICE" and there is no less than lit B, point II, Z 7 (subject-oral examination) according to the traffic service of the staple term "(except for female civil servants in the criminal service)" .

16. Annex 2 shall be replaced by Appendix 2 to this Regulation.
